HomeMy WebLinkAboutMinutes 1953-05-04PLACE: TIME: CALL TO ORDER: ROLL C~LY.: ANIMAL CONTROL PROBLem: REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, MAY 4, 195B Council Chambers, City Hall 8p.m. The meeting .,,,as called to order at 8:20 p. m. by Mayor Cortesi. present: Councilmen John Noonan, Adolph Sani, Emilio Cortesi, Joseph Bracco, Telford Smith Absent: None The minutes of the previous meeting were approved as submitted. Mayor Cortesi asked if there were any protests on the animal control ordinance. Mr. Gerrard arose and stated that he agreed something should be done regarding the dogs as he himself w~s a dog fancier. He was of the opinion that if a dog was properly cared for, this fact deserved some due consideration. He said that the mongrel dog which was allowed to roam the street was the one which ~as doing the damage to the gardens. He also said that if someone had a grievance against dogs, they should make their charges in the open and not hidden. Mrs. Lesko stated she w~s not against dogs or pets but that people had moved to this community to get away from cr~eded conditions and have more freedom. She cited the condition of several dogs in a home attracting more dogs. She further remarked that since we were building a met- ropolis that a limit should be set to two dogs. Mr. McFadden of Winston Manor Improvement Association spoke regarding the petition that had been circulated and regarding more than two dogs aa a business. Mr. Goul~ stated that there was a difference between a Hobby and a Business. He cited photo- graphy aa an example of a hobby, stating that dog raising was a hobby as well. He requested a fair bre~k. Mrs. Fuque spoke on the mongrel dog and the damage done by these stray dogs. She stated that the o~mers of tbe~e dogs should be made to care for them. She felt that these stray dogs should be picke~ up and the owners assessed a fine. Dr. Hambley stated he felt he was in an awkwm~d position. He remarked of having worked with this committee and was appraised of the work dog fanciers put into their hobby. He also realize that many dollars go into these dogs. He then stated that speaking as an individual and not as a representative of a group, he felt that anyone with a small y~rd has a job keeping two pets in shape. He said that in his opinion a limit should be made of two dogs. A restricting ordinance he felt was essential. Mr. Boido remarked that he did not have any dogs nor was he planning on getting them, but if they were properly cared for, should be placed under a special permit and license. Jack Jones stated that most of t_~e point was being missed, stating that in his opinion there was no difference between the bark of a thoroughbred or a mongrel in keeping the children awake. Mr. Anderson stated that if a fancier's license was permitted it would encourage other animal fanciers to ask for a license such as for cats, birds, etc. ~!owing dog fanciers would be an entree to other fanciers. Health Inspector Reint Lingeman explained Section 13 of the proposed ordinance as it had been redrafted by the c~ittee appointed by the council. He said that through the county a person can have as many as two dogs. He further remarked that as proposed by the change it is left up to the people in the neighborhood to allow or disallow aa many dogs as the request is for. Mayor Cortesi then called on City Attorney Lyons for anything he might have to offer to which he stated that he was ready to proceed at any time the council desired. Councilman Smith rema_wked that he had made some notes aa the discussion was in progress remark- ing on Health Inspector Ling~mmn's remawks with regard to the a~ended part of the ordinance and the council allowing permits to have more than two dogs. He stated that if all neighbors spoke up a~d were frank, everyone would get along better. He remarked having watched the Poun~mau go through phy~ieal effort picking up dogs and stated the possibility of the Poundman citing the dog owner. Councilman Noonan remarked on Section 13 as submitted, also the recommendation of Dr. Hambley. He stated that he would like to go through Section 13 more thoroughly. He would like to have the owner show he can first take care of the n~ber of dogs he applies for. Mrs. Stickle stated that they had worked hard on the c~ittee, wanted an ordinance, and wanted it tonight. Mr. Gerrard .again remarked regarding the field champions he has raised. He said that when he moved here he had read the city ordinance and at that time did not find any provisions regarding dogs. Councilman Noonan remarked on the permit that has to first be obtained, defining the meaning behind it. He stated that the rewording could be done by the CityAttorney for the proper legislation. Mayor Cortesi said that a number of persons gathered stated their opinions on the matter and that a motionwas in order to settle this problem. Councilman S~ni remarked on the hard work done by the cow~fttee, stating that the City Attorney should be authorized to draw up the ordi- nance. The councilmen then could work with him and amendments a~ded. Councilman Sani moved the City Attorney be instructed to draw up the ordinance on animal control. Motion as made was seconded by Councilman Smith and regularly carried. At this point Council.man Smith remarked on the discussion held that the people gathered should consider the feelings expressed, citing a reversal of position and the feelings of the people if they were in the position of the council, and not as people gathered here. He requested the consideration of people for good law and legislation. STATE PERSONNEL BOARD SALARY SURVEY AND JOB CLASSIFICATION: NEM SIGN OBDINANCE: RECREATION DEPT. Councilman Bracco moved, secoud%d by Councilman Sani, that the recommendation of the City Manager be accepted and the City Clerk be authorized to sign and execute the agreement. Councilman Smith, under the question, asked if the City Attorney had read the agreement, as he stated that it referred to fees. City Manager McClung explained the fee having averaged between $8 or $9 dollars. He furbher stated that ~r. Byers felt that since a Job classification plan had alread~ been starte4 it might be low~r, about $7. The estimate was to be between $6 and $9. The work was to be"' completed in about thirty days and the final re~ort in about forty days. Councilman Smith asked if there was any information on the salary of the men who were to conduct the surve2 City Manager McClung stated that in talking to the City Manager of San Jose, it would be about $7 per day. At this point, City Attorney Lyons stated that the agreement met with his approval and felt that an itemized bill would be presented at the c~letion of the work. Motion as duly m~le and seconded was regularly carried. C~unication was received frc~ the office of the Planning C~ission recommending the adoption of a new sigm ordinance. Councilman Noonan moved that the matter be referred to the Chamber of Commerce and Business ~en's Association for consideration before acting on it. It was suggested they be notified by letter. Motion as made was seconded by Councilman Bracco and regularly carried. C~unication was received from the Recreation Department regarding operational budget for the coming fiscal year. Councilman Sani moved, seconded by Councilman Smith and regularly carried, that the matter be held over until the budget sessions. C~m~unication was received from the office of't~he Recreation Del~nt regarding use of High School facilities during the s,wa~-rtime for reer~atiomal ~MesIS. Attache~ was a form of agree merit to be entered into by the city and the Recreation Department. Councilman Bracco moved that the recc~endation of the Recreation Co~aission be accepted as a tentative agreement. Councilma Noonan then remark~ on the maintenance of the facilities and who was to bear this. Councilman Braceo stated that aceordir~ to the agreement the school would do this. Mrs. Hernan, a member of the ~eermation Col~ission, said that the school would maintain and u~keep the facilities. Councilman Noonan requested that the agreement have incorporated the motion on the maintenance to the effect that the school would do so at their own ex~ense. Councilman Bracco at this point remarked that the major use would be by the school and not the recreation department. City Attorney Lyons stated that the letter and agreement could be referred to as a tentative agrmmment and suggested he be allowed to confer with the Recreation Commission and draw up the agreement. Motion as made was seconded by Councilman Noonan and regularly carried. Communication was received from the office of the Planning Co~ssion regarding the use permit granted Anton%o Molinu, recommending revocation. It was moved by Councilman Noonan, seconded by Councilman Smith and ragularly carried, that the recomaendation of the Planning Camaission be accepted. Communication was received from the Housing .Authority regarding an easement through a portion of Industrial Village. C~maunication was ordered filed. Communication was received from the Housing and Home Finance Agency for repayment of advance made to the city for preparation of plans and s~ecifications for the Sewage Disposal Plant. City Manager McClung explained that this matter had come up some time ago and a check was made to see if the money was owed, and it was found that it was owed. The money was to be repaid if the bond ..issue passed which also happened. He remarked that there were several methods of repaying which were: (a) by local allocation of funds (b) Bond Sale (c) General funds .if pro- vision is made for reimbursement. City Attorney Lyons suggested that it should first be a~eer- rained where the money was originally deposited. It was moved by Councilman Sani, seconued by Councilman Bracco and regularly carried, that the matter be referred to the City Manager and he ascertain what method of repayment should be made. C~unication was received from Barrett and Hilp regarding the petition for annexation of the Buri Buri Subdivision ~B. Councilman Saui asked if anyone was present from the firm of Barrett and Hilp. Mr. Schw~bel was present and was asked by Councilman Saui if he (Mr. Schwabel) was aware of the necessary requirements to which Mr. Schwabel answered he had received them today. Councilman Sani then requested to know if the Burl Burl Park problem had been settled. At this point, City Manager McClung mentioned regarding the services to be charged for by the city. He stated that in the letter uo mention was made regarding the park. He further remarked that the park was mentioned informally with Mr. Barrett in conversation. Councilman Sani stated he was not in favor of the petition as submitted. Mayor Oortesi said that the 12 Mile Creek was another problem. Councilman Noonan suggested that a rejection be made or serve notice on Mr. Barrett regarding the stipulations. City Manager McClung stated if it was the wish of the council he would write a letter stipulating the park problem. Mr. Schwabel requested to know if the park was a condition to which he was answered that it was not a condition but something promised that was not carried out. City Attorney Lyens stated he agreed it was not a condition but a promise not fulfilled. Upon fulfillment of this performance a better position would be realized iu which to act. Councilman Noonan moved, seconded by Councilman Bracco and regularly carried, that the matter be referred to the Study Session, a s,mw-~_ry to be made by the City Manager of all prior procedure, legality to be submitted by the City Attorney and a represen- tative of Barrett and Hilp to be present. C~unication was received from the Regional Water Pollution Control Board regarding raw sewage that was still being aumped into San Francisco Bay, along with Industrial waste. Councilman Sani msved that the matter be referred to the City Manager and Works Engineer for reply and answmr to the council. City Manager McClung spoke regarding the meeting recently held about three or four weeks ago. Financing is the remaining question. This he stated may be solved in a few days.. He further remarked regarding the approval already given. Dames and Moore on soil sables to be made. The report on the solution would be forthcoming. Motion as made was seconded by Councilman Bracco and regularly carried. Coeaaunication was received from the Veterans of Foreign Wars of the United States regarding the use of the Orange Avenue Memorial Park for the Tri-City Fall Festival. M~tter was ordered laid over. Mrs. Hernan stated that a meeting was scheduled in which to take this matter up. Councilman Smith remarked tha' from the sketch it w~s a beautiful building but requested to know how the parking problem w~s going to be handled and what parking facilities w~re going to be handled. This he stated should be ascertained. Councilman Bracco remarked that parking problems were always a problem but since an Investment had been made, did not see how w~ could hold this up. Councilman Smith stated that this would create a parking problem for the Police Department. Councilman Bracco stated that iu the area there is uo parking limit and also vacant lots were in the neighborhood. Mayor Cortesi suggested that the Union officials be contacted and the matter be discussed with them. Councilman Smith requested that the permit be held u~. City Attorney Lyons remarked that in the present ordinance, there was no provision stipulating that parking facilities had to be provide~l. Councilman Sani stated that no detail plans had been submitted, and that it be held up until the next meeti~ although permission could not be denied. City Attorney Lyons stated that the council has the power to hold up the permit since no detail plans were submitted However no provisions were now in effect to make the people building to provide parking space. Councilman Smith suggested that it be referred to the Planning Compression for working nut the details. It was moved by Councilman Smith, seconded by Counci!m~u Sani and ?egularly carried, that it be referred back to the Planning Commission for study on parkingproblems and any other problems. Communication was received from the Union 0il Products requesting approval of a gasoline tank installation. This carried the approval of the Fire Chief. On motion of Councilman Sani, sec- onded by Councilman Bracco and regularly carried, the rec~ndation of the Fire Chief was accepted and approval granted. A~licatiou wa. received from Edward Banta to engage iu the business of soliciting eggs, making his a~plicatiou aa a disabled veteran. On motion of Councilman Sani, seconded by Councilman Bracco and regularly carried, license wms granted if the location was in the business district. Application was received from Walter~artin, Jr. to engage in the business of light office and store fixtur~ manufacturing under the firm name of Harris and MartinMfg. Co., located at 105 Linden Avenue. It wa~ moved by Councilm~n Sani, seconded by Councilman Bracco and regularly carried, that the business license be granted. COmmunication was received from the Municipal Employees Association requesting permission to hol a dance. On motion of Councilman Bracco, seconded by Councilman Noonan and regularly carried, permission as requested was granted. Communication was received from the Yellow Jackets Motorcycle Club requesting permission to hold a field meet east of the Bayshore Highway. Mr. Snipe was called on to explain this type of field meet ~nd stated that it w~a one of precision riding and maneuvers. These riders he said are Judged for performance, there being no coa~tition. Councilman Noonan suggested that the insurance policy be posted with the City Attorney. Chief of Police Belloni asked for further study on the matter, citing the near riot in Hollister recently by a group of motorcycle enthu- siasts. Councilman Noonan requested a lay overfor two weeks and the organization to contact the Chief of Police, who would then issue his recoem~ndation at the next meeting. C~m~unication was received from the Buri Buri Parent Teacher Association regarding sumner recrea tion progrem at the Buri Buri School. Mrs. Hernan stated that this came up for study and would be taken under consideration. A co~nunication was received from the Chamber of Commerce regarding advertising signs on the hills aud was laid over. A c~unication received.from D. Elwood of San Francisco protestim~ the billboard sign opposite the Steel Mill, advertising a night club, was ordered filed. Cce~unication was received from the office of the Chamber of Commerce relative to the renaming of Old Bayshore Boulevard to Airport Way. This was accc~nied by a letter from the Pacific Co~t Foil Company regarding the same matter. City Manager McClu~g stated that an official name, which he could not recall, had been establishe~ some six months ago. At this point, Victor Robinson, Secretary of the Planning Commissi°n, stated he thought that name was South Bayahore Boulevard. City Manager McClung suggested the matter be referred to the Planning Com- mission for a street name to be recommended. Councilman Sani moved, seconded by Councilman Noonan and regularly carried, that it be referred to the Planning Commission. C~m~unication was received from John Furrer requesting a ten day extension of time in which to complete work on Old Bayshore Boulevard. On motion of Councilman Sani, seconded by Councilman ~N~onan and regularly carried, extension as requested was granted. Co~unication was received from the South San Francisco Junior Chamber of Commerce re~uesting an up to date map of the city to be used in the printing and distribution of city maps'. Works Engineer Randlett stated that the official map is brought up to date but the letter intones a street map. Councilman Bracco suggested that the Jr. Chamber of Commerce contact Works Engineer Randlett. City Manager McClung stated he would contact Luther Smith regarding the map. Works Engineer Randlett stated that it would be brought up to date in one or two weeks. ~nder unfinished business, business license application of Abe Phillips w~s again brought up. Letter as submitted by Building Inspector Rozzi together with the notation of Health Inspector Lingeman were read regarding their recommendation on the matter. Fire Chief Welts reported ver- bally that he was willing to go along with the~recommendation as submitted by Building Inspector Rozzi. Councilman Sani stated that the building was in a deplorable condition. City Manager McClung stated he discussed the matter with the Building Inspector today and the structure is in a bad state. Suggestion was made for a year to year lease iu order that other quarters may be found in the meantime. Councilman Bracco moved, seconded by Councilman Noonan and reg- ularly carried, that the matter be held over for further study. CLAIMS: Councilman Sani moved, seconded by Councilman Noonau and regularly carried, that claims as audi by the Finance Cofmmittee, tu the amount of $B4,505.30, be approved. RESOLUTION NO. 1880 DEC. Roll call vote was as follows: Ayes, Councilmen Noonan, Sani, Cortesi, Bracco, Smith. Councilman Sani introduced a resolution of the City Council of the City of South San Francisco declaring its intention to do certain public improvement work in the City of South San Francisc~ on Second LanefromChestnut Avenue to Eucalyptus Avenue. Roll call vote was as follows: Ayes Councilmen Noonan, Sani, Cortesi, Bracco, Smith. Councilman Sani introduced a resolution of the City Council of the City of South San Francisco alrpointio~ an~engineer forths improvement of Second Lane from Chestnut Avenue to Eucalyptus Avenue, and directio~ said engineer to make an estimate of the cost of said improvement. Roll call vote was as follows: Ayes~ Councilmen Noonan, Sani, Cortesi, Bracco, Smith. Councilman Bracco introduced a resolution approving the esttmate of the Works Engineer. Council man Smith requested to know the purpose of approving the estimate. City Attorney Lyons stated the council authorizes the e~timate and then approves it. It is placed with the City Clerk to be 'viewmd by the property owners. Roll call vote was as follows: Ayes, Councilmen Noonau, Sani, Cortesi, Bracco, Smith. RESOLUTION NO. 1884 ADOPT. PLANS & SPEC. SECOND LANE IMP: To 7-~ RESOLUTION NO~ 1885 EMPLOYING AT~0RNEY SECOND LANE IMP: ~'O 73 RESOLUTION NO. 1886 ESTABLISHING WAGE SCALE SECOND LANE IMP: 1 Councilman Bracco introduced a resolution adolrting plans and specifications for the improvement of Second Lane from Che~tnutAvenue to Eucalyptus Avenue in the City of South San Francisco. Roll call vote w~s as follows: Ayes, Councilmen Noonan, Sani, Cortesi, Bracco, Smith. Councilman Sani introduced a resolution employing attorney for Second Lane proceedings. call v~te wm, as follows: Ayes, Councilmen Noonan, Sani, Cortesi, Bracco, Smith. Roll Councilman Bracco introduced a resolution establishing prevailing wage scale. Councilman Smith asked the purpose of this resolution to which City Attorney Lyons explained tb~t it was in con- formity with the Labor Code. Roll call vote was as follows: Ayes, Counci]m~_-n Noonan, Sani, Cortesi, Brmcco, Smith. BICYCLE 0FOINANCE: ~"/g y ORDINANCE NO. 338 UNIFORM BLDG. CODE: City Attorney Lyons then brought up the ordinance with regard to the licensing of bikes. This was explained in detail by the City Attorney. Councilman Sani asked the reason for the license~ being issued for two years instead of one year to which City Attorney Lyons remarked that it is not a revenue raisio~ measure, but a protection for youngsters who own bikes and to charge more would possibly work a hardship on the youngster in paying for his license. Councilman Smith re. marked on the section with regard to the effect that bikes could not be ridden on the sidewalks He cited small youngsters'such as his own who would be placed in a hazard should they be made t~ conform to this ru~e. City Attorney Lyons stated that the ordinance was drawn up in conformity with other cities but that he would be willing to follow any solution as suggested by the counc: Councilman Smith suggested that possibly it could be regulated by the size of the bike. City Attorney Lyons suggested possibly the size of the bike and the age of the rider. Mrs. Hernan sugges+~d ignoring the part with regard to ridimg on sidewalks. At this point, City Attorney Lyons changed Section 7 to restrict the riding of bicycles on sidewalks in the business distric~ Councilman Sani moved seconded by Councilman Noonan, that the reading be waived and introduced by title'only. Councilman Smith remarked on the cost involved and if the revenue collected would pay for the bookkeeping, licenses, etc. City Manager McClung explained how he and Captai~ Terragno of the Police Department had gone into this and ascertained the cost of tags and other supplies needed. Councilm~n Bracco stated that it would be a savings in man hours searching fo~ stolen bicycles. Roll call vote was as follows: Ayes,'Councilmen Noonan, Sani, Cortesi, Bracc( Smith. City Attorney Lyons then introduced the second reading of the ordinance with regard to the Unif( Building Code, explaining the ordinance and reading it in its entirety. City Attorney Lyons stated a roll call vote should also be taken on the urgency clause that was a part of the ordinance. TRIBUTE TO OFFICER ARTHUR MOYLE: Mayor Cortesi next called for a m~nent of silence in respect to Police Officer Arthur Moyle. Councilman Sani moved that the City Attorney be instructed to prepare a resolution for Officer Moyle, that a copy be sent to the family and that it be spread on the minutes of the council meeting. Motion as made w~s seconded by Councilman Bracco and regularly carried. Councilman Noonan then remarked on the waiting period necessary before an employee can be eligil for benefits and moved that a study be made to see if there was not something in the State to change the law to benefit all men killed in line of duty. Motion was seconded by Councilman Sa~ and regularly carried. SMITH LEAVE STATE: Councilman Smith requested permission to leave the State for thirty days. It was moved by Coun- cilman Bracco, seconded by Councilman Sani and regularly carried, that permission be granted to Councilman Smith to leave the state. WORKS ENGINEER CONTRACTS: ~0 g~ AD JOURNMENT: APPROVED: Councilman Smith then req~sted that the City Attorney real the contracts of the Works Engineer and advise as to their scope a~ s~tus. He further st,t~ that a considerable amount of money was to be spent on lines to the Sewage Di~osal Plant ~om the industrial area and a considerab] amount of moneywould be spent for Engineer's f~s. He ~lt this money could be ~ed in conducl ing 1~ department of p~lic works, who C~handle this venture. He stated that he was bringt this to their attention ~r consideration. City Atto~ey Lyons wished to ~ow if the matter should be held over until Councilman Smith's return. Councilman Smith stated the council co~d go ahe~ and act in his absence. City Attorney Lyons agreed to have a report prepared for the next meeting and the council co~d act on it at that time. There being no further business, the meeting was adjourned at 11:'~0 p. m. Counci man Smith requested to know the purpose of approving the estimate. City AttorneyLyons stated the council authorizes the estimate and then approves it. Councilman Bracco introduced a resolution adopting plans and specifications for the improvement of Second Lane from ChestnutAvenue to Eucalyptu~ Avenue in the City of South San Francisco. Roll Councilman Bracco introduced a ~resolution establishing prevailing wage scale. Councilman Smith asked the purpose of this resolution to which City Attorney Lyons explained that it was in con- formity with the Labor Co~e. Roll call vote was as follows: Ayes, Councilmen Noonan, Sani, Cortesi, Bracco, Smith. BICYCLE ORDINANCE: ~/g 7 City Attorney Lyons then brQughtup the ordinance with regard to the licensing of bikes. This was explained in detail by the City Attorney. Councilman Sani asked the reason for the license~ being issued for two years instead of one year to which City Attorney Lyons remarked that it is not a revenue raising measure, but a protection for youngsters who own bikes and to charge more would possibly work a hardship on the youngster in paying for his license. Councilman Smith re. marked on the section with regard to the effect that bikes could not be ridden on the sidewalks He cited small youngsters~such as his own who would be placed in a hazard should they be made tI conform to this rule. City Attorney Lyons stated that the ordinance was drawn up in conformity with other cities but that he would be willing to follow any s~lution as suggested by the counc~ Councilman Smith suggested that possibly it could be regulate~i by the size of the bike. City Attorney Lyons suggested possibly the size of the bike and the age of the rider. Mrs. Hernan suggested ignoring the part with regard to riding on sidewal~. At this point, City Attorney Lyons changed Section 7 to restrict the riding of bicycles on sidewalks in the business distric~ Councilman Sani moved seconded by Councilman Noonan, that the reading be waived and introduced by title'only. Councilman Smfth re~rked on the cost involved and if the revenue collected would pay for the bookkeeping, licenses, etc. City Manager McClung explained how he and Captai: Terragno of the Police Department had gone into this and ascertained the cost of tags and other supplies needed. CODE: City Attorney Lyons then introduced the second reading of the ordinance with regard to the Unif¢ Building Code, explaining the ordinance and reading it in its entirety. City Attorney Lyons stated tbs a roll call vote should also be taken on the urgency clause that was a part of the ordinance. TRIBUTE TO OFFICER ARTHUR MOYLE: Mayor Cortesi next called for a moment of silence in respect to Police Officer Arthur Moyle. Councilman Sani moved that the City Attorney be instructed to prepare a resolution for Officer Moyle, that a copy be sent to the family and that it be spread on the minutes of the council meeting. Motion as made wms seconded by Councilman Bracco and regularly carried. Councilman Noonan then remarked on the waiting period necessary before an employee can be eligib for benefits and moved that a study be made to see if there was not something in the State to change the law to benefit all men killed in line of duty. Motion w~s seconded by Councilman San and regularly carried. SMITH LEAVE STATE: Councilman Smith requested permission to leave the State for thirty days. It was moved by Coun- cilman Bracco, seconded by Councilman Sani and regularly carried, that permission be granted to Councilman Smith to leave the state. WOREB ENGINEER C ONTRAC TS: AD JOURA94El~: APPROVED: Councilman Smith then requested that the City Attorney ~ the contracts of the Works Engineer and advise as to their scope ar~ status. He further .t~t~(1 that a considerable amount of money was to be spent on lines to the Sewage Disposal Plant from the industrial area and a considerabl amount of money would be spent for Engineer's fees. He felt this money could be used in conduct ing l~e department of public works, who C0~'handle this venture. He stated that he was bringi this to their attention for consideration. City Attorney Lyons wished to know if the matter should be held over until Councilman Smith's return. Councilman Smith stated the council could go ahead and act in his absence. City Attorney Lyons agreed to have a report prepared for the next meeting and the council could act on it at that time. There being no further business, the meeting was adjourned at 11:40 p. m.
