HomeMy WebLinkAboutReso 5379-1970RESOLUTION NO. 5379 A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQL'ISITION OF CERTAIN LAND AND DIRECTING THE FILING OF ,EMINENT DOMAIN PROCEEDINGS TANFORAN AVENUE-SHAW RCAD STORM DRAINAGE PROJECT ASSESSMENT DISTRICT RESOLVED, by the City Council of the City of South San Francisco, California, that WHEREAS, it is the intentio.~ of this Council to construct and maintain storm drainage fac iliti=.s in and on certain real property situate in the City of South San Francisco, California; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. That the public interest and necessity require the acqui- sition of an easement in, over, across and upon the parcel of land more particularly described in E×hibit "A" hereto attached and by this reference made a part hereof. 2. That said proposed acquisition is planned and located in the manner which will be most compatible with the greatest public good and the least private injury, and all of said aCquisition is situated within the City of South San Francisco, California. 3. That John Noonan, City Attorney of this City, and the law firm of Wilson, Jones, Morton & Lynch, be, and they are hereby directed to institute and conduc~ to conclusion an action in eminent domain for the acquisition of saLd easement in, over, across and upon the parcel of land herein described, and to take such action as is necessary therein, and~ saiC law firm of Wilson, Jones, Morton & Lynch shall be paid a reasonable fee theref°r. 4. That an Order for Immediate Possession and Use ~be ob- tained in said action and that a warrant be issued to the County Clerk, San Mateo County, California, in the amount determined by the Court to be so deposited, as a condition to the right of immediate possession.
