Pledge of Allegience was taken. Due to the absence of Father Robert S. Morse of St. Elizabeth's Episcopal Church, no Invocation was tgl~en. Present: Councilmen Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Gamlen, Telford Smith. Absent: None Mayor Smith asked if there were any additions or corrections to the minutes of the previous ~etings. Councilman Lucchio remarked regarding the minutes of October 4, page l, disposition of items ou the pending agenda, item 3, stating that ~e voted uo and did~ not~e a~y ~tmtame~t C~uce~ning hi~avote. He further remarked that he would li~e the minutes to be amended to show the statement tha~ he voted no, based on the fact t~at he was in accord with the rec~ndatioms c~ the Director of Public Works and the City Manager iu eliminating the position now held by Dave Corsiglia. Mayor Smith said that it seemed to him that there was a Question of ~hether or not the minutes could be amended iu such a manner, stating that, maybe the City Attorney would correct him; but that he did not believe the statement c~ CounciLman Lucchio should be included in the minutes of that meeting, that is make a statement explaining a prior vote. Acting City Attorney Reisch said that he was not present at that meeting so could not answer the question at this time. Councilman Lucch~_o stated he simply said no and in order to clarify it, he wanted to refer back to tho~e minutes and explain why, so it would be there for the record. Councilman Lucchio then remarked relative to Page 3 concerning the m~tter of the Hlckey Boulevard Pedestrian overpass, reading the second paragraph which was as follows: "A brief discussion was held in which Mr Whitehead of 207 Clifden Drive remarked that at a council meeting some time ago it had been suggested that $15,000 be set aside from Gas Tax Funds for use in this project. After Further discussion regarding the matter and that such funds could not be used for such purposes, motion as made and seconded was regularly carried, Mayor Smith, then, instructed the City Manager to check the record to see if the City Council had gone on record to contribute to this overpass. Coucilman Lucchio then moved, seconded by Councilman Gamleu a~d regularly carried, that the policy regardir~ the financing of this overpass be referred the next study meeting." He further remarked that his question was whether or not it waz binding that such a fund could not be used for such a purpose and that he would like to have the City Attorney present, if he could, state for the record if such was the case or if Preferrable hold it over and bring baqk a statement iu support of the minutes as reflected. Mayor Smith stated that the council was, at this t~me, considering the approval of the minutes, whether they were correct or should be corrected, remarking that, this was a question that should come up ou the agenda or after the al~proval of the minutes. After discussion, Councilman Rocca moved the minutes be approved as written up by the clerk. No second to the motion being recorded, Mayor Smith seconded the motion as made by Councilman Rocca. Mayor Smith then remarked that there was still some question as to the correctness of the minutes, and after discussion, asked if the council would be satisfied to amend or correct the minutes to confcrm exactly with the transcript on page 10, asking if there was a motion that the minutes be corrected to conform to the transcript which the court Reporter has taken and transcribed. Councilman Lucchio so moved, seconded by Councilman Gamlen that the minutes be corrected to reflect the transcript as shown on page 10. Motion as mazte and seconded was regularly carried. Mayor Smith then asked if Councilman Lmcchio wished to get the answers to his questions this time or wait until later. Councilman Lucchio requested a written report from the- * cffice of the City Manager regarding the legality of Prior council action as to whether or not the sum of $15,000 set aside by a unanimous vote of a previous council can be used to constr~ct an overpass or underpass out of traffic safety funds and motor vehicle tax refunds. Mayor Smith stated that if there were no objections the request of Councilman Lucchio would be complied with by the City Attorney and the City Manager. Councilman Lucchio, remarking on the same question, stated he woul~ l~ke an opinion from the City Attorney whether or not, if such is the case, it required council action to rescind previous council action authorizing the allotment of that money. Acting City Attorney Reisch answered yes. Mayor Smith asked if there were any corrections or omissions to the minutes of the adjourned meeting of October ll, asking if there wa~ a motion the minutes be approved. Councilm~n Cortesi moved, seconded by Councilman Lucchio and regularly carried that the minutes be approved. Mayor Smith, then, took up the matter of cla4m- asking if there was a motion for approval. Councilm-~n Cortesi moved, seconded by Councilman Rocca and regularly carried that the claims, as submitted, be approved. City Manager McCluug reported that tht~ was iu the nature of a report showing that the city w~s setting up au examination for au Assistant Librarian provided for iu the 1954-1955 Budget. Mayor Smith remarked that if there were uo objections, the memorandum would be filed. No o~Jections w~re voiced. Reports were received from the City Clerk, Fire Department, Library~ Building Inspector, and Police Department. Councilman Rocca moved, seconded by Councilman Gamlen a~d regularly carried that they be accepted-and ordered filed. Communication was received from the Joint Cities and County Civil Defense Planning Board regarding a meeting held. Mayor Smith stated that if there were uo o~jections the report would be filed. No objections were registered. Communication was received from the Public Utilitiez~ Commission regarding Southern Pacific Application No. 35739 and case No. 5234. Mayor Smith remarked that before the public hearing would be held there would be a meeting of the North County Councils which wculd be on November 18. He then asked if there was a motion that we bring this matter before the North County Cities. Councilman Rocca moved, seconded by Councilman Cortesi and regularly carried that this matter come up for attention before the Board on November 18. Report ~s received from the Building Inspector regarding the Eschelbach Corporation Yard. Councilman Lucchio moved the report of the Building Inspector be referred to the 0ity Attorney to further aid him in his persmal of this problem to abate the nuisance established by the building not conforming to the building standards iu that area and that the City Attorney be instructed to carry out the previous council's wishes iu this matter. Councilman Gamleu seconded the motion which was regularly carried. Communication was receive~ from the office of the Chief of Police regarding the pro- bationary appointments of James Charles Keane and ALfred J. Stewart, Jr. as police officer. Mayor Smith asked if there was a motion that they be filed. Councilman Rocca so moved, seconded by Councilman Gamlen and regularly carried. Communication was received from. the San M~teo County Department of Public Health and Welfare regarding their monthly report, comments on and copies of Sanitation Guide for Fairs, Circuses and Carnivals. After a brief discussion was held regarding the dispensing of food stuffs at Carnivals, Fairs and Circuses, City Manager McClung remarked that since the Health Inspection Service in San Mateo County is provided by the county for all the cities; he believed it would be proper to hold this and attempt to get a uniform ordinance in all the citie~ in the county so the County Health Officials would have one set of rules to work with. Mayor Smith said that if there were no objections the matter would be brought before the North County Council's meeting. He, then, asked if there was a motion that the report be filed. Councilman Lucchio so moved, seconded by Councilman Rocca and regularly carried. Mayor Smith then took up the matter of the second reading of the 0rdinanc. establishing a 35 mile per hour zone on 01d Airport Boulevard. Acting City Attorney Reisch stated it would be in order to have a motion that the Ordinance be introduced by title only. Councilman Lucchio so moved, seconded by Councilman ~o~t~si and regularly carried. Mayor Smith then instructed Acting City Attorney Reisch to read the title only. The second reading of the Ordinance received a unanimous vote from the council. None C~mnunication was received from the A,1] Souls Fathers Club requesting help in securi~ the use of the 01d High School Gym. At the request of Mayor Smith~ the City Clerk read the co~unicatiou. COuncilman Lucchio explained that he had discussed the matter over the phone earlier with one of the members and inforned him that there would be a meeting between the Recreation C~ssiou and the School Board tomorrow night iu an attempt to resolve this problem. He also remarked that in the discussion at the study meeting the council felt it was definitely the School Boards responsibility and that it would be im- possiblefor the council to act and make a decision one way or the other. 0ounc&~.w~.n__ ...... . Rocca suggested a letter be sent by the City Clerk and City Manager explainiu~W~llinguess to help as much as the law will allow. It was explained that the reply had already been sent to the Fathers 01nb by the City Manager. After more discussion, Mayor Smith ex- plained t~at securlug the use of the Gym came under the scope of the School Board which was an elective body and that they had the entire say in the matter. Councilman Lucchio then moved as follows: "At this time, I move that this matter be referred to the School City Coordinating Committee to be resolved prelimiu, rLly . Perhaps, the only ans~mr is a co[?~act between the school district and the ~ · c_ty, and, I ask that at the next mm,,M~f this motion passes, 2 members of the recreation co~issiou be in attendance to help in this matter." Councilman Gamleu seconded the motion; after which Councilman Lucchio remarked that this was regardless of tomorrow nights outcome. Motion as made and seconded was regularly carried. PETITION AhD LETTER OF Communication was received from A!.L. Reisser, 781 Circle Court accompanied by a PROTEST FROM RESIDENTS petition signed by 36 residents of the area, protesting the flying of model airplanes OF CIRCLE COURT ON MODEL at the Cringe Avenue Memorial Park. City Manager McCluug remarked that it should be AIEPLA~ FLYLNG AT referred to the Recreation Commission and they could report back on their findings. Mayor ORANGE MEMORIAL PkRK Smith stated that if there were no objections, this procedure suggested by City Manager McClung ~-//~ would be carried out. Concilman Cortesi moved, seconded by Councilman Rocca and regularly carried that request as submitted be graU-~d. Communication was received from the Planning Commission concerning the Plan Lines for the extension of San Bruno Road. After an explanation by Direstor of Public Works, Goss, Councilman Lucchio moved, seconded by Counci__~man Rocca and regularly carried that it be approved and the Director of Public Works draw the Plan Lines. C~mmunication was received from the office of the City Manager regarding the auditor's examination. This was accompanied by a letter from the office of Mr. Charles Ledwith and the report itself. Councilman Lucchio moved that this report be referred to a study see~ion. Councilman Cortesi seconded the motion which was regularly carried. Communication was received from the office of the City Manager regarding a Garbage and Refu~e ~urvey as made by the County-Board of Supervisors. Acccmpaniug the communication of the City Manager, was the letter from the County Board of SuDervisors. City Manager McClungremarked that there would be a meeting ou Nove~mber 4 at!the Court House iu Redwood City, to discuss a control burning ordinance iu San Mateo County and that they wanted the cooperation of the various cities of the county. He further remarked that someone from the council should attend. After some discussion, Councilman Cortesi consented to go at the request of Mayor Smith. Communic&tion was received from the Junior 0ham~er of Commerce regarding Nuisance Abatement proceedings. City Manager McClung remarked ~hat this was a request by the Junior Chamber of Commerce supporting previously indicated comucil action and that if it was the council's desire to proceed iu this matter, the City Attoruey could be directed to prepare zuch an ordinance. Mayor Smith asked if there was a motion that the 0ity Attorney be instructed to prepare au ordinance and submit-it to the council for s~udy. Councilw~u Gamleu so moved, seconded by Councilman Rocca and regularly carried. CGmaunicatiou was received from the South San Francisco Municipal Employees Association regarding individual employee complaints. After some discussion had taken place regarding the matter, Councilman Rocca moved, seconded by Councilman Cortesi and regularly carried that this item be held over for study. Councilman Gamlen voted No. Cow~unications were received fromM rs. Dorothy Hyndlng and Mrs. Ethel Hernan tendering their resignations as Recreation Commissioners. CounciSlm~n Lucchio moved, seconded by Councilman Rocca and re~alarly carried that the resignations be accepted; regretfully, and that they be sent a communication in the usual nanuer for their meritorious services to the City. City Manager Mc Clung stated he had received a letter from Mrs. Hopper of Brentwood concerning an article she noted in the San Francisco papers about dogs. He further stated ~e answered Mrs. Hopper's letter quoting the section of our ordinance governing this matter; also remarking that it would be in order to accept the communication and ackuowle~lge action taken. Mayor Smith remarked that if there were no objections the action of the City Mauager would be approved. No objections were voiced. Mayor Smithnext explained the items that should appear under the topic of Good and Welfare. Matters that should be presented to the Council on the regular agenda should not be brought up under Good and Welfare. Mayor Smith then asked if any one from the audience or Councilmen had anything under Good and %%lfare. None were registered. Request w%s received fr~n Councilman Rocca to take a short vacation out of the State. Councilman Lmcchio moved, seconded by Councilman Ge~u and regularly carried that Councilman Rocca be granted permission to leave the State~ as requested.
