Present: Councilmen Andrew Rocca, G. J. Rozzi, ~milio Cortesi, Leo J. Ryan and Patrick E. Ahem Absent: None Mayor Rocca asked if there was a motion approving the minutes of the reg- ular meeting of November 2, 1959, as submitted. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the minutes of the regular meeting of November 2, 1959, be approved as submitted. Mayor Rocca then asked if there was a notion approving the regular claims for payment. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, that the claims in the amount of $24,010.82 be approved for payment as submitted. Council next took separate action on certain claims, payment for which was to come from certain funds. These weme as follows: CLa:m of Wilsey & Ham dated October 30, 1959, in the amount of $3,385.30 for work performed in Industrial Park Unit No. 2-C, Zone 1. Councilman Ryan moved, seconded by Counct~nan Rozzi and regularly carried that the claim be approved for payment. CLaln~of Bragato Paving Company dated October 30, 1959, in the amount of $3,~88.97, for first progress billing, and October 31, 1959~ the amount off S48.60 for second and final progress billing, both of which were for the resurfacing of Linden Avenue from Baden to R~ilroad Avenue. Councilman Rozzi moved, seconded by Councilman Al-em and regularly carried, that the cLa:ms be approved for payment. CLa;m of Utah Construction Company dated October 31, 1959, in the amount off $44,549.73 for Acquisitions in Industrial Park Unit No. 2-C, Zone 3. Co~lncilman Rozzi moved, seconded by Councilman Ahern and regularly carried, thai; the claim be approved for payment. Proceeding on to the matter of public hearings, Mayor Rocca remarked that iff 1;here were no objections, the public hearing on the Person and Swanson I~dustrial Tract which was continued from the meeting of November 2, 1959, wo~lLd be continued to the next regular meeting of December 7, 1959. No objections were registered. The continued public hearing on the Notice to Abate Nuisance of property located at 215 Lux Avenue having been held over at the meeting of November 2, L959, was next taken up. Brief discussion followed concerning the ac=~on which had been taken in cleanirg the first floor and some of the re~laining debris which had to be atterded to. After discussion between the Council and the property owners,,~r, and Mrs. Emile Price, Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the public hearing be continued to the next regular meeting at which time a report would be made, and in the meantime, the conditions of paper and iaff2ammable material on the second floor of the building would be cleaned u Proceeding on, Mayor Rocca opened the public hearing on the vacation of anchorage easements and public service easement in South San Francisco Industrial Park Unit No. 2-C, Zones 1 and 2, asking if any written protests had been received, to which the Clerk replied none had been received. Mayor Rocca then asked if there were any oral protests. None being regis- tered, he closed the public hearing. Mayor Rocca next opened the public heiring on the vacation of a portion of L;z:lefield Avenue and Service Road i~ South San Francisco Industrial Park U~i= No. 2-C, Zones I and 2. City Attorney Noonan suggested that since this mat=er was still under study by Council, that the public hearing be contin- ued to the next regular meeting of December 7, 1959. There being no objec- t:ions, it was so ordered by the Mayor. Council then proceeded to the matter of resolutions and proclamations, tak- ia~ up first the resolution concerning Parking District No. 1. Mr. Scampi~ a~torney for the District, briefly explained the first resolution concern- iag the matter, after which he read the title of the resolution. Councilma Rozzi then introduced: "RESOLUTION OF THE COUNCIL OF THE CITY OF SOUTH SAN F3ANCISCO AUTHORIZING THE ISSUANCE OF BONDS IN PARKING DISTRICT NO. 1 OF TH~ CITY OF SOUTH SAN FRANCISCO, IN TEE SUM OF $405,000 PRINCIPAL AMOUNT OF SERIES A BONDS, PROVIDING THE TERMS AND CONDITIONS FOR ISSUANCE OF SAID BONDS, AND PROVIDING FOR THE PLEDGE OF PARKING REVENUES AND THE LEVY OF A~ VALOREM ASSESSMENTS IN PARKING DIS?RICT NO. COUNTY ORDINANCE #1280 - CHEMICAL TOILET INDUSTRY: Mr. Scampini next explained the second resolution as it affected the Park- ing District No. 1, after which Councilman Ryan introduced: "RESOLUTION AUTHORIZING SALE OF BONDS OF PARKING DISTRICT NO. 1 OF THE CITY OF SOUTH SAF FRANCISCO, SERIES A". Roll call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Cortesi, Ryan and Ahem. City Attorney Noonan then explained the next resolution ready for Council action, after which Councilman Rozzi in;roduced: "A RESOLUTION ORDERING VACATION OF ANCHORAGE EASEMENTS AND PUBLIC SERVICE EASEMENT - INDUSTRIAL PAP~ UNIT NO. 2-C, ZONES 1 AND 2'. Roll call vote was as follows: Ayes, Coar.cilmen Rocca, Rozzi, Cortesi, Ryan ~nd Ahern. The next resolution which had to do wit2 the vacation of a portion of Llttlefield Avenue and Service Road was continued by Mayor Rocca to the meeting of December 7, 1959. No objections were received. The next resolution was then explained ~y the City Attorney, after which Councilman Ahern introduced: "A RESOLUTION OF INTENTION TO MAKE CHANGES AND MODIFICATIONS - INDUSTRIAL PARK UNIT NO. 2-C, ZONE 1". Roll call vote was as ~ollows: Ayes, Councilmen Rocca, Rozzi, Cortesi, Ryan and Ahern. The sixth resolution was next explained by the City Attorney, after which Councilman Ryan introduced: "A RESOLUTIDN OF INTENTION TO MAKE CHANGES AND MODIFICATIONS - INDUSTRIAL PARK UNIT NO. 2-C, ZONE 2". Roll call vote was as ~ollows: Ayes, Councilmen Rocca, Rozzi, Cortesi, Ryan and Ahern. The seventh resolution was explained by the City Attorney, after which Coun- ciLnan Rozzi introduced: "A RESOLUTION DF THE CITY COUNCIL OF THE CITY OF SOUSE SAN FRANCISCO CONSENTING TO THE CDMMENCEMENT OF PROCEEDINGS FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY'. Roll call vote was as fol- lows: Ayes, Councilmen Rocca, Rozzi, Ryan, Cortesi and Ahern. The next resolution as concerned the cancelling of sewer re nra1 charges on the Peichardt property was then explained by the City Attorney. He stated thaa he had spoken to the County Controller's office and after discussion wi~h them, they were satisfied that an earlier adopted resolution of the City Council cancelling City taxes would satisfy their request of cancel- la,Ion of sewer rental charges. This property was recently acquired by the Sou~h San Francisco Unified School District for the construction of another school building. The next resolution was then explained by the City Attorney, after which Councilman Ryan introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO ~RDERING THE FILING OF AN AMENDED ASSESSMENT - HARBOR WA~ ASSESSMENT DISTRICt"'. Roll call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Cortesi, Ryan and Ahem. Although not appearing as resolutions on the agenda, Council then took up the ~ollowing resolutions. After brief explanation by the City Attorney, Councilman Ahem introduced: "A RESOLUTION OF INTENTION TO VACATE ANCHORAGE EASemENTS, PUBLIC SERVICE EASEMENTS AND DRAINAGE EASEMENTS - INDUSTRIAL PA~K UNIT NO. 2-C, ZONES 1 AND 2". Roll call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Cortesl, Ryan and Ahem. The Last resolution was then taken up and explained by the City Attorney, after which Councilman Rozzi lntroducec: 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO OPPOSING REPEAL OF THE 'BUY AMERICAN ACT' RoLl call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Cortesi, Ryan and Ahem. Proceeding on to ordinances, City Attorney Noonan briefly explained the ordinance which had been prepared to a~end Section 2 of Ordinance No. 272, afaer which Councilman Roz~i moved, seconded by Councilman Ryan and reg~ arl ca__Zed, that the ordinanc~ ~ntroduced by the reading of title and the de- tailed reading be waived. City Attorney Noonan read the title of the ordinn al:er which he stated a motion would be needed as follows: "Be it moved that the ordinance entitled: 'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SCUT] SAN FRANCISCO AMENDING SECTION 2 OF ORDINANCE NO. 272' be introduced." Councilman Ryan so moved, seconded by Councilman Cortesi and regularly carrLed. The:re being no unfinished business, Council next took up the first matter under new business which was a communication dated November 3, 1959, from the office of Patrick J. Kearns, concerning a petition for annexation of property located at the northwest corner of Country Club Drive at E1Camino. Acc0~panying the letter was a petition for annexation as signed by the two property owners, Mary Janeira and Violet Fay. Council having already t~ care of the matter under resolutions, r.o further action was taken at this ti~e. Communication dated November 6, 1959, was received from the South San Fran- cisco Unified School District, together with a copy of their Resolution #40 co~ending the City for their cooperat:on. In ordering this communication filed, Mayor Rocca requested that it be acknowledged by the Clerk and that Council's appreciation be expressed to the school authorities. Co~uunication dated November 9, 1959, vas received from the Department of Public Health and Welfare of San Mateo County, together with a copy of theii ordinance concerning the legislation for the chemical toilet industry, re- questing that the City adopt a similar ordinance to that of the County. Councilman Ryan moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the County be accepted and the City Attorney be requested to prepare the necessary ord:nance in accordance with their reque~ REVISED I~PROVEMENT PLANS - SSF IND. Brief discussion followed, at which time, City Attorney Noonan stated that in accordance with the request of Council he had prepared the following motion concerning the matter: "Move that mpon acceptance by contractor, Lowrie Paving Company, and consent and approval of its sureties and insurance carrier of the written request for changes in the plans and specifications and contract documents of Industrial Park 2 by the Director of Public Works {said request to contain plans and specifications of the proposed changes) the said proposed changes stand approved, providing that developer, Utah Construction & Mining Co., shall complete the improvements as previously approved, should the final map to be submitted not be accepted by City". After the City Attorney had read the motion, Councilman Ryan so moved, seconded by Councilman Rozzi and regu- larly carried. Co~unication dated November 10, 1959, was received from the engineering fir~ of Wilsey & Ham, submitting improvement plans, and specifications for South San Francisco Industrial Park Unit 2-D, Zones i & 2 and the revised assess- ment for South San Francisco Industrial Park Unit 2-C, Zones I & 2. There being no objections, Mayor Rocca referred the matter to the offices of the City Attorney, City Manager and Director of Public Works for the setting of a hearing date, continuing the matter to the next regular meeting of December 7, 1959. Me~r~ndum dated November 13, 1959, was received from the Planning Commissio~ recommending granting the resubdivision request of E. T. Dady for Utah Construction & Mining Company to resubd~vide Lot 12, Block 8, South San Francisco Industrial Park Unit No. 2-A, into two Parcels - 12A and 12B. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Variance Application No. 1170, as applied for by Cresta Bros., was received fro~. the Planning Commission, recommending that permission be granted for erection of one 4' x 5' D/F horizontal neon sign to project 3 feet beyond the minimum one foot over public proper~y on Lot 1, Block 123. Councilman Ryan moved, seconded by Councilman Rozz~ and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Variance Application No. 1171, as applied for by Brosnan Bros. and Irma Galls Tognoli, was received from the Planning Commission, recommending that permission be granted to subdivide Lot 4 into two 25-foot parcels, so as to coffbine the westerly 25 feet of Lot 4 with the 50 feet of Lot 5, Block 118. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Use Permit Resolution No. 1172, as applied for by Violette Motors, was re- ceived from the Planning Commission, recommending denial of the request of Violette Motors for permission to store cars on the rear of lot at 401 Airport Blvd.. Mr. James Violette, the applicant, at this time spoke in be- half of his application. After discussion, Mayor Rocca stated that if there were no objections, this matter would be continued to the next regular meet- ing of December 7, 1959, and that in the meantime a further study would be made of the area and information secured. No objections were registered. Use Permit Resolution No. 1173, as applied for by Foster and Kleiser, Div. o: W. ~. Grace & Co., was received from the Planning Commission, recommending that permission be granted for one outdoor advertising structure, 12 ft. x 25 ft. and under 25 feet in overall height, at 333 East Grand Avenue, subjec' to t~e condition that upon termination of the advertising contract with Swif an~ Company, the sign shall be removed. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Plan- ning Commission be accepted and approved. Use Permit Resolution No. 1174, as applied for by Mr. John Philipopolus, was received from the Planning Commission, recommending that permission be granted for the erection of a duplex on the front of Lots 51, 52 and 53, Block 133, Buckingham Subdivision, Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Plan- ning Commission be accepted and approved. Use Permit Resolution No. 1175, as applied for by Mr. Ken F. Royce, was re- ceived from the Planning Commission, recommending that permission be granted for the extension of existing use for m~tel, consisting of addition of 50 note1 units and 50 parking spaces to present facilities at 326 South Air- porl; Blvd., subject to the condition that the proposed 52 room hotel as shown on the plans i~ not a part of this Use Permit. Councilman Ryan moved seconded by Councilman Rozzi and regularly carried, that the recommendation of 1;he Planning Commission be accepted and approved. Planning Commission Resolution No. 1176 was received, recommending approval of ~he vacation of drainage easements on the Akard property. There being no objections, Mayor Rocca continued this ~atter to the next regular meeting of December 7, 1959, stating that in the meantime a further study would be made Use Permit Resolution No. 1177, as applied for by Dinucci's Launderette, was received from the Planning Commission, recommending that permission be granted to establish a self service launderette at Lot 23, Block 117. Coun- ci2nan Ryan moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Use Permit Resolution No.1178, as applied for by Verducci and Meier, was re- ceived from the Planning Commission, recommending permission to erect D/F neon sign, 14' x 23' overall, non-flashing and non-scintillating, at 211 Air SSF IND. Communication dated November 10, 1959, was received from the engineering of Wilsey & Ham, submitting improvement plans, and specifications for Sot San Francisco Industrial Park Unit 2-D, Zones I & 2 and the revised asset ment for South San Francisco Industrial Park Unit 2-C, Zones I & 2. Memorandum dated November 13, 1959, was received from the Planning Commit recommending granting the resubdivision request of E. T. Dady for Utah Construction & Mining Company to resubdivide Lot 12, Block 8, South San Francisco Industrial Park Unit No. 2-A, into two Parcels - 12A and 12B. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carrie¢ that the recommendation of the Planning Commission be accepted and appro~ Variance Application No. 1170, as applied for by Cresta Bros., was recei~ from the Planning Commission, recommending that permission be granted fo~ erection of one 4' x 5' D/F horizontal neon sign to project 3 feet beyon( the minimum one foot over public property on Lot 1, Block 123. Mr. James Violette, the applicant, at this time spoke in half of his application. Planning Commission Resolution No. 1176 was received, recommending appro~ of the vacation of drainage easements on the Akard property. Councilman Cortesi brought to Council's attention the matter of traffic co~ ditions at Orange and 'B' Streets by juvenile drivers going to and from school, creating a traffic hazard. He remarked that the residents of the area had complained to him concerning speeders. He suggested that the Manager discuss this with the Police Chief concerning a man to be placed a' this location. Mayor Rocca referred this matter to the City Manager and Captain of Police who was present. TREASURE ISLAND TRAILER COURT ANNEXATION REQUEST TO MR. BERTETTA: Councilman Cortesi then brought to Council's attention the matter of com- mencing annexation proceedings with the Treasure Island Trailer Court, sta' lng that the City could realize more revenues as a result of trailer coach fees. Berretta of the Treasure Island Trailer Court be requested and instructed to commence annexation proceedings to the City. DEVINCENZI & CUNEO ANNEXATI ON: Councilman Cortesi also suggested that the Devincenzis and Cuneos, owners, property on Mission Road, had also some time back expressed interest in annexation to the City and suggested that they also be contacted concerninl annexing. Mr. John Pryshepa of 3846 Bayshore Blvd., Brisbane, presented to Council a petition by 34 property owners of Brisbane, requesting annexation of their properties to the City of SoOth San Francisco. Discussion followed, at wh time other residents of Brisbane present spoke concerning their desire to annex, after which Mayor Rocca stated that if there were no objections, he would request that the Council have further time to go over the petition a the request.
