TOEL!.NER: MINUTES: REGULAR CLAIMS: 8:00 pom. Council Chambers, City Hall. Vice Mayor Steinkamp called the meeting to order at 8:03 p.m. The Pledge of Allegiance to the Flag was recited and the Invocation was given by Reverend Robert F. Clazie, St. Paul's United Methodist Church. Present: Absent: Councilmen Patrick E. Ahern, Gordon 'T. Boblitt, William A. Borba and Warren STeinkamp. Councilman F. Frank Mammini. Vice Mayor Steinkamp stated that Mayor Mammini's absence was due to illness. Vice Mayor Steinkamp at this time introduced Fire Chief Lawrence A. Toellner. Fire Chief Toellner expressed his gratitude to the Council, stating that he looked forward to a greater Fire Department and would be most happy to do anything requested of him. Vice Mayor Steinkamp asked if there was a motion approving the Minutes of the regular meeting of December 4, 1972. Councilman Borba moved, seconded by Councilman Boblitt and regularly carried, that the Minutes of the regular meeting of December 4, 1972, be approved as submitted. Vice Mayor Steinkamp then asked if there was a motion approving the regular claims as submitted for payment. Councilman Boblitt moved that the regular claims, totaling $106,239.20, be approved for payment. Councilman Borba stated that before he would second the motion, questioned the claim for VWR Scientific. Councilman Borba then seconded the motion with the exception of the claims as submitted for luncheons, VTN and VWR Scientific. Councilman Ahern requested information concerning the monies budgeted for VTN. Lengthy discussion followed concerning the comparison of work being performed by VTN and in-house management and the savings involved. In answer to Councilman Ahern, Director of Ecological Development Hull explained the fact sheet as prepared by Finance Director Alario. Councilman Ahern next questioned a charge for a study for an Orange Avenue drain and this was explained by Director Hull. Vice Mayor Steinkamp stated that there was a motion and second and requested Council's pleasure. Councilmen Boblitt and Steinkamp voted in approval of the regular claims and Councilmen Ahern and Borba against approval of the regular claims. Councilman Mammini was absent. REGULAR CLAIMS: (CONTINUED) The approval of the regular claims of the meeting of December 18, 1972 was ordered continued to the next regular meeting. PARKING DIST. NO. I CLAIMS.: Vice Mayor Steinkamp then asked if there was a motion approving the claims as submitted for Parking District No. I for payment. Councilman Ahern moved, seconded by Councilman Borba and regularly carried, that the claims as submitted for Parking DistriCt No. I, totaling $9.57, be approved for payment. PUBLIC HEARING: The next item was the continued Public Hearing - Appeal from Planning Commission Policy Statement regarding Frontyard Landscaping in the Planned Community and Planned Unit Development. Since this matter was scheduled for Council's agenda of January 2, 1973, Vice Mayor Steinkamp again continued the Public Hearing. RESO ESTABL I SH- I NG SALARY SCHEDULES 1972-73: ,--p_ 0 oO The next item was the resolution entitled: "A RESOLUTION ESTABLISHING SALARY SCHEDULES AND INCREASES FOR THE FISCAL YEAR 1972-73." Discussion followed concerning the specific recommendations from the office of the City Manager, wage negotiation meetings and cost of living increases after which, at the request of City Manager Dreisbach and as there were no objections, Vice Mayor Steinkamp continued the resolution to the next regular meeting. RESO. NO. 5993 APPROVING SPECS CALL FOR BIDS FOR FIRE HOSE: City Attorney Noonan explained the next resolution which comes at the recommendation of the City Manager and Fire Chief after which Councilman Borba introduced the resolution entitled: "A RESOLUTION APPROVING SPECIFICATIONS AND CALLING BIDS FOR FIRE HOSE." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. RESO. NO. 5994 The next resolution for Council's attention awarded the contract for AWARD OF CONTRACT the improvements of Westborough Park, Phase II. IMP. WESTBOROUGH PARK I1: Director of Ecological Development Hull explained the areas of work ~.~ which had been performed and declared the bids received with the lowest ~]]~,~ bid submitted by Collishaw Corporation with the bid of $111,488.00, and recommended award to the Collishaw Corporation. Discussion followed concerning the advisability of certain improvements in the area after which Councilman Boblitt introduced the resolution entitled: 'A RESOLUTION OF AWARD OF CONTRACT IMPROVEMENTS FOR WEST- BOROUGH PARK - II, WESTBOROUGH BLVD, AND GALWAY DRIVE, SOUTH SAN FRANCISCO, CALIFORNIA, 1972." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. RESO. NO. 5995 IN HONOR OF JUDGE JOSEPH A. BRANSON: City Attorney Noonan presented the resolution honoring Judge Joseph A. Branson on his retirement after seventeen years of service, for Council's cons i derat ion. Councilman Ahern introduced the resolution entitled: "A RESOLUTION IN HONOR OF JUDGE JOSEPH A. BRANSON." Roll call vote was as follows: Ayes, Councilmen Patric, E. Ahern, Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. RESO. NO. 5996 DES I GNAT I NG C I TY OFFICIALS TO USE REVOLVING FUND: / Deputy City Attorney John Shaw explained the next resolution as a com- panion resolution to the ordinance listed on the evening's agenda for its second reading and adoption, authorizing City officials to draw upon revolving fund. -2 - 12/18/72 RESO. NO. 5996 (CONTI NUED) In answer to Councilman Ahern, City Manager Dreisbach explained that the revolving fund would be used only for legitimate appropriate funds. Further discussion followed concerning the functions of the Finance Department and the responsiblities for maintenance of the revolving fund. Councilman Ahern suggested that an amendment be made to the resolution to have a breakdown of expenditures from the revolving fund be made available to Council. As there were no objections, Councilman Ahern introduced the resolution entitled: 'A RESOLUTION DESIGNATING CITY OFFICIALS AUTHORIZED TO DRAW UPON REVOLVING FUND." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. RESO. NO. 5997 ESTABLISHING COST FOR STORAGE ABANDONED SHOPPING CARTS: Deputy City Attorney John Shaw explained the next resolution as dealing with shopping-cart aspect of a total problem, further explaining the procedure involved. Councilman Borba introduced the resolution entitled: "A RESOLUTION ESTABLISHING REASONABLE COSTS OF STORAGE, CARE, AND CUSTODY OF ABANDONED SHOPPING CARTS." Further discussion followed concerning previous experiences and notifi- cation of abandoned carts after which roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. RESO. NO. 5998 City Attorney Noonan explained that the next matter is a series of APPROVING PLANS resolutions concerned with the City's wastewater treatment plant im- & SPECS; CALL provements and would be broken down to three projects. FOR BIDS FOR PROJECT NO. I Director of Ecological Development Hull explained that i.n requesting WASTEWATER TREAT- approval from the Environmental Protection Agency, Water Quality Control MENT PLANT IMP. Board and Army Corps of Engineers, notification had come after the (1972): agenda was closed~ that it was eminent that the City would be issued ~7 Corps of Engineers' Permit and it was recommended that the City pro- ~]~t~0 ceed with bidding. He explained that in going to bid now, the City would realize a savings of 5 to 10% on a six million dollar contract. Further discussion followed among Councilman Ahern, Director Hull and City Attorney Noonan concerning consideration of Council for only listed agenda items, recent notification by the Federal Government and urgency of the clean water project. Councilman Ahern introduced the first of the resolutions entitled: "A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR PROJECT UNIT NO. I, WASTEWATER TREATMENT PLANT IMPROVEMENTS (1972)." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba and Warren STeinkamp. Noes, none. NO. 5999 APPROVING PLANS & SPECS; CALL FOR BIDS FOR PROJECT NO. 2 OUTFALL FORCE MAIN (1972): Councilman Ahern introduced the second Of the series of resolutions entitled: "A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHO- RIZING THE WORK AND CALLING BIDS FOR PROJECT UNIT NO. 2, OUTFALL FORCE MAIN (1972)." NO. 6000 Councilman Ahern introduced the last of the three resolutions entitled: APPROVING PLANS "A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK & SPECS; CALL AND CALLING BIDS FOR PROJECT UNIT NO. 3, SUBMARINE OUTFALL (1972)." FOR BIDS FOR PROJECT NO. 3 Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, SUBMARINE OUTFALL Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. NC. 6001 Deputy City Attorney Shaw at this time stated ~hat the resolution that DESIGNATING CITY was listed as an Item from Staff was ready for Council's consideration OFFICIALS AUTHO- and would authorize the City Manager and Director of Finance to examine RIZED TO EXAMINE the Board of Equalization Sales Tax records in Sacramento. SALES TAX,RECORDS: Discussion followed concerning the previous resolution which designated ~q~ the City Manager only and his designee and the new resolution, including · the Director of Finance and his designee. Councilman Ahern suggested that every Councilman have the same opportunity since they represent the people. Further discussion followed concerning the inclusion of the City Clerk's name as an authorized person. Vice Mayor Steinkamp requested Council's pleasure after which Councilman Boblitt introduced the resolution entitled: "A RESOLUTION DESIGNATING CITY OFFICIALS AUTHORIZED TO EXAMINE THE BOARD OF EQUALIZATION SALES TAX RECORDS." Councilman Ahern stated that he like to add the names of the City Treasurer, City Clerk and anyone on the City Council who might have time to check the tax records, to those of the City Manager and Finance Director. Councilman Boblitt stated that he had no objections to the amendment. Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, William A. Borba and Gordon T. Boblitt. CITATION SYSTEM: 2nd Reading/ Ado0tion ,J3 The Deputy City Attorney Shaw explained the ordinance and advised the City Council regarding procedure for adoption and passage. Councilman Boblitt moved that reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Ahern and passed by unanimous vote. Councilman Boblitt moved that the ordinance entitled: "AN ORDINANCE AMENDING ORDINANCE NO. 564, AS AMENDED, PROVIDING FOR IMPLEMENTATION OF CITATION SYSTEM," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Ahern and passed by the following roll call vote. CO: CLAIM AS FILED BY GAlL WENZEL: OZ% Councilman Boblitt moved that the ordinance entitled: "AN ORDINANCE PROVIDING FOR CARE, DISPOSTION AND DESTRUCTION OF UNCLAIMED PROPERTY," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Borba and passed by the following roll call vote. Councilman Boblitt moved that the ordinance entitled: "AN ORDINANCE CREATING REVOLVING FUND FOR USE BY CITY MANAGER AND CITY COUNCIL AND REPEALING ORDINANCE 291 ENTITLED, 'AN ORDINANCE ESTABLISHING A REVOLVING FUND FOR THE CITY CLERK OF THE CITY OF SOUTH SAN FRANCISCO,'" the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Ahern and passed by the following roll call vote. Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Gordon T. Boblitt, William A. Borba and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. The next item was the report dated December 4, 1972 from the Department of Ecological Development regarding Circle Court Levee. City Attorney Noonan at this time explained to Council the analysis made by Director hull and from a sketch, explained how the berm along the north border of Mazzanti property acts to retart waters, resulting in flooding in the agricultural area. Further discussion followed concerning the California Water Company's pumo in the field and City's concern of caoacity. City Attorney Noonan recommended Council consider the installation of a dike on the assumption that the ademuacy will be provided for. Vice Mayor Steinkamp stated that, at the request of the Department of Ecological Development, this matter be continued to the Study Session of January 3, 1973. There being no objections, it was so ordered. Further discussion followed concerning the waters forced into Commercial Avenue, the routing and ponding of waters and alternate solutions of the problem. The next item was the claim as filed against the City by the Pacific Gas and Electric Company for alleged damages as a result of cable dig-in. Councilman Boblitt moved, seconded by Councilman Ahern and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. The next claim as filed by Miss Gall Wenzel for alleged damages to her vehicle as a result of street work was considered by Council. Councilman Ahern moved, seconded by Councilman Borba and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code sections 913, 915.4 and other related sections of the C~vernment Code. -5- 12/18/72 CLAIM AS FILED The next item was the claim as filed against the City by the law firm BY BOCCI AND of Bocci and Modena on behalf of Burkhardt Manufacturing Company for MODENA ON BEHALF alleged damages as a result of flooding of Colma Creek. BURKHARDT MFG.: Councilman Boblitt moved, seconded by Councilman Borba and regularly c~O~ ~ carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the C~vernment Code. CLAIM AS FILED The next matter for Council's attention was the claim as filed by BY JOHN A. PUTKEY John A. Councilman Ahern moved, seconded by Councilman Borba and reqularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the C~vernment Code. CLAIM AS FILED The next item was the claim as filed by John A. Putkey, Attorney at Law, BY JOHN A. PUTKEY on behalf of Elma C. Crouch for alleged damages or loss as a result ON BEHALF OF of Colma Creek flooding. Councilman Ahem moved, seconded by Councilman Boblitt and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. The next claim for Council's attention was filed by John A. Putkey, Esq., on behalf of Peter and Lulu Giachetti for alleged damages as a result of flooding. Councilman Borba moved, seconded by Councilman Boblitt and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the Government Code. The next item was the claim againstithe City as filed by the law office of McCarthy & Perillat on behalf of Saracco Tank & Mfg. Corp., for alleged damages as a result of Colma Creek flooding. Councilman Boblitt moved, seconded by Councilman Borba and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the C~vernment Code. The next matter for Council's consideration was the claim as filed against the City by McCarthy & Perillat, Attorneys at Law, on behalf of Sullivan's GMC for alleged flood damages. Councilman Borba moved, seconded by Councilman Boblitt and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. The next item was the claim as filed by McCarthy & Perillat, ATtorneys at Law, on behalf of Kransco Manufacturing, Inc., for alleged damages as a result of Colma Creek flooding. Councilman Borba moved, seconded by Councilman Boblitt and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. The next matter was the claim as filed by the law office of Xenophon Tragoutsis on behalf of DLM Land Company, Inc., for alleged flood damages. Councilman Boblitt moved, seconded by Councilman Borba and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. The next item was the claim as filed against the City by the law office of Xenophon Tragoutsis on behalf of Prezant Company for alleged damages as a result of Colma Creek flooding. Councilman Borba moved, seconded by Councilman Boblitt and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. - 7- 12/18/72 CLAIM AS FI LED BY HARTFORD INS. RELEASE OF BONDS LANDSCAPE ARCHI- TECT'S FEE: REPORT OF SUNSHINE GARDENS COMM I TTEE: The next item was the claim as filed by the Hartford Insurance Company on behalf of their insured, Pete Mazzanti, for alleged damages as a result of Colma Creek flooding to personal property. Councilman Borba moved, seconded by Councilman Boblitt and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the P~vernment Code. The next item was the request of J. H. Snyder Company dated November 30, 1972 for release of bonds for landscape architect's fee to prepare landcape specifications and drawings for Common Greens - Westborough- West Park 3B and 3C. In answer to Vice Mayor Steinkamp's inquiry if everything was in order, Director of Ecological Developmen Hull recommended release of the bonds which were for architectural fees in the amount of $15,000 and stated that the City still hold bonds in excess of $300,000 for completion of the green areas. Councilman Boblitt moved, seconded by Councilman Borba and regularly carried, that the recommendation of the Director of Ecological Develop- ment be approved and accepted and the Performance, Labor and Material Bond No. 075711 in the amount of $8,100, West Park 3B; Performance, Labor and Material Bond No. 079262 in the amount of $7,800, West Park 3C be released. The next matter for Council's consideration was the report of the Sunshine Gardens Committee. Director Hull commented on the recent meeting held December 6, 1972 by the committee at which time he and Deputy City Attorney John Shaw were present as City's representatives. He read in full the Staff Repor% Discussion followed concerning ownership of the lands and responsibil- ities of ownership at which time City Attorney Noonan explained that a larger area drained into lands owned by the school district and stated that City could explore contribution methods with some of these owners. Director Hull stated that the committee was requesting that City Staff proceed with asking the property owners to implement a project. Discussion followed after which Councilman Steinkamp stated that if there were no objections, he would direct the department enter with legal staff into negotiations with other agencies to determine if it is feasible to go on a broader scale as recommended. Councilman Ahem moved that City proceed with the project to prevent other problems from occurring. Councilman Boblitt inquired as to the cost and was told it would be in the range of a magnitude of $50,000. Further discussion followed after which Vice Mayor Steinkamp stated that the matter could be referred back to the department for consultation with staff for further study. Director Hull recommended that staff go back and negotiate with the property owners to see if it is possible for school district to install this line and other areas to contribute and report back to Council. Lengthy discussion followed concerning County lands, waters from San Bruno Mountain, siltation from recent tilling, restriction of acceptance points of flood waters after which City Attorney Noonan requested ex- ploration with the land owners and County in that area and try to arrive at a financial solution. As there were no objections, it was so ordered. '- 8 - 12/18/72 REPORT OF COLMA CREEK COMMITTEE: The next item was the report of the Colma Creek Committee. Director Hull stated that this committee was made up of II people, including 2 staff members and met for the first time December 14, 1972. He read the report in full. Director Hull read the names of the committee members and stated that they were requesting more members on the committee who were voters in the City. Vice Mayor Steinkamp invited all concerned citizens to apply for membership to this committee which meets on the first Wednesday of each month at 5:00 p.m. ITEMS FROM STAFF: Vice Mayor Steinkamp asked if there were any Items from Staff. City Attorney Noonan at this time presented the resolution in memory of Mrs. Cecille McCormick, deceased, a recordation of the City's appreciation for her contribution to the welfare of the City of South San Francisco. Councilman Borba inquired as to the status of the Battalion Chief's examination. City Manager Dreisbach stated that there were no successful candidates and the examination had been readvertised; and would be held on January 20, 1973, and would be a closed promotion. Councilman Ahern at this time commented on the recently appointed Fire Chief and the fine quality of the present Fire Department and Personnel, objecting to the selection from outside the forces of the City. Councilman Boblitt explained the procedure of the testing and Council's knowledge of the examination. GOOD AND WELFARE: Vice Mayor Steinkamn next invited anyone present to speak under Good and Welfare. PETITION SIGNED Mr. Frank Gillis, representing Local 1507 I.A.F.F., presented a BY LOCAL 1507 Petition signed by the total membership of Local 1507 I.A.F.F. expressing I.A.F.F. dissatisfaction of the recent appointment of Fire Chief. He commented ~-(~)~) on the insecurity felt by the department; then presented a letter dated LETTER PUBLISHED December 18, 1972 as addressed to the Citizens of the City of South OBJECT I NG TO APPOINTMENT OF FIRE CHIEF. San Francisco, which would be published in the newspaper, concerning their objections. Mr. Gillis commented on the recent testing and requested Council review its employee personnel policies and come up with one more equitable to its employees. I NQU I RY RE LESKO FLOODING PROBLEM: COMMENTS RE FIRE CHIEF APPO I NT ,...~T: Mrs. Lesko, 211 Orange Avenue, inquired as to the progress or solution of her flooding problem. Director Hull reported that he had unsuccessfully tried to contact Mrs. Lesko and would report back to Council after discussion with her. Councilman Borba at this time expressed his disoleasure at the recent appointment of the Fire Chief from outside the City forces, stating that he felt it was due to their recent participation in the past election. - 9- 12/18/72 ADJOURNMENT .'
