Mayor Smith remarked that before proceeding with the regular order of b~siness, he would like to extend the Councilt 3 welcome to'the students taking part as City Officials today. He stated he was pleased to see that the students were taking an active part in their governmental function and they turned the gavel over to Kenneth Moe, Acting Mayor. At this time,each City Official, who was represented by a student, introduced his stand-in to those gathered. Pledge of Allegience was led by Acting Mayor Kenneth Moe, after which Invocation was given by Mrs. Louis Thomas of the First Church of ghrist Scientist. Present: C~mncilman Andrew Rocca, Francis Lucchio, Richard Gamlen and Telford Smith. Absent: Comncilman Emilio Cortesi. None for approval. None for approval. Monthly report for the month of January was received from the Street Department. Comncil~n Gamlen moved, seconded by Councilman Rocca and regularly carried that the report be accepted and ordered filed. Communication was received from Frank B. Fitzgerald, relative to his T. V. Shadow project. After c~nt by the City Manager, Mayor Smith remarked that if there were no objections the report would be ordered filed. No objections w~re registered. Communication was received from Henry Schweining, r~questing permission for absence from the Council meetings. Also received was the memorandum from the office of the City Manager recc-m~e_ riding granting of permission. Councilman Lucchio moved, seconded by Councilman Gamlen and regularly carried that the recommendation of the City Manager be acufeX. Councilman Gamlen requested that the reason for the request be made known, asking ohe City Manager to read the ccmmmaication. City Manager Mc Clung read the commmnie&tion, which requested absence; so as to permit Mr. Schweining and his employees to uttered sessions at San Mateo Jr. College on Che~£stry of Sewage Treatment. None City Attorney Lyons explained the first Ordinance prepared concerned the first reading of the Subdivision Ordinance Amendments. After briefly explaining this Ordinance, City Attorney Lyons recommended the first reading tonigh~ and that the reading could be w~ived and introduced by title. Ne, also, remarked that Mr. Smith, from the Peninsula General Contractor and Builders Association Inc., was iu th~ audience; and that he might have some helpful ~ggestions. Councilman Rocca moved, seconded by Councilman Lucchio and regularly carried that, following the instructions of the City Attorney, the reading of the Ordinance be waive& and introduced by title only. City AttorueF Lyons read the title of the Ordinance. Motion, as made and seconded,was regularly carried. 0ouncilman Cortesi was absent. Mr. Smith, of the Peninsula General Contractor and B~il&ers A~sociation Inc., was then permitted to speak; and stated that he would like to make a s-mdy and submit his suggestions by the next meeting. Re asked that, if in the event these suggestions were not ready for the next meeting, the Ordinance be continued for another w~ek. At 9:05 P. M. Councilman Cortesi appeared present and remained for the duration of the meeting. City Attorney Lyons remarked in answer to Mr. Smith' s Question that the Ordinance could be continued to the next m$~t-ing. City Attorney Lyons, also, remarked that when the Ordinance was adopted, suggested adopting all the Ordinance ~emdments under one and record it in the Comity Recorder'a offices so that the Title Cca~anies and other interested persons in Subdivisions would be advised of the City's provisions. The seccmd reading of the Ordinance for the extension of Parking Meters on Linden Avenue was then taken up. City Attorney Lyons read the Amending Ordinance in full, after which roll call vote on its adoption was as follows: Ayes: Councilmen Andrew Rocca, Francisc IAlcchio, ~.-Imtlio Cortesi, Richard Gamlen, Telford Smith. Noes: None Absent: None. City Attorney Lyons then went on to Resolutions; ~hs first concer~g Palou Village Abandon- sent. City Attorney Lyons stated that he had receimed a call from the Regional Office of the Housing ~mthority and was asked if he wo~ld witEhold preparation of the Resolution until they could forward to him some sm~gestio~ re~ar~ing the demolition of these buildings. Their s~estions would affect a savin~ to the Goveawm~nt, if the demolition work was carried ou in a certain manner. Mayor Smith said t~t, if the~e were no objections, this wo~ld be continued to the next meeting, that of February 21, 1955. RESOLUTION NO. 2108 COLMA CREEK CANAL: The next ~esolution concerned the matter of dirt removal from Colma Creek by E. G. Coopman, Frederick F. Scribner and Charles Berger. Thru typosraphical error was dimmed, concerning the matter of five (5) days notice being given. It was written as 15 days, which incorrect. The error of fifteen (15) da~ was ordered corrected to five (5) days. After brief di~cussiou, Councilman Lucchio move~ that the ~ayor be authorized to enter into the agreement. City Attorney Lyons rem~r~e~ that a Resolution had ~n prepared. Councilman Lmcchio introduced "A Resolution of the City Council of the City of South San Francisco authorizi~ E. G. Coopman, Frederick F. Scribner, and Charles Ho Berger to dredge Oolma Creek Canal ar~ remove dirt therefrom, subject to certain ~erms and conditions." Roll call vote was as follows: Ayes: Councilman Andrew Rocca, Pi~ucis Lacchio, Emilio Cortesi, Richard Gamleu, and Telford Smith. Noes: None Absent: None. RESOIAPI~ON NO. ~109 ASSESSMENT ~ - T. WILLIAMS PROPERTY: CHARGES FOR PUBLIC RECORDS: SUNSHINE GARDENS NO. TENTATIVE MAP: STUDENT PARTICIPATION AMERICANISM DAY: City Attorney Lyons next took up the Resolution concerming an amended assessment of the Avalon ~Atfall Sewer of th~ Tom Williams Subdivision. After a brief explanation, Council- man Gamlen introduced 'A Resolution of the City Co~cil of the City of So~th San Francisco instructimg tbs Director of Public Works as Ex-0ffi~io Superintendent of Streets of said Ci'~y to prepare and file with the City Clerk a~ amended assessment for the subdivision area known as 'The Tom Williams Subdivision' with re,peet to the assessment of the Avalon Park O~fall Sewer." Roll call vote was as follows: Ayes: Councilman Andrew Rocca, Francis Lmcchio, Emilio Cortesi, Richa~ Gamlen and Telford Smith. Noes: None. Absent: None. Mayor S~llth next proceeded on to New Business. Memorandum was received from the office of t~e 0ity Manager concerning charges for reproduction of Public Records. City Manager Mc Clung e~plaimed the memorandum and the reason for the charges; which was to recoup some of the e~pense in reproducing and mailing out of papers. Councilman I~acchio remarked that he favored the sending of agendas out to the public free, as they paid for the cost of this service in their taxes, and mo~t organizations were none profit. As far ms those o~tside the City, he favored a charge. City Attorney Lyons cited the cost to attorneyS ~for reproduced documents, that if they are obtained free people have a tendency to be careless with them and make continaal demmuds for free copies. Copies that are subject to a fee are better ca~ed for, thereby eliminating the comstant demand. Ne ree~z~led the acceptance of the City Mana~r's re~om~mmdation. Councilman Rocca moved, se=o~ded by Councilman Gamlen and regularly carried that the reco~aem~ation of the City Maker be accepted. Councilman Lmcchio voted no, stating that he wo~ l~ke ~the record to show that he objected to Paragraph S of the City Manager's memoranda. Under Goo~ and Welfare, Mr. Sch~lhouser, of the Gardmn Development Company, spoke regarding the tents=ire map they had submitted for S~nshine Gardens ~ 8; stating that this w~s to be used as c~maercial area, and since it could not be ~ed ~s such, was therefore placed in first class residential land. He further remarked taat they were anxious to get started on grading, sewmr installation~ etc.; and wanted to '~ow when they could e~t~ect approval of the tentative map. Mayor Smith remarke~ that the C~ncil ~ somewhat ~i~appointed regarding the drainage problem solution, statimg tham so far no furthmr report had been received regarding this matter. Me then asked City Attorney Lyons relative to this matter, who omtlL~ed the discussion held with Mr. Picard, the Attorney for Garden Development Co.; and that something should be done. City Mamager Mc Clmmg explained the discussions he had and that he was awaiting an answer but n~e~ '~ox~:he'~. Mayor Smith stated that since this wo~ld pose further drainage problems suggested serious study be given the matter. After further di cmasion, Councilman Rocea remarked that in order to ~olve this we could only express willingness to the subdivider to help in any~m~ca~. Mr. Sch~lhouser then said that ~ ~ma~len Development Company had already spent s~ $65,000.00 in the overall drainage problem and asked that this be recognized in the set up. Ne further said that if it is recognized, then they can be willing t ~iL~' to think of the other drainage plan. Ma~or Smith said he felt it wo~ld be well for Mr. Picard, Attorney for Garden Development Company, to call~Mr~i Lyons and arrange for a settlement of the matter. City Attorney Lyons remarked that the $65,000.00 spent by Garden Dew. l~mment was for detail arainage throughout their subdivision. Mayor Smith stated that, if ~here were no objections, when Mr. Lyons heard frcm Mr. Picard regarding further information he could then contact the City Ms~ger to place this on the agenda. Councilman Lucchio s~ggested that instead of waiting for Mr. Piccard to call Mr. Lyons, that Mr. Lyons call Mr. Picard. City Attorney Lyons was then irmtructed to contact Mr. Picard, Attorney ~or the Garden Development Co. After ~her discus,ion, Mayor Smith extended the Colncil's thanks to the Students for their part in t~ight's activities; extending to them an invitation to return, re~ng that it was his de~ ire to see this type of program continued.
