HomeMy WebLinkAboutMinutes 1938-10-03REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO, HELD MONDAY, 0CT0~ER 3,1938. The regular meeting of the City Council of the City of South San Francisco was held in the City Hall Monday evening, October 3,1938. The meeting was called to order at 8 o'clock P.M. by Mayor A.J.Eschelbach. Roll Call. Roll call found all members of the council present,as follows;- Councilmen; V~Boido,~A.J.Eschelbach,M.Minucciani,D.W.Ratto,Rod Tibbetts. The minutes of the two previous meetings were read. There being no errors or omissions they were approved~as read. A communication was received from the American Improvement Club, calling the city councilmen's attention to the unsatisfactory lighting system at the Market Street Shelter at Orange and their railroad tracks. The City Clerk was instructed to write the railway company no~fying them of the lack of lighting at the shelter. A communication was received from the SteelnWorkers Organizing Committee, C.I.O. local No.1069, stating a representative of the organizatiowas stopped by a city policeman while passing out leaflets on matters pertaining to Labor Union members, and requested that a pass be issued to the organization allowing the distribution of such leaflets. The Recording Secretary of the lodge stated'the Supreme Court had decided such pamphlets may be distributed without hindrance. ~The 'city attorney Coleberd advised the ~Lity Council that t~e $ organizatio~ was within its ~rights. Councilman Minucctani moved that the Cit~ Clerk wrmte the C.I.0. Committee stating the city has no jurisdiction in the matter and that a pass would be unnecessary. The motion was secoad- ed by Councilman Tibbetts and regularly carried. Pacific Gas & Electric Company applied f~r a permit to extend their main 13~ feet in Tanforan Avenue , west of ~ontgomer~' Avenue. ~a~or Eschelbach stated the company was granted emergency permission and the work alraady done. ........... ~S~uth San Francisco Land & Improvement Company , being about to construct l0 houses in Cit~ Park Addition through Federal Housing aid, ststed the administration could not approve the loan on these houses as the hoUses would be o~er the city sewer at about four feet,and asked the city for a letter of assurance that in the event any rep$ir Work had to be done to the sewer in this easement the city would guanartee that no damage would be done to the houses over the sewer~ such letter to be presented to the Federal Housing Administration in order to secure the-~Z~ Engineer Klassen stated the sewer is muc~ deeper than four feet,abo~t ten to 12 feet, and t~ere appeared no reason why damage might be done to any buildings over the sewer in case_of a break in the sewer. Cit~ attorney Coleberd was of the same opinion. After much discussion the council agree&to issue a letter stating that in the event of any damage to the sewer the city would assure the administration that the work of repair would be done in such manner that no damage will result to improvements on the property and the value of the improvements will not be impaired by the easements owned by the city. The City Clerk was instructed to write such a letter. A communication was received from ~nion Paving Company protesting against withholding the balance of check for the reconstruction of South Linden Avenue. This work was not accepted by the city engineer on account of poor workmanship and its apparent unfinished condition. City attorney Coleberd stated he interviewed Joe Dowling and Lawton on the subject and had a long conversation with them, urging them to complete the work to the satisfaction ol~ the city engineer. He stated a committee might be appointed to investigate the case. Engineer Klassen stated he had notified the paving company of the defects in the work several times as it progressed, they paying no attention to him,and disregarding his instructions. The city council believed the city engineer should have charge of making a settlement with the company. It was finally decided to offer to arbitrate by the city engineer selectLng an engineer, the company an engineer and the two select a third. Notice was received from the State Division of Highways stating that an inspect!on trip showed that t?~ signal light at Grand Avenue and Bayshore Boulevard w~s not being operated accord- ing to the permission given February 13 ,1937, Encroachment Permit No.44007, that ~ellow interval is being used after Red in the ST)P ~ Go. The communication stated that no overlap of colors should be shown in the signal and no YELLOW after RED, that the cycle should be RED-GREEN-YEELLOW- RED, The division asked that this be correcte~. Washington Streets,San Francisco, November ~,1938, at which matters concerning South San Francisco Harbour will be taken t~p. ~ayor Eschelbach asked an2 of the city officials to attend who had a desire to do so. Communication ordered filed. The State Board of Eq~alization issued notice t~at Sociedad Mutualista Mexicana Morelos had made application for an on sale beer license for the location 312 Baden Avenue. Laid over for consideration. City Clerk ~cSweeney reported _n writing having attended the convention of the League of California ~unicipalities at Santa barbara, It was the ~0th annual convention. He reported a fair attendance, but many new features in the wa~ of impr~vements in municipal work of all kinds. Civil service and retirement features were among matters brought up and supported by all divisions of the convention of the convention interested. The~' will be ad~.~ocated Oy the legistative commivtee ~of the league at'the State Legisiature in Sacramento next Spring. The monthly reports of the LibrarianBuilding Inspector,Fire Chief,Health Officer, Chief of Police,City Judge and City Clerk for the mont)~ ending September 30,1938, were submitted and accepted. A communication from the American Improvement Club urged' t].e City Council to pass enabling legislature as soon as possible so that the ~roposed ~lanning Commission cOuld get under way. Under ordinance 198, The City Treasu ret, Health Office and Assistant Engineer are ex-officio members of the Planning Commission, Mayo r Eschelbach accordingly a~i.pointed, E.P.Kauffmann, J.0.McMills and Robert Klassen to the commission , together with Andrew Hynding, 4 years, Adolph Sani, 2 years. Councilman ~oido moved that the five envelopes containing the rosters of those voted 0e opened. The motion was seconded by Councilman Ratto and regularly carried. Councilman Tibbetts moved that the absentee ballot envelope be opened also. ihe motion was seconded by Councilman ~oido and regularly carried. On count by the City Attorney and City Clerk. the result showed 1812 votes cast, includi the absentee ballot, and divided as follows;- For proposition No.1, recreation center ouildings ~ swimming tank 921,against 846 For proposition N~.$, Central fire station,equipment,£urnishings,et 813,against 908. As to the choice of locations for the projects the three highest were$- Recreational Center ouildings , Civic Center 367, High School Park,315,0ra~ge Ave.Park Swimming Tank , " 259 " ~ 369 . . Under the head of unfinished business the matter of the application of the citF firemen for a raise in salar~ wasttaken up. It was considered necessar~ to give tLe subject further consid- eration, and Councilman Tibbetts moved to refer the matter to the fire committee t:: thresh it out. ~ The motion was seconded by Councilman Boido and r~ larly carried. Councilman Tibbetts reported progress on t~ e work of carrying out the recommendations of the Hartford Fire ins Company in installing protecting rails, etc. to Comncilman ~inucciani asked Fire Chief Welte if he knew of a fireman going'the wrong box when going to answer an alarm. The Dire Ch[ef said he had not heard of it. Mayor £schelbach stated that a man nmmed Canagetti wished to ~rocure a,permit to operate an archery husiness. Heferred to Councilman Tib0etts for investigation. Logan Franklin A committee consisting of Andrew Rocca, Andy hynding and ~;'red Lautze&a~p~a~ed before the council and and asked permission to re-submit the proposal to pass a bond issue for recrea~ tional center buildings and a swimming ~ank at the November 8th,election. The proposition to construct a centralS'fire house was left out. Mr. Rocca and tt~e committee explained that the voters did not have a complete understanding of the projects, did not know that the United States government grants 45% of the cost outright to the people for ~he projects proposed. Mr Rocca stated the people of South San Francisco are ent~.tled to a share of the federal grant the same as all other communities in the United States, that o~r people in paying taxes help to pay for projects in other parts of the state and South San Francisco gets nothing by turning down the bond issue. It wa also stated that ~f there was a raise in the tax rate it would be so small it would hardly be noticed. Eugene Lombardi and Henry Conxiani opposed trying to place the propositions upon the ballot in No~ber, saying in effect that the taxes would be raised, the projects unneccessary and they would oppose the measure/  Councilman Ratto said the city went to-we~e-~pe~se-a~a- very considerable expense already, · the propositions were turned down,and did not believe in trying tl~e matter out in November. Councilman Minucciani stated the voters had their chance to votefor the projects, did not do it and there seemed no reason to ask them to vote a ain on the subject. ~r. Rocca explained that there would be very little expense attached to trying the matter out again, the county furnishing the equipment and machinery of holding the election, The committee was told that the petition must be suomitted to t~e Cit~~ Colmcil before any direct action could be taken. ~uesday evenin~ , Octobe~ 11,1~38 , was selected for an adjburned meeting to receice and act upon such a petition.
