CALL TO 0RD~: Meeting called to order by Mayor Smith at 8:11 P. N, ROLL CALL: Present: Councilmen Francis Lucchio, Fmilio Cortesi and Telford Smith Absent: Councilmen George Bosworth and John RESOLUTION NO. 2036 AGRE~tENT FOR IN- STALLING S~ LINE ALONG SOUTHerN PACIFIC RAILROAD RIGHT OF WAY: Mayor Smith explained the first item of business which was the contract with the Southern Pacific Company to extend a sewer line along or inside the railroad right of way. This was in connection with the Industrial Sewer and Assessment District. City Attorney Lyons explaine~ the resolution prepared and after brief discussion Councilman Lucchio introduced a resolution of the City Council of the City of Sou~h San Francisco authorizing the execution of an agreement between said City and the Southern Pacific Company providing for the granting to said City of a license for the installing and maintaining of an eight 1rich sewer line across amd through certain property of said company lying within the Imdustrial Assessment area in ~ aid City. Roll call vote was as follows: Ayes Councilmen Francis Lucchio, Emilio Cortesi, Telford Smith. Absent: Councilme~ John Neonan, George Bosworth. Noes: None RESOLUTION REGARDING MR. RANDLETTS REVISED CONTRACT: Mayor S~Lth then asked City Attorney Lyons to go on to the next item. City Attorney explained that it was regarding the contract of Mr. Randlett. It was suggested that this item be held up at t~is time. Councilmen Bosworth amd Noonan appeared present at thistime and remained for the duration of the meeting. RESOLUTION NO. 2037 APPLICATION FOR ALLOT- M~NT UND~ CHAPT~ 20, STATUTES OF 19&6: City Atworney Lyons then explained the next resolution which appeared as item #2 under resolutions on the regular agenda of Amgust 2, 195~, After an explanation by City Manager McClung, Councilman Lucchio introduced a Resolution of the City Council of the City of South San Francisco providing for the making of an application for an allotment under Chapter 20, Statute~ of 19~6, and designating its City Manager ~s its authorized agent. Roll call vote was as follows: Ayes Councilme~ John Noonan, Franc~s Lucchio, Emilio Cortesi, George Bosworth and Telford Smith. RESOLUTION NO. 2038 CR~SING GATES AT SOUTH LINDEN AVE. GRADE CRCSSI~G: /12 City Attorney Lyons next explained the resolution prepared regarding the South Linden Avenue Grade crossing, After brief explanation Council~n Cortesi introduced a resolution of the City Cour_cil of the City of South San Franciae~ authorizing the making of a request to the Public' Utilities Commission of the State of California for an allocation to said City from the crossing protection fund in connection with the installation of grade crossing gates at South Lit. den Avenue in said City. Roll call vote w.~s as follows: Ayes Councilmen John Noonan, Francis Lucchio, Emilio Cortesi, George Bosworth and Telford Smith, RESOLUTION NO. 2039 AG~ BETWEEN MAC CORP, BARRETT & H ILP CORP AND CITY (SERRA HIGHLAND SUB) City Attorney Lyons then explained the next resolut-on which had to do with the exeuction of an agreement between the City, Barrett & Hilp corporation and Ma'c Corporation. After discussion Councilman ~k~worth introduced the Resohtion and after further discmsion at which time City Attorney Lyons stated he would make a correction and show the sum of $~000.00 for the lot value, Councilman Boaworth stated he would introduce the resolution with the correction. Title of the Resolution was "A Resolution of the Ciay Council of the City of South San Francisco providing for the execution of an agreemmat amoung said City, Barrett and Hilp, and Mac Corporation." Roll call votems as follows: Aye.~ Councilman John Noonan, Francis Lucchio, George ~osworth and Telford Smith. Noes: Council~n Cortesi. RESOLUTION NO. 20;+0 REVISED CONTRACT WI~H CH ARLFS RANDLETT: There being'no further resolutions at thistime, Mayor Smith asked Councilman Noonan and Boswortk if they wished to go through the contract with Mr. Randlett. After lengthy discussion had take~ place Councilman Lucchio introduced a Resolution of the City Council of the City of South ~z Francisco providing for the execution of a revised er new contract with Charles Ee Randlett with respect to engineering services to b~ rendered for the Industrial Sewers and pumping stations assessment district, with the Marc~. 6, 1550 contract to be. cancelled, Roll call vote was as follows: AyeS: Councilmen Franci~ Lucchio, Emilio Cortesi and Telford Smith. Noes: Councilmen John Noonan and George Bosworth, After brief discussion followed City Attorney Lyons mentioned relative to re-~riting the last page to the effect that upon execution of this agreement the other agreememt is terminated. Mayor Smith stated that if there were no ebJecti~rj the last paragraph would be re-written. PROTEST HEARING FOR PROPOSED ZONING ORD: Mayor Smith then took up the matter of the protest hearing on the Proposed Zoning Ordinance asking if any protee~s were entered. No written or oral protests were received after which Mayor SmAth asked if there was a motion to close the hearing. Councilman Noonan so moved, seconde~ by Councilman Lucchio and regularly carriec. Councilma: Noonan then moved, seconded by Councilman, Cortesi and regularly carried that the ordinance be introduced by title, after which City Attorney read the title of the Zoning Ordinan~ee A brief recess was then declared hy Mayor Smith. The meett, ug upon being called to order again, Councilman Bosw°rth r~_rked on a matter concernin a C-1 di~;rict after which Mayor Smith stated that Ln order t8 hold the matter over it would be neceSSary to make a motion rescinding previous council motion closing the hearing and continuil~g the public hearing until the next meeting. Councilman Noonan so moved, seconded by Councilm$_. ~ Lucchio and regular~w c~r-~ ,~. Mayor Smith then remarked that it would be necessary to follow through with the rescinding of the motion closing the hearing. Councilman Noonan so moved, seconded by Councilman Bosworth and reguZ~rly carried. Councilm~n Lucchio then moved, seconded by Councilman Noonan that the hearing be held next Monday night. At this time Mr. A. Gaudio requested to be heard on the matter. After discussion had taken place regarding various sections of the Zoning OrdinanCe relative to addition~ and re writing, Councilman Bos~orth moved, seconded by Councilman Noonan that the hearing be closed, Councilman Bosworth then moved, seconded by Councilman Noonan and regularly carried to res&nd the motion which set the public hearing for next Monday. CLAIM OF ASSOCIATED CONSTRUCTION AND ~G. CO, FOR INDUSTRIAL SEW~ PUMPING PLANT: DONATI'S USE P~M~T RESOLUTION: CLAIM OF ASSOCIATED CONSTRUCTION AND ENG. CO. FOR INDUSTRIAL S ~ PUMPING PLANT: ADJOURNMENT: Mayor Smith then again asked if there were any written or oral protests, None were registered. After brief explmnation by City Attorney Zyona regarding acting on the suggestion of Councilman Bosworth relative to the incorporation into the Ordinance, Counci]w~n Bosworth moved as foll~s: "I move that the proposed Zoning Ordinance for 195~ be re~_sed as marked on the E~hibit a~ identified as filed with the City Clerk Jmne 28, 195~, 8:13 P.M. as the official master zoning ordinance and signed by Arthur Rodondi which has changes as shown on pages l, 6 and 15. Motion was seconded by Councilman Noonan and regularly ~arried. Councilman Bosworth then moved, seconded by Councilman Noonan and. regularly carried that the hearing be closed. Councilman 3osworth then moved, seconded by Councilm~r~ Noonan and regmlarly carried that the ordine.uce be read by title only. City Attorney Lyons read the title of the Zoning Ordinance after which Councilman Cortesi m~ved, seconded by Councilman Bcsworth and regularly carried that the hearing be continued until next Monday night. Mr. John Chapman of Associated Construction and Engineering C~mpany then requested permission ~o speak on the invoice they had presented for payment to the city for work they had done on the Industrial Sewer Pumping Station. After discussion Mayor Smith suggested ohat these bills be set up for next Monday r. ight. Councilman Noonan then asked if there was any way that the matter of Nrc Donati's use permit couP! be facilitated. After discussion C~nc~lm~ Noonan moved that the building permit be ~ranted to the applicant Reno Donati in accordance with the plans submitted to the Building Inspector, said plans to be approved by the B~ilding Inspector with the proviso tha~ a Use Permit be held in abeyance and determined later in accordance with prior court:il action. Councilman Bosworth seconded ~ e motion after which City Attorney Lyema stated that it should be noted in there that the requirements for parking have been met. Counc~l~n Bosworth remarked that this could be made a preamble to the motion to which C~uncilman Noonan stated he would accept that as a preamble to the motion. Councilman B~sworth said his second would stand. Motion as made and seconded was regularly carried, Councilman 3oswerth then moved that the City Clerk send a letter to the attention of Mr. Schaeffer of the Civic Committee of Bari Buri advising them of the action of Council tonight, p~_-ticularly reassuring them they have in no way suffered any loss of their rights to ~ve a hearing on the granting of the Use Permit. Councilman Noonan asked if there could be added to the motion that the matter still is pending before the planning Commission mn the Use Permit. Counci]m~n Boeworth agreed and stated that it should be spelled ou; that they have not suffered any loss and would be notified of the hearing. Comucilman Noonan seconded the motion which was regularly carried. Nr, Aoheso~ then spoke on the claim again for the Pumping Plant work on the Industrial Sewers. Afner brief discussion Councilman Noonan moved that it be paid upon the foll~ring approval, the approval of Mr. Wilsey, Mr. Goss and Mr. R~udlett. Councilman Bosworth seconded tbs motion. After brief discussion relative to its being paid out of the general fund and ~eral fund repaid from the assessment, Councilman Bosworth remarked thet Councilman Noonan in his motion could state that it would be paid out of the general fund to be repaid by the assessment district. Councilman ~-oonan said he would accept that, Upon the a~proval of Mr. Wilsey, Mr. Randlett and Mr. Goss. Motion as made and seconded was regula?ly carried~ Councilman Bosworth then moved that the general fund be repaid out of the first available funds from ~he assessment district. Councilman Nooman seconded the motion. Councilman Bosworth stain restated his motion that the general fund be reimbursed for any payment to the con~ractors from the first moneys obtained from the assessment district. Councilman Noonmn seconded the motion which was regularly carrie~e Councilman Noonan then moved, seconded by Councilman Besworth and regularly carried that the meeting be adjourned until next T~esday night at 8:00 P.M.
