Present: Absent: CounciLmen John Noonau, Adolph Sani, Emilio Cortesi, Telford Smith & Joseph Bracco None Communication was received from the office of the City Manager relative to the expiration of Pete Mazzanti's appointment as a member of the Planning Commission. 0u motion of Couuci.Lmau Saui, seconded by Councilman Bracco and regularly carried, Pete Mazzauti was reappointed for a four year term to expire August l, 1956. Communication was received from the office of the Planning Commission recommending a variance iu lot sizes of Park Haven to a minimum of 4500 sqgmre feet with a minimum frontage of 50 feet. Councilman Bracoo asked Works Engineer Randlett as to how many lots there were to which he was informed about 80. Councilman Sani moved, seconded by Councilman Bracco and regularly carried, that the recommendation of the Planning Commission be accepted. City Attorney Lyons stated that whenever a variance is granted it should be done by resolution and informed the council he would have one ready for the next meeting. Councilman Smith stated that since Works Engineer Raudlett is Engineer for this area, he made a motion that another Engineer for this project be hired. CouucLLman Noouan asked Works Engineer Raudlett if he was the Engineer for the project to which he replied that he was. Councilman Smith stated he was looking out for the welfare of the city. Works Engineer Randlett stated that the welfare of the city was being attended to at all times, that everything was iu conformity. Councilman Smith stated that this was a case in which service was being given to two sep- arate parties. At this point, Councilman Noonau seconded the motion of Councilman Smith. Councilman Bracco inquired as to the legality of hiring an outside engineer. City Attorney Lyons stated that the council has the power to hire an outside engineer as they are delegated this power by law. However, Works Engineer Randlett can legally represent both parties. Councilman Bracco suggested the matter be laid over for further study. Councilman Smith stated he was agreeable to laying the matter over. Mayor Cortesi asked Works Engineer Randlett if this would hold up the project. Works Engineer Randlett stated that they would be ready to start about the time of the next meeting. CounciLman Sani stressed the necessity of letting this project go ahead as weather conditions soon will not permit work to be carried on. CounciLman Noonau stated that the problem of the Engineer has come up time and again. Mayor Cortesi asked if they were in agreeance to lay the matter over to the following meeting. Councilman Smith agreed to this. Mayor Cortesi asked CounciLman Smith if he wished to withdraw his motion. CounciLman Smith stated he did not, asking City Attorney Lyons for the legality of the question. City Attorney Lyons stated that it was proper to table the motion. Application was received from Winfield Hooper of lOB Chapman Avenue to conduct the business of Service Station under the firm name of Hooper's Service at Bayshore Boulevard and California Avenue. 0u motion of CounciLman Bracco, seconded by Councilman Noonan and regularly carried~ business permit was granted. Application was received from Tom Songer of 412 Commercial Avenue to conduct the business of sharpening shop under the firm name of Tom's Sharpening Shop located at 521 Linden Avenue. 0u motion of Councilman Bracco, seconded by Councilman Noonan and regularly carried~ business permit was granted. Notice of Hearing was read as submitted by the San Mateo County Planning Commission relative to the dumping of sawdust and scrap building material on a parcel of land located on the easterly side of Skyline Boulevard. Mayor Cortesi asked City Man- ager McCluug as to the location to which he replied the exact location was unknown. ge further stated that this was the first meeting that a protest could be regis- tered as any building debris d~ped into a depression or culvert would have a tendency to wash down. Councilman Saul moved that the City Manager be authorized to go to the meeting and return with a report. CounciLman Noonau seconded the motion. Mayor Cortesi brought up the problem of Colma Creek having the debris emptied into it. Councilman Sani stated that authorization be given the City Man- ager to protest this. Motion as made and seconded was regularly carried. Communication as received from the Insulation Engineering Company was referred to the City ~uager. Communication was received from the office of the City Manager relative to the contract with the Park Ad Company and permission of Daly City to take part iu the negotiation of a contract with the Park Ad Company. Mayor Cortesi asked City Man- ager McClung for information regarding this matter. City Manager McClung stated he was contacted by Mayor Green and that they expressed intentions of entering into a like agreement as South San Francisco planned doing. DalyCitywas desirous of obtaining results on the matter. Councilman Sani moved, that the recommendation of the City Manager be accepted. CityMauager McClung stated that the contract was explained to Mayor Green. Councilman Noonau seconded the motion which was regularly carried. OFFICER JOHNSTON SUSPENSION: MUNICIPAL AUDITORIUM: MONTELY REPORTS: M & K CORP. CLAIM: BOY SCOUT CABIN ~AtRS: SPRUCE AVENUE BRIDGE RE: ARTHUR W. BKUM: Councilman Smith asked relative to the Parking Meters .as to whether or not the public had really voiced an opinion. He further stated he would like to move that the public be invited to voice an opinion by card, letter or other means of hear- ing from them. Councilman Noonan stated that he was for anything concerning public hearing and seconded the motion. ~. Cribbons stated that the motion as made by Mr. Smith can stir up public concern through the medium of the press. He further stated that this has been hanging fire for some time prior to this council and that he did not want action prior because he did not want this item used as a political football. He went ou to state that some of the signatures ou the petition are those of people who although are not in favor of parking meters, do favor parking meter advertising. He further went on to cite the continual growth of the city and for such growth would warrant a daily newspaper instead of a weekly one. Mr. Cribbous stated a contract for a three year franchise, for a one year trial period and a 90 day cleanup period had been asked for. Mayor Cortesi asked Mr. Cribbous what the guarantee was, to which he replied that it was only for 20% of the gross as this is the only contract that can be given, being a contract that is given the same all over. He further stated he had no fears of selling all the meter posts as they have applications on file already. Leo Cortesi spoke relative to the signatures of business men who signed the petition and are now opposed to this form of advertising. They request the time to go into the matter further. Comunication from the office of the Chief of Police relative to the suspension of Officer Charles Johnston was ordered filed. Communication was received from the office of the City Manager with regard t6 the citizen's group studying the advisability of a municipal auditorium. Councilman Bracco inquired as to whether or not the council had the authority to advance money for expenses. City Attorney Lyons stated that this could be done. Council- man Sani stated that claims could be submitted to the council for payment. City Attorney Lyons stated that Councilman Sani's statement was correct. On motion of Councilman Bracco, seconded by Councilman Noonan and regularly carried, department reports of the City Judge, Police Chief, Fire Chief, Building Inspector, Library, Poundmau and City Clerk as submitted were accepted. Claim of the M & K Corporation in the amount of $89,615.83 less $2,000.00 or $87,615.8B was brought up for payment. Councilman Bracco asked what the item was for. Works Engineer Randlett stated that this was on the Sewage Disposal Plant and the items for which the money was withheld was for the ones under question. He further stated that he had spoken to Mr. White and Slankard of San Bruno rel- ative to this matter. On motion of Councilman Bracco, seconded by Councilman Sani and regularly carried, payment of $87~615.83 w~s ordered made. Councilman Bracco brought up the matter of the Boy Scout Cabin and asked Mr. Leonard who was iu attendance for information. Mr. Leonard stated that at l0 a.m. Saturday, meeting was held with the Building Inspector at the Boy Scout Cabin. The Inspector at that time stated that repairs were needed and that a concrete block floor was suggested. Mr. Leonard further stated that the Inspector opened the floor and found dry rot. It was stated the expenditure of $500 would be made for this work. City Manager McClung stated this could be a rainy day project for the city when manpower could not be utilized on the outside. Mr. Leonard stated volunteer labor woul~ likewise be used. Ou motion of Councilman Bracco, seconded by Councilman Smith and regulary carried, repair to Boy Scout Cabin was authorized. Mr. Leonard stated that the amount of $500 as requested would also include the improvements asked for previously such as sheeting, etc. Councilman Smith then brought up the first communication which was not read but pertained to the payment to Arthur W. Baum, contractor ou the Spruce Avenue Colma Creek Bridge. Works Engineer Randlett asked that it be withheld as one itemwas under question which pertained to the item of fill. At this point, Councilman Smith asked for permission to question Works Engineer Randlett relative to this project. Permission was granted. After questions asked by Couucilm~n Smith were answered, Counci.lman Smith stated that he watched the fill as it took place and Et seemed that the Gas Tax Fund was squandered ou the fill part of the job. Council- man Smith asked City Attorney Lyons if a portion of the contract could be let out. City Attorney Lyons stated the bid is usually let out as a whole. Councilman Smith stated he felt the contract was not a fair one and protested its payment. He further stated an investigation should be made of the component parts and facts shown that these materials were used. Councilman Sani explained the contract method of letting it out to the lowest bidder. City Attorney Lyons stated that some bids may be high on one item, low ou another, but still the lowest bid is accepted. Councilman Noonan stated that if Councilman Smith wished to investigate this matter, to appoint him as a com- mittee and report to the council. Councilman Smith remarked that he watched the operations of the fill, saw it loaded onto the truck and dumped into the hole a short distance away. He felt that it was a glaring overcharge for fill. Works Engineer Randlett explained the various methods of fill and the manner in which they are figured. In answer to the ques- tion, City Attorney Lyons stated that it is legal to call for various contractors to bid ou various types of work but it is not generally done. Councilman Noonan again remarked that if Councilman Smith has offered the time, let him go ahead. Councilman Smith asked if he were authorized to get any records. City Attorney Lyons stated that the records are public. Councilman Smith then asked if he were free to get contractors records at will. City Attorney Lyons remarked that this was not done as business methods are usually secret and those of the~coutractor as well. Councilman Saui then remarked that Couucilman'Smith's action in picking ou the Engineer was not right. Councilman Smith asked what the pleasure of the council was in this matter. ED: C0LMA CREEK PROBLEM: SIDEWALK REPAIRS: BUS SERVICE: UC CELLI VARIANCE PERMIT: BUS SERVICE: City Attorney Lyons then brought up the matter of the curfew ordinance explaining that one of the councilmen co~d make a motion waiving the reading of the ordinance and introducing it by title only. Ou motion of Councilman Saul, seconded by Councilman Bracco and regularly carried, reading was waived and ordinance to be introduced by title. Councilman Smith asked relative to any objection from the publication. He was informed that there was no publication yet. Ordinance was introduced by Councilman Saul. Roll call vote was as follows: Ayes, Councilman John Noouau, Adolph Sani, Joseph Bracco, Telford Smith &Emilio Cortesi; Noes, None; Absent, None. Councilman Noonan introduced a resolution accepting a deed to certain property dedicated to said city by the Stoneson Development Corporation. Roll call vote was as follows: Ayes, Councilmen John Noouan, Adolph Saul, Joseph Bracco, Telford Smith, Emilio Cortesi. Councilman Bracco introduced a resolution accepting a deed to certain property dedicated to said city by the Stouecrest Corporation. Roll call vote was as follows: Ayes, Councilman John Noonan, AdOlph Sani, Joseph Bracco, Telford Smith, EEtlio Cortesi. Councilman Sani introduced a resolution authorizing an agreement between said city and Louis Baldiui, for the purpose of providing for plans and specifications for an exten- sion to the existing Public Library of said city together with supervision of the con- struction of such extension. Roll call vote was as follows: Ayes, Councilmen John Noouau, Adolph Saui, Joseph Bracco, Telford Smith &Emilio Cortesi. Councilman Bracco introduced a resolution directing the Works Engineer and the Super- iuteudeut of Streets to install a curb along the southerly line of Spruce Avenue ad- jacent to the property occupied by the Lindenville Project of the Housing Authority. Roll call vote vas as follows: Ayes, Councilmen John Noouan, Adolph Sani, Joseph Bracco, Telford Smith, Emilio Cortesi. City Attorney Lyons brought up the matter of the resolution relative to the acceptance of a deed from the South San Francisco Laud Company. Councilman Smith brought up the problem of enclosure later of the easement. He questioned as to whether or not that shou~ld be accepted with the easement. Works Engineer Raudlett explained this. Coun- cilman Bracco asked if we were using it at this time to which he was answered that we were. Councilman Smith moved that we accept it exclusive of the easement. City Attoruey Lyous stated that this could not be done. Councilman Bracco moved, seconded by Councilman Saui and regularly carried, that this be laid over to next meeting. Mayor Cortesi next brought up the matter of Colma Creek asking for action in this matter. He made requests as follows: (1) The City should arrange with the County to form a drainage district, (2) That the legal problems be worked out for such a district~ (3) That a competaut engineering study be made of the problem. If necessary we should hire drainage experts. Their study should recommend the best way of solving the problem such as: 1. Lining wall of canal. 2. Placing large pipe iu the canal. 3. Diversion of water from Colma Creek. He further suggested that a committee be named to work this out. In addition to the City Mauager and Engineer he asked that the five councilmen serve as well. Mayor Cortesi further stated that he has tried to bring these matters to a head and has received no cooperation. He remarked that something must be done. Councilman Smith asked Works Engineer Raudlett if reinforcing wire could be laid over the banks of the Creek and anchored iu place thereby allowing debris to adher to it creating a temporary measure. Councilman Bracco stated that this matter could be taken up for discussion when the committee met. Councilman Saul moved, seconded by Councilman Bracco and regularly carried, that the recommendation of the Mayor be accepted. Mayor Cortesi next brought up the matter of sidewalk repairs that were badly needed, stating that something had to be done regarding this matter. Councilman Bracco asked if this had to do with the business district or all over. Mayor Cortesi stated all over. At this point City Manager McCluug explained the problem as it could be handled either through tax money or assessment to property owners. He also mentioned the fact that a trial was going to be given to a plastic type cement and if it worked well would be tried elsewhere. Councilman Noonau stated that the idea of City Manager McClung with respect to plastic cement seemed a good one. Inasmuch as the council was in general agreeauce on the City Manager's idea, he was authorized to give this matter a trial. Mayor Cortesi next brought up the matter of bus service explaining the conversation he had with Walter Ryan. Walter Ryau requested the help of the Mayor stating that he would operate the bus service ou the off hours if the city would compensate him for his loss. Mayor Cortesi was of the opinion that the council would meet with Ryan and contribute some fund. Councilman Saul asked for the legality relative to this problem. City Attorney Lyons stated that a city does not give aid to a private bus company. However, bus lines could be leased for special purposes such as nights and Sundays. The Council should thoroughly investigate the matter to save being called ou again for some other matter. Councilman Noonan asked Mr. Stuller relative to his proposed solution. Mr. Stuller replied that he has been checking on it. Couucilms~n Smith asked Mayor Cortesi if Mr. Ryau has applied for a rate increase. Mrs. Heruau stated the rate has already been increased. It was decided to have a comm~ttee meeting ou this problem, the council acting as a committee and the City Attoruey to obtain the legality of matters discussed. The variance permit as granted to Mrs. Teresa Uccelli by the Planning Commission was brought up and explained by Asst. Buildi,ng Inspector Ghilardi, which would allow for a buildable lot. Variance had already bee~ granted by the Planning Commission and their letter was to follow. City Attorney Lyons stated that a motion was iu order but uo letter necessary. On motion of Councilman Bracco, seconded by Councilman Noouau and regularly carried, variance as granted was issued. Mrs. Betty Mitter spoke relative to the bus service stating that press releases are to be given. STERLING TERRACE DRAINAGE PROBLEM: STERLING MANOR DRAINAGE PROBLEM: SA3T BRUNO ROAD ABA3~)0NME~: GAS TAX BUDGET, DRAINAGE DISTRICT: DRAINAGE PROBLEMS, SUNSHINE GARDENS, MISSION ROAD, OAK AVENUE: APPROVED: Harry Davis of 795 Larch Avenue spoke relative to the drainage problem iu Sterling Terrace. CounciLman Noonau turned over to the City Clerk a letter from the office of Works Engineer Randlett relative to this matter which was read. Upon completion of reading of the letter~ Councilman Noouan stated tb~t the report as submitted by Mr. Klassen conflicted with that of Mr. Raudlett. He moved that the two letters be given to a drainage expert for a decision as he did not know whether Mr. Randlett or Mr. Klasseuwas wrong. Counci.lmau Smith seconded the motion. Councilman Saui stated he wished further time to consider this matter. Motiou~'~%second as made were withdrawn. Remarked from the floor was the fact that vegetation cannot grow where the water comes down as it was tried to grow Ice Plant but to no avail. Mrs. Bose spoke regarding Sterling Manor drainage problem relative to the silt washing down and the 12 mile creek problem. City Mauager McClung stated that two problems existed. One was an engineering and the other a legal one. One was the closing of a natural drain and the other to prevent water from going to the lowest point. Councilman Smith asked if this matter could be brought up for discussion when the committee met. Mayor Cortesi asked that the matter of the San Bruno Road abandonment be held over. City Manager McClung then brought up the matter of items as suggested by Works Engineer Raudlett iu his letter. One had to do with the Gas Tax Budget and the other was the Drainage District. Works Engineer Raudlett gave au explanation as to the Gas Tax. He recommended item l, Bayshore Highway, and item 3 of Mission Road. He further explained that if the project was not done then an amendment could be made with the state relative to the matter. Councilman Bracco suggested that item 5 of B Street and item 6 of the 01d Market Street Railway Right of Way be adopted, also item 4 of Harbor Road but that it be cut down to ~B800.O0. Coun- cilman Bracco moved, seconded by Councilman Noonau that the items as mentioned be considered. Councilman Smith inquired regarding Harbor Road being a private road. Councilman Saul stated that Gas Tax funds could be used as it will be a Major Street. Works Engineer Randlett stated that before a budget could be adopted streets must be declared as Major City Streets. Therefore, Harbor Road and Market Street Rail- way Right of Way would have to be declared Major City Streets. Mayor Cortesi brought up the problem of drainage from property of the High School area to the Market Street Railway and our property. He stated the school should take care of this. City Manager McClung explained relative to giving the people the impression that the Market Street Railway right of way was ours as it is not. City Mauager McCluug spoke relative to the letter from Mr. Cherry of the school and the follow up meeting held later. Councilman Bracco asked what was to be done with regard to the Budget. Works Engineer Raudlett stated he could be instructed to go ahead without Harbor Road and the Market Street Railway Right of Way. Councilman Bracco moved, seconded by Councilman Noouan and regularly carried,that the recommendation of Works Engineer Raudlett be accepted. Works Engineer Raudlett then explained the drainage area problem relative to the property in Sunshine Gardens down Mission Road and Oak Avenue. The figure as submitted was 25~ higher then the preliminary estimate. Any project that was desired could be done without having to do all at once. Mayor Cortesi stated that Commercial Avenue and Chestnut Avenue should be first. City Manager McCluug stated that the area is embracing all that trouble was had with last year. The council he stated shOuld meet within the next week, the latest iu two weeks, to meet on this problem. Councilman Smith stated that plans and specifications have already been approved. Couuci.lmau Bracco moved that plans and specifications of the Works Engineer be accepted. City Manager McClung explained relative to the petition that was going to be circulated which would probably cut down the time element. City Attorney Lyons stated no motion was necessary as a resolution would be prepared for this. On motion of Councilman Sani, seconded by Councilman Bracco and regularly carried, the meeting was adjourned to Monday, September 22, 1952 at 4 p. m. Time of Adjournment - 10:45 p. m.
