TO OEDER: ROLL CALL: The meeting was called to order at 7:52 P. m. by Mayor Cortesi. Present: Councilmen John Noonan, Joseph Bracco, _Rmflio CorteSi Absent: Councilman Adolph Sani, Telford Smith AGBRW~fENTWITHCOUNTY Ccm~mnicationw~s received from the office of the City Man~ger regarding the agreement to be RE: COURTROC~4 FACILITIES:executed betwsen the City and the County for rental of court room facilities used by the new · -oE7 Municipal Court. Councilman Bracco asked City Manager McClung if this was the exact footage to which he replied that it was. He further remarked that the County pays about 75~ for the use, as it is used moetlyby the County With the City's use limited to evening meetings. He stated he recommended signing this agreement. Councilman Bracco asked as to who signed this agreement to which City Manager McClung replied that he did. Councilman Bracco moved, seconded by Councilman Noonan and regularly carried that the City Manager be instructed to sign the a~nt and forward it to the County Manager. PJ~40VAL OF SAND COLMA CREEK: C~ication was received from'the office of the City Manager regarding the removal of sand from Colma Creek by the Associated Pipe Line Company and the M & K Corp. at no cost to the City. Councilman Bracco asked why Mr. Schweining was to supervise. City Manager McClung stated that the sand was needed for backfill by the Pipe Line Co. and that Mr. Cortesi had been contacted regarding this matter. This was to be done at no cost to the City but that the project sho~ receive council a~roval. The work, he stated, has already been started. At th~ point, City Manager McClung stated how the sand would be dug out explaining the stages of pro- grese. Councilman Noonma uke~ what good would be done to the City. Mayor Cortesi stated it would sa~e us expense in doing it ourselves. Councilman Noonau questioned why the whole thing sho~ n~t ~e de~e. City Manager McClung stated that a th~ Job ~s to be done with the al~roval of ~.-Sehm~ining. Councilman Noonan stated he wanted a thorough Job done. Councilma~ Brme~ m~v~, .eee~e4 by Councilman Noonan and regularly carried, that approval be granted for the re~ of. the sand. ~sozim~zo~ No. 19o3 WITH HOUSING AUTHORITY: The matter of the agreement between the City and the Housing Authority for sewer rental charges next ca~e up. Conrad Reisch, associated with City Attorney Lyons, representing the City Attor- ney, stated that he h__-~__ a resolution prepared for this agreement. City Manager McClung explain- ed the resolution that the charges would be paid by a check at the end of each month without benefit of separate billi~ each month. He further remarked on the recent discussion held with Mr. Riccomi and the Housing Authority in San Francisco. Councilman Bracco stated he noticed the term "ifthe money collected," to which City Manager McClung explained Mr. Riccomi's deter- mination of collecting this sewer rental. Councilman Noonan introduced a resolution of the city council of the City of South San Francisco authorizing the execution of an agreement betwee said city and the Housing Authority of the City of South San Francisco with respect to sewer rental charges. Roll call vote was as follows: Ayes, Councilmen Noonan, Bracco, and Cortesi; Noes, None; Absent, Councilman Sani and Smith. RESOLUTION NO. 190~ GRAND AVE. R~CON- STHUCTION: The matter of a resolution on Assembly Bill ~3497 was explained by City Manager McClung as follows: He stated that the improvement was done with Gas Tax funds but paid out ofMaintenance money. He further went on to explain the Assembly Bill as prepared by Assemblymen Dolwig and Creedon. He further rem&rked that the resolution should be sent to the Governor urging passage of the bill. Councilman Noonan introduced the resolution of the City Council of the City of South San Francisco requesting the State of California to permit said city to pay for recon- struction ef Grand Avenue (from Bayshore Blvd. to Spruce Avenue) out of State Gasoline Tax Refu~ Money allocated to new construction and reconstruction. Roll call vote was as follows: -Ayes, Councilmen Noouan, Bracco and Cortesi; Noes, none; Absent, Councilman Sani and Smith. RESOLUTION NO. 1905 BURI BUR1 P LA~ DEED: The next item to be taken up was the matter of the annexation of uninhabited territory to the Buri Buri subdivision by Barrett and Hilp. Councilman Noonan-stated his understanding was to the effect that the City Attorney advised that proceedings can be started. If the details could not be arrived at, then the city could stop proceedings at any time. He further requested ?hat the Buri Buri interests be furnished with a copy of the letter from the City Manager dated April 17, 1953 re~ing the cost of the items as mentioned. He further stated that he had an extra copy and if it was in order would forward it to the City Clerk to forward on to Mr. Barrett. Mayor Cortesi then asked-if the deed to the playground had been prepareA to which Mr. Feldman reported that he had the deed. Conrad Reisch stated that he had a resolution prepared for acceptance of the deed. Mayor Cortesi requested that the deed be read. Conrad Reisch read the deed with the exception of the description which was in meets and bounds. Councilman Braccc introduced a resolution of the City Council of the City of South San Francisco providing for the acceptance of a Quit Claim Deed.fromBuri Buri Homes Inc. to a certain four acre tract for the purposes of a playground. Roll call vote was as ~follows: Ayes, Councilmen Noonan, Bracco, and Cortesi; Noes, none$ Absent, Councilmen Sani and Smith. RESOLUTION NO. 1906 ANNEXATION OF BURI BURI NO. 3: City Manager McClung then explained the conference he had with City Attorney Lyons at 5 P- m. in the aft~n. If the deed were accepted for the playground, legal steps could be taken for publication. Public bearings could be heard and the procedure could be dropped at any time if no agreement w~s reached between the City and Barrett ar~ Hilp. City Manager McClung then state that the only thing done tonight would be to start the procedure. Counci~man Noonan asked if the City would be protected should it pass tonight. Conrad Reisch then explained the dates as set for public hearings. It was then decided that the date for hearing to be set for July 23, 1953 at 7:30 p. m. Councilman Bracco introduced a resolution of the City Council of the City of South San Francisco giving notice of the proposed annexation of certain contiguous uninhabite territory to said City of South San Francisco, said territory to be known as Buri Buri No. 3. Roll call vote was as follows: Ayes, Councilman Noonan, Bracco and Cortesi; Noes, none; Absent, Councilman Sani and Smith. RESOLUTION NO. 1907 ISSUANCE OF BONDS SHAW ROAD: Councilman Noouan introduced a resolution vacating resolution ~1902 and to amend resolution ~188 providing for the issuance of Improvement Bonds. Roll call vote was as follows: Ayes, Council- men Noouau, Bracco and Cortesi; Noes, none; Absent, Councilman Sani and Smith. RESOLUTION NO. 1908 NAMING STREETS: ORDINANCE AMENDING CIVIL SERVICE ORDINANCE: ~'o BUR1 BUR1 PLAYGROUND: APPROVED: Mayor Counci~uNoonau introduced a resolution of the City Council of the City of South San Francism changing the names of certain public streets in said City. Roll call vote was as follows: Ay~ Councilmen Noonan, Bracco and Cortesi; Noes, none; Absent, Councilmen Saui and Smith. Conrad Reisch then brought up the ordinance with respect to an amendment to the Personnel Syste: whereby the Superintendent of the Sewage Treatment Plant would be given permanent status and only the personnel under him would be placed on one years' probation. Mayor Cortesi requested that it be laid over to the next regular meeting. C~aunication received frcm the Jr. Chamber of C¢~erce extending au invitation to hear an address by Dr. Anthony Buscareu, Professor of Political Science at the University of San Franci~ was ordered filed. Under the Good and Welfare, Mr. Bucher stated that speaking as one man of many men's organiza- tions of Buri Buri, he was appreciative of the deed given the City tonight for the Buri Buri playground. He stated that he wished to have the council's reaction as to what was going to be done with the playground in Buri Buri now that the land was made available. He feared that upo~ the recording of the deed that it would rest with the council. Councilman Noonan r~m~arked that plans had been made for the development but that the property was not available. Councilman Bracco stated that development should go ahead with the appro- priate funds, further stating that the one thing needed was a baseball diamond so that the you~ sters would not have to cross the highway to play ball. Mayor Cortesi stated that the answer desired now was what'money could the city spend and not what are we going to do. Mr. Bucher stated that the area was not too much to develop and stated that all of it should be developed. He further remarked that full favor is given the plan for the removal of the traffic lights and the development of the shopping area. City Manager McClung gave an explanation on the process to follow in B~dget Sessions in allocating funds for the development of the area. Mr. Feldmau asked City Manager McClung if anything should be done by Barrett and Hilp to expedi~ the matter ofthe shopping area to which he was answered that the council would expedite it to the Planning C~mnission. Mr. Barrett then remarked that the giving of the deed to the playground area should have been a~public function, stating that au article appeared in the San Mateo Times to the effect that Barrett smd Hilp had brokeu faith with the City. He further remarked that Barrett and Hilp hag never broken faith and offered equipment for the leveling off of the playground area at uo cost to the city. He then stated that possibly there was still time for a ceremony at the dedtcatior of the playground. City Manager McClung stated that the San Mateo Times story was one of fab- rication and not direct quotations. Councilman Bracco stated that at the time the naming of the playground is considered, thought be given to it being named Barrett Playground for the generosity expressed this evening by Mr. Barrett.
