HomeMy WebLinkAboutMinutes 1923-12-10ADJOURNED REGULAR MEETING OF THE BOARD OF TRUSTEES OF THE CITY OF SOUTH SAN FRANCIS- CO, HELD DECEMBER 10th, 1925. Pursuant to adjournment the Board of Trustees of the City of South San Francisco met in regular adjourned session in the City Hall on the 10th of December, 1923. The meeting was called to order at 7:30 o'clock p.m. by G. W. Holston, President of the Board of Trustees. There were present the following trustees, A. J. Eschelbach,' F. A. Cunningham, G. W. Holston, J. W. Pitt and H, Scampini. The minutes of the meetings of said board held on the 3rd day of December, 1923, and the 7th day of December, 1923, were read and, on motion of trustee Cunningham, Seconded by trustee Eschelbach, and regularly carried, were approved as read. An affidavit of Robert Speed, the principal clerk of the printer and publisher of "The Enterprise", dated December 3rd, 1923, testifying and certifying to the publication of Ordinance Ne. 121 in all respects as in said Ordinance No. 121 required and in all respects as required by law, was then presented to said board and filed. The City Clerk then presented to the board all the returns of and from the special election held in said City of South San Francisco on the 3rd day of December, 1923, which said returns were examined and inspected by the board and found by them to be in all re- spects in regular and proper order. On motion of trustee Scampini, seconded by trustee Pitt, and duly carried, it was ordered that the board proceed, and the board did thereupon proceed to canvass and did canvass said returns in public by opening said returns and canvassing and counting the vote for and against the proposition voted upon at said election, The vote as found by said Board of Trustees was as follows: "For the proposition to incur a bonded indebtedness of $58,000.00 in Gold Coin of the United States of _America for the object and purpose of acquiring, constructing and completing by the City of South San Francisco, a municipal corporation, a system of sewers for said city in San Bruno Road from Chapman Avenue to the north boundary line of said city and in Butler Road, including an outfall sewer and the acquisition of the necessary rights of way for said outfall sewer, and also a system of sewers in that' portion of said City of South San Francisco lying west of Chestnut Avenue, -l~r--~i~-prclmo~c~ 198 votes Against said proposition ............................. 81 votes Total vote cast ............................................. 279 votes Trustee Cunningham then offered the following resolution and moved its adoption, to-wit: RESOLUTION "C" Whereas, at a special election held in the City of South San Francisco on Monday. the 3rd. day of December, 1923, pursuant to the provisions of Ordinance No. 121 of said City of South San Francisco, the number of voters voting, and the whole number of votes cast in South San Francisco Municipal Election Precinct No. 1 were 165, and that of Said whole number of votes 133 votes were cast for and in favor of and accepting "The proposition to incur a bonded indebtedness of $68,000.00 in Gold Coin of the United States of A~erica for the object and purpose of acquiring, constructing and completing by the City of South San Francisco, a municipal corporation, a system of sewers for said city in San Bruno Road from Chapman Avenue to the north boundary line of said city and in Butler Road, including an outfall sewer and the acquisition of the necessary rights of way for said outfall sewer, and also a system of sewers in that portion of said City of South San Francisco lying west of Chestnut Avenue"A and that of said whole number of votes so cast in South San Francisco Municipal Election FreCinct No. 1, 32 votes were cast against the adoption of said proposition:- Whereas, at said special election, the number of voters voting, and thewhole number of votes cast in South San Francisco Municipal Electlon Precinct No. 2 were 114, and that of said whole number of votes 65 votes were cast for and in favor of and accepting "The pro- Position to incur a bonded indebtedness of $58,000.00 in Gold Coin of the United States of America for the object and purpose of acquiring constructing and completing by the City of South San Francisco, a municipal corporation, a system of sewers for said city in San Bruno Road from Chapman Avenue to the north boundary line of said city and in Butler Road. in- cluding an outfall sewer.and the acquisition of the necessary rights of way for said outfall sewer, and also a system of sewers in that portion of said City of South San Francisco lying west of Chestnut Avenue", and that of said whole number of votes so cast in South San Francis- co Municipal Election Precinct No. 2, 49 votes were cast against the adoption of said proposit, ion; and Whereas the total number of voters voting and the total number of votes cast in said city were 279, and that of said total vote 198 votes were cast in favor of said proposition and accepting the same, and that of said total vote 81 votes were cast against the adoption of said proposition; and Whereas 'the number of votes cast at said special election for and in favor of said prqpostion and accepting the same, as aforesaid, to-wit: 1~8 votes, was more than two-thirds (2/3) of all the'votes cast at said special election, and said votes for and in favor of ac- cepting the said proposition were cast by more than two-thirds (2/3) of all the voters vot- ing at said special election; and Whereas due notice of said election was given and said election was held at the time and in the manner and in all respects as required by law and the ordinances of said city and said Ordinance No. ~2]; and ~hereas said election was in all respects legally and fairly conducted and the returns thereof were duly and regularly made and certified to this board; Now, therefore, be it resolved by the Board of Trustees of the City of South San Francis- co, as follows: That said proposition, to-wit: the proposition to incur a bonded indebtedness of $58,000.0( 'in Gold Coin of the United States of America f~r the object and purpose of acquiring, construct; That said proposition, as aforesaid, has carried and was duly accepted by the qualified voters of the municipality and that said City of South San Francisco is duly authorized to issue bonds of said City of South San Francisco in the amount and for the proposition and in the manner in said Ordinance No. 121 set forth and specified. I hereby certify that the foregoing resolution was regularly introduced and adopted by the Board of Trustees of the City of SOuth San Francisco this 10th day of December, 1923, by the following vote: Ayes, Trustees ~. W.Holston Noes, Trustees None Absent, Trustees None Attest: Daniel McSweeney 0i~y Clerk The City Clerk's Certificate of the special election was filed in accordance with the law. -,-,-,-,-,-,-,-,-,-,- The City Clerk presented a list of names of taxpayers, who paid the tax for weed clean- in~ under protest and asked for a refund of the same. The Clerk was instructed to request the City Engineer to employ Antone Philiip and G. Bruno, to accompany one of his engineers and inspect the premises of the persons protesting against the payment of the tax, Phillips and Bruno having worked on all the sidewalks from which weeds were removed. Trustee Scampini next brought up the subject of paving the alleys. After discussion as to the ones requiring attention first, Trustee Scampini finally moved that proceedings be begun to pave the following named alleys.- 1. The alley between Baden and Grand Avenues; Between Maple and Magnolia and from the School House to ~range Avenue. 2. The alley between Commerical and Baden Avenues between Linden and 0mange Avenues. 3. The alley between Railroad and CommerCial Avenues, between Linden and Orange Avenue. A. The alley between Grand and Miller Avenues, b~tween Spruce and Locust Avenues. X~he motion was seconded by Trustee Pitt, and regularly carried. The motion was seconded by Trustee Scampini'and.regularly carried. There being no further business before the Board Trustee Cunningahm moved to adjourn until the next regular meeting, Monday, December 17th,1923, st ?:30 o'clock P.M.
