HomeMy WebLinkAboutMinutes 1957-07-23IVER OF CALL AND CONSENT TO SPECIAL gTING OF THE CITY' COUNCIL OF THE C:TY OF SOUTH SAN FRANCISCO We, the undersigne~, being the Mayor and all the Counci'-,men of the City of South San Francisco, de hereby waive the calling of, and de therefore expressly consent to, a special meeting of said City Council to be held at its regular meeting place in t~ City Hall, on Tuesday, the 23rd day of July, 1957, at the hour of 4:30 p.m., so that said City Council may convene in emergency session for the purpose of con~kdering and acting upon the following matters: To consider the purchase of the Magnolia Avenue School site for the sum of $150,000.00, and To consider t~e granting of a pay increase to employees of the City of South San Francisco, efff-ctive July~l, 1957. Ryan, Emilio Cortesi and Mayor G. J. l/~zsi. Councilmen Andrew Rocca and Francis Lucchio. Mayor Rossi asked the Deputy City Clerk to re~d the letter addressed to the City Council from James C. Cherry, Superintendent of the South San Francisco Unified Sc hoe District, r,~garding conveyance of the Magnoli~ Avenue School property by the South San Francisco Unified School District. City Attorney Noonan suggested the Council a~taorize the City Clerk to spread thks letter upon the minutes. Mayor Rossi so tmstructed the City Clerk. The letter follows: "City Council of the City of South San Francisco City Hall South San Francisco, California July 23, 1957 Re: Conveyance of Magnolia Avenue School Property b~ South San Francisco UnifiedDeho~l District Gentlemen~ O~ behalf of the South 8an Francisco Unified School District I wish to call ~our attention to certain facts with respect to the above captioned matter. ~s you know, pursuant to resolution adopted by the B~ard of Trustees of this distr~ct on July 2, 1956othe subject school building and the land directly 'Aaderneath thereof was conveyed to ~our city by deed for the sum of $24,000.)). Am you also know, the propriety of th- said conveyance was questioned by the State Department of Finance and the egfect of said conveyance on the school building aid apportionment program cf this district was the subject of' Attorney General's opinion dated April 23, 1957, rendered at request of the Director of Finance. In that opinion th~ Attorney General concluded that state school building aid allocation should be withheld this district until tlc conveyance was rescinded or additional payments made to the State on behalf of this District in a sufficient a~aount to satisfy the state re- quiremant, of contributions required by this District in the state school buildin[ ~id program. :~ is clear that by reason of the said Attorney General's opinion and th* ~ttitude of the State Allocation Beard with respect to this con- veyance, that the maid building aid program of this district is Jeopardized by reason of the conveyance to your city. S~nce the said conveyance has been r~led to be questionable and the effre~ts =hereof are disastrous to this district's building program through the ume off state funds, it would appear that your Council should consider re~mnvey:t~ to the School District the said building and the underlying real prmpmrt~ consisting of 0.86 acree, more or Less, and accept the return of the ~4,000.)3 paid by your city on the purchase thereof. 3n behalf of the school district we request your po~ition with res- peet to t~e so-called rescission of the sale o~ this school building. At this t:me, Mayor Rozzi gave an explanation of the resolution which was passed ~d the City Council's action regarding school property. City At :orney Noonan then read in full the re~lution which was to be adopted by the .~i=y Council. Roll call vote was as follows: Ayes: CouncilmenLeo ~yan, Enilio Cortesi and M~yor G. J Noes: ~0ne. Absent: Councilmen Andrew R~cc& and Francis Lucchio.
