MONDAY, DECEMBER 21, i936.
The regular meeting of the CitY Council of the City of South San Francisco was held
in the city hall Monday evening, December 21,1936, ~
The meeting was called to order at 8 O'Clock P.M. by Mayor D.W.Ratto.
ROLL CALL. ~
Holl call found all members of the City Council present,as follows;-
· Councilmen, V.Boido, A.j. Eschelbach, J.F.Mager, D.W. Ratto., M.Minucciani
The minutes of the two_previou~ meetings were read. Councilman Mager asked to have
the minutes corrected to read"traffic" signals at the intersection of Grand Avenue and
Bayshore Highway instead of"Lighting#_signals, as shown in the minutes. The corection was

from City Attorney Coleberd the city is barred from contributing toward the association and-
the clerk instructed to return the seals with the city's explanation.
J.Berroni applied for permission to erect a tempora~yBocci Ball Court on the rear of
201 Grand Avehue. The matter was laid over for investigation and consideration.
A reguest for a refund of $4800 for weed cutting was received from S.A. Imperator, again
her lots,16,18,20,24,26, Block 13, aden. Filed with other requests for refunds.
A connnunication was ~eceived from Elmer A.Robe~ts offering to control the ant pest in t
Civic Center for the s~nn c£ $148.00, for the first year. Laid over for consideration.
A letter signed ~ "A,Citizen , addressed to the Mayor, stated policemen were practicall
de~e~ding a package or two of cigarettes when they enter beer parlors, and a stop should be
put to it. Mayor Ratto stated annoymous letters are not accepted by the council. All must
have signatures.
Volonte and Capitelll,of the Sun Insurance Office, stated~-~J.~i in writing that they'wishe
to make a thorough survey of the fire insurance carried by the 0ity of South San Francisco, th
they have been unable to make the survey at the offices of the Board of Fire Underwriters of
Pacificwithout authorization from this city and asked for said authorization. Mayor Ratto sta
a meeting on the subject of the city's insurance would be held in the near future,after which
time the city would be in abetter position '~o~di~cuss~'th~ matter. ,
The Union Oil Company submitted a bid to furnish the city with Union Ethyl Gas for 18c

After considerable discussion Councilman Minu~ciani moved that Councilman Eschelbach
be empowered to enter into an agreement with the Union Oil Company of California for one hundr
per cent of the city's gasoline purchases for a period of ~0 days at the prices n~med in their
bid. The motion was seconded by Counci~m-~ Mager and regularly carried.
RESOLUTION.
Councilmen Eschelbach introduced a resolution of the City of South San Francisco &~cept
a deed from the South SanFrancisco,Land and Improvement Company to a portion'of ~range Avenue
20, Block ~4, Map of South San F~anctsco. The resolution was adopted by the votes of all the
members of the ~ity Council, as follows;-

ORDINANCE N0.191.
Ordinance No.191 had its second reading. This ordinance is entitled"

ORDINANCE REGULATING THE MAINTENANCE AND 0PERATZON OF DOG RACING
TRACES IN THE CITY OF SOUTH SAN FRANCISCO AND PROVIDING FOR LICENSING
OF THE SAME,' adopted July 5,1932, and relating to license fees. The
license fee under the~new ordinance is raised from $25 per day to $250 Der day. Before the
calling of the roll City Attorney Coleberd requested that the petition filed :.i:in the.:offlceof
City Clerk on November 2,1936, by the Italian Amertca~.. Citizens Club calling for ~he enactment of a
ordinance raising the fee of the Baden Kennel Club from $25 per day to $250, per day, be read. After t
reading of the petition Mayor Ratto requested that the roll be called on Ordinance 191. On roll call
the ordinance was passed and adopted as an ordinance of the City of South San Francisco by the

CERTAIN OFFICERS AND EMPLOYEES OF THE CITY OF SOUTH SAN FRANCISCO FROM RECOMMENDING
PERSONS FOR EMPLOYMENT AT ANY RACING TRACK IN SAID CITY, AND FROM WORKING AT ANY
SUCH TRACK AND FROM RECEIVING ANY PAY FROM THE OWNER OR OPERATOR OF SUCH RACE TRACK
AND REQUIRING SUCH OWNER OR OPERATOR OF SUCH RACE TRACK TO PAY ITB OWN SPECIAL POLICE

201 Grand Avenue. The matter was laid over for investigation and consideration.

Not voting J.F.Mager. The result being a tie the ordinance WaS defeated of.passage~
Councilman Mager was questioned by several citizen spectators for not voting. The ~ouncilman
responded saying while his questioners have the right to ask fair questions he, also,has the right
7o his honest convictiOns, the matter requiring deep consideration, there are times when a decision
cannot be made,which is _~h~,?~f he is not clear on what ~h~s~iJudgme~t is the best thing to do,
he' certainly has the ~gative to decline to do anything.
Previous to the roll call on the ordinance Councilman Boido stated he could not see
way clear to vote for such an ordinance, and that if the board bad to be guided by an ordin_n_~ce the
_~rope~ w~a~ is to leave the people vote on it. Councilman Eschelbach contended that the license
ee of $260 per day is sufficient restriction .upon the race track, and that when t~As is paid it
will be more money than the licenses paid by all the manufacturers for a period of ten years. And
~hey also pay in proportion in taxes and insurance.
Mayor Ratto stated that thi~ ordinance had its first reading December 8,1936, and that at
that time three members of the .b0~ had been in favor of it. Since then, one member had evident
ly changed his mind, leaving ~ouncilm~n Mi~ucciani and himself in favor. '
He Said t~he aagpti~nn Of She ordinance would very materially aid in removing politics
f~om the City Hall, in that th~Eeunel 'Club and the Board of Councilmen would be under no
obligations to one another, and t~at it would prevent the building of a political machine amd
prevent the usage of the Kennel Club as a poligical football. He further stated that such
an o~dinance should have the "yes" vote of every councilman interested in the welfare of the
city.
Stating that opposing members ~laimed that the ordinance interfered with their personal

1' That the subject matter of the ordinance we deem to be, in ge~eral,px~pper for munt6ipal
regulation.We can well see that the m,~ing of recommendations for such employment by City Officials
and employees, and the employment of the persons recommended, by the pperators of the tracks, or
the employment of such officials and employees at a track, would place such city officials and
employees in a tif.ficult position in the event some duty devolved upon them as city officials with
reference ~o the regulation of such tracks.

American Citizens C~ub. The Kennel Club and the Italian American Citizens Club arrived at an und~r-

which is self-explanatory, and which Mayor Ratto requested ,be made a part of these minutes,viz;

To the City Council of the City of South San Francisco;
Gentlemen;- On condition that no election be called or held upon the petition requesting
the City Council of the City of South San Francisco to enact an ordinance amending Ordinance No.160
in such manner aS to raise the daily license for,the operation of a dog racing track from.Twenty-
Five Dollars ($25.00) per day, to Two Hundred and Eifty Dollars ($250.00) per day, which-petiti~n was
filed in the office of the City Clerk of said city on the 2nd day of November, i936,and on condition that
no election be called or held with respect to the petition requesting the enactment of 'an...er~i~uoe
by the City Council of the City of South San FrancisCo prohibiting the operation of a_.dog~ racing track
in said city, which latter petition was filed in the office of the said,City Clerk on the 2nd day of
November.1936, Baden Kennel Club, a corporation,will consent to the'enactment of an ordlnanc~ amending

who will be deputized by the city.
It will be understood that an agreed percentage of South San Francisco people will be
employed at the track. This provision is n~t to be part of the ordinance.

a~eement, as follows;- 1,That no salaried city official or city em?_loyee shall be employed at a race '~';-~c
t~ack, 2,That no city official or city employee shall recommend any person for employment at a race track.
$,That race trabks must hire their own special police,which will be deputized bY the clty. A,T~at any
official or employee of the city who violates provisions of the agreement shall be discharged.
~-That an agreed percentage of employees at race tracks will be from South Ean~Francisco. On roll call
all,members of the council v~ted for the agreement.

track, 2,That no city official or city employee shall reco~end any person for employment at a race track.
3,That race trabks must hire their own special police,whtc~ will be deputized bY the city.4,T~at any

Mayor Ratto suggested that an ordiance be enacted covering the appointment of deputies, such
as fingerprinting them, etc, and asked Logan Franklin the approximate cost of such ~ ordinance, M~.
Franklin stated the cost would be about.S10.00.

The-~ace track matter having been aatisfaCtOrilY Settled Mayor katto Complimented the
Italian American Citizens Club for its efforts in~/matter and for the interest it has always
taken in civic ~Cfalrs,and the Baden Kennel Club for its cooperation in an endeavor to elimim
future disconteh~ and friction.
Under the head of unfinished business the application of A.R. Zanetti for a refund of
~10.08 taxes,when paid, on his property deeded to The Veterans Welfare Board, WaS 0.K'd by the
City Attorney, and the clerk instructed to issue a check for the -mount.
Nayor Ratto ~eported the mabter of adjusting the city's insurance~ polices was not yet
completed.
City Attorney Coleberd had no reply from the California Water Service Company regard~
a request, to reduce the Hydrant Rental for fire hydrants from $3.00 to $1.50 per month~ accept
that the city 'procure whatever facts available as to the increase of water comsumption since
agreement made with the company, and the same could be used in advocating the city's case wit!
the'Railroad Commission. The City Engineer and City Attorney w~t]~ report~at the next meeting.
In the matter of a proposed conference between City M~nager Wilsey, The city engineer
City ,Attorney Coleberd to make joint request upon the State Highway Commission to install Tra~
Signals at the intersection of Grand Avenue and Bayshore Highway, ManaEe~cWilaey Saidihts.clt~

The City Clerk reported that a number of license holders have become delinquent~ some
for a period of two years,and requested advice as to the methSd of procedure. City Attorney

Councilman Boido proposed that a shelter building be furnished the police department fo~
use at the Junction of Grand Avenue and the Bayshore Highway during inclement weather. He was
instructed to procure such a structure. '~

fire alarm system. He was instructed to purchase one. He also requested W.P.A. assistance in
