Council Chambers, City Hall CALL TO ORDER: The meeting was called to order by Mayor Rozzi at 8:05 p.m. PLEDGE OF ALLEGIANCE TO THE FLAG AND INVOCATION: Pledge of Allegiance to the Flag was recited, after which invocation was given by Councilman Frank Lucchio in the absence of Reverend R. Conrad of the Parkwood Methodist Church. ROLL CALL: Present: Absent: Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan. None MINUTES Mayor Rozzi then asked if there were any errors, omissions or corrections to the minutes of the regular meeting of June 17, 1957. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the minutes be approved as submitted. CLAIMS: Mayor Rozzi asked if there was a motion approving the regular claims for pay- merit as submitted. Councilman Rocca moved, seconded by Councilman Lucchio and regularly carried, that the regular claims be approved for payment. FAY IMPROVEMENT COMPANY CLAIM: In addition tothe regular claims, a claim was received from the Fay Improvement Company dated June 30, 1957, for work completed to date at Industrial Park Unit No. 1 in the amount of $7,186.93. This claim carried the approval of the Director of Public Works and Mr. R. L. Smart of the firm of Wilsey & Ham. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried that the claim as submitted be approved for payment. LINDENVILLE SEWER: There being no public hearings, the Council proceeded on to the matter of resolutions. City Attorney John Noonan explained that the first resolution concerning the acceptance of an easement for the Lindenville sewer was to be held over since the City was awaiting the deed. RESOLUTION NO. 2492 City Attorney Noonan then explained the next resolution for Council action AUTHORIZING AGREEMENT which concerned an easement to the California Golf and Country Club over West FOR EASEMENT TO Orange Avenue· After a brief explanation, Councilman Lucchio introduced: CALIF. GOLF & COUNTRY "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZI~ CLUB OVER WEST ~ THE EXECUTION OF AN AGREEMENT GRANTING AN EASEMENT TO PASS OVER AND ACROSS ORANGE AVENUE:. WEST £PANGE AVENUE EXTENSION." Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. RESOLUTION NO. 2493 ENDORSING SAN MATEO COUNTY SOCIETY FOR CRIPPLED CHILDREN & ADULTS, INC. /)53 The next resolution for Council adoption, as explained by the City Attorney, concerned the endorsing of the San Marco County Society for Crippled Children and Adults, Inc. After explanation, Councilman Ryan introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ENDORSING THE SAN MATEO COUNTY SOCIETY FOR CRIPPLED CHILDREN AND ADULTS, INC." Roll call vote was as fol].ows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. There being no ordinances or unfinished business, the Council then proceeded on to the matter of new business, taking up first the items as received from the Plarning Commission. PINEVIEW CREST ACCEPTANCE OF FINAL SUBDIVISION MAP: Inter office memorandum dated June 26, 1957, was received from the Planning Commission recommending the acceptance of :he final residential subdivision map of Pineview Crest Subdivision, subject to various conditions. Mayor Rozzi remarkei'that if there were no objections, this matter would be referred to the City Attorney to work out all the necessary details concerning the annex- ation and the fees which were to be paid. No objections were registered. L. B. HAM REZONING PETITION: Inter office memorandum dated June 26, 1957, was received from the Planning Commission, recommending the approval of t~e petition of L. B. Ham to rezone property located at E1Camino Real and Hickey Boulevard, subject to certain conditions. Councilman Rocca moved, seconded by Councilman Ryan, that the recommendation of the Planning Commission be approved, since it was the under- standirg of the Council that everything was in order with the Division of Highways concerning the matter. Brief discussion followed, after which motion as made and seconded was regularly carried. HORN'ER SUBDIVISION Inter office memorandum dated June 26, 1957, was received from the Planning APPROVAL OF TENTATIVE Commission, recommending the approval of t~e tentative map of the Homer MAP OF PROPOSED Subdivtsion, for two lots on Avalon Drive, subject to the approval of petition sUBDIVISION: an ,exation. Mayor Rozzi remarked that if there were no objections, this matter would be referred to the City AttorJey for the preparation of the nec- essary resolutions as required and the working out of any other details that might be necessary. No objections were registered. FRANK & ANNIE ELI VARIANCE APPLICATION: .9-O~--B Variance Application No. 724, as applied for by Frank and Annie Eli, was receive. from the Planning Commission, recommending that permission be granted to allow a distance of 15 feet instead of the required 20 feet between structures, located at rear of 704 Grand Avenue, subject to certain conditions· Councilman Rocca moved, seconded by Councilman Ryan a~d regularly carried, that the recom- mendatLon of the Planning Commission be approved. JOSEPHINE UDMAN VARIANCE APPLICATION: Variance Application No. 725, as applied for by Mrs. Josephine Udman, was re- ceivei from the Planning Commission, recommending permission be granted for an 18-k~ch encroachment into the required 15-foot front yard setback, located at 52]. Spruce Avenue· Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Commission be accepted. FRANK & ANNIE ELI USE PERMIT: Use Perm:t Resolution No. 726, as applied for by Frank and Annie Eli, was re- ceived :from the Planning Commission, recommending permission be granted to construc: a second single family dwelling cn the rear of lot at 704 Grand Avenue, subject to certain conditions. NATION PAINT AND Use Permit Resolution No. 727, as applied for by D. D. Lewis for Nation Paint a~ WALLPAPER USE PERMIT: Wallpaper Company, was received from the Planning Commission, recommending per- f-n~ mismio~ be granted for an exterior plastic sign, 50" x 172", double face, illumiua:ed, located at 1131 E1Camino ReaL, subject to certain conditions. Councilman Rocca moved, seconded by CounciLman Ryan and regularly carried, that the recommendation of the Planning Commiss:.on be accepted. ASSOCIATED CONSTRUC- TION & ENGINEERING Use Pe~uit Resolution No. 728, as applied ~or by John Chapman for Associated Construc:ion and Engineering Company, was received from the Planning Commission recommending permission be granted for a s~gn, located at the southeast corner of East Grand Avenue and Sylvester Street, subject to certain conditions. Use Permit Resolution No. 729, as applied for by Joe Bertolucci, was received from the Planning Commission, recom mending permission be granted for a 4 ft. by 6 ft, standard commercial real estate s:gn, located at 421 Cypress Avenue, subject to certain conditions. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recomnendation of the Planning Commission be approved. RICK PASCO VARIANCE APPLI CATI ON: Variance Application No. 730, as applied for by Rick Pasco, was received from the Planning Commission, recommending permLssion be granted for a 7 ft. en- croachment into the required 20 ft. rear yard, located at lot 29, block 2, Parkway Terrace No. 3. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Commission be approved. MRS. CHARLOTTE NICHOLAS USE PERMIT: Use Per~it Resolution No. 732, as applied for by Mrs. Charlotte Nicholas, was received from the Planning Commission, recommending permission be granted to erect z second single family dwelling on the rear of 1~ , located at 528 Grand Avenue, subject to certain conditions. Councilman Rocca moved, seconded by CounciLman Ryan and regularly carried, tha; the recommendation of the Planning Commission be approved. ISABEL RUFFIN USE PERMIT: Use Permit Resolution No. 733, as applied for by Isabel Ruffin, was received from the Planning Commission, recommending permission be granted to erect a seconc sidle family dwelling on the rear ~f lot, located at 774 Commercial Avenue, subject to certain conditions. Councilman Rocca moved, seconded by CouncSL~.an Ryan and regularly carried, that the recommendation of the Planning Commission be approved. SOUTH S. F. YELLOW CAB COMPANY REQUEST FOR FARE INCREASE: Commur.±cation dated June 30, 1957, was received from the South San Francisco Yellow Cab Company, Peninsula Cab Company and South San Francisco Taxi Company, over the signature of A. E. Ryan, requesting approval of a fare increase in cab rz:es. Brief discussion followed, after which Councilman Rocca moved, seconded by Councilman Ryan, that the City Attorney be instructed to prepare the necessary ordinance to allow the taxicab company to increase its fares as reques:ed. Brief discussion followed, after which motion as made and seconded was regularly carried. A. S. ALOE COMPANY CLAIM AGAINST CITY: Claim for damages was received from the A. S. Aloe Company, through their attorneys, Dinkelspiel & Dinkelspiel, for work allegedly performed by the City on a sewer line near their company. Councilman Ryan moved, seconded by Counc~lnan Lucchio and regularly carried, that the claim be denied and referred to the City's insurance carrier. BRENTWOOD CLUB LETTER OF THANKS: Communication dated June 12, 1957, was received from the Brentwood Club over the s:gnature of Bob Harris, president, expressing its appreciation to the City for ti~e prompt and efficient manner in which a street painting job on Hazelwood and Maywood Drives was carried out by the'City. After the communication had been read by the Clerk, Mayor Rozzi requested that it be accepted and placed on file. LI NDENV ILLE INTERCEPTOR SEWER AWARD OF BID: Inter office memorandum dated June 26, 1957, was received from the Director of Public Works, submitting a compilation of bids received for the Lindenville interceptor sewer, recommending that the contract be awarded to the low bidder, A. Dale Williams. Councilman Rocca moved, seconded by Councilman Cortesi, that the work be awarded to the low bidder in keeping with the City's practice and ti~a~ the 15-inch sewer be ordered installed. Brief discussion followed, after which motion as made and seconded w&s regularly carried. FI NAL ACCEPTANCE RAILROAD AVENUE IMPROVEMENTS: Inter office memorandum dated June 27, 1957, was received from the Director of Public ~orks, recommending the final acceptance of the Railroad Avenue Improve- ments. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Director of Public Works be accepted and that ten percent be withheld for a period of thirty-five days after the filing of the notice of completion. TERM EXPIRATIONS OF LIBRARY BOARD MEMBERS MRS. EDGAR PIERSON AND MISS RUE CLIFFORD:~~ MARTIN MORO RESIGNATION: Inter office memorandum dated June 14, 1957, was received from the Library Board, advising of the expiration of the ~erms of Mrs. Edgar Pierson and Miss Rue Clifford as members as of June 30, 1957. Mayor Rozzi remarked that if there were no objections, this matter would be held over. No objections were registered. Communication dated June 27, 1957, was received from Martin Moro tendering his resignation as an employee in the Park Department inasmuch as he was retiring. from the City's service as of June 30, 1957. Councilman Ryan moved, seconded by Councilman Lucchio and regularly carried, that the request be granted. The appointment of Albert Fedele as a Special Officer for the Utah Construction Company was received from Police Chief Belloni. Councilman Cortesi moved, seconded by Councilman Lucchio and regularly carried, that the appointment be accepted. There '~elng no further business, Mayor Rozzi asked if any of the members of the Co~ancil had anything they wished to offer under Good and Welfare. Coun- cilman Rocca brought to the attention of the Council the need for street repairs on Butler Road which leads to the City Park and on Parkway from Loma Liuda Subdivision west. Brief discussion followed concerning the im- provemeu~ of these two streets and the possibilities of widening, after which the Director of Public Works was instructed to look into the matter as re- quested. Councilman Cortesi brought to the Council's attention the matter of weeds in the vacant lots near the Union Hall on Miller Avenue which needed attention. Councilman Lucchio then asked the Fire Chief concerning the weeds in vacant lots in ~he vicinity of Cypress, California and Pine Avenues. Fire Chief Welte remarked that they were working on this matter. councilman Ryan then brought to the Counci:.'s attention the matter of the traffic signal at E1Camino Real and Chestnut Avenue, remarking that he noticed that work had ceased and upon investigating found, in checking with the City Manager, that the lack of overhead arms hac caused work to be temporarily held up but that he noticed that today these arms were being installed. Counciluan Ryan then brought to the CounciL's attention the matter of the Bauer-Lesser Subdivision, requesting that the City Attorney read the letter as received from their attorneys, Pillsbury, Madison and Sutro. City Attorney Noonan then read the letter dated June 27, 1957, remarking that a request had been made by that firm for a complete List of all the deficiencies which they would then have checked by their engir.eer. Brief discussion followed, at which time, the resident of 335 Arroyo Drive spoke on the subject matter as well. William Rorsfall of 335 Alta Mesa then spoke on the drainage ditch which aad been located on his property, which should not have been placed there since the subdivision map showed it ~s being on the property to the rear. Further discussion followed, after which D~rector of Public Works Louis Goss was reLuested to compile the list of deficiencies which were to be submitted to the attorneys for the subdivider.
