The meeting was called to order at 5:05 p. m. by Mayor Smith. Present: Councilman Francis Lucchio, Emilio Cortesi, Telford Smith Absenc: Councilmen Andrew Rocca, Richarc Gamlen (Councilmen Rocca & Gamlen appeared later in the meeting). The fLrst matter taken up by the council concerned department reports as receiwed from the City Clerk for the month of November and the revised October report, Police Department for the ~onth of November, Library for the month of November, Fire Department for the month of November, Health Department for the month of October, Poundmaster for the month of November, .Buildi~g Inspector for the month of November. Councilman Lucchio moved, seconded by Councilman Cortesi and regularly carried, that the reports be accepted and filed. Councilman Gamlen appeared at 5:07 p. m. and remained for the duration of the meeting. Next taken up were the reports as received from the office of the City Manager which were as follows: Leased ~?arking Lot: City Manager McClung explained briefly the ownership of lots as they existed, being owned by Jucge Thomas L. Bocci and F. D. Minucc_ani. A brief explanation was given concerning the agreeme~s made for the use of the lots as parking areas, the City accepting responsibility for the'payment of taxes. He also explained a communication dated Nov- ember 22, 1955 as received from Thomas L. Mocci concerning the future use of ~he lots and the termination of their use should they desire to build oh them. City Manager McClung recomxended the month-to-month basis as reqLested by the owners. Councilman Garalen then moved, seconded by CounciLman Cortesi and regularly carried, that the recommendation of the City Maflager be accepted. Gasoline Contracts: City Manager McClung taen explained the notification to the ~hell Oil Co. and Standard Oil Co. which had been made since they were to ,supply fuel products to the City. After brief explanation of the contracts to be entered into, Councilman Gamlen moved, seconded by Council- man Luc~hio and regularly carried, that the City Manager be authorized to enter i~to the contracts based on the bids opened in July. Mayor Smith remarke~ that if there were no objections, zhe City Manager's reports concerning this matter'would be filed. There being no objections, it was so ordered. Brentwood Gully: City Manager McClung explained his communication to the City of ~an ~runo concerning the drainage problem in Brentwood as a result of the development of Rollingwood. A meeting date had been suggested, but as y~t no date set. He remarked that a~other attempt would be made to get a~meeting date. Councilman Gamlen moved, seconded by Councilman Cortesi and regularly carried, that the report be accepted and placed on file. Linden Avenue Playground: City ~anager McClang explained the appraisal which h&d been received on the Thompson'property, and of his recent learning that the~Eschelbach holdings on Linden Avenue were for sale. He also ex- plained ~he investigation which was to be made of the square footage in ~he area-to determine the square footage cos;. Councilxan Rocca appeared at 5:23 p. m. and remained for the duration of the meeting. Councilman Gamlen then moved, seconded by Councilman Lucchio and regularly carried, 'that th~ report be accepted and placed on file. Library Addition: City Manager McClung summarized the subject matter, explaining that an attorney had been hired by the Beacon Construction Co. He also s~ated that it probably would be best for the solution to be worked ou~ between the attorneys. Councilman RocCa moved, seconded by CouncilmaO Gamlen and regularly carried, that the report be acaepted and placed om~file. City Attorney Lyons remarked that he hoped to have a conference with the Director of Public ~orks and suggested that either solution #1 or #2, as submitted by the attormey in his letter, be accepted. City Attorney Lyons further remarked that it ~as felt by the Director of Public Wo~'ks that #1 was the best solution to follow. Further discussion followed, after which Councilman Rocca moved, secmnded by Councilman Gamlen, ~]:d regularly carried, that the matter be referred to the City Manager ard City Attorney for a meeting to be held with the Beacon Cons- truction Metal & Tt~ermit Sewer Rental: City Manager McClung then explained the matter of the request made for sewer rental charge adjustment by the Metal & Thermit Co. He also explained the preliminary report first made and the final report made by the firm of Brown & Caldwell concerning the disposal f the plants fluid from tinning processes on their property. He also stated that approval had been received by the company from the Health Dep, City Mana~ of the Bro Schweining to this a~ justment ~rtment to dispose the fluid mentiored on their own property. er McClung remarked that a report had been made by Mr. Norgard ~n and Caldwell firm, as well as Supt. of Sanitation Henry for the chaZge of $1,490.00, and recommending the reduction )unt. He also recommended a refund of monies paid and an ad- on the billing. County Tax Collection: City Manager McClung explained the communication dated lecember 12, 1955 as received from the office of the County Manager, concerning the subject matter, as well as his memor~dum dated December 13, 1955. He remarked that if the council was satisfied with the County report, an ordinance should be adopted entering into a cQntract on a year-to-year basis. Councilman Rocca moved, secmnded by Councilman Gamlen and regularly carried, that the City Attor~.ey be instructed to prepare such ah ordinance. Electric Franchise Contract: After a brief explanation by the City Manager concerning the form letter which was sent out, Councilman Rocca moved, seconded by Councilman Gamlen and regularly carried, that the communication be accepted and placed on file. Staff ~eeting Minutes: Councilman Gamlen ~oved, seconded by Councilman Cortes' and regularly carried, that the Staff Meeting Minutes of December 7, 1955 be accepted and placed on file. Sewer ~ficiencies: Brief explanation was given by the City Manager, after which he reported that a further report would be forthcoming on the Jan- uary 3, 1956 agenda. Councilman Rocca moved, seconded by Councilman Gamlen and regularly carried, that the report be accepted and placed on file. .-.v-'-o// Mercury Vapor Lights: Brief explanation was given by the City Manager concerr.~ng the advisability of vapor lights to' be installed on Old MissioL Road and Grand Avenue to Spruce Avenue. He recommended council approv~.L to install the lights on the streets mentioned. Councilman Gamlen so moved, seconded by Councilman Rocca and regularly carried. State Agency Reports: Report was received from the Department of Alco- holic ~¥~rage Control concerning transfer of license at the Southern Restaurmnt and Town Liquors;. as well as Notice of Hearing before the Public Utilities Commission on the application of the Western Union Tel- egraph Co. Councilman Gamlen moved, seconded by Councilman Rocca and regularly carried, that the State agency reports be accepted and placed on file. Branch Library: City ~anager McClung remarked on the communication dated ~ecember 13, 1955 as received from the Librarian, stating that further information was to be received from the State Library Board, and recommended acceptance and filing of the communication with a request to the Library Board that the council be kept advised. Councilman Rocca so moved, seconded by Councilman Gamlen and regularly carried. Purchasing Restrictions: City Manager McCl~ng remarked that the writer could best explain the communication. Councilman Lucchio explained his memorandum dated December 12, 1955, concernLng the adoption of a resolution by the .2ouncil which would restrict purchases from firms where a City Official or Board Member might have a veste~ interest. Discussion followed after which Councilman Lucchio moved that tke city adopt the policy of prohibiting members of boards or commissions from receiving bids or offer- iag services to the City for remuneration from the City, or entering into contracts. Councilman Cortesi seconded the motion, after which further discussLon followed. Roll call vote was as follows: Councilman Rocca, No, sta~£ng he felt State law covered this xatter sufficiently; Council- man Lucchio, Aye; Councilman Cortesi, Aye; Oouncilman Gamlen, No, who remarked that the City was already protected by State law; Mayor Smith, No. ~AYFAIR AVENUE BRIDGE, SPRUCE AVENUE DRAINAGE: City Mar.ager McClung brought up the memorandum of the Director of Public '~orks da~ed December 20, 1955, concerning the matter of Spruce Avenue flooding, reading from the memorandum. The 2ity Manager recommended that muthorization be given the appropriate officials to construct a ditch along Spruce Avenue to prevent flooding of t~e area. Lengthy discussion took place, at which time, Councilman Cortesi voiced his objections as a property owner on the method of handling tme problem; after which Councilman Cortesi asked to be excused at 6:36 p. m. and received per- mission ms requested. Councilman Gamlen then moved, seconded by Council- man Rocca and regularly carried, that a 48" pipe be installed across Mayfair Avenue and that cleaning be done for a temporary drain as necessary. ROLLEY USE PER~IT: CHMCKING OF PETITIONS ~AZZA~rI REZONING: Mr. Rolley, Jr., present in the audience, then brought up the matter of his fathers' use permit, concerning the approval which was to be received from the Architectural Committee of the Planning Commission. After lengthy ~iscussion, Mr. Rolley was instructed to contact the Architectural Committee as soon as possible for the disposition of the subjeqt matter. City Clerk Rodondi then mentioned to the members of the City Council an extension of time would be necessary for the checking of signatures on the petitions which had been presented in the Mazzanti rezoning matter, since th~ work load and time limi~ did not permit there being checked immediately. Respectfully submitted, Approved: Mayor WAIVER OF CALL AND CONSE~ TO SPECIAL MEETING OF CITY COUNCIL OF THE CITY OF SOUTH SAN FKANCISCO ~e, the undersigned, being the Mayor and all the Councilmen of the City of South San Francisco, do hereby waive the calling of, and do therefore expressly consent to, a special meet- ing of said City Council to be held at its regular meeting place in the City Hall on Thursday, the 29th day oF December, 1955, at the hour of 5:00 o'clock p. m., so that said City Council may convene in emergency session for the purpose of considering and acting upon the following matters: The necessary of (1) requesting assistance from the San Francisco Distr. ict, Corps of i~ngineers, U. S. Army, in order to relieve the City of South San YranCisco from ~ very serious flood hazard (a) by removing sediment from a portion of Colma Creek and (b) by removing sediment from a portion of Spruce Avenue Creek; (2) authorizing the Director of Public ~orks to execute a formnl request addressed to smid Corps of Engineers on behalf of said City. Meeting was called as an emergency measure in order to make the City of South San Francisco eligible for Federal Emergency relief under public law. CounciLman Gamlen introduced, "A RESOLUTIOF OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DETERMINING AND DECLARING THE NECESSITY OF REQUESTING AID FRO~ THE UNITED STATES OF A~ERICA IN DREDGING PORTIONS OF COLMA CREEK AND SPRUCE AVENUE CREEK IN ORDER TO ELIMINATE A SERIOUS FLOOD HAZARD, AND INSTRUCTING THE CITY MANAGER TO EXECUTE A FORMAL WRITTEN REQUEST IN THAT REGARD.'
