M. The meeting was called to order by Mayor Smith at 8:12 P. M. Present: Councilmen Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Gamlen and Telford Smith. Absent: None Mayor Smith announced that the meeting was being called for the purpose of public hearings on three mm~ters. He stated that the first hearing was on the Uccelli request for re- zoning frc~ an "R-i" to "~' classification. Mayor Smith asked if there was anyone present who wished ~o speak on the matter. No one spoke. Mayor Smith then asked if there was a motion that the Public Hearing be closed. Councilma~ L~l~io move, secon4~¥by Councilman Rocca and regularly carried, that the hearing be ~losed. Mayor Smith then announced that the next hearing w~e regarding Quality foods request for rezoni~g i~ "R-l" to "~P' classification. Before proceeding farther, Mayor Smith announced ~hat the Uccelli hearing was closed. He then asked if there was anyone present who wished no speak on the matter. No one spoke. Mayor Smith then asked if there was a motion that the hearing be closed. Councilman Rocca so moved, seconded by Councilman Lucchio an& regularly carried. Mayor Smith, at this time, announced that the hearing on Quality Foo~s request was closed. Mayor Smith announced, at this time, that the re~uest of Safeway for rezouing from "R-3" to "DTM was ¢~en; asking if there was anyone who wished to speak. First to speak was Mr. Ricba~ Dolwig, who stated he was an attorney representing Safeway Stores; who stated as foilers: "For the record, I believe I should state that this is a formal application for rezoni~g of the Safeway property on Chestnut and EL Casino, made on the third of December 19~. The matter ~ referred to the Planning C~tssion, and a special meeting was held ou December 6, 1954. On December 13, 1954, aL1 the applications; and I am now referring to the other two applications now before you, ~re referred to the Pla~ing Consultamt for study. On Jaamary 10, 1955, the Planning Conaultamt made his report and the mm~ter was then put over until January 24. On January 24, the al~lication for Safeway remoning was approved by the Planning C~ssion, by a vote of six to three. The matter was then referre~ to the City Council and taken under consideration a week ag° last Monda~', for the purpose of holding, a ~blic hearing. It is my umderstanding this public hearing ~ continued until t~ight; and, insofar as procedure is concerned, I would like to see whether my understanding is correct; that is, the pablic hearing will be held until all people wishing to be heard on this application are heard and then this Council will take action as to whether the public hearing will be closed or not. Then an ordinance is introduced, and. five days mast elapse;and at that tine the hearing set by the Council, and the matter then taken under consideration by the City Council" City Attorney Lyons, at this time explained the procedure in the adoption of a City Ordinance. A discussion followed, st which time, Mr. Dolwig and Mr. William Lardtbom spoke in behalf of Safeway Stores. After discussion, Cosncilman Lucchio amk~-t~h~t into the record be read the reco~endation of the Planning Consultant; since this was an official meeting. Mayor Smith asked if there were any objections to this being read into the ~ecord. No objections were registered. Mayor Smith then asked if there were any obJectioms to it being referenced to the minutes. None were registered. At this time, City Manager Mc Clang read that part of the memorandum fr~a the Plaaning CcmaLission regarding the Planning Consultant,s recommendations and signed by Mr. Barber. It read as follows: "Gentlemen: We have been called ~ for a recc~men~lation regarding the rezoning Application bY Safe way Stores, Inc. from R-~ to C-1 on the California Water Service Company property at Mission Road and Chestnut Avenue., 0h the grounds that a large amount of undeveloped c~rcial zoning exists near the proposed site, and that any enlargement of C~rcial zoning in this area should be as a contingmems unit, we therefore recommend that the above application be denied in favor of an ~ltimate development of the subject area, as shown on the attached map. Very truly yours, J~STIN F. B.~BER, HAHN WISE & ASSOCIATES." Mr. Dolwig then spoke further on the matter, after which he introduced Mr. Peter Shields who made further c~nts on behalf of Safeway Stores, .citing statistics. After the remarks by Mr. Shields, Mr. Dolwig again spoke; after which he placed ~n file with the City, Postcards and signed petitions on the matter of Safe, my ~-~res. Further discussion followed betweer, members of the City Council, Mr. Dolwig~ and Mr. Shields. After discussion was completed by Mr. Dolwig and others in behalf of 8a_°eway Stores, Mr. Dewey Bell of 225 Camarit~s Avenme made a presentation opposirg the rezoning of Safeway Store property. After discussion by Mr. Bell, Mr. Lawrence Livingston, Attorney in ~he R~ss B~ilding in San Francisco, made a presentation on behalf of Barrett Construction Company opposing ~ rezoning. After Mr. Eivingson had completed his remarks, Mr. William Grapengater, of 101 Knoll Circle, briefly spo~e stating that the decision should be left to -~he people. Further discussion took place after which, the Mayor declared a recess. The meeting was recessed at 10:20 P.M. and recalled to order at 10:~5 P.M. Upon the meshing being called back to order, Mr. Carroll Bucher, of 212 Alta L~ma Drive, spoke on the matter on behalf of h~maelf and other residents of the B~ri-Bmri area. Mr. Mario Bregan-~, of 568 Miller Avenue, then spoke om ~he matter and was follo~ by Mr. John Noonan~ Attorney representi~ the Buri-B~ri merchants association. He asked that the minority re?erts of the Planning Co,~ssion be read and regmested that they be made a part of the reco_~_. After the ~rks of Mr. John Noo~an~ he wa~ followed by Mr. John Ertola, Attorney at Law 437 Grand A~nue, who spoke in behalf of Mr. A. J. Scampini, opposed to the rezoning. Mr. Walter ~a~k~ of 437 Valencia Drive spoke in support of the rezoning. Mr. Jack Brownell of 1057 Gran4 Avenue spoke in s~p~ort of the rezoning. .~r. Michael Minuccian~ of 555 Miller Avenue then ~ade his remarks on the matter as a member of the Planning Commission. Following ~r. ~M~ab~o~t ~sre Mr. Edw~d Calk, of Eighth Lane, South San Francisco; Mr. Thomas Kay, of Spruce Avem~e, South San Francisco, and Mr. A. Fountain of San Francisco. After discussion, Councilman Gamlen asked that the Planning C~.~,~ssion report dated January 26, 1955 be made a part of the record. City Manager Mc Clang, after discussion read fr~ the memorandum of the Planning Co~ission dated Janizary 11, 1955. Peter Martiuez spoke, giving his presentation ou his position as a member of the Plarning Commission. Mayor Smith asked if there wa~ anyone else that wished to be heard. No one responded. Mayor Smith then asked if there was a motion that the hearing be closed. Councilman Rocca so moved, seconded by Councilman Lucchio. At this time, Mr. Adolph Sani presented his view~ on the matter of rezoniug. After discussion, motion as made and seconded was regularly carried. .Mayor Smith then asked if any Councilman wished to introduce the Ordinance rezoning the Ucce~Li property from "R-i" to "D"'. Councilman Cortesi introduced the Ordinance, which was then read in its entirety by City Attorney Lyons. Mayor Smith then asked if any Councilman wished to introduce the Ordinance rezoning the Quali~Y Foods property from "R-l" to "~'. Councilman Gamleu introduced the Ordinance, which was then read iu its entirety by City Attorney Lyons. MAyor Sm/~h then asked if any Councilman wished to introduce the Ordinance rezoning the Safeway Property from "R-3" to "D~'. Councilman Rocca introduced the 0rdiuance, which was then read in its entirety by City Attorney Lyons. Mayor Smith, at this time asked if any Counci]m~_n had anything to offer under Good and Welfare. No response was made. A brief discussion followed regarding study meetings, after which Mayor Smith asked if anyone in the aadience had anything to offer under (k~ and Welfare. No reepc~se Mayor Smith then remarked that if there were no objections, and no further business, the meeting would stand adjourned until the next reg:~t~r meeting on February 21, 1955.
