PLACE: Council Chambers, City Hall TIME: 7:30 P.M. CALL TO ORDER: The meeting was called to order at 7:40 p.m. by Vice Mayor Richard Gamlen. ROLL CALL: Present: CounciLmen Andrew Rocca, Francis Lucchio, Richard Gamlen Absent: Emilio Cortesi, Telford Smith PARK IIAVHN HEIGHTS GRADING PERMIT: Vice Mayor GamLen remarked that in the absence of Mayor Smith he would act as Chairman of nhe adjourned meeting. , V£/v First item on nhe agenda concerned the Park l~a~,~a F~eights grading permit. Director of PubLic Works Goss remarked that he had received a letter from Mr. James Cherry, Superintendent of the South San Francisco Unified School District dated October 5, 1955 and was pursuant to a meeting that he had attended. He requested Council permission to read the letter. After Director of Public Works Goss had read the letter as received from Mr. Cherry he remarked that he recommended that the grading permit for Park Haven Heights.be approved~ in accordance v;th the stipulations in this letter from Mr. Cherry. Vice Mayor Gamlen asked if the contractor signed the agreement as well, to which Mr. Goss replied that i~ had been mutually agreed between the contractor, the school district, and himself. Councilman Lucchio then moved, seconded by Councilman Rocca and regularly carried that the recommendation of the Director of Public Works be accepned and that the grading permit be granted and carried out pursuant to the grading plans and the agreement made by the school district. HIGH SCHOOL PARK TERRACE GRADING PERMIT: / The next item concerned the request for a grading permit in the High School Park Terrace Addition and concerned Lots 15 and 16 in Block 3. The revised grading requesn had been submitted by Nr. John Harkness. After some discussion and explainatio~ by the Director of Public Works Louis Goss, Councilman Rocca moved, seconded by Councilman Lucchio and regularly carried that the application for the plans of the developer of Lots 15 and 16 be accepted. SERRA HIGHLANDS UNIT 1-C At this time Councilman Lucchio asked Vice Mayor Gamlen if he wished to ask anyone else in ~he audience if they had some subject matter that they wished to be heard on inasmuch as the Mazzanti rezoning hearing might be a lengthy discussion. Mr. George ~cKeon, present in the audience, stated.that he had a map prepared for the extension of King Drive. Discussion followed by the members of the Council present, Mr. McKeon, Director of Public Works Goss, and City Manager McClung after which Councilman Rocca ~oved, seconded by Councilman Lucchio that t~e city approve the location of King Drive and the map in accordance with the plans submitted and that they meet the ap[roval of the Director of Public Works and the City Attorney and that the City Attorney be instructed to get all the signatures necessary to bind all the parties to the agreement. On the ~uestion, Councilman Lucchio remarked that he would like to state for the record thaz the City's participation is contin~ent upon the signing of the contract by all three parties. Councilman Rocca then remarked that he would like to amend n~e motion that the City's participation would not be over $5,000. Councilman Lucchio seconded the amendment.. '~otion as made and amended was regularly carr2ed. MAZZANTI REZONING PROTEST HEARING Vice Mayor GamLen then took up the matter of the Mazzanti Rezoning. Opening the protest hearing, City Attorney Lyons remarked that the applicant could first be called on a~d then the protestants. APPEARANCE OF Councilman Cornesi appeared present at 8 p.m. and remained for the duration of COUNCILMAN CORTESI: the meeting. Louis Poletti of 7377 Mission Street, ~aly City Realto~ was the first speaker stating that he was authorized to speak on behalf of the property owner, Mr. Mazzanti. He presented the names of two persons who signed the petition with- drawing their aames as protestants. After Mr. Poletti had spoken the following protestants spO~e against the rezoning: Mr. Leo Leoni, 4 Eucalyptus Ave., South San Francisco; ~r. Rich of Circle Court, South San Francisco; Mr. Charles Oliver, 700 Circle Court, South San Francisco; Mr. Scanal, 775 Circle Court, South San Francisco; Ernest Reed of Circle Court, So. San Francisco; Mr. J. McGee, 679 Commercial Avenue, So. San Francisco; Mr. Golski, Lll Eucalyptus Ave., So. San Francisco; Mr. James Claire, 717 Circle Court, So. San Francisco. RECESS: Recess was declared at 9:17 p.m. and'recall to order was at 9:30 p.m. ADJOURNMENT: The meeting upon recall to order Vice Mayor Gamlen asked if anyone else wished to speak concerning the Mazzanti rezoning. Mr. McGee again spoke, followed by Mr. Rich, Mr. $canal, Mr. Golski0 He was then followed by Mr. Watson of 810 Baden Avenue, So. San Francisco who spoke in favor of the rezoning. Mr. D. DeZorto of 206 Eucalyptus Ave., So. San Francisco also spoke in favor of the rezoning. There being no further discussion either for or against the rezoning, Vice Mayor Gamlen asked if there was a motion that the hearing be closed. Councilman Roc:a moved, seconded by Councilman Lucchio and regularly carried. Discussion followed by members of the council concerning the rezoning after which Councilman Lucchio moved that the request for rezoning be granted but in no way would it mean that the use permit would be granted. Councilman Rocca seconded the motion after which roll call vote was as follows: Ayes, Councilman Rocca and Lucchio; Abstained, Councilman Cortesi; Noes, Councilman Gamlen, after which Councilman Cortesi requested that his vote be changed to a '~No" vote. Discussion followed concerning Councilman Cortesi changing his vote to which City Attorney Lyons stated that if the chair did not declare the decision of the vote a Councilman's vote could be changed. Vice Mayor Gamlen then stated that it was a tie vote. City Attorney Lyons remarked that as a hie vote it did not carry and would have to be brought up again. Councilman Lucchio then moved that the meeting be adjourned. Vice Mayor Gamlen then adjourned the meeting until 4:30 p.m. October 10, 1955.
