CALL TO ORDER:__ Mayor Mammini called the meeting to order at 8:02 p.m. PLEDGE OF ALLE- GIANCE AND INVOCATION: The Pledge of Allegiance to the Flag was recited after which the Invocation was given by Reverend Charles Erion of the Hillside Church of God. ROLL CALL: ..Present: Absent: Councilmen Patrick E. Ahern, Gordon T. Bobtitt, William A. Borba, F. Frank Mammini and Warren Steinkamp None MINUTES: Mayor Mammini asked if there was a motion approving the Minutes of the regular meeting of October 24, 1972 and the special meeting of October 30, 1972, Councilman Steinkamp moved, seconded by Councilman Borba and regularly carried, that the Minutes of the regular meeting of October 24, 1972 and the special meeting of October 30, 1972, be approved as submitted. REGULAR CLAIMS: Mayor Mammini then asked if there was a motion approving the regular claims as submitted for payment. Councilman Borba requested a breakdown on two claims, that of the Leaning Tower Restaurant and the New Southern Restaurant. Discussion followed after which, there being no objections, Mayor Mammini ordered these~two claims withdrawn for approval this evening, and that a breakdown be provided. Councilman Steinkamp moved that the regular claims, total of which had been shown as $57,477.84 and with the requested claims of the Leaning Tower and New Southern Restauran~ in the amount of $253.63 withdrawn, leaving a balance of $57,224.21, be approved for payment, seconded by Councilman Boblitt and regularly carried. RESO. NO. 5973 The first resolution was explained by City Attorney Noonan concerning AUTHORIZING EXE- the Deep Water Outfall, Souther Pacific Transportation Company Indent- CUTION OF INDENT- ure after which Councilman Steinkamp introduced the resolution entitled: URE WITH S.P.CO. "A RESOLUTION AUTHORIZING EXECUTION OF AN INDENTURE WITH SOUTHERN OUTFALL FORCE MAIN PACIFIC TRANSPORTATION COMPANY (OUTFALL FORCE MAIN PROJECT C-06-0656)." PROJECT C-06-0656) Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, ~_~ /~] ~ Gordon T. Boblitt, William A. Borba, F. Frank Mammini and Warren Steinkamp. Noes, none. Absent, none. RESO RE SALARY SCHEDULES & IN- CREASES FOR 1972-73" RESO RE AWARD OF CONTRACT WESTBOROUGH PARK The next resolution concerning the establishment of salary schedules and increases for the fiscal year 1972-73 was explained by City Attorney Noonan. At the request of City Manager Dreisbach that this resolution be withdrawn and since there were no objections, Mayor Mammini so ordered. The Inter-Office Memorandum from the Department of Ecological Development submitting compilation of bids and recommendation for award of contract for Westborough Park II - Westborough & Galway, was next considered by Citv Council. RESO RE AWARD OF CONTRACT (CONTINUED: RENO. NO. 5974 APPROVING FINAL MAP CONDOMINIUM PROJECT NO. 2 STONEGATE RIDGE & AUTHORIZING RELATED ACTS: Mr. Fred Hull, Director of Ecological Development, requested that the accompanying resolution be withdrawn. There being no objections, Mayor Mammini so ordered. The next item was the Inter-Office Memorandum dated October 25, 1972 from the Secretary to the Planning Commission submitting recommend- ation of approval of the Instant Final Map, subject to compliance with City regulations - SA-25 Final Map of Condominium Project No. 2 Stonegate Ridge Planned Community District. City Attorney Noonan explained the resolution after which Councilman Borba introduced the resolution entitled: 'A RESOLUTION APPROVING FINAL MAP OF CONDOMINIUM PROJECT NO. 2 STONEGATE RIDGE PLANNED COM- MUNITY DISTRICT AND AUTHORIZING RELATED ACTS." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba, F. Frank Mammini and Warren Steinkamp. Noes, none. Absent, none. RESO. NO. 5975 After an explanation by City Attorney Noonan, Councilman Steinkamp REQUESTING S'.M. introduced the resolution entitled: "A RESOLUTION REQUESTING THAT CO. FLOOD CONTROL THE SAN MATEO COUNTY FLOOD CONTROL DISTRICT ACQUIRE RIGHTS OF WAY FOR DIST. ACQUIRE COLMA CREEK IMPROVEMENT INCLUDING STATE LANDS, PURSUANT TO WATER RIGHTS OF WAY FOR CODE ACT 7261, SECTION 30." COLMA CREEK IMP.: RESO REGARDING AGREEMENT WITH CHAMBER OF COMMERCE: RESO. Noes, none. Absent, none. · City Attorney Noonan requested that the next resolution regarding the amendment to the agreement with the Chamber of Commerce be deleted. As there were no objections, Mayor Mammini so ordered. City Attorney Noonan explained the next resolution concerning signatures authorized for checks and warrants after which brief discussion followed. Councilman Steinkamp introduced the resolution entitled: 'A RESOLUTION REGARDING SIGNATURES AUTHORIZED FOR CHECKS AND WARRANTS." Roll call vote was as follows: Ayes, Councilmen Patrick E. NO. 5977 NOISE ELEMENT OF GENERAL PLAN: City Attorney Noonan requested that the next resolution concerning custody of funds be deleted from the agenda. After an explanation by City Attorney Noonan, Councilman Boblitt introduced the resolution entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO TO THE HONORABLE BOARD OF SUPERVISORS OF THE COUNTY OF SAN MATEO RECOMMENDING THAT THE RPC BE CHARGED WITH THE PREPARATION OF A COUNTY-WIDE NOISE GENERAL PLAN ELEMENL' Roll call vote was as follows: Ayes, Councilmen Patrick ED Ahern, Gordon T. The ordinance entitled: "AN ORDINANCE REGULATING SHOPPING CARTS" was the next matter for Council's attention. At the request of the City Attorney that the ordinance be continued, and since there were no objections, Mayor Mammini so ordered. City Attorney Noonan at this time stated that City Council had received a petition from the law office of Bocci and Modena on behalf of certain residents of Sunshine Gardens requesting permission to take up this matter at this time as it could be considered as a Public Hearing which should have been taken up earlier. Mayor Mammini recessed the Council meeting in order that the hearing could proceed. Mr. Thomas Bocci in detail explained the problem, suggesting solutions in this regard as well as suggestions for Council's action. A brief recess then took place so that the TV cameras could be retaped at 8:57 p.m. The public hearing was recalled to order by Mayor Mammini at 9:14 p.m. with all Council present. Further discussion followed by Mr. Bocci after which,ther6 being no objections, Mayor Mammini suggested that the City Attorney confer with Mr. Bocci and discuss this matter which could then be referred back to Staff for study. Mr. Bocci requested that the public hearing be continued. The following residents then spoke concerning the matter: Mr. Louis Martin, 1313 Crestwood Drive; Mr. Rudolph J. Biondi, 437 DellbroSk Dr ve. Since there were no further discussions, Mayor Mammini continued the public hearing to November 20, 1972. Mayor Mammini at this time recalled the regular meeting back to order at 9:27 p.m. The next item was the claim against the City as filed by Caritina M. Gonzalez for alleged personal injuries sustained as a result of flooding waters. Councilman STeinkamp moved, seconded by Councilman Ahern and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the C~vernment Code. CLAIM AS FILED ON BEHALF OF JAMES & SONIA PETERS: The next item was the claim as filed by Bocci and Modena, Attorneys at Law, on behalf of James and Sonia Peters, 1309 Crestwood Drive, for alleged flood damages. Councilman Boblitt moved, seconded by Councilman Ahern and regularly carried, that the claim be reJected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of theGovernment Code. CLAIM AS FILED ON BEHALF OF FRED & LILLIAN MATAS: The next item was the claim as filed by Bocci and Modena, Attorneys at Law, for damages as a result of flooding, on behalf of Fred and~Lillian Matas, 1321Crestwood Drive. CLAIM AS FILED ON BEHALF OF MRS. EDWARD PATON: The next item was the cl~aim as filed by Mrs. Edward Paton for alleged damages sustained to her vehicle while being serviced in a flooded area. Councilman Ahern moved, seconded by Councilman Steinkamp and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. CLAIM AS FILED The next item was the claim as filed by the law office of Wexler & BY WEXLER & WEXLER Wexler on behalf of Mclntyre Engineering Company, Inc., and S. P. ON BEHALF OF Trapanese and Harvey E. Finch for alleged d~mages as a result of over- MclNTYRE ENG. CO.: flow of Colma Creek, October II, 1972. Councilman Ahern n~ved, seconded by Councilman STeinkamp and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the C~vernment Code. CLAIM AS FILED BY KENNETH G. PATRICK: The next matter was the claim against the City for alleged damages as a result of collision with City-owned veh~icle by Mr. Kenneth G. Patrick. Councilman Boblitt moved, seconded by Councilman STeinkamp and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. CLAIM AS FILED BY P.T.&T. CO.: The next item was the claim against the City as filed by the Pacific Telephone and Telegraph Company for alleged damages to underground facilities at 2350 Galway Place as a result of City street work. Councilman Ahern moved, seconded by Councilman Borba and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. APPEAL TO P.C. POLICY STATEMENT OF PUD "K" WESTBOROUGH WEST PARK 3: The next item was the letter of appeal dated September 28, 1972 from AVCO Community Developers, Inc., appealing Planning Commission's Policy Statement of PUD "K" in Westborough West Park 3, Planned Community District, That Developer Should Landscape Front Yards of Townhouses. City Attorney Noonan suggested that the Public Hearing be set for December 4, 1972. As there were no objections, Mayor Mammini so ordered. REPORT - DED COLMA CREEK IMP. LOCAL PROJECT The next item was the Staff Report concerning Improvement of Colma Creek. Director Fred Hull, Department of Ecological Development, in detail read from his report concerning the matter after which he made recom- mendations in this regard to Council. RESO. NO. 5979 Discussion followed after which Councilman STeinkamp introduced a reso- RE PROPOSED COLMA lution entitled: "A RESOLUTION REGARDING PROPOSED COLMA CREEK IMPROVE- CREEK I MPROVE- MENTS 1972: RECESS ~ RECALL TO ORDER:, MENT LOCAL PROJECT - 1972." Further discussion followed after which Mayor Mammini recessed the meeting at 10:14 p.m. for retaping of TV cameras. Mayor Mammini recalled the meeting to order at 10:25 p.m. with all Council present. Further discussion followed after which City Attorney Noonan recommended that, in addition to the conditions as mentioned by Mr. Hull, there be a further condition that the matter proceed with a conference with San Mateo County officials. -6- 11/6/72 COLMA CREEK IMP. Further discussion followed during which the following persons spoke: Mr. Prezant, businessman fron the industrial area; Mrs. Betty Higgins, 701 Hillside Boulevard; Mr. Robert Whitehead, 5 Sonora Avenue. Absent, none. ,.Mayor Mammini declared a recess at 11:25 p.m. The meeting was recalled to order by Mayor Mammini at 11:31 p.m. with all Council present. Mrs. Inez Lesko, 211 Orange Avenue, brought to the attention of the Council a problem of flooding which she suffered, with the request that some suggestions be made by the City in order to prevent this reoccurrence. Mr. Fred Hull stated he would try to contact Mrs. Lesko in the very near future to see what the solution of the problem could be. The next item was the report concerning suit on Moratorium to building in upper: watershed areas and law suits on Injunctions on surrounding communities. City Attorney Noonan requested a continuance since he had not been able to complete the study, having ordered briefs from other such cases which have not arrived as yet. Mayor Mammini so ordered as there were no objections. The next matter was the report of recommendation regarding Acceptance of Common Greens for Maintenance - Stonegate Ridge Unit No. I. At the request of Mr. Hull, Director of Ecological Development, Mayor Mammini continued the matter. The report concerning financing of Police Facility was the next item for Council's consideration. Mayor Mammini continued this matter to the next meeting at the request of the City Manager and since there were no objections to the continuance. The next item was the report concerning the remodeling of City Hall. Director Hull, Ecological Development, explained the remodeling of the basement to take place after which Councilman Steinkamp moved, seconded by Councilman Boblitt and regularly carried, that the City proceed with the remodeling. Councilman Borba voted "No." The next item was the communication dated October 23, 1972 from Mr. Phillip Van Der Leest submitting his resignation from the Park and Recreation Commission. Mayor Mammini ordered the communication accepted and placed on file. Mayor Mammini asked if there were any items from Staff. As there were none, Mayor Mammini requested to know if there were any Items from Council. Councilman Steinkamp requested permission to be absent from the State. Councilman Boblitt moved, seconded by Councilman Ahern and regularly carried, that permission be granted. -7 - 11/6/72 COMMENTS RE DEBRIS IN COLMA CREEK CHANNEL: Councilman STeinkamp at this time brought up the matter of dumping of debris which took place in the Cnl~a Creek channel, asking as to what enforcement the City needed to'apply. City Manager Dreisbach mentioned that the creek had been sign,posted advising of the penalties which would be involved. He stated that it would again be sign-posted to replace th~se which had been destroyed by recent flood waters. COMMENTS RE Councilman Borba then brought up the matter of the recent newspaper NEWSPAPER ARTICLE article concerning the reorganization of the Park and Recreation Depart- RE CHANGES IN ment, objecting to some of the suggested changes. PARK & REC. DEPT.: Discussion followed after which Director Hull, Department of Ecological .~h~7~f/~2 Development, stated that when the meeting had been completed with the Commission, he would report back to the City C~uncil. GOOD AND WELFARE: Mayor Mammini asked if anyone in the audience wished to speak under Good and Welfare, upon the conclusion of Items from Council. INFORMATION RE- QUEST RE ANIMAL CONTROL ORD.: Mr. Wesley Slade, 2555 Donegal Avenue, requested information as to the progress of the new animal control ordinance. City Manager Dreisbach stated that the Deputy City Attorney had the ordinance ready for Council's consideration at their last meeting but that a report had been received from the County concerning the matter of rabies and that this item had to be placed into the ordinance. He stated that this ordinance should be ready for Council's attention at their next regular meeting. ADJOURNMENT N MEMORY OF MR. E. P.
