The meeting was called to order by Mayor Mirri at 8:05 PM. Pledge of Allegiance to Flag recited. Present: Councilmen Richard A. Battaglia, Terry J. Mlrri, Leo Padreddii, and Warren Steinkamp. Absent: Councilman F. Frank Mammini. Mayor Mirri asked if there was a motion approving the Minutes of the Adjourned Regular Meeting of Tuesday, June II, 1974; Minutes of the Regular Meeting of Monday, June 17, 1974; Minutes of the Adjourned Regular Meeting of Wednesday, June 19, 1974; Minutes of the Special Meeting of Thursday, June 20, 1974. Councilman Battaglia moved, seconded by Councilman Padreddii and regularly carried that the Minutes of the AdJourned Regular Meeting of Tuesday, June II, 1974; Minutes of the Regular Meeting of Monday, June 17, 1974; Minutes of the Adjourned Regular Meeting of Wednesday, June 19, 1974; Minutes of the Special Meeting of Thursday, June 20, 1974 be approved as submitted. Mayor Mirri then asked if there was a motion approving the regular bills of July I, 1974. Councilman Stelnkamp moved, seconded by Councilman Battaglia and regularly carried, that the regular bills Of July I, 1974 be approved for payment. Mayor Mirrl asked if there was a motion approving correction to claims lis, of June I?, 1974. Adjusted total from $200,840.81 to $200,?99.06. Councilman Steinkamp moved, seconded by Councilman Battaglia and regularly carried that the correction to claims liS, of June 17, 1974 be approved as submitted. MANJARREZ (PARK & REC.) E'O/'7 The next item was the claim against the City as filed by Dell E. Pipkin alleging damages as a result of false arrest. Councilman Steinkamp moved, seconded by Councilman Battaglia and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and NOtice be given to claimant In accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. The next item was the Application for Leave to Present Late Claim as filed by Richard E. Perttz, Attorney, in behalf of Scott Barragan, a minor, and Frank Barragan, father of minor, together with a claim against the City as filed by Richard E. Peritz, Attorney, for Scott Barragan, a minor, alleging personal injuries as a result of a collision between plaintiff's bicycle and a motor vehicle. Councilman Battaglia'moved, seconded by Councilman Padreddli that the Application for Leave to Present a Late Claim be granted and the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4, and other related sections of the Government Code. The next item was the claim against the City as filed by the law office of Quaresma, Avera, Benya, Hall & Haun in behalf of Royal Oxford alleging personal injuries as a result of a ditch cave-in, together with original amended claim. Councilman S~einkamp moved, seconded by Councilman Battaglia and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. Staff Report, dated July I, 1974, regarding a resolution expressing appreciation to Joseph W. Manjarrez. A RESOLUTION EXPRESSING APPRECIATION TO JOSEPH W. MANJARREZ. Page 2 7/I/74 PUBLIC SERVICES SOUTH SPRUCE AVENUE REZONING FROM C'3 AND R-3 TO PCM (PUBLIC HEARING) ROMAN CATHOLIC CHURCH REZONING (PUBLIC HEARING) Public Hearing - South Spruce Avenue Rezoning from C-3 and R-3 to PCM. Staff Report, dated June 3, 1974, recommending the adoption of the recommendation of the Planning Commission. RESOLUTION OF THE SOUTH SAN FRANCISCO PLANNING COMMISSION TO REZONE 9.023 ACRES OF LAND, LOCATED BETWEEN THE WESTERLY SIDE OF SOUTH SPRUCE AVENUE AND THE R-I DISTRICT OF MAYFAIR VILLAGE, FROM R-3, RESTRICTED MULTIPLE-FAMILY RESIDENTIAL DISTRICT AND C-3 HEAVY COMMERCIAL DISTRICT, TO PCM,,PLANNED COMMERCIAL AND LIGHT INDUSTRIAL DISTRICT. A brief explanation was made by the Director of Public Services concerning the meetings which had been held with the property owners and the Planning Commission's recommendation of the buffer strip which was to be installed for landscaping and parking. After explanatlon~Mayor Mirri declared the public hearing open, asking if anyone wished to comment on the matter. Mrs. Irene Mann, 103 Fir Avenue, requested information concerning the open ditch which was located to the rear of the properties. The Director of Public Services explained what was to be done in this regard after which there being no one else to speak on the subject Mayor Mirri declared the public hearing closed. The City Attorney then suggested a motion to approve the recommendation of the Planning Commission and order the ordinance prepared in accordance with the recommendation of the Planning Commission. Councilman Stelnkamp so moved, adding that the recommendation of the Director of Public Services be also adopted, seconded by Councilman Battaglia and regularly carried, Public Hearing - Roman Catholic Church Rezoning. Staff Report, dated June 3, 1974, recommending the adoption of the recommendation of the Planning Con~nlssion. RESOLUTION OF THE PLANNING COIV~4ISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING TO THE CITY COUNCIL THEREOF THAT RZ-28, PETITION OF ROMAN CATHOLIC ARCHBISHOP OF SAN FRANCISCO TO REZONE A 4,10 ACRE PARCEL OF LAND, LOCATED NEAR THE NORTHEAST INTERSECTION OF CALLAN BOULEVARD AND GREENDALE DRIVE, IN THE WESTBOROUGH WEST PARK #3 NEIGHBOR- HOOD,~FROM PLANNED COMMUNITY SINGLE FAMILY DISTRICT TO PLANNED COMMUNITY CIVIC DISTRICT. NO. 669-74 AMENDING ZONING ORDINANCE (FEES) AMENDMENT OF SECTION VII SPECIAL REGULATIONS - PLANNED COMMUNITY CIVIC DISTRICT OR ZONE, OF ORDINANCE NO. 575, AS AMENDED, WHICH WOULD ADD CHURCHES AS A USE PERMITTED UPON THE GRANTING OF A CONDITIONAL USE PERMIT. A brief explanation was made by the Director of Public Servlces after which Mayor Mirri declared the public hearing opened aski.ng if anyone wished to speak on the matter. There being no one to speak, Mayor Mirri then declared the public hearing closed. Councilman Steinkamp then moved, seconded by Councilman Battaglla and regularly carried that the recommendation of the Director of Public Services be approved and accepted. Staff Report, dated July I, 1974, recommending adoption of a resolution to solicit bids for the 1974-75 Weed Abatement Program, The Director of Public Services briefly outlined the program after which Councilman Steinkamp introduced the resolution entitled: A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR WEED ABATEMENT PROGRAM - 1974-75. Roll Call vote was as follows: Ayes, Councilmen Richard A. Battaglia, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Memminl. 2nd Reading/Adoption AN UND1NRNCE AhIENUING SECTIONS 5.5(a), 6.21(a), 6.31(a) AND 6.61(a)-I, OF ORDINANCE NO. 353, AS AMENDED, ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO," The Director of Public Services explained that this was to update the City's fees. Mayor Mlrrl ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Battaglia ~moved Feading~f the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Stelnkamp and passed by unanimous vote. Councllman Battaglla moved that the ordinance entitled, AN ORDINANCE AMENDING SECTIONS 5.5(a), 6,21(a), 6.31(a) AND 6.61(a)-I, OF ORDINANCE NO. 353, AS AMENDED, ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Steinkamp and passed by the following roll call vote, Roll Call vote was as follows: Ayes, Councilmen Richard A. Battaglia, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman F. Frank Mammini. Staff Report, dated July I, 1974, concerning Status Report of A, B, and C Streets Assessment District. The Director of Public Services explained the work which had been done by staff and whlch had been completed, He commented on the Improvement work which was proposed and the petitions which had been prepared to be circulated among the affected property owners. He commented that a reply had been received from the City and County of San Francisco Water Department who voiced objection to this improvement, indicating that it was not compatible to rapid transit, He further commented on the meetings which had been held with Mr. Stan Haney of the South San Francisco Unified School Dlstrict and Mr, Lucian Caron of the South San Francisco Housing Authority, Discussion followed between members of the City Council and the City staff after which Mr. Ken Backen, 226 "C" Street, voiced objection to the proposed improvement work stating that it would create a hardship on the elderly people living in the area who are living on a fixed income, Mayor Mirrl recessed the meeting at 9:00 PM for the retaping of the television cameras. The meeting was reCalled to order by Mayor Mirri at 9:20 PM with all Council present, Absent, Councilman F. Frank Mammini. Councilman Steinkamp then moved, seconded by Councilman Battaglia and regularly carried that the Director of Public Services be instructed to proceed with the proposed plans, Page 5 7/I/74 COMMUNICATIONS PETITION RE CYCLONE FENCE AT BURl BURl SCHOOL PLAYFIELD PETITION RE SPRUCE AVENUE CLOSING DURING CONSTRUCTION COMMUNICATION RE REOPENING ROAD TO BYPASS OYSTER POINT YACHT HARBOR Petition to extend the existing cyclone fence the length of Buri Buri School playfield. City Manager Alarlo requested that the matter be referred to staff for a report from the Director of Parks and Recreation and Director of Public Services. Discussion followed at which time Mr. Robert Tweedie, 129 Nyla Avenue, explained the problems which the neighbors were suffering from as a result of the fencing not having been installed, Further discussion followed concerning the time it would take to submit a report after meeting with the School District. The Clty Manager reported the City's staff would need at least 30 days in order for a report to be submitted. There being no objection Mayor Mirri requested staff to meet with school authorities and submit a report within the 30-day period. Petition re Spruce Avenue Improvement Project expressing concern over closing Spruce Avenue during construction. City Manager Alario stated a meeting had been held with Mr. Thomas Bocci~ the attorney ~epresenting the petitioners, during which time the matter was explained to Mr. Bocci who was to be meeting with the County and then meet with his clients. The City Manager Surther explained the costs Involved if the request were to be considered insofar as the construction of a service bridge. Mr. George Radenbaugh, owner of the Good and Rich Dairy, explained to Council the effect that the closing of the bridge would have on his business. He requested Council's consideration to keep trafflc flowing during the period of construction. The Director of Public Services pointed out to the City Council the unsafe condition of the present bridge and that meetlngs were to be held with the property owners, Communication from Mr. Paul Stoyko concerning reopening of the existing road extending from Oyster Point Blvd. (I block east of Eccles) through the old dump~ to the eastern most tip of Oyster Point, bypassing OYster Point Yacht Harbor. Mr. PaUl Stoyko, 422 Holly Avenue, commented that presently some acts of vandalism and theft are occurring at the Marina and the children using this area are sometimes accused of these acts. He stated by opening the proposed road persons using ,he fishing areas would bypass the Marina. The City Manager then read a letter from Rosemarie Scatena in this regard after which there being no objections, Mayor Mirrl referred the matter to staff with a report to be submitted in two ~eeks. Mayor Mirri offered for Council's confirmation the reappoint- ment of Mr. Peter D, Ruggeri to succeed himself as a member of the Parking Place Commission, Councilman Padreddii moved, seconded by Councilman Battaglia and regularly carried that the reappointment of Mr. Peter D. Ruggeri to the Parking Place Commission be confirmed, The City Manager brought to the attention of the City Council a surcharge ~h[ch was being placed by the -Environmental Protection Agency re~uest[,ng that staff be permitted by ~lotlon to contact the tw.o senators and congressmen requesting re~oyal of thissurcharge, He further ~nted that letters would be prepared from the Mayor and staff and sent to all interested persons, Brief mxP!anation was made by the Mayor concerning the Environmental Protection Agency and its effect on parking in the cities, Counci Iman Battagl ia moved, seconded by Councilman Padreddii and regularly carried that the .letters be prepared and forwarded, The Director of Public Services at this time brought up the matter of the addition to the City Hall Council Chambers and the study made by th~ Structural Engineer concern!ng the tower, which was found to be unstable for seismic forces. RECESS: RECALL TO ORDER:, ITEMS FROM COUNCIL ADDITIONAL FENCING AT BRENTWOOD PARK MOSQUITO ABATEMENT PROGRAM SENIOR CITIZENS SHELTER STATUS REPORT INQUIRY It was the recommendation of the Director of Public Services that the additional excavation and shell .construction be accomplished. Mayor Mlrri then moved, seconded by CoUncilman Battaglia and regularly carried that the recommendation of the Director of Public Services in his staff report of July I, 1974 be approved and accepted. Mayor Mirri recessed the meeting at 10:15 PM for the retaping of the television cameras. Mayor Mlrrl recalled the meeting to order at 10:28 PM wi,h all Council presen,. Absent. Councilman F. Frank Mammlnl. Councilman Battaglia at this time brought up his earlier request concerning additional fencing at the Brentwood Park, stating it was his understanding staff was to make a report. The City Manager repop,ed that the peFson to whom this was assigned was on yacat[on but that a'repOrt Would be submitted, Mayor Mirri commented ,hat it was his understanding that the City did not have a Mosquito Abatement Program.and presently existed some problem,' He requested,he City Manager to lOOk into this matter and submit a report~~ Mayor Mirri at this time requested a report on the progress of ,he Senior Citizens Shelter at ,he Ci,y Hall. The City Manager reported that this had been included in the Capital Improvement Program and it was necessary to have detail drawings before the costs were known ~lf Council wished to proceed. Councilman Battaglia then moved, seconded by Councilman Padreddii and regularly carried that the architect be instructed to proceed with the project and prepare plans and specifications for the Senior Citizens Shelter at City Hall. Mayor Mirri at this time Inquired as to the information in the Status Report containing information on a Council inquiry. The City Manager reported the City was in the process of contacting other cities as to the method they follow in order to obtain the best form. Page 8 7/I/74 59 ITEMS FROM COUNCIL (CON'TD,) CIIY COUNCIL AGENDA Mayor Mirri commented on the City's present policy in charging for printed matter which included the Council's agendas. He suggested agendas be made available for review by the residents as well as publicizing them in the local newspaper. The City Manager briefly commented that if Council so desired the agendas could be made available not only at the City Hall but at the City's two public libraries, It was the request of the City Council such agendas be made available in this fashion as soon as they were prepared. GOOD & WELFARE BUDGET HEARING INQUIRY There being nothing further Mayor Mirri asked if anyone present had anything they wished to offer under Good and Welfare. Mr. John Falsarella, 282 Westview Drive, requested information on whether or not the Cityts budget had as yet been finalized, He was informed that it had. 57 0 He then commented on the proposed 9¢ tax increase and the fact the public had not been informed Of public hearings, The City Manager in detail explained to Mr. Falsarella the budget hearings had been publicized but that no one attended the sessions when they were held, He further commented on the cuts which had been made in the Cityts budget in order to effect savings and the reasons for the need for the proposed tax increase, He concluded by stating that City staff would be pleased to sit and discuss the matter of budget and tax rate with anyone who wished to have this matter explained.
