HomeMy WebLinkAboutMinutes 1958-01-06TIME: PLACE: CALL TO ORDER: PLEDGE OF ALLEGIANCE AND INVOCATION: ROLL CALL: MINUTES: CLAIMS: S & (~ CONSTRUCTION COMPANY CLAIM: PUBLIC HEARING - NOTICE TO ABATE NUISANCE AT 343 ARROYO DRIVE: CONTINUANCE OF PUBLIC HEARING ON NOTICE TO ABATE NUISANCE AT 343 ARROYO DRIVE: RESOLUTION NO. 2563 PROVIDING FOR CITY TO PARTICIPATE IN HARBOR WAY ASSESSMENT DISTRICT: HARBOR WAY ASSESSMENT DISTRICT - WAIVER OF PROPERTY OWNERS: REGULAR ~EETING OF THE~ CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO, HELD MONDAY, JANUARY 6, 1958 8:GG p.m. Council Chambers, City Hall The meeting was called to order by Mayor Rozzi at 8:01 p.m. Pledge of Allegiance to the Flag was recited, after which invocation was given by the Reverend Richard Eggert of the First Co~unity Church. Present: Absent: Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan None Mayor Rozzi asked if there were any errors, omissions or corrections to the minntes of the regular meeting of December 16, 1957, and the adjourned regnlar meeting of December 19, 1957, am submitted. Councilman Cortesi move, seconded by Councilman Lucchio, that the minutes as submitted be approved. Under the question, Councilman Rocca stated that the minutes of the adjourne, regular meeting of December 19 did not ~ndicate whether or not the resolu- tions adopted Md the concurrence of the City Attorney. City Attorney Noonan reearked that he did concur in the resolutions. Councilman Lucchio asked Co~ncilman Cortesi if he would accept t~is amendment to the motion, which he did. Councilman Lucchio seconded the a:~endment, and the motion as made, amended and seconded, was regularly carried. Mayor Rozzi asked if there was a motion approving the regular claims as sub- mitted for payment. Councilman Lucchio moved, seconded by Councilman Rocca ant regularly carried, that the regular claims as submitted be approved for payment. The Council then took separate action on the claim for S & Q Construction Company dated December 30, 1957, in the amount of $350.86, for checking of se~er line for the Utah Construction Company at the South San Francisco Ind~strial Park Unit No. i project. ThLs claim carried the approval of the firm of Wilsey & Ham and the Director off Public Works. Councilman Rocca moved, seconded by Councilman Lucchio and regularly carried, that the claim be approved for payment. Thd Council, under public hearings, took up item 1 which appeared under un- firished business, concerning the Notice to Abate Nuisance in connection wit] a b~ilding at 343 Arroyo Drive. Mayor 2ozzi opened the public hearing, afte: which City Attorney Noonan remarked tha= Mr. Ressner, attorney for the sub- divider, was present in the audience and that the city could proceed in the matter. The City Attorney then briefly explained the notice which had been posted by the Building Inspector and that Nello Certiberi, Assistant Build- ing Inspector, made a physical inspection of the building and could be calle~ upon at this time to testify concerning its condition. The City Clerk admin. istered the oath to Nello Certiberi, after which, in answer to the questions of the City Attorney, he testified that he was the Assistant Building Inspector, had posted the notice on the building, had made the physical in- spection and was also a member of the ~using Survey Team. He then recited the conditions which were listed in the notice to abate nuisance dated the 13th of December, 1957, which was signed by the Building Inspector, showing seven listed public nuisances. In answer to the City Attorney's question, Nello Certiberi testified that the building was uninhabitable and that its appearance constituted a nuisance. City Attorney Noonan then asked Mr. Ressn, if he had any questions he wished to ask, to which he replied he had none. Further brief discussion took place, after which it was suggested by the Citl Attorney that the hearing be continued ~o the next regular meetin~ in order that additional information could be brought to the attention of the Council. Councilman Ryan then moved, seconded by Councilman Rocca and regularly car- ried, that the public hearing on the abatement of the nuisance at 343 Arroyo Drive be contined to January 20, 1958. Proceeding on to the next item of Resol-~tions, City Attorney Noonan remarked that Mr. Robert Miller, attorney at law, had a series of resolutions for the Council's attention =elative to the HarborWayAssessment District. Mr. Robert Miller, of the firm of Dolwig and Miller, then took up the first resolution concerning the subject matter, which concerned the consent of the city to participate in the special assessment proceedings. After a brief explan- ation by Mr. Miller, during which time he mentioned that his firm had been designated as the attorneys to act, Councilman Rocca introduced: "A RESOLU- TION ~F THE CiTY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR SAID ~ITY TO PARTICIPATE IN THE SPECIAL ASSESSMENT PROCEEDING TO BE KNOWN AS ~HAI~B~R WAY ASSESSMENT DISTRICT', SAID CITY'S PARTICIPATION BEING LIMITED TO THE EXTENT OF THE BENEFITS TO BE DEREVED BY LAND OWNED BY SAID CITY AND LYING WITHIN SAID PROPOSED DISTRICt'. ~fter introduction of the resolution by Councilman Rocca, Councilman Lucchio asked concerning the method of appointment of the firm of Dolwig and Mkl~ r. After discussion, roll call vote was as follows: Ayes, CoBncilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan. Mr. Miller then explained the document which had been prepared relative to the PROPERTY OWNERS' WAIVER OF THE PROVISIONS OF THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION, AND MAJORITY PROTEST ACT OF 1931 INSOFAR AS CON- CERFS PROPOSED SPECIAL ASSESSMENT PROCEZDINGS TO PROVIDE FOR THE IMPROVEMENT OF A PORTION OF THE PROPOSED PUBLIC STREET TO BE KNOWN AS "HARBOR WAY". He then gave the City Clerk the document mentioned for filing. RESOLUTION NO. 2564 WAIVING OF REQUIREMENTS - HARBOR WAY ASSESSMENT DISTRICT: The next resolution for Council action on the subject matter concerned the waiving of the requirements as required by law. After brief explanation by Mr. Miller, Councilman Lucchio introduced: 'A RESOLUTION OF THE CITY COUNCIL OF TEE CITY OF SOUTH SAN FRANCISCO DECLARING THAT INVESTIGATION PROCEEDINGS ARE NOT REQUIRED IN CONNECTION WITH THE iMPROVEMENT OF HARBOR WAY FROM ITS NORTEERLY TERMINUS AT EAST GRAND AVENUE, IN SAID CITY, AND EXTENDING SOUTH- ERLY THEREFROM TO THE IMPROVED PORTION OY SAID HARBOR WAY AT THE NORTHERLY EDGE OF THE SUBDIVISION KNOWN AS 'SOUTH SAN FRANCISCO INDUSTRIAL PARK"*. At this time, Councilman Rocca asked the City Attorney if he concurred in all of the resolutions which were to be presented, to which he replied that he did. RESOLUTION NO. 2565 DESIGNATING ATTORNEYS FOR HARBOR WAY ASSESSMENT DISTRICT: The next resolution, as pertained to the Harbor Way Assessment District, concerned the designation of attorneys for the preparation of the legal documents. After explanation, Councilman Cortesi introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO EMPLOYING ATTORNEYS FOR THE PREPARATION OF ALL LEGAL AND LEGISLATIVE DOCUMENTS PERTAINING TO PROCEED- INGS TO BE TAKEN IN CONNECTION WITH THE ~ROPOSED SPECIAL ASSESSMENT DISTRICT TO BE.KNOWN AS 'HARBOR WAY ASSESSMENT DISTRICT"*. Roll call vote was as fol- lows: Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan, all ayes. RESOLUTION NO. 2566 APPOINTING ENGINEERS- HARBOR WAY ASSESSMENT DISTRICT: The next resolution appointed the engineers for the project. After explan- atior, by Mr. Miller concerning the firm that was to act ~n this capacity, Cou cil~an Rocca introduced: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUT~ SAN FRANCISCO APPOINTING ENGINEERS FOR THE PROJECT OF IMPROVING HARBOR WAY FROM ITS NORTHERLY TERMINUS AT EAST GRAND AVENUE IN SAID CITY, AND EXTEND ING SCUTHERLY THEREFROM TO THE PRESENTLY IMPROVED PORTION OF SAID HARBOR WAY LYIFG WITHIN THAT CERTAIN SUBDIVISION KNOWN AS 'SOUTH SAN FRANCISCO INDUSTRIA! PARK*, AND DIRECTING SAID ENGINEERS TO P~EPARE PLANS AND SPECIFICATIONS AND TO i~AKE AN ESTIMATE OF THE COST OF SAID IMPROVEMENT". Roll call vote was as follows: Ayes, COuncilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan. RESOLUTION NO. 2567 RESOLUTION OF INTENTION TO PERFORM WORK HARBOR WAY ASSESSMENT DISTRICT: The r;ext resolution regarding the matter was the Resolution of Intention to perform the proposed work. Robert Mille: described the work that was to be done~ remarking that the date of January 20th be designated as the date for Wilsey & Ham to submit their report for adoption. After brief discussion, Councilman Rocca introduced: '*RESOLUTION OF INTENTION NO. 2567 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTEN- TIO~ TO IMPROVE HARBOR WAY FROM ITS NORTHERLY TERMINUS AT EAST GRAND AVENUE IN SAID CITY, AND EXTENDING SOUTHERLY THlREFROM TO THE IMPROVED PORTION OF SAID ~RBOR WAY AT THE NORTHERLY EDGE OF THE SUBDIVISION KNOWN AS *SOUTH SAN FRA¥CISCO INDUSTRIAL PARK*'*. Roll call vote was as follows: Ayes, Councilme G. ~. Rozzi, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan. RESOLUTION NO. 2568 DESIGNATING NEWSPAPER FOR LEGAL PUBLICATIONS HARBOR WAY ASSESSMENT DISTRICT: RESOLUTION OF INTENTION TO VACATE The Last resolution concerned the design~tion of the official newspaper for the naking of all legal publications. After a brief explanation, Councilman Ryan introduced: '~A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DESIGNATING AN OFFICIAL NEWSPAPER FOR THE MAKING OF ALL LEGAL PUBLICATIONS IN CONNECTION WITH THE PROCEEDINGS PERTAINING TO HARBOR WAY ASSESSMENT DISTRICT". Roll call vote was as follows: Ayes, Councilmen G. Jo RozzL, Andrew Rocca, Emilio Cortesi, Francis Lucchio and Leo J. Ryan. City Attorney Noonan then remarked that the Resolution of Intention to vacate the easement for the Lindenville Sanitary Sewer had been prepared but that a EASEMENT - LINDENVILLE report was forthcoming concerning the description and that this matter would SANITARY SEWER:~, be ready for Council action at their next regular meeting. There being no ~'~2..~! objections, this matter was continued to the meeting of January 20, 1958. EXPLANATION OF 343 ARROYO DRIVE NUISANCE ABATEMENT TO BUR1BURI #3 RESIDENTS: There being no ordinances, and the matter of the item under unfinished bus- iness having been taken up under public hearings, the Council~s next item was new b~siness. Councilman Ryan remarked that before proceeding on to new bus,ness and since some of the residents of Burl Buri #3 appeared present at the hooting after the matter of the dwelling at 343 Arroyo Drive had been disposed of, it might be well to brief them on what had taken place. City Attorney Noonan, at the request of Councilman Ryan, explained the Council's action concerning the matter. Brief discussion then took place concerning the Length of time it would take to remove the building in question. After discussion, the Council proceeded on with the remainder of their agenda. RICHARD SLEPIN CLAIM: Comnunication was received from Mr. Richard Slepin alleging damages to his autonobile tire as a result of driving over an uncovered sewer entry in the vicinity of Magnolia and Baden Avenues. Mayor Rozzi remarked that if there were no objections, the matter would be referred to the office of the City Manager for disposition. No objections were registered. MICHAEL & MARGARET AMOROSE AND MR. & MRS. O. R. SWANSON CLAIMS: Cla~ns of Michael & Margaret Amorose ani Mr. & Mrs. O. R. Swanson of 129 Duva and L27 Duval, respectively, in Winston Manor No. 1, were received alleging damages to their property as a result of drainage conditions.. Councilman moved, seconded by Councilman Rocca, that the claims as submitted be denied and referred to the city's insurance carrot. At this time, Mr. Kaufmann, present in the audience, a property owner of Winston Manor #2, who at a prev- ious Council meeting filed a claim concerning similar allegations, spoke con- corning his claim. Brief discussion followed, after which the motion as made and ~s®conded concerning the Amorose and Swanson claims was regularly carried. JOSEPH I. PAPALE CLAIM AS FILED BY PEARL M. PAPALE: Clash of Pearl M. Papale was received ir behalf of Joseph I. Papale, deceased alleging damages as a rssult of personal injuries and damages to his property arising out of an automobile accident i~volving former City Attorney Richard P. Lyons. Councilman Lucchio moved, seconded by Councilman Rocca and regu- larly carried, that the claim be denied and referred to the city*s insurance carrier. SAFETY AWARD TO CITY: SERRA HIGHLANDS IMPROVEMENT ASSOCIATION LETTER OF THANKS: ADJOURNMENT: RESPECTFULLY SUBMI~ City Clerk Variance Permit Resolution No. 829, as applied for by Vincent and Joseph Armanino, was received from the Planning Commission, recommending that ~ermission be granted for a 10-foot encroachment into the required 15-foot front yard, portion of Parcel 17, Map 21, northeast corner of Grand and Willow Avenues. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Com- -~ssion be accepted. Variance Permit Resolution No. 830, as applied for by the Jennings Pharma was received from the Planning Commission, recommending that permission '~e granted for a 2-foot projection ever the property line instead of the permitted one foot, with double face illuminated sign, on Lot 22, Block la0, at 231 Grand Avenue. Councilmsn Rocca moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Com- ~ssion be accepted. Variance Permit Resolution No. 831, as applied for by Lawrence Vincenzini was received from the Planning Commission, recom~ending permission be granted for the re-subdivision of lot 75 feet on Baden Avenue and 140 fee o~ Orange Avenue to two lots, divided on Orange Avenue, thus having two lots 70 feet by 75 feet, each, at northwest corner of Baden and Orange Avenues, subject to the condition that only one duplex be permitted on each lot. Councilman Rocca moved, seconded by Councilman Ryan and reg- ularly carried, that the recommendation of the Planning Commission be accepted. 2ecommendation was received from Police Chief Louis Belloni that James S~infard receive his permanent appointment as a police officer, effective ~cember 1, 1957, having satisfactorily completed.his probationary period Councilman Ryan moved, seconded by Councilman Rocca and regularly carried that the recommendation of the Police Chief, as concurred in by City ilanager Aiello, be accepted. Inter office memorandum dated December 17, 1957, was received from Fire Chief A. J. Welte, recommending that James Lynch receive pay for one day sick leave. Councilman Ryan moved, seconded by Councilman Rocca and reg- · ~larly carried, that the recommendation of Fire Chief Welte, as concurred in by City Manager AieIlo, be accepted. T~e following monthly reports were received: City Clerk - mgnth of November, 1957 Building Inspecti~n Dept. - month of December, 1957 San Mateo County Health Dept. - month of November, 1957 City Garage Work Schedule - months of January, February, March ar.d April, 1958. ~iayor Rozzi remarked that if there ~ere no objections, the reports would me accepted and placed on file. No objections were registered. Notice was received, from the ~tate of California, Dept. of Alcoholic ~everage Control, concerning the transfer of On-Sale General license fre~ Elva Molinari to Elva Molinari & George Molinari at the same location. 2ouncilman Rocca moved, seconded by Councilman Ryan and regularly carrie¢ that the application be accepted an, placed on file. Mayor Rozzi then asked if any of the Council had anything they wished to offfer under Good and Welfare. Councilman Ryan briefly remarked that sine t~e opening 'of the Quality Foods Market and the delicatessen store across the street, traffic had increased, creating a pedestrian problem. He recommended that the Chief of Police and City Manager make a study of the traffic conditions and recommend whatever changes were necessary concern- ing the problem. There being no ob~ections, Mayor Rozzi requested this s~udy be made. A= this time, Mayor Rozzi brought to the attention of the Council and ~embers of the audience an award whkch had been received by the city for an outstanding campaign in safety o~. the streets and highways. He asked Captain Terragno of the Police Department to convey to the Chief and members of his department the Council's appreciation for this award. There being nothing further from any of the members of the Council, Mayo~ Rozzi asked if anyone in the audience had anything they wished to offer. Mrs. Betty Hammond, a member of the Serra Highlands Improvement Associ- ation, at this time read a communication dated December 31, 1957, fr~m her association, thanking the city for the cooperation received during the year just past, giving the letter to the City Clerk for filing. There being nothing further, CounciLman Ryan moved, seconded by Council- man Rocca and regularly carried, that the meeting be adjourned to themguls meeting of January 20, 1958.
