HomeMy WebLinkAboutMinutes 1955-10-24ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, OCTOBER 24, 1955 PLACE: Council Chambers, City Hall, South San Francisco TIME: 4:30 p.m. CALL TO ORDER: Meeting was called to order at 4:37 p.m. by Mayor Telford Smith ROLL CALL: Present: Councilmen Andrew Rocca, Richard Gamle.n, Telford Smith Absent: Emilio Cortesi, Francis Lucchio AIRPORT BOULEVARD Mayor Smit~ stated that the first item of business was the protest yearing for INDUSTRIAL TRACT the Airport Boulevard Industrial Tract. Mayor Smith asked if any written protests POLETTI SUBDIVISI]~: had been received to which the City Clerk replied that none had been received. .~~ He then asked if there were any oral protests. None were registered. Discussion followed at which time Mr. Poletti, the major property owner, spoke as well as Director of Public Works Goss and members of the City Council concerning Mro PolettJ desire to ~o one phase of the work himself through a private contractor, which in this case '#as the Associated Construction Compz.ny. The work to be done concerned the culvert. APPEARANCE OF ~ Councilman 2ortesi appeared present at 4:45 p.m. and remained for the duration COUNCILMAN CORTESI: of the meening. At this time Councilman Gamlen asked Mayor Smith that pending the arrival of the City Antorney if the Council could possibly continue on with other items on the agenda. %¥I NSTON MANOR SEWER PROBLEM: At this ti~e Mayor Smith proceeded on with the matter of the Winston Manor sewer problem. 2ity Manager McClung explained the reports as received so far concerning the subjecn matter and the pending reports which were forthcoming. Antonio Gaudio, Attorney for the property owners in the area, then spoke in behalf of the property owners. Farther discussion followed at which time Director of Public Works Goss suggested nnat Mr. Edwin Smith, the engineer wko did the work in Winston Manor, submit a more thorough report. Mr. Goss suggested to Mr. Gaudio that possibly his report '~e accompanied with his working papers. Councilman Gamlen then moved, seconded by Councilman Rocca and regularly carried that the recommendation of the Director of Public Works be accepted that it be referred to him for a full report outlining ~o Mr. Smith his requirements on the report in full detail° Mayor Smith remarked that if there were no objections the Director of Public Works would con- tact Mr. Charles Randlett for whatever report ke has and submit all this inform- ation for n~e next meeting. He also suggestec that the inspectors be present for whatever report they could make concerning the work as was done on the project. Brief discussion followed concerning the meeting time after which it was unanimously agreed than the meeting be held at 8 p.m. on Monday, October 31, 1955. PROTEST HEARING Mayor Smith at this time returned to the protest hearing on the Airport Boulevard ~IRPORT BLVD. INDUS-Industrial ?ract at which time discussion again took place conerning the matter TRIAL TRACT - of Mr. Pole:ti doing one phase of the work himself. An explanation of the method POLETTI SUBDIVISION:in which this matter could be handled was given by the City Attorney who stated ~~ that after ~he first problem of awarding the contract a letter should be received by the City from Mr. Poletti explaining his intention to de this phase of the work. After further discussion Councilman Rocca moved, seconded by Councilman Gamlen an~r~gu~arLy carried that the protest hearing be closed. City Attorney Lyons then expialnee resolutions he had prepared concerning the subject matter. RESOLUTION #2263 After a brief explanation by the City Attorney Councilman Gamlen introduced AIRPORT BLVD. "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ORDERING THE INDUSTRIAL TRACT: WORK FOR TEE IMPROVEMENT OF AIRPORT BOULEVARD INDUSTRIAL TRACT, AND DIRECTING THE POLETTI SUBDIVISION:WORK TO BE DONE.~' Roll call vote was as follovas: Ayes, Councilmen Andrew Rocca, ?~-..~ Emilio Cortesi, Richard Gamlen, Telford Smith; Noes, None; Absent, Councilman Francis Lucchio. RESOLUTION #2264 City Attorney Lyons briefly explained the next resolution after which Councilman AIRPORT BLVD Rocca introduced "A RESOLUTION OF THE CITY COUNiIL OF THE CITY OF SOUTH SAN INDUSTRIAL TRACT FRANCISCO AWARDING THE CONTRACT TO PERFORM THE WORK DESCRIBED IN RESOLUTION OF POLETTI SUBDIVISION: INTENTION NO. 2237." Roll Call vote was as follows: Ayes, Councilmen Andrew Rocca, ~-~.~ Emilio Cortesi, Richard Gamlen, Telford Smith; Noes, None; Absent, Councilman Francis Lucchio. RESOLUTION #2265 AIRPORT BLVD. INDUSTRIAL TRACT: A brief explanation was given by the City Attoraey concerning the next resolution after which Councilman Gamlen introduced "RESOLUTION DIRECTING THE ASSESSMENT TO BE MADE AND SIGNED BY THE DIRECTOR OF PUBLIC WOIKS." Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Emilio Cortesi, 2ichard Gamlen, Telford Smith; Noes, None; Absent, Councilman Francis Lucchio. SOUTH CANAL AND MAYFAI R AVENUE I ~fPROVEMENT: At this time Mayor Smith remarked that no repot'; has been received from Mr. Wilsey's office, the engineers of this work, and that if it pleased the Council the matter would be held over until the Council met with Mr. Wilsey and received all of the information. Lengthy discussion then took place at which time Antonio Gaudio representing the ~ayfair Improvement Group spoke in their behalf. After discussion has taken place Mayor Smith remarked that if there were no objections the matter of the Mayfair Avenue bridge would be placed on the agenda for the meeting of October 31, 1955. No objections hav~ng been re~istered the City Manager was instructed to place this matter on ;he agenda for October 31, 1955. TERMINATION OF SERVICE OF ALBERT DELLAPIANE: Discussion then took place concerning the termination of city services of Albert Dellapiane, since some question arose concerning the two weeks notice which had been given. Discussion followed at which time Antonio Gaudio representing Mr. Dellapiane, Director of Public Works Goss, City A~Drney Lyons and members of the City Council took part. After further discussion has taken place City Attorney Lyons phrased the following motion at the request of the City Council, "Be it moved that in view of the fact that Mr. Dellapimne was not given written notice until on or about October 21, 1955, that his employment with the City of South San Francisco was being terminated as of Octobe~ 31, 1955, his employment termin- ation be extended to and including November 4, L955 provided that he is willing to serve until that dat. .n~ that h~ He then asked if there were any oral protests. Be it further moved that the director of Public Works so notify Mr. Dellapiane in writing." Councilman Rocca ~--- OOO so moved, seconded by Councilman Gamlen. Brief discussion followed after which roll call vo-;e was as follows: Ayes, Councilman lndrew Rocca, Richard Gamlen, Telford Smith; Noes, Councilman Emilio Cortesi, stating that it was on the grounds he felt that the man had not received a fair deal; Absent, Councilman Francis Lucchio. ABANDONMENT OF SOUTHWOOD CENTER: Next taken up was the matter of the Southwood Center abandonment. At this time Mr. Barriman who was requesting the abandonment remarked that a meeting had been held with the utilitie companies concerning their questions in the matter and that letters had been sent by the utilitie companies withdrawing their objections. He also stated that a bond had been signed in the matter. City Attorney Lyons explained a letter which should be filed concernkng Ponderosa Road and also the fact that the property owners should stand any expenses that might be necessary in the condenmation proceedings on Ponderosa Road. He stated that he felt the City should also have a guarantee from the Williams Company guaranteeing full cost of condemnation proceedings and then a statement concerning the dedication to the City or the County for Ponderosa Road. At this time Director of Public Works Goss stated that the City had the communications from the utilitie companies with the exceptior~ of the California Water Service. He remarked that he had spoken to the Califorr.ia Water Service and was informed that a discussion with Mr. Williams was had concerning the relocation of the water mains and that all costs for such relocation was to be borne by them. Mr. Barriman at this time agreed to the re- location of ~hese water mains. City Attorney Lyons then asked Mr. Barriman if he had sent such a letter as he had requested concerning the condemnation costs to which Mr. Barriman replied he had. Brief dis~3usmion followed concerning Ponderosa Road at which time Mayor Smith asked as to the status of the City's position should the improvement of the Southwood Center not go through. At this time Mr. Barriman agreed to pay for any and all costs of condemnation which might be.necessary and City Attorney Lyons recommended a time element on the bond for performance of the work. Mr. Barriman asked for twelve month's time. RESOLUTION #2266 ABANDONMENT OF SOUTHWOOD CENTER: After an explanation by the City Attorney Lyons of the resolution Councilman Gamlen introduced "A RESOLUTION OF THE CITY COI~CIL OF THE CITY OF SOUTH SAN FRANCISCO O~DERING THE VACATION OF A CERTAIN PUBLIC STREET DEDICATED TO THE CITY OF SOUTH SAN FRANCISCO AND KNOWN AS "SOUTHWOOD CENTER."" Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Emilio Cortesi, Richard Gamlen, Telford Smith; Noes, None; Absent, Francis Lucchio. GOOD AND WELFARE: WESTVIEW TERRACE #2 DRAINAGE: Mayor Smith asked if any of the members of the Council has anything they wished to offer under Good and Welfare. Councilman Cortesi brought up the matter of the corrective steps which Callen Company had taken on his neighbors property in Westview Terrace. This concerned a drainage dj:ch which water runs over. Council- man Cortesi stated that the work had been poorly done, cement has been spilled all over his neighbors garden and that the water was still lying in the back. He requested that an inspection of the work be made. It was agreed by Director of Public ~orks Goss that he would make such an inspection. PARKWAY TERRACE City Manage~ McClung then brought up the matter of a letter dated October 21, 1955 IMPROVEMEh~ CLUB received from Parkway Terrace Home Owners Association requesting a meeting with REQUEST FOR MEETING: the City Council. After some discussion Mayor Smith remarked that inasmuch as 57/? he could non be present at the time that possibly Vice Mayor Gamlen could set a date for the meeting. After some discussion the meeting was scheduled for October 27, 1955 at 4:30 p.m. City Manager Mc¢lung was instructed to notify the Parkway Terrace Home Owners Association.
