TO VACATE SEWER EASEMENT ARMISTICE DAY HOLIDAY: SORENSET~ EXTENSION OF ~: ADJO~ ~q~TING OF THE CITY COUNCIL OF THE CITY OF SOUTH S~2~ FRANCISCO HELD WEDNESDAY, NOV. 5, 1952 Council Chambers, City Hall 4p.m. The meeting was called to order at 4:37 p. m. by Mayor Cortesi Present: Councilmen Adolph Sani, Joseph Bracco, Telford Smith, ~kailio Cortesi Absent: Councilman John Noonan. 4:40 p. m. - Councilman Noouan is present and present for remainder of the meeting. Bids for the improvement of Spruce Avenue from Railroad Avenue to North Canal Street were opened and read and were as follows: B & D Truck Service J. Smith C Gnpauy $12,128.00 12,639.00 11,728.00 12,841.00 11,218.20 13,223.60 Upon completion of reading of the bids, Councilman Smith asked Works Engineer Randlett relati~ to the unit prices ou the items asking what was out of line with the estimates as submitted. Works Engineer Raudlett stated that the major increase was in the crusher run base. The dis- cussiou then took place regarding the sand fill, Councilman Smith stating that if we let the bid and rented trucks for use of the fill dug from Colma Creek doing the fill ourselves, we would be money ahead. Mayor Cortesi at this point asked what the council was waiting to do now. City Manager McClung stated that council action w~s being awaited on whatever the wishes are of the council relative to the hiring of trucks and doing of the fill ourselves. Works Engineer Randlett stated that the council could not award the contract until the state is notified inasmuch as it is iu excess 10% of the bid. However we could move the sand iu ourselves and then within l0 days would be notified by the state if the low bid was accepted. We would know by the next meeting. Councilman Bracco moved, seconded by Councilman Sani and regularly carried, that the City Manager be instructed to prepare the necessary papers and notify the state regarding the lowest bidder being iu excess of the estimate. Councilman Smith then stated that if Works Engineer Raudlett should find we cannot get the fill iu to notify us and then a special meeting could be called to decide what we are going to do. Councilman Bracco then asked City Manager McClung regarding Chestnut Avenue being opened up. City Manager McCluug replied that it might be possible to put iua temporary pipe bUt~this would entail going through a few lots in the rear of the Uccelli property. Mr. william F. McGuire then spoke relative to the abandonment of the easement iu the area between Linden Avenue and the Old Bayshore Boulevard near Armour Avenue. City Attorney Lyons explained the easement as it presently existed ou the title search from which he was reading, also sta~ing that there presently is a natural ditch in the middle of the property and that sanitary.and storm sewers already exist, being in. City Attorney Lyons stated that Mr. McGuire has consented to pay all the publishing costs. Mr. McGuire stated that this was cor- rect. City Attorney Lyons stated that December l, 1952 would be the first date for the hear- ing. The only item requested by the Title Compauy was a letter from the City Attorney on this matter. Councilman Sani introduced a resolution of intention to vacate a sewer easement in the City of South San Francisco. Roll call vote was as follows: Ayes, Councilmen John Noouan~ Adolph Saui, Joseph Bracco, Telford Smith and Emilio Cortesl. Robert Swope an employee of the City spoke in behalf of the City Hall employees, City Clerk and Clerk of the Police Dept., asking for a clarification of the Armistice Day holiday. Mayor Cortesi stated that he had been instructed by the City Employees Assn. to recognize only a duly authorized representative of that body and not an individual employee. Mr. Swope stated that he had been sent by Mr. Esparza, the president of the association, as their rep- resentative. },~. Swope then fdrther went ou to state.that the other peninsula cities are granting the holiday to City Hall Employees, and was speaking in behalf of them omly, excludin the Fire, Police, Street and Park Employees. City Manager McClung explained the questionaire that bad been sent to the majority of the Peninsula cities ou the holidays and found that they were being granted Armistice Day Holiday, Lincoln's Birthday and Columbus Day. City Manager McClung then read from the Civil Service ordinance stipulating the holidays as are allowed. Ctty AttorueyLyous stated tb~t the council has the right to regulate the holidays. Councilma Smith remarked why not all the City employees gett%ng the same amount of holidays. Councilman Noouau raised the question of the council passing on Armistice Day now and then consider all the employees with respect to holidays later. Mayor Cortesi remarked that all employees should be treated equally. Councilman Bracco moved the Municipal Employees cc~prisiug the City Hall Employees, City Clerk and Clerk of the Police Department be granted the three addi- tional holidays of Armistice Day, Columbus Day and Lincoln's Birthday. Councilman Sani secon- ded the motion as made. Councilman Smith then remarked to l{ayor Cortesi that the motion be rejected and grant the holiday to all the employees as one would be pleased and the other dis- pleased. Later a meeting with the employees could be held with Department Heads, and the Em- ployees Association. In this manner, we would not be creating a problem. Councilman Bracco withdrew his motion and Councilman Sani withdrew his second. Councilman Smith moved, seconded by CounciLman Saul and regularly carried, that Armistice Day holiday be granted to all City employees and at a later day to meet with the help. Cce~nunication was received from Peter Sorensen requesting an extension of time on the improve- meut of Industrial Acres. Works Engineer Randlett explained that the council could if they wished grant this extension of time until the first meeting iu December as he should be fin- ished by then. Councilman Saul moved~ seconded by Councilman Noouan and regularly carried, that the contractor Peter Sorensen be granted an extension until December, 1952. He further remarked that a peti- tion and waiver was to be included. Councilman Smith introduced a resolution declaring that investigation proceedings are not required in Industrial Acres fire protection system proceedings. Roll call vote was as follows: Ayes, Councilmen Noouan, Saul, Cortesi, Bracco and Smith. Councilman Bracco introduced a resolution employing attorney for Industrial Acres Fire Pro- tectiou System Proceedings. Roll call vote ~as as follows: Ayes, Councilmen Noouau~ Sani, Cortesi, Bracco~ and Smith. Councilman Bracco introduced a resolution ordering Plans and specifications, appointing Engineer of work and directing estimate to be made. Roll call vote was as follo~: Ayes, Councilmen Noonau, Saui, Cortesi, Bracco and Smith. Councilman Sani introduced a reeolution approving the plans and specifications of fire pro- tectiou system in Shaw Road, Industrial Acres and approving estimate of Engineer of Work. Roll call vote was as follows: Ayes, Councilmen Noouau, Sant, Cortesi, Bracco & Smith. Councilman Noonan introduced the resolution of intention for prote~ hearing December 1, 195~ Roll call vote was as follows: Ayes, Councilmen Noouan, Saul, Cortesi, Bracco & Smith. Councilman Bracco introduced a resolution designating newspaper. Roll call vote was as foll¢ Ayes, Councilmen Noouan, Sani, Cortesi, Bracco and Smith. Councilman Noonau introduced a resolution establishing prevailing wage scale. RoLl call vote was as follows: Ayes, Councilmen Noouau, Sani, Cortesi, Bracco, and Smith. Councilman Sani introduced a resolution directing publication of notice inviting sealed pro- posals and fixing date of hearing thereon for the fire protection system in Shaw Road, Indus- trial Acres. Roll call vote was as follows: Ayes, Councilmen Noouau, Saul, Cortesi, Bracco and Smith. Councilman Smith brought to the attention of the council the water which was standing at Second and B Streets which was stagnated and gave off au offensive odor. City Attorney Lyons remarked to the council that a fee for inspection should be considered connection with the ordinance for the control of animals. On motion of Councilman Noouan, seconded by Councilman Sani and regularly carried, the meeti~ was adjourned until Monday, NovemberlT, 1952 at 8 p. m. Time of Adjournment - 6:35 Po m.
