HomeMy WebLinkAboutMinutes 1976-09-082O2 AMENDED NOTICE SPECIAL MEETING CITY OF SOUTH SAN FRANCISCO SEPTEMBER 8, 1976 NOTICE IS HEREBY GIVEN, pursuant to the Government Code of the State of California, that the City Council of South San Francisco, California, will hold a Special Meeting on Wednesday, September 8, 1976, at 7:30 PM in the West Orange Avenue Library Auditorium, 840 West Orange Avenue, South San Francisco, CA. Purpose of Meeting: CONTINUED PUBLIC HEARING - Receive and review final E.I.R. (Sutter Hill) in relation to (1) General Plan Amendment 76-4; (2) UP-75-315, a use permit to construct a neighborhood shopping center; and (3) RZ-29, rezoning of a 6.85+ acre site (Sutter Hill). CONTINUED PUBLIC HEARING - General Plan Amendment (GP-76-4) amending the Land Use Element of the General Plan designating a 6.85+ acre parcel located at the intersection of Westborough Boulevard and E1 Camino Real, neighborhood commercial, as recommended by Planning Commission Resolution No. 2189 adopted May 25, 1976. CONTINUED PUBLIC HEARING - Appeal from UP-75-315 (Sutter Hill), in which the Planning Commission on May 25, 1976, granted a use permit to Sutter Hill to construct a neighborhood commercial shopping center. 4. CONTINUED PUBLIC HEARING - RZ-29 - Rezoning of the Sutter Hill parcel as recommended by the Planning Commission in Resolution 2190, adopted May 25, 1976. Leo Padreddii, Mayor Dated: September 2, 1976 City of South San Francisco SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO SEPTEMBER 8, 1976 TIME: PLACE: CALL TO ORDER: PLEDGE OF ALLEGIANCE:~. ROLL CALL: 7:30 PM. West Orange Avenue Library Auditorium. The meeting was called to order by Mayor Padreddii at 7:39 PM. The Pledge of Allegiance to Flag recited. Present: Councilmen Leo Padreddii, Emanuele N. Damonte, Terry J. Mirri, William A. Borba, and Richard A. Battaglia. Absent: None. 203 CONTINUED PUBLIC HEARING - Receive and review final E.I.R. (Sutter Hill) in relation to (1) General Plan Amendment 76-4; (2) UP-75-315, a use permit to construct a neighborhood shopping center; and (3) RZ-29, rezoning of a 6.85+ acre site (Sutter Hill). Mayor Padreddii stated that Council had a full discussion on the matter, also that Council had received from both the applicant and the opponents additional information and that the hearing tonight would be for Council's decision with no more discussion. The Acting City Planner recommended to Council that the public hearing on the portion of the E.I.R. be closed and Council could then discuss the matter between themselves and then the matter continued until after Council made a determination on the General Plan, Zoning and Use Permit. Mayor Padreddii then closed the public hearing on the E.I.R. and asked if there were any questions from Council. Councilman Damonte commented on the matter of traffic, noise and residential developmsnt in the area. The Acting City Planner replied to the inquiries of Councilman Damonte. The City Attorney then requested that the record show that each member of the Council received a copy of the final E.I.R. prior to the meeting of August 5, 1976 which was reviewed and considered at that time and which was additionally reviewed and considered at this meeting. Mayor Padreddii then stated that if there were no questions from Council it would be ordered that each Councilman had received a copy of the E.I.R. at the original meeting and had a copy available during the time this session was on. Brief comments were made by Mr. Clifford Farber of All Med Drugs which were responded to by the Mayor and the Acting City Planner. CONTINUED PUBLIC HEARING - General Plan Amendment (GP-76-4) amending the Land Use Element of the General Plan designating a 6.85+ acre parcel located at the intersection of Westborough Boulevard and E1 Camino Real, neighborhood commercial, as recommended by Planning Commission Resolution No. 2189 adopted May 25, 1976. 9/8/76 Page 2 2O4 RESOLUTION NO. 127-76 AMENDMENT TO GENERAL PLAN The Acting City Planner recommended on the General Plan that Council close the public hearing and after due consideration and Council discussion based on the findings specifically set forth by the Council if the Council determined that the General Plan Amendment as requested should be approved then a resolution was attached for Council consideration. If based on the findings as specifically set forth the City Council determined to amend the General Plan other than a neighborhood commercial designation the following steps would be necessary. Prepare and submit a new draft of Environmental Impact Report, prepare data for the new land use designation and after necessary public hearing at the Planning Commission level review the final E.I.R. and the recommendation of the Planning Commission and conduct future public hearing of the City Council. Finally, if based on the findings as specifically set forth the City Council determined that the request to the amendment to the General Plan should be denied. This could be done in the form of a motion. Mayor Padreddii then closed the public hearing. After brief discussion Councilman Battaglia introduced a RESOLUTION TO AMEND THE GENERAL PLAN TO NEIGHBORHOOD C-1 USE COMMERCIAL. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, Emanuele N. Damonte. Noes, Councilman William A. Borba, Terry J. Mirri and Leo Padreddii. Absent, none. CONTINUED PUBLIC HEARING - RZ-29 - Rezoning of the Sutter Hill parcel as recommended by the Planning Commission in Resolution 2190, adopted May 25, 1976. The Acting City Planner recommended that the public hearing be closed since Council was now in a position with the General Plan having failed. He stated that it was Staff's recommendation that Council deny the zoning. Mayor Padreddii then declared the public hearing closed. After brief discussion Councilman Borba moved to deny the zoning. Councilman Mirri seconded the motion. Discussion followed at which time the City Attorney commented that the motion was to deny or reject the rezoning. The City Attorney further stated that those Council members who want to deny would vote Aye. Those who did not want to deny would vote No. 9/8/76 Page 3 RESO. NO. 128-76 APPEAL OF APPROVAL OF USE PERMIT 75-315 After further discussion roll call vote was as follows: Ayes, Councilmen William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, Councilman Richard A. Battaglia. Absent, none. CONTINUED PUBLIC HEARING - Appeal from UP-75-315 (SutterHill), in which the Planning Commission on May 25, 1976, granted a use permit to Sutter Hill to construct a neighborhood commercial shopping center. The Acting City Planner recommended that the public hearing be opened, Council could accept testimony if it wished and then close the public hearing. He further recommended that Council deny the use permit request, stating that Council would have to uphold the appeal of William Henderson. Mayor Padreddii declared the public hearing opened asking if there was anyone to speak on this matter. There being no one to speak Mayor Padreddii declared the public hearing closed. After brief discussion the Acting City Planner stated that Council should adopt a resolution reading the title which was as follows: RESOLUTION UPHOLDING THE APPEAL OF WILLIAM HENDERSON ON THE PLANNING COMMISSION'S APPROVAL OF USE PERMIT 75-315 OF THE SUTTER HILL DEVELOPMENT COMPANY WITHIN THE CITY OF SOUTH SAN FRANCISCO." Councilman Mirri then introduceda resolution: RESOLUTION UPHOLDING THE APPEAL OF WILLIAM HENDERSON ON THE PLANNING COMMISSION'S APPROVAL OF USE PERMIT NO. 73-315 OF THE SUTTER HILL DEVELOPMENT COMPANY WITHIN THE CITY OF SOUTH SAN FRANCISCO. Roll Call Vote was as follows: Ayes, Councilmen William A. Borba, Emanuele N. Damonte, Terry J. Mirri Leo Padreddii. Noes, Councilman Richard A. Battaglia. Absent, none. The Acting City Planner stated that the City Council would now have to take action on the E.I.R. recommending that Council make a motion directing the staff not to file a notice of determination on the Environmental Impact Report. Councilman Borba so moved, seconded by Councilman Mirri. Motion as made and Seconded was regularly carried. Councilman Battaglia voted "no". Mayor Padreddii at this time read a statement explaining the reason for his "no" vote on the earlier action taken in this matter. 9/8/76 Page 4 206 ADJOURNMENT The Acting City Manager at this time stated that if Council concurred staff could be directed to make a study of the property as it relates to the General Plan to determine the best use. There being no objections it was so ordered with an invitation to the property owner to attend. Paul Davis, 849 West Orange Avenu~ stated that the residents would not object to the study and would cooperate in this regard. There being nothing further to come before Council Councilman Damonte moved, seconded by Councilman Borba and regularly carried that the meeting be adjourned. Time of adjournment was 8:12 PM.
