HomeMy WebLinkAboutMinutes 1957-02-18REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, FEBRUARY 18, 1957 TI~E: PLACE: 8:00 p.m. Council Chambers, City Hall CALL TO ORDER: The meeting was called to order by Mayor Rozzi at 8:05 p.m. PLEDGE OF ALLEGIANCE TO THE FLAG AND INVOCATION: Pledge of Allegiance to the Flag was recited, after which invocation was given by Councilman Lucchio in the absence of Reverend Samuel Blackman of the Friends! Baptist Church. ROLL CALL: Present: Absent: Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan None MXNUTES: ~ Mayor Rozzi asked if there were any errors, omissions or corrections to the minutes of the regular meeting of February 4, 1957. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the minutes be approved as submitted. CLAIMS: Mayor Rozzi remarked that, in addition to the regular claims, there were three claims which required separate action and would be taken up after completion of the approval of the regular claims. Councilman LucchiO moved, seconded by Coun. cllman Cortesi and regularly carried, that the regular claims as submitted be approved for payment. ENTERPRISE-JOURNAL CLAIM: Mayor Rozzi then requested the City Clerk to read the claims which required separate Council action. The first was a claim from the Enterprise-Journal da,, February 1, 1957, in the amount of $19.20 for Notice of Filing Assessment on th, South Canal & Mayfair Ave. Improvement District. Councilman Ryan moved, secon~ by Councilman Rocca and regularly carried, that the claim be approved for payme: FAY IMPROVEMENT CO. The next two claims were as follows: CLAIMS: I ..~(q) */ Claim of Fay Improvement Company dated January 4, 1957, in the amount of $6.77 for subgrading in the South San Francisco Xldustrial Park Unit No. 1. Claim of Fay Improvement Company dated January 5, 1957, in the amount of $665.41 for Saturday overtime work on South San Francisco Industrial Park Unit #1. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the claims be approved for payment. SOUTH CANAL & MAYFAIR The Council then proceeded on to the matter of public hearings, taking up the IMPROVEMENT DISTRICT divided assessment for the South Canal and Mayfair Avenue Improvement District. PUBLIC HEARING: After a brief explanation as to the procedure as explained by the City Attorney ~ ~ John Noonan, Councilman Ryan moved, seconded by Councilman Rocca, that the hear: be opened. Since this did not require Council motion, Mayor Rozzi opened the public hearing and asked if any written protests had been received, to wMch th, City Clerk replied that none had been received by his office. Mayor Rozzi then asked if anyone in the audience wished to protest the public hearing. No prote~ were registered. Councilman Ryan then moved, seconded by Councilman Lucchio an. regularly carried, that the hearing be closed. City Attorney Noonan then ex- RESOLUTION NO. 2458: plained the resolution which had been prepared concerning the divided assessmen %~ after which Councilman Lucchio introduced "A RESOLUTION OF THE CITY COUNCIL OF - THE CITY OF SOUTH SAN FRANCISCO CONFII~ING A DIVIDED ASSESSMENT WITH RESPECT TO A PORTION OF THE AREA INCLUDED WITHIN THE DISTRICT DEFINED IN RESOLUTION OF INTENTION NO. 2207":. Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. "ENGINEERS WEEK" PROCLAMATION: D~C, Proceeding on to the next item under resolutions, City Attorney Noonan explaine the proclamation designating February 17 to 23, 1957, as "Engineers Week". T~ not requiring any Council action, Mayor Rozzi remarked that the proclamation would be issued accordingly. RESOLUTION NO. 2459: CREATING SOUTH S.F. REDEVELOPMENT AGENCY The next item on the agenda, although not appearing as a resolution, concerned the creation of the South San Francisco Redevelopment Agency. In accordance wi the request of Councilman Lucchio, City Attorney Noonan read the resolution in full, after which Councilman Rocca introduced "A RESOLUTION OF THE CITY COUNCIL OF TME CITY OF SOUTH SAN FRANCISCO CREATIN~ THE SOUTH SAN FRANCISCO REDEVELOPME AGENCY'. Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortes Lucchio and Ryan. MEETINGS WITH DOWNTOWN MERCHANTS ASSN ON PARKING DISTRICT AND URBAN RENEWAL: y/ i At this time, Mayor Rozzi remarked that the Downtown Merchants Association desi to have a meeting with the members of the City Council concerning the matter of the parking district and urban renewal. He further stated that with Council pe mission, he would request the City Manager~to arrange a meeting this week for the Downtown Merchants and in two weeks for the urban renewal. The meeting wit the Downtown Merchants was tentatively scheduled for Thursday evening, February 21, 1957. TRAFFIC REGULATION AND TRUCK ROUTE ORDINANCE FIRST HEADING: Proceeding on with ordinances, City Attorney Noonan took up the first as listed on the agenda concerning the regulati~n of traffic upon the public streets of the City and establishing truck routes. He briefly explained the change from t original ordinance which had received its first reading and introduction at the last meeting, Stating that Section 8 in that ordinance was to be taken out. He further remarked that this ordinance would be re-introduced, having a first rea ing, and suggested that a motion could be entertained that the detailed readint be waived and the ordinance introduced by title only. Councilman Rocca so move seconded by Councilman Lucchio and regularly carried. City Attorney Noonan the read the title of the ordinance, after which it was introduced by Councilman Ryan. ORDINANCE SETTING FIVE-MEMBER RECRE- ATION COMMISSION FIRST READING: ,,~ ORDINANCE REGULATING STORE CLOSING HOURS FIRST READING: ORDINANCE REGULATING STORE CLOSING HOURS FIRST PANIGIRIS VS. PERMIT~~o ASSOCIATED CONSTRUC- TION & ENGINEERING COMPANY USE PERMIT: The next ordinance concerned the amendment to 3ection 1 of Ordimnce No. 212 concerning the creation of a Recreation Commission for the City. This amendmel provided for the Commission to consist of five members. City Attorney Noonan read the ordinance in full, after which a brief explanation was given by Mayor Rozzi. After further discussion had taken place, Councilman Ryan introduced the ordinance. The next ordinance for Council attention concerned the repealing of Ordinance No. 169 regulating the hours of closing for retail stores. After a brief expll ation by the~City Attorney, he suggested a motion that the detailed reading be waived and the ordinance be introduced by the reading of title only. Councilm~ Lucchio moved, seconded by Councilman Ryan and regularly carried, that the detailed reading be waived and the ordinance introduced by the reading of titl~ only. City Attorney Noonan then read the title of the ordinance, after which it was introduced by Councilman Lucchio. The last ordinance for Council attention concerned an ordinance repealing Ordii ance No. 170 which regulates the hours of closing for retail stores. After a brief explanation by the City Attorney, Councilman Ryan moved, seconded by Com cilman Cortesi and regularly carried, that the detailed reading of the ordinam be waived and that it be introduced by title only. City Attorney Noonan then read the title of the ordinance, after which it was introduced by Councilman Ryan. Summons and Complaint for Damages ~74083 was received, as filed by Alexandria Panigiris versus the City of South San Francisco. City Attorney Noonan stated that the complaint and stmmons should be denied and referred to the City's insurance carrier, Councilman Ryan then moved, seconded by Councilman Lucchio and regularly carried, that the matter be denied and referred to the City's insurance carrier. Communication dated February 8, 1957, was received from Michael Minucciani tendering his resignation as a member of the Planning Commission for the City, inasmuch as in the very near future he anticipated taking a trip which would cause him to be absent from the City for a period of approximately six months. Councilman Lucchio moved,that the resignation be accepted regretfully. Coun- cilman Ryan suggested that a Certificate of Merit be issued, after which Counc: man Lucchio accepted it as an amendment to his motion. Motion as made and amended was seconded by Councilman Rocca and regularly carried. At this time Councilman Lucchio commended Mr. Minucciani for the assistance and efforts whi~ he gave as a member of the Planning Commmissionfor the betterment of the City. Mr. Mlnucciani, present in the audience, remarked that it was a pleasure to have served as a member of this Commission and pledged his assistance in the future. Inter-office memorandum dated February 13, 1957, was received from the Planninl Commission recommending that consideration be given to the extension of Butler Road to the Beach, 'permission to be obtained from the Public Utilities Commiss: to cross the Southern Pacific Railroad crossing. Councilman Rocca remarked thl in the study session earlier this afternoon, it was felt that the matter shoul~ be held over for further study by the City Manager and City Engineer. Mayor Rozzi remarked that if there were no objections, this matter would be held ove~ for further study by the offices mentioned. No objections were registered. Inter-office memorandum dated February 12, 1957, was received from the Plannin~ Commission together with their resolution #683 recommending that Parcels 7A an, 8, Zone E, be rezoned from R-1 and R-3 to PCM, a portion of the property to be used for additional stables. Councilman Ryan reflected on the statement of th~ Planning Commission's recommendation concerning the rezoning, relative to the matter of a portion of the property being used for additional stables. He further stated that it should be publicly stated for the record that in approv: this recommendation, the Council in no way intended to approve of the general use of this area for stables inasmuch as the need existed for parking. Council man RYan then went on to explain the traffic conditions along Spruce Avenue as a result of the parking of automobiles during the racing season, again mention: that in no way did this approval constitute the Council's intent to have the area used for stables. He further remarked that this would require a Use Perm: Brief discussion followed, at which time, Mrs. Robertson, secretary of the Planning Commission, spoke on the subject matter. City Attorney Noonan sUgges' that a resolution of intention be introduced to rezone the area which would also call for a public hearing as required by law and notice to be published for the general public. Further brief discussion followed, after which Council man Ryan introduced "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLiRING ITS I~ENTION TO AMEND ZONING ORDINANCE NO. 353 SO AS TO REZONE PARCELS 7A AND 8, ZONE E, TO PCM AND SETTING THE REQUIRED PUBLIC HEARING". Roll call vote was as follows: Ayes, Councilman Rozzi, Rocca, Cortesi, Lucchio and Ryan. Use Permit Resolution No. 685, as applied for by G. Mantegani, was received frol the Planning Commission recommending that permission be granted for the con- struction of a truck and flower shed 26 ft. by 40 ft. and a storage shed 12 ft by 16 ft. located at 741 Chestnut Avenue, to replace the existing temporary structures, subject to certain conditions. Councilman Rocca moved, seconded b' Councilman Ryan and regularly carried, that the recommendation of the Planning Commission be accepted and proceed accordingly. Use Permit Resolution No. 686, as applied for by the Associated Construction a Engineering Company, was received from the Planning Commission, recommending that permission be granted for a temporary construction sign 8 ft. by 16 ft., located at E1Camino Real and Camaritas Avenue, to advertise the building of a new super market for Quality Foods, Inc., provided the sign is removed upon completion of the building. Councilman Rocca moved, seconded by Councilman Ry and regularly carried, that the recommendation of the Planning Commission be accepted. MILLER & ORANGE DRAIN: Inter office memorandum dated February 6, 1957, was received from Director of Public Works Goss, concerning the acceptance of the Miller Avenue and Orange Avenue storm drain, recommending the acceptance of the work subject to the pos ing of a maintenance bond to guarantee the improvements and that payment be made to the Callan Construction Company in accordance with the terms of the agreement dated October 18, 1956. Mayor Rozzi remarked that if there were no objections, Shis matter would be held over and referred to the Director of Public Works' and City Manager, and City AttOrney, for study and report. CROCKER SCHOOL OVERPASS HILLSIDE BOULEVARD: Inter office memorandum dated February 13, 1957, was received from Director of Public Works Goss concerning the proposed Crocker School overpass at Hillside Boulevard, recommending that the plans for this construction as submitted by the School District's architects be approved. Councilman Lucchio moved that upon the filing with the City Clerk a Resolution of the Trustees of the South San Francisco Unified School District, acknowledging notice of the fact that the proposed overpass to the site known as the Crocker School location may hav to be modified and/or extended by reason of modification, realignment or other change in Hillside Boulevard, or location of another highway, and further ackn 1edging and agreeing that any modification or extension of said overpass shall be the responsibility of the Unified School District with no obligation accrui to the City of South San Francisco, the plans as submitted and approved by the Director of Public Works shall stand approved by the City Council. Councilman Rocca seconded the motion which was regularly carried. JOSEPH MANAREZ APPOINTMENT TO RECREATION CO ISSION: At this time, Mayor Rozzi remarked that he wished to make an appointment to th Recreation Co~mission, appointing Joseph Manarez as the fifth member of the Recreation Commission. No objections were registered. Brief discussion follo concerning the status of membership of the Recreation Commission, the question having been asked by Mr. Olson, presently a member of the Commission, after which Mayor Rozzi replied that the appointment was to take effect after the adoption of the ordinance. MONTHLY REPORTS: Monthly reports for the month of January 1957 were received from the offices of the City Clerk, Police Department, Fire Department, Building Inspector, PoUnd- keeper, Library and San Marco County Health Department. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the reports be accepted and placed on file. APPLICATION FOR Application for transfer of alcoholic beverage license was received from the TRANSFER OF ALCOHOLIC Department'of Alcoholic Beverage Control as applied for by Marino R. Donati, BEVERAGE LICENSE: ANGELO CANZIANI LEAVE OF ABSENCE: f. O CC Julio A. Donati and Gus W. Speridon, to conduct the Buri Burl Liquors at 11 Cai aritas Avenue. Brief discussion followed, after which, there being no object- ions, the application as received was accepted and placed on file. At this time, City Manager Aiello brought to the Council's attention a request from Angelo Canziani, a member of the FireDepartment, for a leave of absence from May 1, 1957 to November 1, 1957, in order that he and his wife might make a trip. This carried the written approval of the Fire Chief. Councilman Ryan moved, seconded by Councilman Rocca, that the request be approved. Councilman Lucchio stated that th*s did not include payment of salary during his absence, to which the City Manager remarked that it did not include any remuneration by the City during the six months absence. GOOD & WELFARE: MISSION & CHESTNUT RAILROAD CROSSING: Mayor Rozzi then asked if any of the members of the Council had anything they wished to offer under Good and Welfare. Councilman Ryan asked the City Manage: what was being done concerning the traffic signals at E1Camino and Chestnut Avenue. City Manager Aiello explained the calls which were made every week, during which time the Police Chief and Captain of Police and himself took turm in making these calls. He stated that the matter was out to bid now and that the City should be hearing from the Division of Highways very shortly. Councilman Cortesi asked if anything had been heard concerning the railroad crossing at Chestnut Avenue and Mission Road which he considered a dangerous intersection. City Manager Aiello stated that the matter had been referred to the superintendent of the area who was to take care of it and that he would also follow through on the matter. ~ Councilman Lucchio at this time commended the members of the Recreation Com- mission for the efforts which they put forth in their work, also extending his commendation to any of the members of the various commissions or boards who are serving the City, stating that the work oftentimes went unnoticed by the general public. Councilman Lucchio also announced at this time that the City had recently com- ,~-~-~pleted a new dog pound. He briefly compared the former pound operated by the City with the new one now in existence. He suggested to the people of the Cit] who did not have pets that they could call at the pound and procure the pet they desired, keeping in mind, however, the ordinance governing the keeping of pets and animals within the City. Mayor Rozzi then asked if anyone in the audience had anything they wished to offer under Good and Welfare. No response was received. City Manager liello explained the calls which were made every week, during which time the Police Chief and Captain of Police and himself took turn in making these calls. He stated that the matter was out to bid now and that the City should be hearing from the Division of Highways very shortly. Councilman Cortesi asked if anything had been heard concerning the railroad crossing at Chestnut Avenue and Mission Road which he considered a dangerous intersection. City Manager Alello stated that the matter had been referred to the superintendent of the area who was to take care of it and that he wmld also follow through on the matter. Councilman Lucchio at this time commended the members of the Recreation Com- mission for the efforts which they put forth in their work, also extending his commendation to any of the members of the various commissions or boards who are serving the City, stating that the work oftentimes went unnoticed by the general public. Councilman Lucchio also announced at this time that the City had recently com- ,~pleted a new dog pound. He briefly compared the former pound operated by the City with the new one now in existence. He suggested to the people of the Cit who did not have pets that they could call at the pound and procure the pet they desired, keeping in mind, however, the ordinance governing the keepin~ of pets and animals within the City. Mayor Rozzi then asked if anyone in the audience had anything they wished to offer under Good and Welfare. No response was received. ADJOURNMENT: ..... ' .....
