Wall, of St Paul's Methodist Church. AND INVOCATION: ROLL CALL: Present: Absent: Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan None MINUTES Mayor Rozz: asked if there was a motion approving the minutes of the last regular meeting held Monday, December 3, 1956. Councilman Rocca moved, seconded by Coun- cilman RyLn and regularly carried, that the minutes be approved as submitted. CLAIMS: INDUSTRIAL PARK CLAIMS: Mayor Rozz~ then said that in addition to the regular claims for approval this evening, ~here were some claims that would recuire separate Council action. He then asked kf there was a motion approving the regular claims for payment as sub- mitted. Councilman Ryan moved, seconded by Ccuncilman Lucchio and regularly carried, =h&t the regular claims be approved ~s submitted. City Clerk Rodondi stated tha= the first set of claims for individual approval concerned those for Industria2 Park Subdivision No. 1, as follows: Claim received from A. Carlisle & Company dated November 30, 1956, for printing of 54 - 191~ Act Street Improvement Bonds .......... $308.36 Claim received from A. Carlisle & Company dated November 30, 1956, for one Bo~d Register & Binder .............. 53.41 Councilmaa Rocca asked if these claims were charged to the District, to which Director of Public Works Louis Goss stated that they were. Councilman Lucchio then moved, seconded by Councilman Rocca and regularly carried, that the claims as read by =he City Clerk be approved. City Clerk Rodondi then stated that the next set of claims concerned the South Canal ~nd Mayfair Avenue Assessment District as follows: SOUTH CANAL AND MAYFAIR AVE.CLAIMS: Claim received from Wilsey and Hmu dated November 30, 1956, for inspectkon services during construction, of Mayfair Ave. Bridge and additional engineering authorized ....... Claim received from Oscar C. Holmes, Inc. dated December 12, 1956, for removing concrete slab at Mayfair Ave. Bridge . . $651.91 63.62 Claim received from Oscar C. Holmes, Inc. dated November 23, 1956, for ~layfair Ave. Bridge Pavement Feathering ....... 198.00 Councilmaa Rocca again asked if these claims were borne by the Assessment District to which ~irector of Public Works Goss stated that they~ere. Councilman Lucchio then movet, seconded by Councilman Rocca and regularly carried, that the claims be approved for payment. City Clerk Rodondi then stated that the next claim was a claim received from H. T. Guerin for work which was done on the Winston Manor ov®wpass in the amount of $12,188.34, a claim against which a levy had been made. City Attorney Noonan remarked that the attac~]ent had n~ effect because it was an improper one and the claim could be paid. Councilman Lucchio then moved, seconded by Council~an Cortes/ and regularly carried, zhat the claim be approved for pay- ment. City Atterney Noonan then stated that e claim had also been received concer~ ing monie~ due the Sequoia Construction Company. He remarked that originally twenty percent retention was made in accordance with the contract to insure per- formance. In addition to the twenty percent, there was also posted a bond in the amount of $5,000.00 to assure labor and materials and to protect the City in the event of any attachments by reason of non-paynent of labor or material bills. He further stated that the City's usual policy r,quired a ten percent retention, and in view of the fact that the job was completed and the $5,000.00 bond was posted, he recommended that the usual ten percent retention be made and the rest of the money released to Sequoia Construction Company. Councilman Rocca then moved, sec- onded by ~ouncilman Ryan and regularly carried, that the recommendation of the City Attorney be accepted. RESOLUTION NO. 2435 COMMENDING VOLUNTEER FIREMEN: ~.~OLUTION NO. 2436 R~SERVE FOR COUNTY TAX COLLECTIONS: There beirg no public hearings, the Council t~en pro~eeded on to the item of Resolutio~s. The City Attorney explained the first resolution for Council atten- tion which concerned commendations to the'volunteer firemen and ordering the issuance of certificates of recognition for services performed. After a brief explanation by the City Attorney, Councilman Cortesi introduced "A RESOLUTION OF THE CITY COUNCIL iF THE CITY OF SOUTH SAN FRANCISCO COMI~ENDING THE VOLUNTEER FIRE- MEN AND C~.EERING ISSUANCE OF CERTIFICATES OF RECOGNITION." Roll call vote was as follows: Ayes., Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. City Attorney Noonan then explained the next resolution concerning the establish- ment of a working capital reserve. After a brief explanation, Councilman Lucch~o introduced a "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ESTABLISHING A WORKING CAPITAL RESERVE FOR EACH OF THE RESPECTIVE FUNDS SO THAT EXPENDITURES MAY BE PLANNED TO MEET RECEIPTS FROM COUNTY TAX COLLECTIONS." Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortes/, Lucchio and Ryan RESOLUTION NO. 2437 City Attorney Noonan explained the next resolution concerning the authorization AGREEMENT WITH CRYSTAL of an agreement between the City and the Crystal Springs Valley Model Engineering SPRINGS VALLEY MODEL Society, Inc., after which Councilman Rocca introduced a "RESOLUTION OF THE CITY ENGINEERING SOCIETY: COUNCIL~ THE CITY OF SOUTH SAN FRANCISCO A-JTHORIZING THE EXECUTION OF AN AGREE- ~J[~ MENT BETWEEN SAID CITY AND THE CRYSTAL SPRINGS VALLEY MODEL ENGINEERING SOCIETY, INC. WITE RESPECT TO SALE AND REMOVAL OF A B]ILDING." Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. RESOLUTION NO. 2438 AGREEl/ENT WITH SOUTH SAN FRANCISCO ROD AND GUN CLUB: fl 1 The next resolution as explained by the City Attorney concerned the execution of an agreenent between the City of South San F~ancisco and the South San Francisco Rod and Gnn Club. After a brief explanation by the City Attorney, Councilman Rya introduced a "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZ~FG THE EXECUTION OF AN AGREEMENT BETWEEN SAID CITY AND THE SOUTH SAN FRANCISCO ROD AND GUN CLUB WITH RESPECT TO SALE AND REMOVAL OF A BUILDING." Roll call vote was as follows: Ayes, Councilmen lozzi, Rocca, Cortesi, Lucchio and Ry RESOLUTION NO. 2439 ACCEPTANCE OF AGREE- MENT BY SYLVESTER RD. City Attorney Noonan then explained the next resolution concerning the execution of an agreement with the Associated Construction and Engineering Company on the widening of Sylvester Road, after which Councilman Rocca introduced a "RESOLUTION OF THE CETY COUNCIL OF SOUTH SAN FRANCISCO AUTHORIZING THE ACCEPTANCE OF AN AGREE MENT EXECUTED BY CERTAIN O~I~ERS ON SYLVESTER ROAD WITH RESPECT TO DEDICATION OF LAND AND ]iMPROVING THE CITY'S STREET AND SIEEWALKS." Roll call vote was as fol- lows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. RESOLUTION NO. 2440 ACCEPTING REVOCABLE PERMIT FROM S.F.WATER DEPARTMENT: ~1 ~ ~ The nex~ resolution as explained by the City Attorney concerned the acceptance of a RevocabLe Permit from the San Francisco Water Department concerning the storm drain in Vinston Manor #3. Brief discussion followed, at which time, Councilman Lucchio asked Director of Public Works Goss as to the amount of work which the City was to do. After discussion, Councilman Lucchio introduced a "RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ACCEPTING A REVOCABLN PERMIT FROM THE SAN FRANCISCO WATER DEPARTMENT OF THE CITY AND COUNTY OF SAN FRANCISCO." DISTRICT NO. 1: City Attorney Noonan then explained the next resolution concerning the amendment to the Contract for Work and Improvements being done in the Industrial Park Imprc ment District No. 1. RESOLUTION NO. 2444 REQUESTING VOTE ON SALES & USE TAX: The last resolution for Council attention concerned the Sales and Use Tax, re- questing the County Board of Supervisors to place the matter on a ballot. After explanation by the City Attorney, Countil~an Ryan introduced a "RESOLUTION OF THE CITY COUNCIL OF SOUTH SAN FRANCISCO R~.Q'~STING THAT THE SAN i/ATEO COUNTY BOARD O~ SUPERVISORS. REFER THE i/ATTER OF A ~ALES AND USE TAX TO THE VOTERS OF T~ COUNTY." Roll call vote was as follows: Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan - all ayes. ORDINANCE NO. 408 AMENDMENT TO PERSONI~L ORDINANCE NO. 216 SECTION 7: .~/~~ The Council then proceeded on to the matter of ordinances, there being only one for Cour. cil attention at this time and whic~ concerned the second reading and adoptior of an ordinance amending Personnel Ordinance No. 216, Section 7. City Attorney Noonan stated that the motion could be made waiving the detailed readin! and that it could be adopted by the reading of the title only. Councilman Rocca so movec, seconded by Councilman Lucchio and regularly carried. City Attorney Noonan then read the title of the ordinance after which roll call vote on adopti~ was as follows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. SUB. #2: SUSDIVISION ALVISO VARIANCE APPLICATION: Inter-office memorandum dated December 12, L956, was received from the Planning Commission advising of action taken by Planning Commission, recommending approval of subdivision subject to certain conditions. Inter-office memorandum dated December 12, 1956, was received from the Planning Commiss2on, advising of action taken by Plaaning Commission regarding tentative subdivision map. Variance tPplication No. 661, as applied for by Steve Alviso, was received from the Pla~.ning Commission reco~ending denial of a request for a 3-foot sideyard on two sides instead of the required 5-foot at 650 Baden Avenue. Use permit Resolution No. 664, as applied for by the Bank of America, was re- ceived frca the Planning Commission, recom~end:ng that permission be granted for the erection of a single face illuminated plas:ic sign 3 ft. 5 in. by 30 ft. 6 in. on leading front face of building at 1119 E1Camino Real, as per plot plan on sign sketch,' provided it does not conflict with pending Sign Ordinance. Use Permi= Resolution No. 666, as applied for by Lloyd Ham for the Texas Company, was received from the Planning Commission, recom~ending that permission be granted for one Texas Company banjo style sign, 6 ft. in diameter, and one 4 ft. by 33 ft. 10 inches Texaco Highway sign with letters internally illuminated by neon tube, Located at 110 Hickey Boulevard, as specified in the Use Permit for the service station, filed previously. Councilman Rocca then moved that the recommendations of the Planning Commission in the above-mentioned matters be accepted. Communicazion dated December 3, 1956, was received from Giovanni Uccelli, re- questing :he City to erect a fence between his property and the City Park. Mayor Rozzi remarked that if there were no objections, this matter would be re- ferred to a meeting which was to be held with the City Manager, himself and the inter~sted parties, and anyone else who wished to attend. No objections were registered. Communiea;~on dated October 26, 1956, was received from Mrs. Theresa Uccelli requestin~ the City to erect a fence between her property and the City Park. Mayor Rozzk remarked that if there were no objections, this ~atter would be held over for a meeting which was to be held with the City Manager, himself and the interested parties, and anyone else who ~ished to attend. No objections were registered, Communication dated December 7, 1956, was received from Ralph Caffey, pastor of the First Southern Baptist Church, concerning the use of a building at 800 Grand Avenue f~r a classroom on Sunday morning, re~uesting the waiver of certain res- trictions in connection therewith. Accompanying the communication was a report dated December 13, 1956, as submitted by NelLo Certiberi, Assistant Building Inspector, and William A. Fox, Jr., captain of the Fire Prevention Bureau, con- cerning certain items which should be corrected before the use of the building was allowed. Brief discussion followed, at which time, Reverend Caffey spoke, after wtich Mayor Rozzi remarked that if there were no objections, an on-the-site meeting vould be arranged with the City Manager, Building Inspector, Fire In- spector, himself, Reverend Caffey, and any Councilmen who wished to attend. No objections were registered. Mayor Rozzi then instructed City Manager Aiello to notify those concerned as to the meeting date. A claim was received against the City of South San Francisco, as filed by Philip Adams, attorney at law, in behalf of Mildred Yeager, for injuries suf- fered by her son, Paul, at the Brentwood Playground. Councilman Ryan moved, secondec by Councilman Rocca and regularly carried, that the claim be denied and referred to the City's insurance carrier. Communication dated November 14, 1956, was received from Edwin G. Coopman, re- questing a divided assessment against property at the corner of Spruce Avenue and Sou=h Canal Street, being assessment #5 in the South Canal and Mayfair Avenue Improvenent District. Mayor Rozzi remarked that if there were no objections, the mat~er would be referred back to the Planning Commission for study and report. No objections were registered. Brief discussion followed concerning the subject matter. Proceedin4 on to reports, the Council then took up the inter-office memorandum dated December 11, 1956, as received from Ckty Attorney Noonan, which concerned the Winston Manor No. 1 storm drainage problem. Mr. Noonan explained the meet- ing which was herd with the Stoneson Development Company, concerning the problem, after which he stated he would like to have the Council approve the authoriz- ation of the City to prepare a lawsuit at the first of the year. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that in view of the lor~ negotiations, on and on and on in :his matter, .the City Attorney be instructed to take whatever steps necessary, including Court proceedings if necessary, in order to get Stoneson to fulf~11 his obligation in Winston Manor #~ Inter-office memorandum dated December 7, 1956, was received from Director of Public 'orks Louis Goss concerning the finn'[ acceptance of Brentwood Park storm drain, recommending acceptance of the work and authorization of final payment - ........ + ~+..+i~n ~ 35 days. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that in view o the long negotiations, on and on and on in this matter, the City Attorney be instructed to take whatever steps necessary, including Court proceedings if necessary, in order to get Stoneson to fulfill his obligation in Winston Manor Inter-office memorandum dated December 7, 1956, was received from Director of Public Works Louis Goss concerning the final acceptance of Brentwood Park stor drain, recommending acceptance of the work and authorization of final payment with ten percent retention for 35 days. Yde, tendering her resignation as Assistant Librarian, effective December 31, 1956. Monthly reports were received from the Police Department, Building Department, Fire Depar=ment, Library and City Clerk for the month of November. Councilman Ryan asked Planning Commission secretary Anita Ro~ertson, present, if the Planning Technician recently hired was relieving some of the duties, to which she replied tha= it was. Letters as received by the City from Mr. James C. Cherry, secretary of the Sou~ San Francisco Unified School District, Raymond DeJong, coach of the South San Francisco High School football team, and Pete Engbretson, Student Body President of the South San Francisco High School, were read by the City Clerk. Ail of the comm~nications expressed thanks to the Mayor and members of the City Council for the City's presentation of the plaque and individual certificates of recog- nition to the high school football team for winning the N'PAL co-championship for 1956.
