Council Chambers, City Hall CALL TO ORDER: The meeting was called to order by Mayor Rozzi at 8:09 p.m. PLEDGE OF ALLEGIANCE TO THE FLAG AND INVOCATION: Pledge of Allegiance to the Flag was recited, after which invocation was given by Reverend Theodore Wall of St. Paul's Metmodist Church. ROLL CALL: Present: Absent: Councilmen G. J. Rozzi, Andrew Ro:ca, Francis Lucchio and Leo J. Ryan. Councilman Emilio Cortesi. MINUTES: Mayor £ozzi asked if there were any errors, omissions or corrections to the minutes of the regular meeting of May 20, 1957, and the special meeting of May 2. 1957. Councilman Rocca moved, seconded by 3ouncilman Ryan and regularly car- ried, that the minutes as submitted for the regular meeting of May 20th and the special meeting of May 24th be approved. CLAIMS: Mayor Bozzi then asked if there was a motion approving the regular claims as submitted for payment. Councilman Lucchio noved, seconded by Councilman Rocca and regularly carried, that the regular claims be approved for payment. FAY IMPROVEMENT COMPANY CLAIM: Mayor Bozzi then stated that separate action was necessary on a claim for Industrial Park Unit No. 1. City Clerk Rodondi remarked that a claim dated May 31, 1957, had been received from the Fay Improvement Company for work com- pleted ~o date on Industrial Park Unit No. I in the amount of $41,918.51 and that ii; carried the approval of the Director of Public Works and Mr. Smart of Wilsey & Ham. Councilman Rocca moved, seconded by Councilman Lucchio and regu- larly carried, that the claim be approved for payment. DOWNTOWN PARKING DISTRICT PUBLIC HEARING: RESOLUTION NO. 2488 CANCELLATION OF UNSOLD IMPROVEMENT BONDS SOUTH CANAL & MAYFAIR AVE.: Mayor Bozzi stated that no action was to be taken on the Downtown Parking Distri which appeared under Public Hearings, as this matter was to be discussed the followk~g evening at an adjourned meeting. Proceeding on to resolutions, City Attorney Noonan explained the first which was ready for Council action and concerned the cancellation of certain unsold improvement bonds for the work done on South Canal and Mayfair Avenue. After a brief explanation, Councilman Rocca introduced "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ORDERING THE CANCELLATION OF CERTAIN UNSOLD IMPROVltl/ENT BONDS, TOGETHER WITH ATTACHED COUPONS, UPON THE PAR, OR FACE, VALUE THEREOF BEING PAID IN FULL." Roll call vote was as follows: Ayes, Coun- cilmen 3ozzi, Rocca, Lucchio and Ryan. Noe~, None. Absent, Councilman Cortesi. RESOLUTION NO. 2489 SALE OF BONDS SPECIAL ASSESSMENT SOUTH CANAL & MAYFAIR AVE.: The ne::~ resolution ready for Council action, as explained by the City Attorney, concerned the sale of bonds issued in connection with the special assessment proceedings for the improvement work done on South Canal and Mayfair Avenue. After explanation by the City Attorney, Co~ncilman. Lucchio introduced "A RES- OLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR THE SAL~ OF THE BONDS ISSUED IN CONNECTION WITH THE SPECIAL ASSESSMENT PRO- CEEDINGS CONDUCTED PURSUANT TO THE PROVISICNS OF RESOLUTION OF INTENTION NO. 2207." Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Lucchio and Rya~. Noes, None. Absent, Councilman Cortesi. PROCLAMATION COMMENDING BAY VIEW FEDERAL SAVINGS & LOAN ASSN: RESOLUTION NO. 2490 City A==orney Noonan then explained the proclamation which had been prepared commending Bay View Federal Savings and Loan Association for establishing a branch off their financial institution in t~e City of South San Francisco. No Council ~ction was necessary. The lasz resolution for Council action concerned the authoriza~on of an AUTHORIZING AGREEMENT agreemen~ between the City and A1Bertetta with respect to sewer connections. BETWEEN CITY AND After an explanation by the City Attorney, Councilman Ryan introduced AL BERTETTA FOR "A RESOLUTION OF THE CITY COUNCIL OF SOUTH SAN FRANCISCO AUTHORIZING THE SEWER CONNECTIONS: EXECUTION OF AN AGREEMENT BETWEEN SAID CITY AND AL BERTETTA WITH RESPECT TO ~ SEWER CONNECTIONS." Roll call vote was as follows: Ayes, Coumilmen Rozzi, ~ Rocca, Lucchio and Ryan. Noes, None. Absent, Councilman Cortesi. Councilman Ryan ~) then moved, seconded by Councilman Lucchio and regularly carried, that the de- tailed reading be waived and the ordinance be introduced by the reading of the title. City Attorney Noonan then read the title of the ordinance which was as follows: "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO PROHIBITING PARK- ING ON THE SOUTH SIDE OF RAILROAD AVENUE BETWEEN MAPLE AND LINDEN AVENUES.~ L I NDENV I LLE INTERCEPTOR The firs~ item of business for Council attention concerned the Lindenville sanitary sewer, plans, specifications and cost estimates for the construction of the proposed interceptor sewer having previously been submitted by the Director of Public Works at the meeting of May 6, 1957. Communication from Haas-Haynie-Utah dated May 24, 1957, together with a communication dated May 28, 1957, from Zellerbach Paper Company and inter office memorandum dated May 31, L957, from the Director of Public ~orks, were received concerning the subjec~ matter. Brief discussion followed concerning the need for a larger sewer, ~Ae to the developments taking place, after which Councilman Lucchio moved, seconded by Councilman Ryan and regularly carried, that the plans and specifications as submitted by the Director of Public Works be accepted and he be authorized to call for bids. GEORGE KNEESE USE PERMIT: HARBOR WAY ASSESSMENT DISTRICT: PROPOSED COLMA REZONING: SPRUCE AVENUE BUFFER ZONE: PROPOSED ZONING ORDINANCE APPROVAL OF TENTATIVE VIEW MONT SUBDIVISION MAP: EXTENSION OF PONDEROSA ROAD, PINEVIEW CREST SUBDIVISION: C. W. VIER VARIANCE APPLICATION: NEESON USE PERMIT: (SPERRY & HUTCHINSON) FINAL ACCEPTANCE COUNTRY CLUB MANOR IMPROVEMENTS: 12 MILE HOUSE A.C. FIREWORKS LICENSE: Use Per~Lt Resolution No. 714, as applied for with the Planning Commission by George A. Kneese, requesting permission to erect a building for use as a tavern for on-sale liquor establishment, which previously came to the attention of the Council at their meeting of May 6, 1957, again came up for Council action. City Attorney ¥oonan explained the action which c~uld be taken by the City concerning the resc~r.ding of the previous motion and subsequent Council action, after which Councilnan Ryan moved, seconded by Councilman Rocca and regularly carried, that the previous action taken by the Council be rescinded. Councilman Lucchio voted no. Cou~cilman Ryan then moved, seconded by Councilman Rocca, that the recom- mendati~ of the Planning Commission as previously submitted be approved. Brief discuss~on followed concerning the reasons for the action taken by the Council, after w~ich roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca and Ryan. ~oes, Councilman Lucchio. Absent, Councilman Cortesi. The nex~ 2rem for Council action appearing ~nder new business was the matter of the Harbor Way Assessment District. Mayor Eozzi remarked that if there were no objections, this matter would be held over, since the petition had not as yet bee received ~rom the property owners in the area. No objections were registered. Inter office memorandum dated May 20, 1957, was received from the Planning Com- mission concerning the proposed zoning of ar. area between Old Mission Road and E1Cami~o Real in Colma, suggesting that the Council take steps to prevent this, since it ~as felt the zoning would be det~i~ental to the City. As was explained, the City ~anager, at the request of the Cour.cil, had already communicated with the City Officials of Colma notifying them of the City's opposition to the use o~ the are~ as proposed and suggesting that it be rezoned to a more adaptable use. At the request of Mayor Rozzi, the City Manager explained the steps already take~ in registering a protest, after which Mayor Rozzi again instructed the City Man- ager to meet with the City Officials of Colna and express the City's desires in the matter. Inter office memorandum dated May 20, 1957, was received from the Planning Com- mission concerning the planting for 15 feet of the 50-foot buffer strip on Spruc~ Avenue, as recommended by the Supt. of Parks & Recreation. Mayor Rozzi remarked that if there were no objections, this matter would be held over pending a meeti~ which was to be arranged by the City Manager between the property owners affected No objections were registered. The City Manager was then instructed to arrange such a meeting. Resolution No. 721 was received from the Planning Commission, passed and adopted at their regular meeting held May 27, 1957, recommending that Zoning Ordinance NO. 35~ be amended to include standards for hillside residential subdivisions. Councll~mn Ryan moved, seconded by Councilm~n Rocca and regularly carried, that the reco~mendations of the Planning Commission be accepted. The City Attorney was requested to draw the appropriate amendment to the ordinance. Discussion followed, at which time, Mr. Harry Smith, representing the Peninsula Contractors & Builders Association, spoke requesting Council action be delayed until he and Mr. DoyLe of the San Francisco office had time to submit their recommendations i writing. There being no objections, this vms agreeable to the Council. Mayor Rozzi ~hen instructed the City Attorney to hold up the preparation of the amend- ing ord~r.ance until such time as the written recommendations had been received from the Contractors & Builders Association. Inter e~ice memorandum dated May 29, 1957, was received from the Planning Com- mission advising of their approval of the View Mont tentative residential sub- divisio~ map as revised May 25, 1957. Councilman Ryan moved that approval be given ~e tentative residential subdivisio~ map as submitted by the Planning Com missio~ and that the School Board and Recreation Commission be sent copies of the te~';ative approved map, noting that certain restrictions, conditions or pro- visions hav~ been made by the Planning Com~ission. Brief discussion followed, after w~ch Councilman Rocca seconded the ~otion which was regularly carried. Inter office memorandum dated May 29~ 1957, was received from the Planning Com- mission, requesting that the City Council employ the necessary people to prepar~ estimates of costs and condemnation for the extension of Ponderosa Road. Dis- cussioa ~ollowed, at which time, residents of the area spoke, after which Mayor Rozzi remarked that the City Manager had been requested to contact the develope~ in an .~ffort to work out the necessary detLils concerning the extensions of Ponderosa Road and that if there were no objections, the City Manager would be instru~ted to do so. No objections were registered. Variance Application No. 719, as applied for by C. W. Vier, was received from the Planning Commission, recommending that permission be granted for a 6-foot e~ croach~e~t into the required 20-foot rear yard located at 357 R~d~ood Drive, fo~ the construction of a laundry, drying and storage room. Councilman Rocca moved~ seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Commission be accepted. Use Permit Resolution No. 720, as applied ~or by John J. Neeson, was received f~ the Planning Commission, recommending that permission be granted to erect a Pyl~ type sign, the top of which is 65 ft. above grade with 3 exposed legs extending above the sign height 3'6", 6' and 12', located at 900-940 Dubuque Avenue, subj~ to ~ertain conditions. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Commission be accept~ CommuL~.cation dated May 28,1957, was received from Francis Brown of Brown and Cartwr~ht, Builders, requesting final acceptance of all street improvement in Country Club Manor. Council Lucch~o moved, seconded by Councilman Rocc~ and regularly carried, that the rec, mendat~on of the Director of Public Works be accepted upon the posting of the necessary bonds and the execution of the agreement. Communication dated May 28, 1957, was received from the 12 Mile House A.C., Inc reques~ing a City license to sell fireworks at the corner of Mission Road and Grand Avenue from June 28 to July 6, 1957, also requesting that the fee be waived. Councilman Rocca moved, seconded ~y Councilman Ryan and regularly car- ried, ~hat the fee not be waived. Councilman Ryan moved that approval be given the tentative residential subdivision map as submitted by the Planning C~ mission and that the School Board and Hecreation Commission be sent copies of the tentative approved map, noting that certain restrictions, conditions or pr. visions have been made by the Planning Commission. Brief discussion followed, after which Councilman Rocca seconded the motion which was regularly carried. EXTENSION OF PONDEROSA ROAD, PINEVlEW CHEST SUBDIVISION: Inter office memorandum dated May 29, 1957, was received from the Planning Com mission, requesting that the City Council employ the necessary people to prep&: estimates of costs and condemnation for the extension of Ponderosa Road. Dis- cussion followed, at which time, residents of the area spoke, after which Mayo: Rozzi remarked that the City Manager had been requested to contact the develop, in an effort to work out the necessary details concerning the extensions of Ponderosa Road and that if there were no objections, the City Manager would be instructed to do so. Communkcation dated May 24, 1957, was received from the South San Francisco Junior Chamber of Commerce, setting forth the activities sponsored by them and explaining the need for funds to carry out this program. Inter o~fice memorandum dated May 21, 1957, was received from the office of the City Manager advising that the State Division of Highways had requested the Ci~7 to make some expression of its wishes with regard to the Junipero Serra Freeway. Mayor Rozzi remarked that this matter would be referred to the City A==orney's office for the preparation of the necessary resolutions. There being no objections, it was so ordered. Inter offffice memorandum dated May 29, 1957,ms received from the Planning Com- mission advising that they had recommended disapproval of the tentative res- idential map of Country Meadows Subdivision. Mayor Rozzi remarked that if there were no objections, this would be accepted and placed on file. No ob- jections were registered. Commun~cation dated May ! 6th,. 1957, was received from Albert McKay tendering his resignation from the Police Department effective May 31, 1957. Councilman Rocca noved, seconded by Councilman Ryan and regularly carried, that the resignaz~on be accepted and ordered filed. Commun~cation dated May 16, 1957, was received from Jack Jones tendering his resigna't~on as a member of the Police Department effective June 3, 1957. CounciLman Rocca moved, seconded by Councilman Ryan and regularly carried, that t~e resignation be accepted and placed on file. Inter offfice memorandum dated May 23, 1957, was received from the Personnel Board, submitting the eligible list for the position of City Attorney, as es- tablished at the meeting held May 23, 1957. Councilman Ryan moved, seconded by Councklman Rocca and regularly carried, that the eligibility list as sub- mitted by the Personnel Board be accepted and John Noonan appointed as City Attorney as of the meeting of the Personnel Board of Ray 23, 1957. Inter office memorandum dated May 10, 1957, was received from the Personnel Board submitting the eligible list for Street Department maintenance men. Accompauying that memorandum were memoranda dated May 23, 1957, as received from the office of the City Manager, Eugene Alello, and Acting Superintendent of public Works, David Corsiglia, recommencing the appointment of Robert G. Soto fron this list. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the City Manager be accepted. Inter offfice memorandum dated May 28, 1957, was received from the office of the Ci=y Clerk, recommending the permanent appointments of Louise Elliott a~Seni~ Accoun= Clerk and Jeanette Petroni as Account Clerk, as of May 1, 1957. City Ma2ager Aiello concurred in the above recommendation. Ceuncilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the recommen- dation eft the City Manager be accepted. Communication dated May 15, 1957, was received froa Gene Lazzari, Street Department employee, requesting a leave of absence of approximately two to four wee~s in order to undergo surgery. Accompanying the communication was an inter office memorandum dated May 24, 1~57, from Acting Supt. of Public Works Dave Corsiglia, recommending that he be granted this leave without pay. This recomme~dation carried the concurrence of the City Manager. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the recom- mendation of the City Manager be accepted. Inter orifice memorandum dated May 28, 1957, was received from the Acting Supt. of Public Works Dave Corsiglia, recommending a 30-day additional sick leave '~e granted Joseph Dias, laborer in the Street Department. City Manager Aiello ~riefly explained the certificate as received from the physician attend- ing Mr. ~ias, after which he concurred in the recommendation of Dave Corsiglia. Councilman Ryan then moved, seconded by Conncilman Rocca and regulaPly carried, that t~e recommendation of the City Manager be accepted. Inter orifice memorandum dated May 23, 1957, was received from the Personnel Board s~bmitting the eligible list for the position of Chief Operator at the Sewage Treatment Plant. Accompanying this memorandum was a memorandum dated May 27, 1957, as received from the Supt. off Sanitation, Henry Schweining, recommending that William Stephenson be appointed Chief Operator at the Sewage Treatmen= Plant, to start his probationary period as of June 1, 1957. Monthly report for the month of April, 1957, was received from the San Mateo County Department of Public Health and Welffare. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the report as submitted be acc~p'ted and placed on file. GOOD & WELFARE: SCHOOL TAX ELECTION: AVALON PARK BREAK-THROUGH AT VALENCIA DRIVE ESCANYO DRIVE SETTLING CONDITIONS BUR1 BURl: .~C?jl~ McKNEESE APPLICATION FOR POLICE OFFICER: · O GARDEN REFUSE PICKUP: ADJOURNMENT: Councilman Ryan briefly mentioned he noticed that the traffic lights on E1 Camiz Real and Chestnut Avenue were about half way completed. He spoke on the forth- coming school tax election, urging support by the public for its passage, list- ing th2 reasons that exist for the need of more schools. The other members of the Co:~ncil likewise expressed their support of the measure. Councilman Ryan then briefly spoke on the recent publicity received by the Police Department, stating that there was no alarm to be felt, since adequate protection existed with the local Police Department. Mayor 2ozzi then asked if anyone in the audience had anything they wished to offer ~ader Good and Welfare. Mr. Carlson, resident of Avalon Park, spoke on the proposed break-through at Valencia D~ ye, stating that the Avalon Improvemen Club w~s opposed to this break-through. Mr. WaL~°n of 68 Escanyo Drive asked as to the status of the repairs on Escanyo Drive as a result of the settling conditions. Director of Public Works Goss briefly gave a report relative to the bondi2g company being called upon to do the work, should the subdivider not do i;. The City Attorney then enumerated the steps, that could be followed. Discussion followed, at which time, other residents of the area, as well as members o~ the Council, spoke concerning the matter of the subdivision improvements in t~e Bauer-Lesser Buri Buri #3 sub- division. Mr. McKneese, present in the audience, then brought up the matter of an oral examination he had to take recently in addition to the one he had already taken with regard to his application for the position of Police Officer with the Police ~e~artment, remarking that after hav~ng taken the last examination, he was inf~r~ed by the Police Chief that he was no longer on the eligible list. Lengthy discussion took place during which time the methods were explained which were followed in conducting the examination. A questio~ was asked from the audience concerning the matter of garden refuse pickup, tS which Mayor Rozzi remarked that this was now under study. City Manager Aiello remarked that the charge for this service was paid by the City and not ~he home owner.
