NO. 702-76 INCREASE IN TAXI CAB RATES 2nd Reading/Adoption 7:30 PM. West Orange Avenue Library Auditorium. The meeting was called to order by Mayor Battaglia at 7:36 PM. The Pledge of Allegiance to the Flag was recited. Mayor Battaglia asked for a moment of silent prayer. Present: Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Absent: None. Mayor Battaglia asked if there was a motion approving the Regular Bills of March 3, 1976. Councilman Padreddii moved, seconded by Councilman Steinkamp and regularly carried that the Regular Bills of March 3, 1976 be approved for payment as submitted. Staff Report, dated February 25, 1976, recommending that Council introduce and conduct the first reading of ordinance as prepared by the City Attorney increasing taxi cab rates for a flag drop from 90¢ to $1.10 and mileage from 90¢ to $1.10 per mile at the rate of 10¢ for each 1/11 of a mile. Mayor Battaglia ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council.regarding procedure for adoption and passage. Councilman Steinkamp moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Mammini and passed by unanimous vote. Councilman Steinkamp moved that the ordinance entitled, AN ORDINANCE AMENDING ORDINANCE NO. 251, AS AMENDED, PROVIDING FOR AN INCREASE IN TAXI CAB RATES, the entire reading of ADMINISTRATIVE SERVICES ' ORD. NO. 702-76 INCREASE IN TAXI CAB RATES 2nd Reading/Adoption (CONT' D. PARKS & RECREATION RESO. NO. 27-76 BUDGET TRANSFER TO PROGRAM 423 AQUA TICS POLICE RESO. NO. 28-76 FOUR CITY CLOSE-UP CAMERAS PUBLIC SERVICES ROBERT F. SCHUMANN PETITION TO REZONE SETTING PUBLIC HEARING FOR 3/17/76 RESO. NO. 29-76 AWARD OF CONTRACT MISSION ROAD REALIGNMENT which has been duly waived, be passed and adopted, seconded by Councilman padreddii and passed by the following roll call vote, Roll Call Vote was as follows: Ayes, CoUncilmen Richard A. Staff Report, dated March 3, 1976, recommending Council approve budget transfer 0-14 for $35,000.00 from unappro- priated reserves to Program 423 - Aquatics. After a brief explanation by the Director of Parks and Recreation Councilman Steinkamp introduced a resolution entitled: A RESOLUTION APPROVING AMENDMENT 0-14, 1975-76 OPERATING BUDGET. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. Staff Report, dated March 3, 1976, recommending Council approve resolution authorizing application for grant funds for the purpose of obtaining close-up cameras for the Police Departments of South San Francisco, Daly City, Pacifica and San Bruno. Councilman Padreddii introduced a resolution entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING APPLICATION FOR GRANT FOR LAW ENFORCEMENT PURPOSES - FOUR CITY CLOSE-UP CAMERA. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. Staff Report, dated March 3, 1976, recommending Council schedule a public hearing to consider the rezoning petition of Robert F. Schumann (RZ-34). There being no objections Mayor Battaglia set the public hearing for March 17, 1976. Staff Report, dated March 3, 1976, recommending Council adopt a resolution awarding the Mission Road Realignment Project to Freeman-Sondgrath Construction Company of Mountain View, who submitted the lowest responsible bid in the amount of $207,440.00 3/3/76 Page 2 PUBLIC SERVICES RESO. CONSTRUCTION COSTS After declaration of bids by the Director of Public Services he recommended the award of contract to Freeman-Sondgrath Construction Company. Councilman Steinkamp introduced a resolution entitled: A RESOLUTION OF AWARD OF CONTRACT FOR MISSION ROAD REALIGNMENT, PROJECT NO. ST-74-3. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. Staff Report, dated March 3, 1976, recommending Council adopt a resolution adopting the general prevailing rate of per diem wages for 1976 in South San Francisco. After a brief explanation by the Director of Public Services Councilman Steinkamp introduced a resolution entitled: A RESOLUTION ADOPTING THE GENERAL PREVAILING RATE OF PER DIEM WAGES IN SOUTH SAN FRANCISCO. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. Staff Report, dated February 18, 1976, recommending that Council adopt a resolution of intention to participate in the construction costs for Gellert Boulevard between Westborough Boulevard andRowntree Way. The Director of Public Services explained the proposed work commenting that Mr. Callan concurred with the resolution. He then explained the cost for the work to be done. Discussion followed between members of the City Council and Staff. Speaking in this regard were: Douglas Butler, 133 Adrian Avenue, who stated that he felt the developer should put in the improvements. Deborah Carson, 3820 Carter Drive, who commented she was concerned with the total amount the City was going to expend. Further discussion followed after which Councilman Mammini introduced a resolution entitled: A RESOLUTION OF INTENTION TO PARTICIPATE IN THE CONSTRUCTION COSTS FOR GELLERT BOULEVARD BETWEEN WESTBOROUGH BOULEVARD AND ROWNTREE WAY. 3/3/76 Page 3 PUBLIC SERVICES RESO. NO. 31-76 GELLERT BLVD. CONSTRUCTION COSTS (CONT ' D. ) ORD. NO. 703-76 PROHIBITING USES IN THE URBAN CORE & ADJACENT SUPPORT AREAS 1st Reading/Adoption AGREEMENT FOR ENGR. SERVICES WITH KCA ENGINEERS- AIRPORT BLVD. CONSTRUCTION ~0~0 COMMUNICATIONS APPEAL OF EARL S. KUHNS (UP-75-334) Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. Staff Report, dated March 3, 1976, subject: Urban Core Study to Develop a Zoning Proposal per Resolution No. 27-76 adopted February 25, 1976. The City Planner presented the above-entitled Staff Report to the Council, reading it in full and explaining the study referred to. Upon order of Mayor Battaglia the City Clerk then read in full the Ordinance entitled "An Interim Ordinance Prohibiting Uses in the Urban Core and Adjacent Support Areas which May Conflict with the Zoning Proposal Under Study Pursuant to Government Code Section 65858," and advised the Council that as an urgency ordinance it was subject to adoption immediately. Councilman Steinkamp moved adoption of the Ordinance as an emergency measure, seconded by Councilman Mammini, and said Ordinance was adopted unanimously with the following roll call vote: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, none. Staff Report, dated March 3, 1976, recommending Council make a motion authorizing the staff to prepare an agreement with KCA Engineers of San Francisco to provide engineering services for South Airport Boulevard Improvement, Utah Avenue to South City Limit - Airport Boulevard Reconstruction, Produce Avenue to North City Limit. The Director of Public Works explained the evaluation of the firms to perform this work recommending the award to KCA Engineers. Councilman Steinkamp moved, seconded by Councilman Mammini and regularly carried that the recommendation of the Director of Public Services be approved and accepted. Letter from Peter G. Keane of Keane & Keane, Law Offices, representing Earl S. Kuhns (UP-75-334) and appealing the decision of the Planning Commission denying his client's application for use permit. At the request of the City Attorney and there being no objections Mayor Battaglia set the public hearing for July 21, 1976. 3/3/76 Page 4 PUBLIC SERVICES PUBLIC NUISANCE- 130 SOUTH SPRUCE AVE. PUBLIC NUISANCE - UNWIN COURT TO WILLIAMSBURG CRT. Public Hearing -- Abatement of Public Nusiance at 130 South Spruce Avenue. Staff Report, dated March 3, 1976, recommending Council open a public hearing and adopt a resolution declaring the unimproved property at approximately 130 South Spruce Avenue, Assessor's Parcel 14-125-6, a public nuisance. Mayor Battaglia declared the public hearing opened after which the Chief Building Inspector through photographs taken of the location commented on the debris which existed on the property and the notice for removal which had been forwarded to the property owner. Bud Eschelbach representing his sister who is the property owner explained to Council his attempts to keep the property clean stating that rhe debris was being dumped by others. He also stated that he had sign posted the area bu~ even the signs had been removed. After some discussion it was agreed to allow the property owner one month in which to remove the existing debris. There being no one further to speak Mayor Battaglia closed the public hearing and continued the matter to the meeting of April 7, 1976. Public Hearing -- Abatement of Public Nusiance (Unwin Court to Williamsburg Court). Staff Report, dated March 3, 1976, recommending Council open a public hearing and adopt a resolution declaring the property located within the 50-foot P.G. & E. easement from Unwin Court to Williamsburg Court in Westborough a public nuisance. Mayor Battaglia declared the public hearing opened after which the Chief Building Inspector through photographs taken of the location commented on the debris which existed on the property and the notice for removal which had been forwarded to the property owner. Mr. Tom Callan commented on the debris which had been cleaned previously and that dumping was being done by others but he would again clean up the area. He suggested some assistance by the City in attempting to stop the dumping in the area. Cormenting in this regard was Deborah Carson. 3/3/76 Page 5 PUBLIC SERVICES PUBLIC NUISANCE - UNWIN COURT TO WILLIAMSBURG CRT. (CONT ' D. ) There being no one else to speak Mayor Battaglia closed the public hearing and continued the matter to the meeting of April 7, 1976. RECESS: Mayor Battaglia recessed the meeting at 9:30 PM. RECALL TO ORDER:. Mayor Battaglia recalled the meeting to order at 9:44 PM with all Council present. ITEMS FROM STAFF APPEAL ON PUBLIC SAFETY COMPLEX o--IOJ ITEMS FROM COUNCIL TRIM TREES AT The City Manager advised Council that an appeal had been filed on the Public Safety Complex suit on March 2, 1976. The City Attorney briefly explained what the procedure would now be in this regard. Councilman Padreddii brought to Council's attention the need to trim the trees which were blocking the traffic signal at GALWAY AND WESTBOROUGH Galway and Westborough Boulevard. STOP SIGN AT DEL MONTE & ROMNEY SPEED LIMIT ON WESTBOROUGH BLVD. ~770J EMERGENCY LIGHTING AT SWIMMING POOL A woman from the audience requested Council also make a correction at the stop sign on Del Monte and Romney. Councilman Mammini requested staff study unifying the speed limit on Westborough Boulevard. Councilman Steinkamp suggested that emergency lighting power be provided at the swimming pool so that adequate lighting would be provided in the event the lights were to go out just as it did during a recent storm. COMMENT BY MAYOR OF CITY MANAGER'S DECISION ON CERTAIN PERSONNEL POSITIONS EMERGENCY LIGHTING AT SWIMMING POOL ADJOURNMENT Mayor Battaglia at this time stated that during an Executive Personnel Session when certain positions in the City were discussed it had been left up to the City Manager to decide on this matter. After brief discussion concerning emergency lights at the swimming pool, Mayor Battaglia adjourned the meeting to March 9, 1976 at 7:30 PM at the South San Francisco High School Auditorium. Time of adjournment was 9:55 PM.
