HomeMy WebLinkAboutMinutes 1974-05-13ADJOURNED REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, MAY 13, 1974 TIME:, PLACE: CALL TO ORDER: ROLL CALL: USE PERMIT 269 RE ROLLER SKATING RINK PUBLIC HEARING 7:00 PM. Council Chambers, City Hall. The meeting was called to order by Mayor Mirri at 7:05 PM. Present: Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, and Warren Steinkamp. Absent: Councilman Leo Padreddii. At the request of Mayor Mlrri the City Attorney in detail explained the covenants and restrictions as well as the more recent deed which he had received late this afternoon from Mr. Rosingana. lie commented that after Council had heard from Mr. Rosingana, he would further explain this matter to Council. Mr. Rosingana at this time explained a more recent deed which would restrict parking in the area and his call to representatives of Cabot, Cabot and Forbes, who informed him that they would refer the matter to their attorneys. Mayor Mirri at this time remarked that a withdrawal of an earlier protest had been received from Mr. Poletti and Mr. Mazzanti, reading their communication in full. City Attorney Noonan then further explained the more recent grant deed and restrictions presented by Mr. Rosingana as well as the parcels of property which were affected. After explanation he suggested the following motion to the City Council: r~ve that the Council finds upon the report and recommendations of the Planning Commission set forth in the Planning Commis- sion's action made the 26th of March, 1974, the Planning Officer's report, summary of hearings and findings of fact, the several documents and communications received and the oral presentations made at the hearing held on the 6th day of May, 1974, at the El Camino High School's Little Theatre, 1320 Mission Road, South San Francisco, all of which were considered and made a part of the record in this proceeding, that said use will not under the circum- stances of the particular case be detrimental to the health, safety, peace, morals, comfort and general welfare of the persons residing or working in the neighborhood of such proposed use, and will not be detrimental or injurious to property and improvements in the neighborhood, or the general welfare of the City if parking is Drovided and maintained as hereinafter set forth, and if said Use Permit is subject to the conditions approved by the Commission as amended hereinafter, and the Council does order that UP-269, granting an application to establish a Roller Skating Rink at 213 East Grand Avenue, South San Francisco, California, as approved by the Planning Commission on the 26th of March, 1974, stand approved on the terms and conditions approved by the Commission, (except condition ~'2", which is hereinafter revised), when applicant/ permittee establishes the right to use the described parking areas including the reciprocal parking areas. The Planning Commission's condition 2 shall be revised to read as follows. 2. That permittee shall provide and maintain not less than one (I) space for each three hundred (300) square feet of gross floor area totaling I00 spaces for the premises, subject of this Use Permit, which s~aces are to be located on the parcels as shown on the plat attached hereto designated "Parking Spaces for UP-269 Roller Skating Rink, 213 East Grand Avenue, South San Francisco, California, Council Motion dated May 13, 1974," and reciprocal parking spaces as designated for use during the hours 7:00 PM to 12:00 Midnight on weekdays, and the hours of 12:00 Noon to 5:00 PM and 7:00 PM to 12:00 Midnight on Saturdays, Sundays and legal holidays, as shown on said plat. That applicant/permitttee shall establish the right to use the parking area claimed to be subject to Cabot, Cabot & Forbes' Declaration of Covenants and Restrictions, dated 3/23/64, filed in the Official Records of the County of San Mateo on 3/26/64, Volume 4675, Page 121, etc., and said Use Permit is not effective until said use is so established. The permittee shall file with the Planning Division a signed agreement which sets forth the reciprocal parking arrange- ments for the reciprocal parking spaces, which shall detail the hours for use of said parking spaces as coordinated between the owners and tenants of the parcels of land shown on said plat. If permittee increases the floor area gross square footage, permittee shall be required to increase the number of parking spaces by not less than one full-time space for each additional three hundred (300)square feet of space, or as re- quired by the terms of the ordinance then in effect. Page 2 5/13/74 USE PERMIT 269 RE ROLLER SKATING RINK PUBLIC HEARING (CON'TD.): 6-O5'0 RECESS: Upon completion of the reading of the suggested motion by the City Attorney, Councilman Battaglia so moved. A request was made from the audience as to whether or not the motion would be acceptable to Mr. Del Vecchio. Mr. Del Vecchio stated he would accent the motion as read. Mayor Mirri recessed the meeting at 7:35 PM for the retaping of the television cameras. RECALL TO ORDER: __The meeting was recalled to order by Mayor Mirri at 7:42 PM with all Council present; Councilman Padreddii, absent. USE PERMIT 269 RE ROLLER SKATING RINK PUBLIC HEARING (CON'TD.): Councilman Mammini commenting on the suggested motion remarked that this would not grant permission for the estab- lishment of a roller skating rink but that the matter of parking would first have to be established. Mrs. Claire D'Amico at this time presented additional petitions signed by 244 adults and 807 youngsters commenting on the need for a roller skating rink, also requesting cooperation of industry in this regard. Councilman Steinkamp then seconded the motion of Councilman Battaglia after which roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, and Warren Steinkamp. Noes, none. Absent, Councilman Leo Padreddii. EXECUTIVE PERSONNEL SESSION: P O00 RECALL TO ORDER: Mayor Mirri recessed the meeting at 8:00 PM to an Executive Personnel Session. The meeting was recalled to order by Mayor Mirri at 8:50 PM with all Council present; Councilman Leo Padreddii, absent. Mayor Mirri stated that during the Executive Personnel Session no action was taken. ADJOURNMENT: Mayor Mirri then adjourned the meeting at 8:51 PM.
