City Attorney Lyons explained the meeting which held; at which time. he, Director of Public ~¥orks Goss, nnd Mr. Cosgrove, al-ret,ney for ~Irco Building Company, attended. At whi~lh time, Mr. Cosgrove stated that the .Arco Build Co. would pay the sewer connection charges. City Attorney Lyons also explained, relati to the credit ~eing allowed the .~rco Building Co. for the time the improvements were .~:!lowing them time for the holding up of acceptance. Further discussion took pla ee :on:erning the improvements and the payment of morey owed; after which, Coun:~lm.~n moved, seconded by Councilman Cortesi, that the mz_tter be held over until such time as necessary work was complet, ed as requested and the money paid. PROGRESS flEPOR F MASTER DRAINAGE STUDY: ~ / ~ Com~nunication dated July 19, 1955 was received from the office of E.P. Wilsey, together a progress report on the master drainage study. Mmyor Smith asked if there was a motior accept and file the report. 'Councilman Rocca moved, seconded by Councilman Gamlen~ regularly carried that the report be accepted and plac~d on file. CITY MANAGER ~.EPORT~: Inter-Office nemorandum dated July 21, 1955 was received [rom the office of the City ager concerning the blasting being done on Loma Linda Terrace, At the request o~ Mayor Smith, City Manager McClung explained the meeting which was held with the residents of the area and also the decision to have blasting done in the afternoon at 12:00 o'clo~ noon and bet~veen 5:00 and 5:~0 P.M. He further explained that the later hour in the aeon would find ]ess chi!dren on the streets because of the dinner hour: also. all bl~ was to be under the supervision and the inspection of the Public Work's Department. TOR: tor~ his salary to be charged directly to the Loma Linda Co. Councilman Gamlen remark, ~-~ ]~ that this in r.o way w~s a reflection on Superintendent of Public Works Ray Volkman, bu' was being done so that it could relieve Mr. Volkman for other important city duties si: it was taking up too much of Mr. Volkman's time to be present during the periods when blasting operations were taking place. Director of Public Works Goss then remarked recommended, at this time, that a powder expert, '0lasting man be hired, and that the be borne by the Developer. Councilman Lucchio moved, seconded by Councilman Rocca, an reg,~larly carried, that the recommendation of the Director of Public Works be a,~cepted PUBLIC HEARINGS' '~here were no Public Hearings at this time, ORDINANCi NO. ~?1 The Council then proceeded on to the matter of ordinances; taking up first the second TAX r~YM~N.~ reading and ~doption of the ordinance concerning the collection of the city taxes. ~-~? ~fter a brief explanation by City Attorney Lyons, at which time, he stated that 'the ordinance had been drafted so as to bring the City's collection dates the same as those of the county. He requested a motion that the reading of the ordinanc:e be waived and introduced by title only. Councilman ORDINANCE NO. 372 TOW CAR REGULATION: Gamlen so moved, seconded by Councilman Rocca and regularly carried. City Attorney Lyons then read the title of the ordinance which was: An Ordinance of the City of South San Francisco Amending Sections 33, 35, and 41 o~ Ordinance No. 21 Entitled: An Ordinance Providing A System For the Assessment, Levy, and Collection of all City Taxes in the City of South San Francisco", Passed And Adopted on the 19th Day of April, 1969. After which~ Roll ?all vote was as follows: Ayes: Andrew Rocca, Francis Lucchio, Emilio Cortesi, ~ichard Gamlen~ Telford Smith. Noes: None. Absent: None~ City A~orney Lyons then brought to the attention of 'the council the second reading and adoption of the ordinance regulating tow car activities. ACtor ~ brief explanation by City Attorney Lyons, he again requested a me,ion that the reading of the ordinance be waived, anf that it be introduced by title only. 2ouncilman Rocca then moved, seconded by Councilman Gamlen, and regularly carried, that the ordinance be introduced by title and the reading be waived. City Attorney Lyons then read the title of the ordinance which was ~s follows: An Ordinance of the City of South San Francisco Prohibiting Solicitation by Tow Car Operators and Other Persons at the Scene of Highway Accidents, Disasters, or Other Happenings Resulting in Injury or Damage to Persons or Property. At this time, Mr. Ray Simonivich of 715 Southwood Drive, South San Francisco, operator of the Speedway Auto Repair inColma, spoke in protest to the adoption of the ordinance. Noes: " None Absent: " None SUBDIVISION ORDINANCE .AMENDMENTS' ~/~ 7 Mayor Smith stated that a request had beea made to hold up the first reading and inzroduction of the subdivision ordinance amendments; that if there were no obf'ections, it would be held over until August 15. No objections having been registered, it was so ordered. AMENDMENTS TO ZONING ORDINANCE: ~-/g y The f£rst reading and introduction concerning the amendments to the zoning ordinance for the rezoning of property at 813-19 Baden Avenue was next taken up. Coun::ilman Gam]en moved, seconded by Councilman Lucchio, and regularly carried, that 'this be held over until August 15, 1955; at which time, the protest hearing was scheduled. Mayor Smith t~-~en remarked that the next resolution concerned -the definition of the limits o~ Belair Road. City Attorney Lyons briefly explained the resolution; ~fter which, Councilman LuccLio introduced A Resolution of the Ci'ty Council of the City of South San Francisco Designating Certain Portions' of Belair Road githin Said City to be a Public Street. RESOLUTION NO. 2179 USE ~F D~LL TO WER City Attorney Lyons then explained the request which had been received from the cities of Brisbane and San Bruno to use the drill tower of the Fire Depar men~ of South San Francisco. Fire Chief Welte recommended that the request be granted. 'Councilman Rocca then introduced A Resolution of the City Council of the City of South San Francisco Authorizing the Use of the City of South San Fra. ncisco's Drill Tower by the Fire Departments of Brisbane and San Bruno. RESOLUTION NO. 2180 FRANK & JEANNE STOUT: Councilman Gamlen then stated that he hid a resolution commending Frank Stout and Jeanne Stout's success in thelnternational Yacht Races which were to be heli in Fleetwood, England, August 7 and 14. STOUT SUCCESS IN THE INTERNATIONAL YACHT RACES TO BE HELD mT FLEETWOOD, ENGLAND. WH~R.EAS FRANK STOUT and JEAN-NE STOUT, of No. !1Tunitas Avenue, City of Souzh San Francisco, have been selected to represent the United States of America, the defending champion, at the English Open Yacht races and the In'terna5ional Model Yacht races which are to be.held on ;ugust 7th and August L4th, at Fleetwood, England; and WHEREAS said FRANK STOUT AND JEANNE STOUT, along with their yacht "THE MAGIC", have been undefeated in Class "A" competition and have won Pacific Coast and national titles; and WHEREAS 'the yach[ "TILE MAGIC" is a new conception in model yacting and was deskgned and constructed by said FRANK STOUT as the ultimate in model yacht design; and WI~REAS said JEANNE STOUT is the first woman during the fifty-five-year history of the international races to participate in these races; and WI'~REAS the participation of said FRANK STOUT and said JEANNE STOUT in the international races is the :ulmination of two years of difficult and painstaking labor and planning on'their part, NOW, THEREFORE, BE IT RESOLVED by the 2ity Council of the City of San Francisco that said FRANK STOUT and JEANNE' STOUT be congratulated for achievkng the honor of representing the United States at the International Model Yacht races at Fleetwood, England. Rodond~ City Clerk RESOLUTION NO. 2181 ANNEXATION OF PROPERTY BY DALY CITY: ~-D~ ~ City Attorney Lyons then reported that he h~d two additional resolutions which came in too late for the agenda. He took up the first which concerned a request from the neighboring city of Duly City, concerning their annexing a piece of property near the community of Broadmoor which in no way affects the city of South San Francisco. The city ~f Duly City requested the approval of Sout~. San Francisco concerning the matte~ and it was recommended by City Attorney Lyons that the resolution be adopted. Councilman Rocca then intro- duced A Resolution Consenting To Annexation of Property by the City of Da!y City. Discussion followed concerning the matter; at which time, Mr. Antonio Gaudio, legal advisor to the proponents of Northgate, spoke requesting that the city take no .action on the adoption of the resolution. Roll call vote was as follows: Ayes: Councilmen Andrew Rocca, Richard Gamier,.. Telford Smith Noes: " None Abstained: " Francis Lucchio, Emilio Cortesi Absent: " None RESOLUTION NO. 2182 City Attorney Lyons then said that the othe~ resolution was in connection with SANITARY SEWERAGE SYSTEM: the Airport Boulevard Sanitary Sewer System, explaining the request of the ~-//3 bom~ Louse concerning a technical change in the wording of the resolution. Councilman Lucchio then introduced A Resolu;ion of the City Council of the City of South San Francisco Determining to Undertake Proceedings to Construct a Sanitary Sewerage System and to Provide Tact Costs Shall Be Assessed Upon the District Benefited Under Appropriate Special Assessment and Assessment Bond Acts Without Proceedings Under Division 4 of the Streets and Highways Code. Roll call vote was as ~ollows: Ayes: Councilmen Andrew Rocca, Francis Lucchio, ~milio Cortesi, Richard Gamlen, Telford Smith. Noes: " None Absent: " None At this time, Mr. AntOnio Gat~dio, attorney at law, asked the Mayor and members of the Council if he could be informed as to whether or not a communication which he had addressed to the City Council, concerning the sewer problem in Winston Manor No. 1, would be on the agenda, in as much, as it did.not appear as an item. City Manager McClung replied that it would be a matter on the agenda, explaining that the reason for its not being listed was because the agenda had been prepared early so that the local paper could publish the items for discussion. He further remarked, since the letter arrived in his office on Wednesday afternoon, it did not appear. He also stated that 'there was anether item for Council action on the ~genda this evening which concerned the City Hall bid altera~ioh~. Both items would appear as items 14 and 15 respectively. RECESS: At this time Mayor Smith declared recess for six minutes at 9:2'5 P.M. RECALL TO ORDER: The meeting was recalled to order at 9:32 P.M. EMPLOYEES HOLIDAY PAY: Communication dated July 2S, 1955 was received from the South San Francisco Municipal Employees Association concerning i~oliday pay question, accompanied by an ir.ter-office memorandum dated July 27, 1955 from the office of the City Manager concerning the same subject ma;ter. Mayor Smith remarked that the Council ~ould at this time hear from the employees. Councilman Lucchio suggested that the discussion should, be held in caucus instead of in a public meeting, entering the remark as a motion, seconded by Councilman Cortesi.' Under discussion PhilL±p Burton, attorney at law, spoke as a representative for the Municipal Employees Association. Discussion took place between the members of the Counc and tr. Burton relative to the discussion of the subject matter being done in private or public meeting; after which, r011 call vote on the motion was as follows: Noes: Councilmen Andrew Rocca, Richard Gamlen, Telford Smith. Employees Association, made a lengthy discussion on The subject of consideration of extra holiday pay for municipal employees. Discussion algo took place by members of the Council and City Manager concerning the subject matter; after whick,_~Cpunc~Lm~_~ortesi moved that the ,Lity do away with the State Personnel Boar~"'~~n~wn government. There being no second to the motion, Mayor Smitk stated the motion died for lack of a second. %t this time, Mayor Smith remarked that if there were no objections from any members of the Couw~i permission to submit writtem briefs would be granted and that if ~he Council wished to have the matter placed on ~he agenda, it could be done by Cp~ncil motion. I[ was the recommendation of the Director of Publi.~ ?,;ork~ that the req~es!: be grante~:,. Councilman Oamlen moved, seconded by Council-- man Rocca add regularly :~arried, that the recommnedation o'f the Director o~ Publi~ Work.~: be accepted. Communication dated July 2~, 1955 was received from Frank Kelly, togc~:her with an inter office memorandum 'from the office o:f the City Manager, under date of July 28, 1955, concerning the widening of Baden ~.venue. Di~:~ussion followed; at which 'time, Mr. Frank Kelly, 205 Baden Avenue, requested city assistance in moving his home back, which he felt was brought about by the widening of Baden Avenue. Councilman Lucchio then moved, seconded by Council- man Rocca, that a survey be made to see if the city was iqfringing on the property. Director of Public Works Goss stated that a survey had been made and the property was some 4 feet from the City line. Councilman Rocca then moved, seconded by Councilman Lucchio and regularly carried that the matter be referred to the Director of Public Works for a report and that the Council would then have time to take it up at another meeting. RECESS: -- RECALL TO ORDER:-- At th~s time, a five minute recess was declared at 11:12 P.M. The meeting was recalled to order at 11:2¢ P.M. REZONING FOR MORTUARY ~.MOS~. LARSON: ~~ Resolucion No. 458 as applied for by Amose Larson was received from the Plannkng Commission recommending favorable action to amend section 2.2 of 'the zoning ordinance so that the property known as Parcel 2 and 3 of Zone D, Jcreag located at 705-735 Commercial Avenue, may be zoned R-3 with the intention of using 5he property for a mortuary. Lengthy discussion took place concerning the m&~ter in question; at which time, residents of the area spoke in opposk~ion; as well as, Robert Miller, attorney at law, who spoke in behalf of Mr. Larson, Mortician. Also taking part in the discussion were members of the Ckzy Council. Bt this time, City Attorney Lyons stated that the ordinance, as weLL as, street law, required that a notice should be published in the paper for a protest hearing as was done by the Planning Commission. Bfter discussion, it was agreed to hold the protest hearing on August 29, 1955 at 8:00 P.M. Mayor Smith stated that if there were no objections, it would be so ordered. No objections were registered. STROUD SE~¥ER EASEMENT: Mayor Smith at this time remarked that since there were people waiting in the audie~.ce who were interested in the matter of the sewer problem in Winston Manor, he suggested that this item be the next taken up. City Manager McClung read the communication received from Antonio Gaudio, attorney at law, under date of July 27, 1955; after which, di~cu~ion followed. The communica- tion ms received from Mr. Gaudio concerning an easement which had been given -to the City by. Mr. & Mrs. Stroud. Councilman Lucchio then moved thnt wi'th the exception o~ paragraphs 4 and 5 of the letter, the City Clerk inform Mr. Gaudio that the City accede to the wisaes stated therein, the e×cep~ion being the payment of $750.00 and the stopping of operations. Councilman Rocca seconded the motion, followed by disLussion. After which, mo~ion a.m made and seconded was regularly carried. At 'this time, Councilman Cortesi proposed adjournment. Mayor Smith replied that tte meeting was rather short from now on and that possibly it could some- what be shortened, stating that the Recreazion Commission had ~sked for a meeting with the Council and that if there were no objections, the meeting would be on the 29th of August after the protest hearing. No objections were registered. POLETTI SUBDIVISION' Communication dated July 27, 1955 was re~e_ved from Louis Poletti, requesting the formation of an assessment district fo= the purpose of providing public facilities for the proposed industrial area lvin~ between So~th A~r~mr~ permission to submit writtem briefs would be granted and that if ~he Council wished to have the matter placed on .~be agenda, it could be dome by motion. S WER REqUeST:5'/~ BADEN AVENUE WIDENING: Communication dated July 20, 1955 was received from the office of Charles Randlett, accompanied by an inter-office memorandum from the office of the Director of Public Works under date of July 27, 1~55 and ~he City Manager under date of July 2~, 1955, concerning the matter of the Pacific Co.sst Foil Company Sewer. It was the recommendation of the Director of Public Works that the reqaest be granted. Councilman Gamlen moved, seconded by Council- man Rocca and regularly carried, tbmt the recommnedation of the Director of Public Works be accepted. Communication dated July 26, 1955 was received from Frank Kelly, together with an inter office memorandum from the office of the City Manager, under date of July 28, 1955, concerning the widening of Baden Avenue. Discussion followed] at which time, Mr. Frank Kelly, 205 Baden Avenue, requested city assistance in moving his home back, which he felt was brought about by the widening of Baden Avenue. Councilman Lucchio then moved, seconded by Counci man Rocca, that a survey be made to see if the city wamolqfringing on the property. Director of Public Works Goss stated that a survey had been made and the property was some 4 feet from the City line. Councilman Rocca then moved, seconded by Councilman Lucchio and regularly carried that the matter be referred to the Director of Public Works for a report and that the Council would then have time to take it up at another meeting. REMONING FOR I~ORTUARY AMOSE LARSON: ~Og~ Resolution No. 458 as applied for by Amose Larson was received from the Planning Commission recommending favorable action to amend section 2.2 of th~ zaning ordinance so that the property known as Parcel 2 and 3 of Zone D, Acr~ located at 705-735 Commercial Avenue, may be zoned R-3 with the intention of using the property for a mortuary. Lengthy discussion took place concerning the matter in question; at which time, residents of the area spoke in opposition; as well as, Robert Miller, attorney at law, who spoke in behalf of Mr. Larson, Mortician. Also taking part in the discussion were members of the City Council. ~t this time, City Attorney Lyons stated that the ordinan~ as well as, street law, required that a notice should be published in the paper for a protest hearing as was done by the Planning Commission. After discussion, it was agreed to hold the protest hearing on August 29, 1955 at 8:00 P.M. Mayor Smith stated that if there were no objections, it would be so ordered. No objections were registered. STROUD SEWER EASEMENT: oqo Mayor Smith at this time remarked that since there were people waiting in th~ audience who were interested in the matter of the sewer problem in Winston Manor, he suggested that this item be the next taken up. City Manager ~McClung read the communication received from Antonio Gaudio, attorney at law, under date of July 27, 1955; after which, discu~sion followed. The communic tion as received from Mr. Gaudt. o concerning an easement which had been given to the City by. Mr. & Mrs. Stroud. Councilman Lucchio then moved that with the exception o[ paragraphs 4 and 5 of the letter, the City Clerk inform Mr. Gaudio that the City accede to the wishes stated therein, the exception being the payment of $750.00 and the stopping~of operations. Councilman Rocca seconded the motion, followed by discussion. After which, motion as made and seconded was regularly carried. At this time, Councilman Cortes/. proposed adjournment. Mayor Smith replied that the meeting was rather short from now on and that possibly it could some what be shortened, stating that the Recreation Commission had asked for ~ meeting with the Council und that if there were no objections, the meeting would be on the 29th of August after the protest hearing. No objections were registered. POLETTI SUBDIVISION: Communication dated July 27, 1955 was received from Louis Poletti, requesting the formation of an assessment district for the purpose of providing public facilities for the proposed industrial area lying between South Airport Boulevard and Bayshore Freeway. Mayor Smith remarked that if there were no objections, the City Attorney would be instructed to prepare the proper petition for submission to the Council in its proper form. City Attorney Lyons stated the CoLncil w~Id have to designate an engineer and attorney for the district. CounciLman Gamlen moved, seconded by Councilman Ro,:~ca,' that Mr. Lyons be appointed as the assessment attorney and Wilsey and Hamm appointed as engineers. Mayor Smith remarked that this was to be on the contingency basis, which meant that should the district not go through, no money was to be paid the engineer and attorney. Motion as made and seconded was regularly carried. L. BOWMAN DRAINAGE: Communication dated July 20, 1955 was received from Leo Bowman, 310 Holly Avenue together with an inter-office memorandum from the office of the City Manager dated july 28, concerning drainage proplems at 310 Holly Avenue. Mayor Smith remarked that the Director of Public Works informed the Coufidil'at the study session meeting that the oonstruction in the area by Ca]lan Development COmpany had not been done according to the plans and since improvements not been accepted, and that if there were no objections from the Council, ~be Bublic Works Director would be ~nstructed to notify Mr. Callan to complete the improvements as called for in the specifications and Mr. Bowman be notified of the Co~ncil action by the Director of Public Works.
