Mayor Battaglia asked for a moment of silent prayer. Mayor Battaglia asked if there was a motion approving the Minutes of the Special Meeting held on Tuesday, March 18, 1975. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried that the Minutes of the Special Meeting held on Tuesday, March 18, 1975 be approved as submitted. Mayor Battaglia asked if there was a motion approving the Regular Bills of April 2, 1975. Councilman Steinkamp moved, seconded by Councilman Mammini and regularly carried that the Regular Bills of April 2, 1975 be approved for payment. Public Hearing -- Xtra Oil Company. Staff Report, dated April 2, 1975, recommending Council uphold the Planning Commission's denial of Use Permit 300, denying the establishment of the retail liquor store (beer and wine only) in an existing automobile service station. Mayor Battaglia declared the public hearing opened. He explained that a request had been received from the applicant for a continuance until April 16, 1975. There being no objections Mayor Battaglia continued the public hearing to the regular meeting of April 16, 1975. Councilman Mammini moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Steinkamp and passed by unanimous vote. Councilman Steinkampmoved that the ordinance entitled, AN ORDINANCE AMENDING ORDINANCE NO. 636 PASSED THE 5TH DAY OF SEPTEMBER, 1972, ENTITLED "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO REGULATING MECHANICAL AMUSEMENT DEVICES AND PROVIDING FOR LICENSE FEES, PROHIBITING ILLEGAL DEVICES AND PROVIDING PENALTIES," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Mammini and passed by the following roll call vote. NO. 690-75 EXECUTION OF FACILITY LEASE - PUBLIC SAFETY FACILITY 2nd Reading/Adoption CITY CLERK CLAIM OF EUGENE, RODDY & JENA PAGUYO Councilman Steinkamp moved that the ordinance entitled, AN ORDINANCE AMENDING ORDINANCE NO. 251, AS AMENDED, PROVIDING FOR INCREASE IN TAXICAB RATES," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Mammini and passed by the following roll call vote. Councilman Steinkamp moved that the ordinance entitled, AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A FACILITY LEASE WITH CITY OF SOUTH SAN FRANCISCO PUBLIC FACILITIES CORPORATION," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Mammini and passed by the following roll call vote. Staff Report, dated April 2, 1975, recommending Council take action on claim as filed by Henry G. Kohlmann, Attorney at Law, on behalf of Eugene, Roddy and Jena Paguyo of South San Francisco, alleging damages resulting from the loss of two birds. Councilman Steinkamp introduced a resolution entitled: A RESOLUTION APPROVING AMERICAN NATIONAL RED CROSS DISASTER SERVICES AS ATTACHMENT "I" TO THE CITY'S REVISED BASIC EMERGENCY PLAN DATED SEPTEMBER 1, 1974. PUBLIC SERVICES RESO. NO. 46-75 LOCAL AGENCY TOPICS IMPROVEMENT PROJECTS Staff Report, dated April 2, 1975, recommending Council adopt a resolution authorizing the Mayor to execute Supplement No. 2 (Revised) to Local Agency State Agreement No. 29 in connection with the Topics Project - Airport Boulevard Traffic Signal Projects. 5'o g0 After an explanation of not only this item but the companion item which followed Councilman Steinkamp introduced a resolution entitled: A RESOLUTION ADOPTING PROGRAM OF LOCAL AGENCY TOPICS IMPROVEMENT PROJECTS IN THE CITY OF SOUTH SAN FRANCISCO. Lengthy discussion followed between the City Council, Staff and Mr. Kenneth Bertelsen, co-owner of Spun Steak, relative to the need for large trucks to enter his place of business, possible traffic hazards, improvement of City-owned area and City participation in this regard. After discussion, Councilman Steinkamp modified his resolution to stipulate the City pay 75% of the cost of improvement. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Staff Report, dated April 2, 1975, recommending Council adopt a resolution approving the specifications for the operations and maintenance of the City's bus system and direct staff to solicit bids from bus operating firms. After comments by the Director of Public Services and the City Planner discussion followed between the City Council, Staff and Mrs. Debra Carson of 3820 Carter Drive, Westborough, after which Councilman Steinkamp introduced a resolution entitled: A RESOLUTION APPROVING SPECIFICATIONS AND CALLING BIDS FOR THE OPERATIONS AND MAINTENANCE OF THE CITY'S BUS SYSTEM. Staff Report, dated April 2, 1975, recommending Council approve a resolution authorizing execution of an agreement between the City of South San Francisco and the City and County of San Francisco to allow for the installation and operation of a noise monitoring device on City property located on Diamond Avenue, westerly of Telford Avenue, to measure aircraft noise levels. After an explanation by the Director of Public Services who stated that Dr. Garbell also concurred in this Councilman Mammini introduced a resolution entitled: A RESOLUTION AUTHORIZING EXECUTION OF AGREEMENT BETWEEN THE CITY OF SOUTH SAN FRANCISCO AND THE CITY AND COUNTY OF SAN FRANCISCO. Staff Report, dated April 2, 1975, recommending Council adopt a resolution which authorizes the City Manager to execute a Cooperation Agreement with the County of San Mateo regarding Housing and Community Development Act of 1974. After a brief explanation by the Director of Public Services, Councilman Mammini introduced a resolution entitled: A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE FIRST AMENDED COOPERATION AGREEMENT WITH SAN MATEO COUNTY REGARDING HOUSING AND COMMUNITY DEVELOPMENT ACT APPLICATION. 4/2/75 Page 5 242 PUBLIC SERVICES RESO. Staff Report, dated April 2, 1975, recommending Council set May 7, 1975 for public hearing to consider the adoption of the 1973 Uniform Code for the abatement of dangerous buildings, and also recommending first reading and introduction of ordinance regulating abatement of dangerous buildings and adopting by reference the uniform code for the abatement of dangerous buildings. There being no objections Mayor Battaglia scheduled the public hearing for Wednesday, May 7, 1975. Discussion then followed between the City Council and Staff relative to the code. Mayor Battaglia declared a recess at 8:30 PM. The meeting was recalled to order at 8:49 PM with all Council present. Mayor Battaglia ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Steinkamp moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first time by reading title only, seconded by Councilman Mammini and regularly carried. Councilman Leo Padreddii voted no. Discussion followed at which time it was pointed out that without a unanimous vote it would be necessary to read the ordinance in its entirety, Councilman Padreddii then changed his no vote to a yes vote only in order that the ordinance would not have to be read in full. Councilman Steinkamp moved that the ordinance entitled, AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO REGULATING ABATEMENT OF DANGEROUS BUILDINGS AND ADOPTING BY REFERENCE THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, the entire reading of which has been duly waived, be introduced, seconded by Councilman Mirri and passed by the following roll call vote. Staff Report, dated April 2, 1975, recommending amendment to Ordinance No. 396, which pertains to amending the sewer rentals and charges. 1st Reading/Introduction AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE NO. 396, AS AMENDED, ENTITLED "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO PROVIDING FOR SEWER RENTALS AND CHARGES IN SAID CITY, PROVIDING THAT SUCH SEWER RENTALS AND CHARGES SHALL BE COLLECTED ON THE MUNICIPAL TAX ROLLS AND SHALL BECOME A LIEN UPON THE RESPECTIVE PARCELS OF REAL PROPERTY" AND REPEALING CERTAIN SECTIONS AND SUBSECTIONS. Discussion followed at which time the City Manager requested this item be scheduled for another meeting night. PARKING DISTRICT MALL - Staff Report, dated April 2, 1975, concerning request by 427 GRAND AVE. the South San Francisco Planning Commission that Council ~/~/ authorize staff to prepare a resolution instituting Eminent 4/~/?s Page 8 245 PUBLIC SERVICES PARKING DIST. MALL - 427 GRAND AVE. (CONT'D.) WESTBOROUGH- WEST PARK 3C - GELLERT BLVD. EXTENSION ITEMS FROM STAFF RESO. NO. 51-75 ASSOC. ENGINEER POSITION P-ooo Domain precedings for the property located at 427 Grand Avenue, South San Francisco, for the purpose of purchasing the property to be used as a Parking District Mall. After an explanation by the Director of Public Services concerning the unanimous vote of the Parking Place Commission to acquire the property, discussion followed between the members of the City Council and Staff relative to funds to purchase not only this property but property to be used for parking lots, and location to this walkway. After discussion the City Manager stated that the Director of Administrative Services would prepare a financial statement for this matter. There being no objections Mayor Battaglia requested that this matter be scheduled for a study session between the City Council and Parking Place Commission. Letter, dated February 10, 1975, from Henry L. Richman of J.H. Snyder Company requesting to appear before Council on matter of extension of Gellert Boulevard south of King Drive. Letter, dated March 13, 1975, from Henry L. Richman of J.H. Snyder Company requesting to appear before Council on April 2, 1975. Staff Report, dated April 2, 1975, recommending Council make a motion to reaffirm all of the conditions as set forth in the Agreement entitled, "Subdivision Improvements and Common Greens, Westborough-West Park Unit 3C" between the City and Beverly-Glenwood Corporation and also recommending a motion to readvise the developer to complete all the conditions of the Agreement by May 31, 1975. After an explanation by the Director of Public Services concerning the subject and the discussion he had with Mr. Henry Richman today, Council took the following actions. Councilman Steinkamp moved, seconded by Councilman Mirri and regularly carried that the City reaffirm all of the conditions as set forth in the agreement entitled, "Subdivision Improve- ments and Common Greens, Westborough-West Park Unit 3C", between the City and Beverly-Glenwood Corporation. Councilman Steinkamp then moved, seconded by Mayor Battaglia and regularly carried to readvise the developer to complete all the conditions of the agreement by May 31, 1975. The City Manager at this time brought up the matter of the reclassification of engineering positions requesting Council take action with regard to the two Junior Civil Engineer positions. Councilman Steinkamp then introduced a resolution entitled: A RESOLUTION AMENDING RESOLUTION NO. 103-74 ENTITLED "A RESOLUTION ESTABLISHING THE SALARY PLAN FOR FISCAL YEAR 1974-75". Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. There being nothing further from Staff, Mayor Battaglia asked if any member of the City Council had anything they wished to offer. In answer to Councilman Steinkamp's inquiry regarding the property development along Gellert Boulevard the City Planner explained what would be taking place in this regard. The City Manager at this time acknowledged the birthdays of Mayor Battaglia and Councilman Mammini inviting those present to join in cake and coffee at the conclusion of the meeting. There being nothing further to come before Council, Mayor Battaglia adjourned the meeting to Tuesday, April 8, 1975, at 7:00 PM in the Conference Room. Time of adjournment was 9:40 PM.
