M. The meeti~ was called to order at 5:03 P. M. by Mayer S~ith. Present: Co~ncil~a~ Andrew Rocca, Francis Lucchio, Emilio Cortesi, Telford Smith. Absent: COmncilman Ricberd Gamlen. The first order of bmsinesm wes the Amendments to the Subdivision Ordinance. City Attorney l~wons e~plained the changes in th~ subdivision ordinance, which affected the Industrial Area, explaining scme of these sections. Councilman ~amlen appeared present at 5:11 P .M. and remained present for the duration of the meeting. Lengthy discussion was held between the Comncil members concerning the sale of parcels of prc~ert7 fromm the original area, an~ ho~ the I~t~rial ~tivielo~ Ordimaaee would affect the _~ales. No ob~ection~ were registered. Mayor Smith then ~laced this matter over to the st~dy meeting- of Janua~ ~1, 19~. Mayor smith reqmested ~ermission to leave th~ state on business. Councilman Lucchio moved, secoaded by Councilman Gamlen and r~e~ly oarr. ied that permission I:~: :granted Ma~ Smith reported that a ccmsamnication had been received from the Winston Manor Home Owner A~aoelation re$~rding a sewer, problem at the intersection of Dural and Arlington E~iv~. Mayor Smith maid that no reports w~rm available frc~a the Adaztnimtrative heads, and sm~ested holding l~s over to the next meetin~ ~til the reports were received. ~ Councilman ~ asked as t$ the steps that were eapl~CSed to have been taken. Director of P~blic W~rks, Goss, stated that he had notified the ~mb~ivi~ers; but that there was no ec~lian~ as yet, nor any answer to his letter. Co~.ucilman Lacchio requme'tm,d Director of Public Wor~s, Goss, to pursue this and clear it ~p. Upon requesm, Mr. Lester Kelting of Winston ~anor was ~ven permission to speak. He stated that the tract was accepted in Janaary 1954, and that under Ordinance ~3~2, before a~oe~tance, a ~rantee bond shomld be posted. ~e said that no ~h bond had been posted. He f~rther stated that the present eonditlo~s womld not ~e corrected by a lateral ccemection. ~nder terms of a performance bo~a, Stoneson is responsible for these correatio~s he said. He felt that the City forces should not be the ones to do this wark ~ f~r' remarked that immediate steps be taken to clear u~ this problem. Mayor Smith requested the Director of Pmblic Works to h~ve the information prepared for the solution mhd the City Attorney given this information so that the necessary bond and agreement be _~osted. City Attorney Lyons remarked that he could contact Stoneeon Development Company and have him contact the Director of PmBlic Works far the solution. Dir-~ctor of P~blic Works, Louis Goss, re- marked that it may require a new line to be installed f~r proper ~rain. City ~r Me Clung suggested that the 0ity Attarmey be instructed y~o have Stoneson take ears of the matter at ones and post the bo~d. Lester Kelting ~u~-~d the placing on file of a performance bond; and Oity Attorney Lyons stated he wool& contact Stonsson at o~ce for a bond and cc rTliance. M~yor Smith asmed if it w~e the Council's pleasure to haws this matter referred to the office of the ?ity Attarney for action. This was asreed, and the Oity At~y so instraeted.
