MINUTES: Mayor 3ozzi asked if there were any errors, omissions or corrections to the minu:es of the regular meeting of August 19, 1957. Councilman Rocca moved, secoaded by Councilman Lucchio and regularly carried, that the minutes be approved as sul~nitted. CLAIMS: FAY IMPROVEMENT CO. CLAIM I INDUSTRIAL PARK UNIT NO. 1: Mayor 3ozzi then asked if there was a motion approving the regular claims for paymen=. Councilman Rocca moved, seconded by Councilman Lucchio and regularl~ carried, that the claims be approved as submitted. Mayor Rozzi then took up the claim of Fay Improvement Company dated August 26, 1957, for work complete~ to date at Industrial Park Unit No. 1. The claim carried the approval of Mr. 3. L. Smart of the firm of Wilsey ant Ham and Louis GeEs, Director of Public Works. The claim was in the amour.t of $7,665.50. Councilman Lucchio movet, seconded by Councilman Rocca and regularly carried, that the claim be approved for payment. PUBLIC HEARING FOR COST AND EXPENSE OF REMOVING WEEDS: j Proc*eding on to public hearings, Mayor P, ozzi took up first the public hearint on t~e cost and expense of removing weeds. He opened the public hearing, aski~i if any written protests had been received, to which the City Clerk replied none had been received. He then asked if there were any oral protests None were registered. Councilman Lucchio moved, seconded by Councilman Rocca and regularly carried, that the hearing be closed. PUBLIC HEARING FOR VACATION OF PORTION OF BIRCH AVENUE: The 2ext public hearing concerned the vacation of a portion of Birch Avenue. Mayo: 3ozzi opened the public hearing, declaring that if there were no ob- jections, it would be continued to the next regular meeting of the City Counct to b~ held September 16, 1957, at 8 p.m. Councilman Cortesi asked as to the reason for the holding up of the public l.earing, to which Mayor Rozzi replied that t~e city was awaiting a settlement between the property owners concern- ing the property line. PRESENCE OF COUNCILMAN RYAN: Councilman Ryan appeared present at the nesting at 8:07 p.m. and remained for the duration. Mr. 8aason, a resident of Loma Linda, present in the ~tdience, inquired as to what effect the vacation of Birch Avenue would have in relation to their property. This was explained to him by Director of Public Works Louis Goss. RESOLUTION NO. 2519 CONFIRMING CHARGES FOR REMOVING WEEDS: Proceeding on to resolutions, City Attorney Noonan explained the first which was ready for Council attention concerning the removal of weeds and assessing costs. After a brief explanation, Councilman Rocca introduced: A RESOLUTION OF TFE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO CONFIRMING REPORT OF SUPEIINTENDENT OF STREETS AS TO CHARGES FOR REMOVING WEEDS'*. Roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. RESOLUTION RE VACATION The next resolution concerning the vacatkon of Birch Avenue was held over OF PORTION OF BIRCH to tie next regular Council meeting. AVENUE: RESOLUTION RE AMENDING ZONING ORD. #353 FOR "H" DI STRICT PARKING: RESOLUTION NO. 2520 AUTHORI ZING EXECUTION OF AGREEMENT WITH SCHOOL DISTRICT: 51oi The Re~olution of Intention to amend zonkng ordinance #353, amending the provisions for parking in "~' Districts, where additions to buildings are made, was likewise held over to the next regular Council meeting. City Attorney Noonan then explained the =esolution authorizing the execution of an agreement with the State Allocations Board and the Unified School District, which concerned the Magnolia Avenue School. After explanation by the City Attorney, Councilman Ryan introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING THE EXECUTION ON ITS BEHALF OF AN AGREEMENT R~TITLED "AGREEMENT COMPROMISING DISPUTE BETWEEN THE SOUTE SAN FRANCISCO UNIFIED SCHOOL DISTRICT AND THE CITY OF SOUTH SAN FRAN- CISCO''. The presentation w~ to be in the form of a brochure which contained a message from the Mayor and members of the Council as well as a copy of the resolution previously adopted. He then called on Duane Mattison, Director of Parks and Recreation~ to introduce the three ball players selected from the City's recreation pm- gra~. Mr. Mattison introduced the three, giving a brief summary of their activities and the reasons for their selection. The three youngsters were: Johrny Giusti, Rlc Brewer and Bob Satterlee. The next item for Council attention concerned the pro~lamation for National Civil Defense Week. City Attorney Noonan stated that motion would be in order requesting the Mayor to declare such a proclamation. Councilman Cortesi so moved, seconded by Councilman Ryan and regularly carried. Alt~o'lgh not appearing on the agenda, tile Council was to consider a resolu- tio:£ approving the execution of an agreement establishing a subdivision plan for Pineview Crest Subdivision. At the request of City Attorney Noonan, this matter was to be held until later in the meeting, during which time the developers would have the opportunity off reading the agreement and executing it. City Attorney Noonan then proceeded on =o the matter of ordinances, taking up first the second reading and adoptioa of the ordinance for the formation of the Downtown Parking District 1955-1. After a brief explanation, he stated that the detailed reading could be waived and the ordinance adopted by the reading of title only. Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the detailed reading be waived and the ordinance be ad~pted by the reading of =itle only. City Attorney Noonan the~ read the title of the ordinance, after which he suggested that a motion be ma~e that the ordinance be adopted by roll call vote. Councilman Ryan moved: seconded by Councilman Rocca and regularly carried, that the ordinance be adopted. Brief discussion followed, after which roll call vote was as follows: Ayes, Councilmen Rozzi, Rocca, Cortesi, Lucchio and Ryan. The Council then returned to the matter of the resolution approving the execution of an agreement establishing =he subdivision plan for Pineview Crest Subdivision. After an explanation by the City Attorney, Councilman Cortesi stated he wished to go on record that this was not setting a prece- de£t since at some future date it might be necessary to make a change in the a~eunt of payment. After a brief explan- ation by the City Attorney, Councilman Ryan moved, seconded by Councilman Rocca and regularly carried, that the ordinance be adopted by the reading of title only and the detailed reading be ~mived. The Council then proceeded on to unfini~hed business, taking up the Variance Application of Barrett and Hllp on Lots 19, 20, 21, 22 and 23, located on Arroyo Drive between Alta Loma and Camaritas Avenue. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recom- mendation of the Planning Commission be accepted, as shown on the ~ap sub- mitted. The first item under new business concerned the adoption of the City Budget. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the budget as submitted b~ the City Manager be approved, however, the Conncil reserving the right to amend. 3riel discussion followed, at which time, Councilman Lucchio and Councilman Ryan both commended the City Manager for the work done in its preparation. Communication dated August 15, 1957, wa~ received from the San Mateo County Advisory Planning-Council, submitting t~eir Resolution No. 4 and Policy Statement recommending the selection of Route "B" with certain modifications as the most desirable route on the proposed routing of Junipero Serra Freeway. Accompanying this communication was a letter dated August22, 1957, from the City of Millbrae, over the signature of ~ayor Emilio Massolo, giving their views regarding this route. Mayor Rozz; remarked that if there were no objections, this matter would be held over to the meeting of September 16, 1957, since shortly after that time maps would be available for study. No objections were registered. Inter office memorandum dated August 27, 1957, was received from the Recre- atto£ Co~ission requesting a special appropriation to cover expenses of the Commissioners and the Superintendenz of Parks and Recreation to attend the 39th National Recreation Congress as representatives of the City. No objections were registered. 39TH NATIONAL RECREATION CONGRESS REQUEST FOR SPECIAL APPROPRIATION: Inter office memorandum dated August 27, 1957, was received from the Recre ation Commission requesting a special appropriation to cover expenses of the Commissioners and the Superintendent of Parks and Recreation to attend the 39th National Recreation Congress as representatives of the City. In addition to the request for an amount of $200 for this appropriation, a further request was made to the Council to waive the limitation of two Commissioners attending any one conference for this special Congress. Councilman Lucahio moved, seconded by Councilman Rocca and regularly carried, that the Mayor issue a proclamation and that the ~atter be referred to the office of the City Attorney for its prep~ratioE Communication dated August 27, 1997, was received from the Tanforan Company, Ltd., requesting the City to postpone aLy physical work on Spruce Avenue until after the race meeting which runs September 9 through October 26, 1957, since it was felt a serious traffic congestion problem would result. Dis- cussion followed, at which time, it was mentioned that by the time the pre- liminary details had been completed, the physical work invo]sed would not interfere with the traffic conditions d~ring the race meeting. Mayor Rozzi remarxed that if there were no objections, the City would proceed with the worx. No objections were registered. Claim for damages against the City of South San Francisco was received from Richard J. Carr through his attorney, Walker & Choulos, claiming injuries alleged to have occurred as a result of striking a traffic sign. The claim was in the amount of $75,000.00. Councilman Lucchio moved, seconded by Courcilman Rocca and regularly carried, that the claim be denied and re- ferred to the City's insurance carrier. Communication dated August 22, 1957, was received from Stoneson Development Corporation requesting the acceptance off improvements of Westview Terrace No. 2. Accompanying the communication was an inter office memorandum dated August 25, 1957, from the Director of Public Works, recommending the ac- ceptance, subject to the posting'of a bend in the amount of 10 per cent of the value of improvements. Councilman 2yah moved, seconded by Councilman Lucchio and regularly carried, that the recommendation of the Director of Public Works be accepted. Cos~unication dated August 7, 1957, was received from the Garden Development Con, any, requesting final acceptance of the improvements in Sunshine Gardens Units 1, 2, 3, 4, 5 and 7. Accompanying the communication was an inter offi~ memorandum dated August 28, 1957, from ~irector of Public Works Louis Goss recomuending the final acceptance of these improvements. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recom- mer~ation of the Director of Public Wor~s be accepted. Although not an item on the agenda, inter office memorandum dated September 3, 1957, was received from the Planning Commission concerning the tentative ma~ of Lindenville Industrial Park, being subdivided by the Utah Construc- tion Company, recommending the acceptance of the tentative map subject to certain conditions. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the tentatiTe map of Lindenville Industrial Park be accepted along with the recommendations of the Planning Commission. Memorandum was received from Acting Superintendent of Public Works David Corftflia, recommending the permanent appointment of Richard Platano in the Str-et Department, effective August 6, 1957. This memorandum carried the neoon~nendation of the chairman of the Personnel Board and the City Manager. Co~Loilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation as submitted be accepted. Inter office memorandum dated August 21, 1957, was received from Lauretta Hussar, Librarian, recommending the probationary appointment of Elizabeth McCt.esney as Assistant Librarian. Councilman Rocca moved, seconded by Co~r~llman Ryan and regularly carried, that the recommendation of the Librarian be accepted, that the appointment be effective upon the passing of the physical examination, and that it carry the concurrence of the City Manager. Inter office memorandum dated August 28, 1957, was received from the office of ~he Fire Chief, A. J. Welte, referring to his memorandum of June llth subnitting the names of eight applicants for appointment to the Fire Department and requesting that the probttionary appointments be made effec- tive October 1, 1957, since they had satisfactorily passed their medical exaninations. Those to be appointed were as follows: John Petroff Anthony Bachle Harold Geer Hommo Zylker Patrick Dunleavy Richard Wagner William Schille James Lynch Conacilman Rocca moved, seconded by Councilman Ryan and regularly carried, tha~ the recommendation of the Fire Chief be accepted and that it carry_ the concurrence of the City Manager. In=er office men~randum dated August 28, 1957, was received from the Super- in%endent of Sanitation, Henry Schweining, recommending the probationary appointment of Bernard Schweyer as Plart Operator and Richard Vergara as RekLef Operator at the Sewage Treatment Plant, effective September 4, 1957. Bo~h applicants successfully passed their physical examination and the appo:ntments were concurred in by the City Manager. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation of ~he SUperintendent of Sanitation be accepted. Con~unication dated August 14, 1957, was received from the County of San Ma~eo Department of Public Health and Uelfare, submitting their monthly report for the month of July, 1957. Mayor Rozzi remarked that if there were no objections, the communication and report would be accepted and placed on file. No objections were registered. PACIFIC TEL & TEL PROPOSED RATE INCREASE: Altho'Agh not appearing as an item on the agenda, the matter of the pending rate increase by the Pacific Telephone and Telegraph Company was taken up. Discussion followed, after which CounciLman Ryan moved that the city formall~ reqAest the Public Utilities Commission to deny application of the Pacific Tel®phone and Telegraph Company for a rate increase and that the North County Council of Cities be notified of the city's action, urging their support in this matter. Councilman Rocca seconded the motion, which was reg'Alarly carried. GOOD & WELFARE: SKIATR~ T~, INC. pay TV Proceeding on to the matter of Good and Welfare, Mayor Rozzi asked if any of the-Council members had anything they wished to offer. Councilman Ryan bri®flY spoke on the letter as received from Skiatron TV, Inc., concerning pay TV, remarking that he was opposed to such a plan since it was an infringaent on the rights of the people. BAUER-LESSER DEFICIENCIES: Couacilman Ryan then asked City Attorney Noonan as to the status of the Bauer-Lesser problem, to which Mr. Noonan replied that a number of defic- iencies had been resolved and that the controversial items were to be dis- cussed. Michael Arvello, a representative~f~heare~,present in the audience, re- marked that he wished to see test borings made by a firm other than one employed by Bauer-Lesser. Councilman Rocca asked as to what projects were yet uncompleted, to which City Attorney Noonan remarked that the Loma Linda Subdivision and Serra Highlands were about the only two left. Councilman Rocca ftwther stated tha= it was his hope to get all of these cleared up before the beginning of' the rainy season. COMMENDATION TO FIRE DEPARTMENT: Mayor Rozzi then read to the Council a Letter dated August 30, 1957, as re- ceived from the Winston Manor #3 Improvement Club, comending the South San Fran:isco Fire Department for the manner in which they handled a recent fire at 134 Hilton Avenue. Councilman P. yan comended the Fire Department and tae Chief, requesting that he notify his department of the coe~nendation. BUR1 BUR1 #3 PROBLEM: Z~ 7 ~Z/ FIRE HAZARD IN REAR OF LOMALINDA: There being nothing further from any member of the Council, Mayor Rozzi asked if anyone in the audience had anything they wished to offer. Mr. Horsfall, present in the audience, a resident of Burs Burs #3, asked City Attorney Noonan concerning their problem, to which the City Attorney replied tha= ~he Bauer-Lesser Company had consented to take care of the problem. Mrs. 3ecker, a resident of Parkway Terrace, remarked that a fire hazard existed in the rear of the properties aaJoining Loma Linda Subdivision as a res'Alt of grass which had been plantea te take care of the erosion. Fire Chief Welte stated that since this was on private property, it would be the respo~sibility of the owners.
