The meeting was called to order by Mayor Battaglia at
7:44 PM.

APPROVAL OF BILLS:.
Mayor Battaglia asked if there was a motion approving the
Regular Bills of October 1, 1975 and October 15, 1975.
Councilman Padreddii moved, seconded by Councilman Mirri
and regularly carried that the Regular Bills of October 1,
1975 and October 15, 1975 be approved for payment as
submitted.
APPROVAL OF MINUTES:
Mayor Battaglia asked if there was a motion approving the
Minutes of: the Regular Meeting of September 3, 1975;
the Special Meeting of September 4, 1975; the Regular
Meeting of September 17, 1975; and the Adjourned Regular
Meeting of September 22, 1975.
Councilman Padreddii moved, seconded by Councilman Mirri
and regularly carried that the Minutes of: the Regular
Meeting of September 3, 1975; the Special Meeting of
September 4, 1975; the Regular Meeting of September 17,
1975; and the Adjourned Regular Meeting of September 22,
1975, be approved as submitted.
ADMINISTRATIVE SERVICES Staff Report, dated October 15, 1975, recommending Council
RESO. NO. 151-75 award the bid for one (1) 20 mile, 12 volt radar for rescue

Staff Report, dated October 15, 1975, recommending Council

Claim of Walter & Dolores Julian, 26 Elkwood Drive, South
San Francisco, alleging hospitalization and damages as a
result of B-B's being shot thru bedroom windows.
Councilman Steinkamp moved, seconded by Councilman Mirri
and regularly carried that the claim be rejected and
referred to the City's Insurance Carrier and office of
the City Attorney; and Notice be given to claimant in
accordance with Government Code Sections 913, 915.4 and
other related sections of the Government Code.
CLAIM OF ARNOLD LEE
Claim of Arnold Lee, 2895 Shannon Drive, South San Francisco,
alleging damages to vehicle resulting from light pole
falling over roof of said vehicle.
Councilman Steinkamp moved, seconded by Councilman Padreddii
and regularly carried that the claim be rejected and
the City Manager suggested that the claim be

Claim of Elaine DiFalco, a minor, c/o Elinor Grant,
758 Park Way, South San Francisco, alleging personal
injuries sustained from falling in playground at Spruce
Elementary School.
Councilman Padreddii moved, seconded by Councilman Mirri
and regularly carried that the claim be rejected and
referred to the City's Insurance Carrier and office of
the City Attorney; and Notice be given to claimant in
accordance with Government Code Sections 913, 915.4 and
other related sections of the Government Code.
Claim of Luci Buffington, 10501 Croetto Way #70, Rancho
Cordova, CA, alleging damages and personal injuries
sustained while being arrested by South San Francisco
Police Department.
Councilman Steinkamp moved, seconded by Councilman Padreddii
and regularly carried that the claim be rejected and
referred to the City's Insurance Carrier and office of the
City Attorney; and Notice be given to claimant in accordance
with Government Code Sections 913, 915.4 and other related
sections of the Government Code.
Staff Report, dated October 15, 1975, recommending Council
deny all requests for Social Service funding at this time.
However, should Council desire to become more deeply involved
in supporting such activities, Staff should be provided
with Council guidance so perimeters and procedures can be
developed to address and evaluate the anticipated influx
of proposals.
The City Manager briefly explained the recommendation and the
reasons for the recommendation.

With the exception of William C. Hern. the mentioned
speakers requested Council funding in order to continue
carrying out the work of their respective group.

SURPLUS PROPERTY
Discussion followed at which time Councilman Mirri entertained
a motion that would request Council if it wanted to accept
the recommendation of the City Manager and take a vote and
if it was in the affirmative in terms of acceptance of
that recommendation then it would be a closed matter. If
it did not then Council could consider those individual
applicants that made their requests.
Councilman Mirri then requested the City Attorney as to
the appropriate way to make this motion.
The City Attorney then commented if Councilman Mirri first
wished to consider a motion to accept the recommendation
and then find out the consensus of the Council with respect
to that motion. Council would then know whether to
proceed to the next motion.
Councilman Mirri stated he would make such a motion.
Discussion followed at which time the City Attorney commented
on the motion that the Council declare its intention
to, as Councilman Mirri said, leave the door open or find
a way to address the problem of funding social services.
He further commented that the Council could then individualize
after the passage of the motion.
Councilman Mirri then moved that the recommendation of
Staff be denied and that in fact all requests for social
services be denied at this time. The motion died for
lack of a second.
Councilman Padreddii then moved, seconded by Councilman
Steinkamp that we accept the recommendation as stated which
still leaves the door open. At a later date, if the Council
wanted to give funds to certain groups they can still do it.
Motion as made and seconded was regularly carried.
Councilman Mirri voted "no".
Staff Report, dated October 15, 1975, recommending Council
modify Resolution No. 6130.
After a brief explanation by the Assistant to the City
Manager, Councilman Padreddii introduced a resolution
entitled: A RESOLUTION AUTHORIZING CITY REPRESENTATIVES
TO SIGN FOR AND ACCEPT SURPLUS PROPERTY ON TERMS AND
CONDITIONS STATED.

Staff Report, dated October 15, 1975, recommending Council
determine whether $2,250.00 be appropriated for the
restoration of the 1915 Seagrave fire truck.
After a brief discussion Councilman Padreddii moved,
seconded by Councilman Mirri and regularly carried that
this item be placed on the next agenda for a resolution.
Councilman Steinkamp voted "no".
Staff Report, dated August 13, 1975, recommending approval
of an ordinance correcting a conflict in Section 13.301(d)
of the Uniform Fire Code.
Mayor Battaglia ordered the title of the ordinance read.
The title of the ordinance was read.
City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for adoption
and passage. Councilman Steinkamp moved reading of the
ordinance in its entirety be waived and that the ordinance
be passed and adopted by reading title only, seconded
by Councilman Padreddii and passed by unanimous vote.
Councilman Steinkamp moved that the ordinance entitled,
"AN ORDINANCE AMENDING THE UNIFORM FIRE CODE--1973
EDITION (SECTION 13.301(d) AS AMENDED), the entire reading
of which has been duly waived, be passed and adopted,
seconded by Councilman Padreddii and passed by the
following roll call vote.

After a brief explanation by the City Manager, Councilman
Padreddii introduced a resolution entitled: A RESOLUTION

AUTHORIZING APPLICATION FOR GRANT FOR LAW ENFORCEMENT
PURPOSES - CONSOLIDATION OF POLICE SERVICES.
Roll Call Vote was as follows: Ayes, Councilmen Richard A.

Noes, none. Absent, Councilman F. Frank Mammini.
Mayor Battaglia declared a recess at 8:42 PM for the
retaping of the television cameras.
The meeting was recalled to order by Mayor Battaglia at
8:59 PM with all Council present. Absent, Councilman
F. Frank Mammini.
Mayor Battaglia at this time stated if there were no
objections he would take out of order the letter, dated
October 7, 1975, from June Veenstra concerning proposed
fencing project on Baldwin Hills Court and requesting
extension of time for submission of petition asking for
postponement. No objections were registered.
Mayor Battaglia commented on the previous Council action,
the joint meeting with the School District and that the
contract for the fence had been signed. Further that
the matter of financing the work would not be discussed
and this was presently under study by the City Attorney.
Speaking on the matter were:
Baron Huddleston, 2465 Erin Place, S.S.F., President
of the student body who presented a petition with 119
signatures.
June Veenstra, 2442 Williams Court, S.S.F.
Janet Warden, 3607 Baldwin Hills Court, who requested to
speak stated she would not at this time.
Deborah Carson, 3820 Carter Drive, S.S.F., commented on
the height limitation of the fence.
The City Manager stated that a Special Study Meeting was
proposed in this regard and that ~ose interested would be
notified.

Staff Report, dated October 15, 1975, recommending UP-273
be revoked in accordance with Section 6.52 and 6.53 of
the City's Zoning Ordinance.
At the request of the City Attorney the Public Hearing
was scheduled for November 5, 1975.

Staff Report, dated October 15, 1975, recommending Council
enact an ordinance rezoning the 10.365 acre parcel located
at the southwest corner of Westborough Boulevard and
Oakmont Drive from R-3 to R-1.
Mayor Battaglia declared the public hearing opened. The
City Planner gave a brief explanation after which he
read the letter, dated October 1, 1975, from the law
office of Wilson, Jones, Morton & Lynch over the signature
of Thomas B. Adams, Attorney for Thomas J. Callan, Jr.
Speaking on the matter was Michael C. Callan, 82 Isabella
Avenue.
There being no one else to speak, Mayor Battaglia declared
the public hearing closed.
Mayor Battaglia ordered the title of the ordinance read.

City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for adoption
and passage. Councilman Steinkamp moved reading of
the ordinance in its entirety be waived and that the

vote.

Public Hearing -- Abatement of Nuisance at 224 Alta
Loma Drive.
Staff Report, dated October 15, 1975, reccmmending Council
declare the property located at 224 Alta Loma Drive, adjacent
from Kaiser Hospital, a public nuisance, due to accumula-
tion of rubbish and storage of lumber.
Mayor Battaglia declared the public hearing opened. A
brief report was made by the Director of Public Services
and the Chief Building Inspector. It was Staff's recommenda-
tion that the Council declare the matter as a public
nuisance and order the abatement.
The owner of the building material commented that he was
making every effort to move the material but because
of the size of some of the timber~ required a crane which
he was bringing in the following day, he requested of
Council a continuance. There being no one else to speak,
Mayor Battaglia declared the public hearing closed.
After further discussion Councilman Padreddii moved, seconded
by Councilman Mirri and regularly carried that a continuance
be granted until November 5, 1975.
Staff Report, dated October 15, 1975, recommending Council
authorize execution of an agreement with Jenks & Adamson,
Inc. of Palo Alto for consulting engineering services
in connection with the Wastewater Solids Management Program.

CITY CLERK RODONDI: Next Mr. Mayor, public hearing on
Callan 10.365 acre parcel. Staff report dated October 15th, recommending
Council enact an ordinance rezoning 10.365 acre parcel located at the
southeast -- southwest corner of Westborough Boulevard and Oakmont Drive,
from R3 to R1. The ordinance is before you for second reading and adoption,
and there has been a letter received from Thomas P. Adams, attorney stating
that they will abide by any decision reached by the City Council at their
meeting this evening. It's on the date of October 1, and there has been a
request that it be read in the record.

MAYOR BATTAGLIA: At this time, I declare the public hearing
open with a report from staff first.
CITY PLANNER HALE: Mr. Mayor, members of the Council, this
can be a brief staff report. This matter, as you recall, dates back over a
year, when the Planning Commission recommended -- (an aside) is this
thing on? (Meaning the microphone.) -- the 10 acre site located at Oakmont
and Westborougt~ Boulevard be rezoned from the present R3 zone to the R1,'
single-family district in conformity with the City's General Plan. On

August 5th, 1974, the Council held a public hearing, but deferred action at
that time because of the intent announced by one of the property owners of
presenting plans for the development of that 10 acre site and, in fact, did
submit plans for the development which are indeed good deSign quality,
however, there are still problems with the site in terms of ownership and
the question of ownership is still being resolved by the Courts. It's
staff's opinion that the development plans which have been prepared for the
site, actually by one of the owners, Mike Callan - uh, these plans would be
an asset to the Westborough residential neighborhood. However, if the pro-
perty is sold to another buyer, the new owner could develop the site at far
greater densities and create an undesirable situation at this location. The
R3 zone, presently, does not have adequate standards to safeguard against
undesirable development, therefore, to p~ovide adequate development controls
for this parcel staff recommends that the property be rezoned to R1 single=
family residential. At some future date when the proper~y owner is ready to
move ahead with development, it would be appropriate for the City Planning
Commission, at that time~ to consider a planned unit development approach
based on plans similar to what was developed by Hall & Goodhue, the' archi-
tectural planning firm retained by the owner - one of the owners - and that
concludes the staff report at this time Mr. Mayor.

Yes, there's a letter from the --
Thomas P. Adams, attorney for Thomas J. Callan, Jr., to the Honorable City
Council. "Dear Mr. Rodondi, City Clerk. Thank you for your notification of
the hearing on the Callan property on October I5, 1975. Subsequent to
receiving your letter, I received a copy of the South San Francisco
Enterprise Journal wherein an article was written regarding said property.
I would appreciate it if you would read this letter into the record at said
City Council meeting to advise them of the present status of this parcel.
The Callan brother's lawsuit was recently concluded and a ten acre parcel
was held to be legally owned one-half interest in the whole by each brother.
During the past three years, acting as at. torney for Thomas J. Callan, Jr.,
he and I have tried to work out a joint development plan with Michael C.
Callan or sell the property to a prospective buyer. All of our attempts
have either been turned down by Michael Callan, or changed to such an extent
as to make the property unsaleable. As late as one month ago, we were
informed that Michael Callan had a buyer ready, willing and able to'purchase
the property and before the Court, we agreed to the sale. We have not heard
one word since that time. We also agreed that the development of the pro-

Good evening gentlemen - I'd like that
I think he would be intereste~~ in that last
letter that was read here at the Council because ! don't think ithe Judge has
that impression'. Uh -- I personally liked the site and tentatii~e map that
was developed for the City of South San Francisco, together wi.t~ the Hall
and Goodhue plan planners. I'd like to see it enacted, and the ~roblem is
most banks today are looking for investments in housing that are - housing
that is well above the average, rather than just - uh - a home ~hat would -
uh - there, what I mean by that, they would like to see the a~m~ties and
prorated costs, the advertising, and as we noticed the 1906 tr~ line
within it and we had quotes as high as $20,000 to discover where ever it may
be and to really do a great job up there you need the numbers t~ prorate it
against the amenities and that's why we had numbers of approximmitely 125
units. Now, if it was just single-family R1 the numbers would ~ similar
to somewhere around 42. In the numbers of 42 units, you would I~ve this
problem. You have about 30,000 acre (sic) developed units - a~l~roxlmately 8
acres useful that you would have developed - you've got about ~ acres of
backwoods you would have to plant. In that area, approximatel~, ~hen you're
wholesaling land or developing land, your're figuring roughly a~l~ut $12,000
a lot x 42, you're roughly talking about $500,000 as against th~ ~cost of
developing it at $30,000 an acre, you're talking about a deduction of 240.
Well, with 42 units it doesn't leave you enough money really to ~1o a great
job through design. I personally have spent, since the Counci~ Ihere - this
Council over $50,000 in research and development; that's just ~tm~ site on

paperwork alone. Well, if you only have 42 units, you'd never do that - so
with that in keeping if I went to a bank and I says well, the City Council
has made a statement that this is going to be down-zoned to R1 without
putting on a plan of development of equal numbers, they would not allow me
the funds that I personally spend to develop that site. In other words, if
I went into them saying I needed developing funds for design and plans, they
say, well lets stick with' the ordinance -- what does the ordinance say, and
that's all they would allow. You wouldn't have the great thing that could
be on that hill because it has all the views and the potential that you'd be
looking at from coming up lJestborough Boulevard, and the same thing goes for
where the shopping center was if that was lowered 50 or 100 feet where you
could develop it and had trees on it. You would not create that big bank
and the same thing would be going up on this property. Now, the view that
you'd be seeing has been reversed to about a 14 percent grade. That's
looking up at it, and going across to the right from there, it's almost at a
4 percent grade. So, I'd like to go along with the agreement of David Hale
and the Council and I'd like to see your ordinance amended to PUD and plan
to develop for 125 units so I can get the ~:unds from the bank rathe~ than them
saying it's zoned R1. Why spend any money rather than what it's zoned for?

answer them.

for, I think, is that the last we discussed this - just before, during the
break there, at the last sentence if we could, instead of putting period, we
could put a semicolan and say -- and/or a comma and say - based - or similar
to plans developed by Hall & Goodhue on this it would be something that he
could present to lenders that might be looking at his property for lending
on the development. So the sentence there is, at some future date when the
property owner is ready to move ahead with development, it would be
appropriate for the City to consider a planned-unit development approach
similar to the plans developed by Hall &.Goodhue; and it would be staff's
recommendation that that staff report be amended to reflect that.

After a brief explanation by the City Planner comments
were made by Mrs. Celia Bronstein of 608 Lassen Street,
South San Francisco.
Mayor Battaglia then set the public hearing for the regular
meeting of November 19, 1975.
Staff Report, dated October 15, 1975, requesting removal
of four parking meters at Grand and Maple Avenues.
The Director of Public Services explained the reasons
for the removal of the parking meters. Speaking on the
matter as well was Janet Fogerty, 490 Alhambra Road,
South San Francisco, a member of the San Mateo County
Transit District.
Councilman Padreddii moved, seconded by Councilman Steinkamp
and regularly carried that the recommendation of the Director
of Public Services be approved and accepted.
Mayor Battaglia recessed the meeting at lO:O0 PM to an
Executive Personnel Session.
The meeting was recalled to order by Mayor Battaglia at
10:20 PM with all Council present. Absent, Councilman
F. Frank Mammini.
Mayor Battaglia announced the purpose of the meeting was
to give Council legal advice on pending litigation.

NAM REFUGEES -
TRAINING PURPOSES
Mr. Victor Brincat, 301 Linden Avenue, South San Francisco,
stated that a building was being sought for some Vietnamese
refugees for training purposes in their work and requested
permission to use the City building at Grand and Magnolia
Avenues.
The City Manager stated that very shortly a report would be
received from the Parks and Recreation Department on what
the City should be doing with the building.
There being nothing further to come before the City Council,
Councilman Steinkamp move~ seconded by Councilman Padreddii
and regularly carried that the meeting be adjourned. Time
