CONSENT TO SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SO~I~t SAN FRANCISCO We, the undersigned, being all the members of the City Council of the City of South San Francisco, do hereby consent to a special meeting of said City Council, to be held at its regular meeting place, at the hour of seven (7) P- m., ou Monday, June 16, 1952, for the purpose of discussing and dealing with the following matters: 1. A report of the works engineer of said city relative to sewage disposal plant of said city. 2. A report of the works engineer of said city relative to the parking lot owned by said city, and located on the north east corner of the intersection of Miller and Maple Avenues of said city. 3. A report of the works engineer of said city relative to the surfacing of Spruce Avenue, and the payment to be made to Lowrie Pavement Co., the contractor engaged for such work. 4. A report of the city manager of said city with regard to a 5 day work week for the employees of said city. 5- A report of the city manager of said city relative to the improvement of Tanforau Avenue in said city. 6. A report of Mayor Cortesi relative to drainage problems existing iu the City of South San Francisco, and discussion pertaining thereto. 7. A report of the Personnel Board recommending certain amendments to the Civil Service Ordinance of said city. 8. A report of the Personnel Board relative to the list of individuals eligible for employment as firemen and patrolmen by the City of South San Francisco. 9- The resignation of Victor Robinson as a member of the Planning Commission of said City. 10. A report of the Recreation Commfssiou relative to the use of classroom at Liudenville. ll. A report of the Recreation Commission recommending support to the San Mateo Recreation Com- mission. 12. A report of the Recreation Commission with regard to its proposed budget for the coming year, and certain recon~ended salary increases. 13. A report of the Recreation Commission pertaining to part-time recreation workers. 14. The recommendation of the Recreation Commission relative to the use of Orange Avenue Park by the Veterans of Foreign Wars Organization. 15. The request of Police Chief Louis Belloni for the appointment of George W. Alexander as a guard. 16. The report of the Health Department with respect to the Enterprise Pallet Company. 17. Application of Cottage Sweets for a business license. 18. The application of Shell 0~1 Company for a gasoline tank permit. 19. Monthly reports of the Chief of Police, City Judge, Building Inspector, Tax Collector, Fire Chief, City Clerk, Librarian, and Humane Officer. 20. Resolution with regard to the passing of Mr. Coleberd and Mr. Hyland. 21. The appointment of Librarian Board Members. 22. The proposals of Councilmen Smith and Noonan relative to changes in the city government and counter-proposals of Councilmen Sani and Bracco. Dated this 16th day of June, 1952. Present: Absent: Councilmen John Noonan, Adolph Sani, Emilio Cortesi, Joseph Bracco, Telford Smith None City Clerk having forwarded copy of the minutes of the previous meeting to all councilmen, Mayor Cortesi asked if there ~ere any errors or omissions, there being none, the minutes were approved as submitted. A co~m~unication was received from the office of the Works Engineer relative to the submission of the final Construction Progress Report and the Distribution of Construction Costs Report for the Joint sewage treatment plant for the cities of South San Francisco-San Bruno. Works Engineer Randlett reported a lead that had to be repaired and suggested that the acceptance of the plant be held up. Councilman Joseph Bracco moved that the acceptance of the plant be held up but that a progress payment in the amount of $29,399.87 be made to the M & K Corp., the South San Francisco portion being $23,551.71 and the San Bruno portion being $5,848.16. At this point Acting City Attorney Lyons advised that no bills could be authorized for payment at a Special Meeting. This matter was then laid over together with two other communicatinns for action at the regular meeting. A communication was received from the Office Of the City Manager recommending that office employees of the City be granted a 5 day work week effective July l, 1952. Councilman Sani moved, seconded by Councilman Noonau, that the recom- mendation of the City Manager be accepted. Under the question Councilman Bracco brought up the matter of working ou Saturdays during tax time. City Manager McClung reported that the employees understood that they have to work at certain times of the year such as Tax Collection and Veteran's Exemption sign up time. City Manager McCluug also reported that next year a place would be made available iu the Basement of the City Hall for Veterans Exemption sign up and Tax times. This was regularly car- ried by a unanimous vote. A communication was received from the Office of the City Manager relative to a letter received by his office from R. Jaramillo of 21 Tauforan Avenue, San Bruno, relative to a petition for work to be done ou that street,whichwas badly needed. Copy of the letter from R. Jar~millowas attached and read. Councilman Noouan moved that Jaramillo be answered by letter that ~ approve the project and that it is a good thing but have to withhold the matter until such time as our own work is completed. Councilman Smith suggested that he was in favor of a joint meeting with San Bruno relative to this matter. Mayor Cortesi ordered that the letter be filed. A communication vas received from the office of the Mayor regarding a Proposal to study South San Francisco's Drainage Problem. Councilman Noonan moved, seconded by Councilman Bracco, that this matter be referred to the council for appropriate action. This motion vas regularly carried. A co~nuuicatiou ~.~s received from the Personnel Board of the City of South San Francisco suggesting that Classification Schedule, Sec. i of Rule IV of the Civil Service Ordinance be amended to include Superintendent of Sanitation, sewage dis- posal plant and sewer maintenance personnel. Counci.Lmau Saul moved, seconded by Councilman Noonau, that the City Attorney be granted permission to draft au amendment to the Civil Service Ordinance. This motion was regular~carried with a Nay vote registered by Councilman Smith who stated that the reason for his Nay vote being that he was not iu favor of department heads being ou Civil Service. Communications were received from the Personnel Board of the City of South San Francisco submitting names of candidates eligible for the position of Fireman and Patrolman. Mayor Cortesi ordered that these letters be filed. Councilman Bracco stated that these applicants should be interviewed by the members of the city council before July l, 1952. Mayor Cortesi stated that the Fire & Police Chiefs were better judges as to what men would be the best qualified for the positiouso Councilman Bracco stated that the procedure of the City Council interviewing the candidates was done before and that the procedure should be followed. Councilman Smith stated that according to the submitted lists, of the five names on the Police Dept. list, the first two were eligible and the last three were the ones bo be screened. On the Fire Dept. list, the first five were eligible with the option of numbers 6, 7, and 8. Councilman Noouau stated that this was ubt the correct way iu which to handle the matter. City Manager McCluug ex- plained the Police Dept. list stated that four were asked for, three being suc- cessful applicants and two being holdovers from the last time. Thereforethis was the reason for 5 appearing on the list. Councilman Noouan suggested that this matter be left up to the City Manager and the Dept. heads. Councilman Noouau then made a motion that the lists be approved. Councilman Sani spoke with ref- erence to the holdover that vas presented to the City Council once before. He stated that men that are suitable should be chosen. Councilman Noonan remarked that to approve the list does not mean that the men were accepted. Councilman Bracco again stated that he felt it was the duty of the City Couucil to inter- view the men. Motion of Councilman Noouan was then seconded by Councilman Smith. City Manager McClung stated that the hiring of the men is the power of the City Council, but that the selection comes from the Dept. heads. Councilman Noonan again stated that it was not the duty of the City Council to interview the men. Acting City Attorney Lyons stated that the city council hires the men but that the Dept. Heads and the City Mauager suggest the recommendation. The letters were ordered filed. Motion of Councilman Noouau and second of Councilman Smith were withdrawn by the respective councilmen. A communication vas received from Victor E. Robinson, Secty. of the Planning Com- mission, submitting his resignation as a member of the Planning Commission inasmuch as under the ordinance governing the Planning Commission, he cannot serve iu the dual capacity of member and Secretary. Councilman Bracco moved that the resigna- tion be accepted and that a letter of thanks and appreciation be sent to Mr. Robinson for his fine work. This motion was seconded by Councilman Sani and reg- ularly carried. A communication was received addressed to Mr. James Cherry, Supt. of the Unified School District, signed by Lura Sellick, Secty of the Reereatiou Commission. Councilman Noouan called ouMrs. Sellick regarding the comuuicatiou who reported that this letter was merely a copy. A communication vas received from the Recreation Commission relative to the rec- ~mueudation of the Recreation Commission to the City Council that the San Mateo County Recreation Commission be encouraged and supported by the city of South San Francisco iu its efforts to obtain and develop adequate and suitable recreational areas and facilities iu the northern part of San Mateo County. Councilman Noouau asked what action the city council could take iu the matter. Councilman Saul moved that the Acting City Attorney draw up a resolution to be sent to the county. Mrs. Sellick stated that the letter vas sent to the City Council at the request of the City Manager as the County is endeavoring to obtain facilities. City Manager McClung explained that the Girl Scouts sent iua resolution to provide some facilities for recreational purposes. The first resolution was from the Girl Scouts and this takes ou a wider scope. Councilman Noouau then seconded the motion of Councilman Saul. Councilman Smith asked what type of aid we were ex- pected to give. He vas informed that we would give moral support and not finan- cial aid. Communications were then received from the Recreation Com~fssion relative to matters of budget for the coming fiscal year. City Clerk Rodoudi asked if it was the pleasure of the City Council to read them at this time o~ bring them up at budget time. PART TIME RECREATION DIRECTORS: VFW USE OFMEMORIAL PARK: PLACE: TIME: CALL TO ORDER: ROLL CALL: MINUTES: FINAL REPORT SEWAGE DISPOSAL PLAET: Communication was received from the Recreation Department relative to the employ- ment of part time recreation workers in the Recreation Department for the summer period of June 16, 1952 to September 6, 1952. The commission also requested con- sideration to the list of applicants submitted that they also be approved as an eligible list from which substitute workers could be drawn as needed throughout the year. Councilman Noouan moved, seconded by Councilman Sani, who also ques- tioned the last two names mentioned on the list as being from out of the City of South San Francisco. Mrs. Sellick reported that they had been placed on the list because uo suitable personnel could be found withih the city. These men would likewise not be l~m~:ted to the activities as mentioned but both Mr. SanClement~ and Mr. DeJong would have a broader scope with regard to sports. Councilman Brac~o stated that he was very much in favor of this program because heretofore there has been a lack of sports activities in Memorial Park and is happy to see this re- turn. The motion was regularly carried. A communication was received from the Recreation Commission with regard to the application from the Veterans of Foreign Wars for use of Memorial Park during the Labor Day Weekend. Councilman Noonan suggested that the Commission approve the use of the park for program, the rear area for the sale of food, but that no games of chance be conducted. Les Kelting spoke with regard to this, stating that these would be activities for the children but uo games of chance. This would be with regard to ?ides for children and the like. Acting City Attorney Lyons stated that uo admission charge could be made for use of a public park. Food sale could be Conducted in as much as it is for the convenience of the public. Games of chance are prohibited. The use of the park for rides to children is a matter for the council to decide as it is a matter of policy and not legality. It could be construed as a public convenience. Mayor Cortesi then called on Mrs. Heruan who stated that the park is open to the public as a whole. It brings iu outsiders and the case arises that some children may not have the money for rides or games. Mrs. Heruan cited the example of Brentwood having such a similar occasion but the parents bring the children with the knowledge that they must pay for the concessions. Mrs. Hernan also stated that the major problem in an event of this nature is clean up, and remarked that facilities should be cleaned up properly. Mayor Cortesi asked Acting City Attorney Lyons if the road could be blocked off to which he received the reply that this could not be done without the permission of the City Council* Acting City Attorney Lyons remarked that the road should be left open for the use of emergency vehicles such as Ambulance, Fire and Police. Mayor Cortesi then asked Capt. Terragno what police personnel would have to be made available,to which he replied that three men at least would be necessary. Mayor Cortesi then brought up the question as to who should stand the burden of expense f~r police protection, the council or the Veterans of Foreign Wars. Councilman Noonan moved that the permit be granted to the Veterans of Foreign Wars for the use of the park with limitations to the Veterans of Foreign Wars as stipulated by the Recreation Commission Recommendation that adequate police patrol, sanitation, athletic events, sale of flood, that the road be kept open as well and the premises be returned to the same state. Mrs. Hernan re- quested that two good directors be hired to act in a supervisory capacity as well. Councilman Smith seconded the motion with the stipulation that when they leave the premises were to be left clean. This motion was regularly carried. Mayor Cortesi then requested from Councilman Noonan information as to how much money remains in town. Councilman Noonan remarked that th~ Veterans of Foreign Wars is a wholesome organization that has a good purpose iu mind. Councilman Smith then moved that all unfinished matters be carried over to the regular meeting. This motion was seconded by Councilman Noonau and regularly carried. COLEBEKD: ACTING CITY ATTORNEY APP OINTMENT: A communication was received from the office of the Works Engineer that the Lowrie Paving Company,the contractor for surfacing the parking lot at the corner of Miller and Maple Avenues, having completed the contract iu accordance with the plans & specifications, recommended the work be accepted and that a notice of completion be filed. Total amount of the contract is $4,216.34 of which ninety percent, or $3,794.71 should be paid at this time and the remainder after thirty days. Coun- cilman Bracco moved, seconded by Councilman Sani that the payment be made and that the press give this parking lot some publicity. This motion was regularly carried. A communication was received from the office of the Works Engineer that the Lowrie Paving Co., the contractor for surfacing Spruce Avenue between Colma Creek & E1 Camiuo Real, had completed work in the amount of $16,134.25 during the month of May. He recommended that a progress payment be made to him for 90~ of this work or $14,520.83. Since this was a Gas Tax Project payment should be made from Gas Tax Funds. Councilman Noouan requested a comparison to be made. Councilman Smith remarked regarding the recommendations ou the plans and specifications. Works Engineer Randlett stated that it was not a completion notice but partial payment. Councilman Bracco moved, seconded by Councilman Saui, that this payment be made. This was regularly carried. Appointment of George W. Alexander as Guard at Consolidated Western Steel Co. (only) was received from the office of the Chief of Police. Councilman Sani moved, sec- onded by Councilman Bracco that the appointment be approved with uo remuneration from the city. This was regularly carried. A communicatiou was received from the Dept. of Public Health & Welfare relative to an outhouse which was constructed over a slough adjacent to the Enterprise Pallet Co., east of the Old Bayshore Highway. Councilman Smith requested information relative to this matter from the Acting City Attorney. Acting City Attorney Lyons stated that this could be held as a public nuisance. Also that the City Clerk could be advised to eliminate this structure. Councilman Smith moved that the City Clerk write and advise that they act immediately ou this inasmuch as it is a nuisance. Building Inspector Rozzi stated that this concern had ordered a chemical toilet and was awaiting delivery. Councilman Noonau seconded the motion made by Councilman Smith, it being regularly carried. Application for Business License was received from Jeannette MArie Sermans of 3428 Rivera St. San Francisco to conduct the business of ice cream aud candy retail sales under the firm uame of Cottage Sweets, 348 Grand Avenue, South San Francisco. Inspection was approved by Health Dept. Councilman Sani moved, seconded by Coun- cilman Bracco that this business license.be granted. Regt~arly carried. Communication was received from the Shell Oil Co. relative to the construction of a gasoline storage plant at the San Francisco Airport (Mills Field) in the total amount of 656,460 gallons. Councilman Bracco requested of the Fire Chief if it had been referred to him to which he replied it had. Councilman Bracco moved, seconded by Councilman Saui & Regularly carried, that permit be a~proved. Claims in the amount of $24,172.75 were submitted by the Finance Committee. On motion duly made, seconded and regularly carried, claims as submitted were ordered paid. Reports for the month of May were submitted by the Chief of Police~ City Judge, Building Inspector, Tax Collector, Fire Chief, City Clerk, Librarian and Pound- keeper. 0u motion duly made, seconded and regularly/reports as submitted were accepted and ordered filed, carried, Councilman Smith introduceda resolution authorizing the Mayor and the City Clerk of the City of South San Francisco to execute a deed to certain property to the San Francisco Bridge Co. This resolution was adopted by the unanimous vote of all members of the council. CounciLman Bracco introduced a resolution authorizing the Mayor and the City Clerk of the City of South San Francisco to execute a deed to certain property to the San Francisco Bridge Co., a corporation. The resolution was adopted by the unan- imous vote of all members of the council. Councilman Sani introduced a resolution authorizing the ~urchase of certain parcels of laud from the San Francisco Bridge Co. to be used for the location and main- tenance of sludge beds in connection with the operation of the Sodth San Francisco Sewage Disposal Plant, and accepting the deed to said parcels of laud. The resolution was adopted by the unanimous vote of all members of the cbuncil. Councilman Bracco introduced a resolution iu memory of Daniel J. Hyland, City Clerk. The resolution was adopted by the unanimous vote of all members of the council. Councilman Noonan introduced a resolution in memory of John W. Coleberd, City Attorney. The resolution was adopted by the unanimous vote of all members of the council. Councilman Smith moved, seconded by Councilman Noonan that Richard Lyons be appointed to the position of Acting City Attorney at the same salary paid the late John W. Coleberd, the salary to commence from the date of Mr. Coleberd's death. This motion was regularly carried. CITY ENGINEER: USE PERMIT ACKERMAN: APPROVED: Councilman Smith moved, seconded by Councilman Noonau that the Personnel Board be advised to conduct an examination for full time City Engineer. At this time Council- man Saui spoke relative to the list of proposals and counter proposals that had been submitted. Mayor Cortesi stated that it was unfair at this time to take up the matter without further discussion. Councilman Smith stated that this is a motion to hold an examination and that each one should know how they feel iu their own miud. Council- man Smith further stated that the question is confronting us with regard to large construction problems. Councilman Saui suggested that the cost should be first ascer- tained and to see if it would be fiuaucially beueficial to the city, also would it be necessary to have a full time engineer. Councilman Smith stated that the report was made a mouth ago, that he had arrived at a conclusion in the matter. Councilman Noonau discussed what the proposals were for that were shbmitted. Stipulations had been made to have a list of qualified applicants submitted for examination. Councilman Noouan further stated that a list of qualified men would then be set up which would be avail- able from which to draw au Engineer if one were needed. Councilman Saul then listed expenditures of the Engineer's office and stated as to where else could au Engineer be hired for less. Roll Call vote ou this was as follows: Ayes, Councilmen Noouan and Smith; Noes; Councilmen Saul, Bracco, & Cortesi. Councilman Cortesi stated he voted no because he had not been consulted regarding the problem. A question was asked from the floor as to the reason why a full time engineer was re- quired. Councilman Smith stated that some $56,000.00 had been spent for Engineer's services. Couuci.lmau Sani reported that the majority of this figure was for the Sewage Disposal Plant. Mr. Sapiro then remarked regarding closed sessions, that in- stead there should be more open ones as advocated by the League of Municipalities. Mayor Cortesi stated that he was not for closed sessions but discussions had to be held for planning. Mr. Walter Ackerman then requested information regarding his use permit for the home at 460 Miller Avenue. Acting City Attorney Lyons gave the legality as to the inter- pretation of the ordinance as to the use permit. Councilman Noonan moved, seconded by Councilman Smith that' the recommendation of the Planning Commission be accepted. This was regularly carried with the exception of Councilman Saui who wished to go ou record as being opposed. Councilman Saul moved, seconded by Councilman Bracco and regularly carried, that the meeting be adjourned until the next regular meeting night.
