of P~lic W~rk~ and that the request to mae City prope~y for Right of Way be demied.
Councilman Rocca seconded the motion, after w~ich, under the question, Councilman Lacchio
e~laime~ ~ reason for the m~tio~ was that it would ~e quite hazardous to our invest-

~-~ ~ ~ e~mination 1!or Fire Captain. Councilman Lmcchio moved as follows: "I move that this be
filed with o~e inclusion, with o~r understanding that one member of t~Department who is
not eligible to take the test; because of the ten~re period of two years. I believe it is
advi~le t~at this be waived in his case, and that he may take the e~natiom with the
~uderstandiz~ that he is not eligible for the ~ob but a~ a means of t~ng the pers~mnel
of the del~a~nt and give the Chief a Chance to o~erve the aptitude and knowledge of this

for a Joint ~metingwith the City Comncil. Mayor Smith remarked that this was sched~
for the following evening at 8:00 P. M. and understood -~t the Planniug Ccm~ission had
been notifie&. City ManagerMc Clmng reported that they had been notified.

Mayor Smith asked if there were any public hearings; to which, City Attorney Lyons reported

Mayor Smith,went on to the next item whichwas the ~atter of ordinances, taking up
first a c~ication from the EealthDepartment requesting the adoption of certain
sanitation requirements. Councilman Rocca moved, seconced by Councilman Gamlen and regularly
carried that it be placed on the PendingAgendato come before the Council at the proper time.

ORDINANCE:
The Health E~p~rtment, also, requested an ordinance relating to the use of Public and
Private sew~ and d~aius. Mayor ~aithemked if there was a motion to place this on the
PendingA~ea~a. Councilman Rocca moved, seconded by Councilman Gamleu and regularly
carried that this matter be ~. on the Pending Agenda and the City Mam~N~er be instructed
to contact other cities relative to the prevailing rates.
Councilman L~cchio then moved that the City Manager be, also instructed to keep in close
contact with the City of San Bruno and see that this ma~ter is presented to their

The third item under Ordinances related to the matter of Subdivision Ordinance revision.
Mayor Smith a~ked that, inasmuch as there were 1~ or four points for the Council to
determine, if there was a motion to hold this over for _~r study. Councilman Cortesi
so moved; after which,'May°r Smith-remarked that there wo~ld be a, $~tnt ~t~ ou January
24th. Councilman Rocca seconded the motion which' w~s r~gmlarly carried.
Mayor Smith a~ed City Attorney Lyons if he ha~ any ordinances for this evening; to which,
he replied ~ had none,-but that he did have some resolutiOn~.
The first roi olution brought to ~ attention of the City Council by the City Attorney
· concerned the acceptance of a deed free t~e South San Francisco ~mtfied School District
for a p~rtie~_ of G~anada Drive. After a brief expla~t-on by the City Attorney, Councilman
Gamlen intre&~ced "A resol~n of the City Oo~ncil of ~he City of South San Francisco
accepting a &eed to certain property dedicated to said City ~y the South San Francisco
Unified School District."~ Roll call vote was as folio?s: Ayes: Oo~ncilmen Andrew Rocca,
Francis Lmcchio, Emilio Certesi, Richard Gamlen and T~l_~ord Smith.
City Attorney Lyons then explained that he had two other deeds, one from the Stoneson
Development Corporation and the other from the Stonecre~t 0oration s+~ting that they
had to do with a portion of Camaritas Aven~e, which has been aaed by the public. Mayor
Smith asked if the City Manager and Director of Public Works had anything to say to this;
to which, they replied that they recommended its a~ceptance. Mayor Smith remarked

City Atto~ Lyons next ex~ined the Rmsolutio~ concerning the request to the legislature
to provide ~e of Tideland Oil monies for schools, roa~., etc, .After reading the resolution
in its entirety, Councilman Oortemi introduced "A resolution of the City Cc~e~ ~f the
City of South San Francisco ~rgi~g that appropriate legislation be enacted l~y the legis-
lature of~e State of California so as to ~ermit the u ,e of Tideland Oil funds for
school~, streets and hig~ys, .storm drain facilities, and ot._~_r ~lic l~s."
Roll call vote was as follows: Ayes: Councilmen Andes--Rocca, Francis Lucchio, Emilio
Cortesi, Ric~ar~ Gamlen and Telford Smith.
The first matter under new bnsiness was Variance and Ad~ ustment Resol~icm ~39 a~ applied
for by Joseph ~oode. Counci~w~u Gamlen moved, seconded by Councilman Cortesi and re~arly
carried that the rec~ndation of the Planning C~sslon be accepted.
The next variance and adjustment was Resolmtion ~ aa applied for by the Arco B~ilding Cb.
After brief discussion, ~tlman Rocca move~, secoude~ ~y 0o~ncilman 0orteei and
regularly carried that the rec~ndation of the Planning C~m-~ssion be accepted.
The matter cf S~per Market re,meats before the Planning O~m~zission was the next item under
new business. After brief discussion on the matter of the market sites, pro~lems involved
and the feces mendation;~ of the Planning 0c~aisalon~ Co~ilman Lacchio moved that both
parcels of ~ be zoned ~nder a "~' cla~sifi~tion. City Attorney Lyons s~gested that
the motion ~lude that a hearing be set ap; amd that the City A,~orney draw the pertinent
Ordinance and Notice of Hearing. Councilman Lmcehio re~arke~ t~at he wo~ld include the
c~nt of ~ City Attorney in his motion. Councilman Rocca secom~d the motion as made.
After discussion by the members of. the Comscil, Counci~n Cortesi remarked he would
abstain from voting, due to the fact that his relatives were interested persons in the
matter. Co~acilman Lucchio, also, placed d~t heads en notice that, should either
applicant be treated unfairly; he, as one Councilman, would see that proper re~rimsmd was
given. Roll call vote was as follows: Ayes: Coancilman Andrew Rocca, Francis Lmc~hio,
Richard Gamleu, Telford Smith. Abstain l~ voting: Councilman W~flio Cortesi.
Noes: Nome. Absent: None.
The next item taken up under the Saper Market subject w~a a request of the Pacific Coast
Construction C~pany that their re,nest for a super market be withdrawn. Councilman
Rocca moved, ~e~omded by Cou~Alman Gamlen and regularly carried that the re~% be
granted and the application be withdrawn. After brief discussion concerning the matter of
the application of the Safeway Stores, Mayor Smith w~nt on to the next subject matter.
The next matter concerned the final Map of Serra Highlar~is No. 2 B, a communication having
been received fr~n the Planning 0c~mission rec~nding approval. Director of P~blic Works,
ss, report~l that his office had made a thorough check of the subdivision and recommended
s approval, subject to the condition that they enter into an agreement with the City in
regards to Lo~ 5 - Block 18 which they wou~ld dedicate fcr City street purposes; and with
the provision that after a certain period of time that if the underpass is not going to be
I~xt through that the lot will revert to the sm~div~Aer~ He further reccam~nded that a
bond be deposited in the amount of $50,000.00 which will cover the amount of the
improvements and also a two (2) percent inspection fee. He also stated that he had
checked with -~ s~bdivider and had their letter from Mr. Wadsworth giving their approval
on the slope Lines as shown on the map. Ne a~ed that as soon as an official agreement is
entered into and recorded in the 0omnty R~cor~er's office, that designation w~atld be placed
on the map wi~h certain minute cha~s. He further remarked that the perio~ to hold Lot 5
should be twenty (20) years. Mayor Smith a~ if there was a motion acceding the
reco~aendatiou of the Planning Co.~$sion, and a~ the recc~nendatioua of the Director of
Public Works. Councilman Gamlen so moved, seconded by Coanc~]mau Rocca. Director.of Public
Works, Goss, ~hen said that ou Lot 5, the subdivider be required to construct the Curb
returns on a ~uty (20) foot radius and that he pave 'the area between the e~b~'.l~mee, .and
twenty (20) feet back to provide for off street parking. Also, construct a barricade
along the lo~ to prevent vehicles from going through the lot to Serra Drive. After brief
discussion, .~"ounci)man Gamlen remarked that he would include this recommendation iu his
motion. Motion as mede and seconded was regularly carried.

other previos request sent.
C~icatio~ ~as received from the Board of Supervisors regardi~ the matter of a County
Wide Master Plan. After explanatio~ by City M~mager Mc Clung, Councilman Lucchio
moved that he believed the City Clerk sho~ be instructed to notify the Board of
Smpervisors of the Comnty of San Mateo that this body Looked with favor =pon their
action and wo~ld do everything in o~r pow~r to cooperate to the i~est extent. Council-
man Rocca ~ecouded the motion which was regularly carried.

At the request of Mr. Charles Carr of Quality l~x~s, City Attorney Lyons explained the
procedure of Ordinance change on zoning changes.
Mayor ~th rec~nded to the Council that the Planning C~ssion have submitted to them
the Problem, for their study as to the undeveloped and unoccupied areas aroun~ the city and
how they should be used.

CCMPIAINT - T. EAY:
Mr. Thcm~s ~y of 656 ~ruce Avenua remarked on the fact that his business license for his
hotel cost him $2.00 per rocm, which was an eammnt greater than is paid by Super Markets, who
do a greater volume of busine~. Ne asked that some revision be made to the business license
ordinance. Mayor ~mith remarke~, that inasmuch as this is a new matter, ~ms it the
Co~ncilts pleasure to place tl~s on ~x~ study agenda and invite Mr. Kay to atten~
give any information he might have. No objections were registered, an~ therefore, ordmred
placed on the study agenda.
Since there was no further business, Mayor ~mith asked if there was a motion to adjourn
until 4:~0 P.M. January 2~th. Oouncil~n Lmcchio so moved, secom~ed by Councilman Rocca
and regularly carried.
