West Orange Avenue Library Auditorium. The meeting was called to order by Mayor Damonte at 7:35 PM. The Pledge of Allegiance to the Flag was recited. Present: Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Absent: None. The City Manager requested that the following changes and additions be made to the agenda: The addition of City Manager Item No. 9 concerning a report on the current status of the Paramedic Program. The addition of City Manager Item No. 10 which would be an Executive Personnel Session to consider appointment to the position of Fire Chief. The addition of an Item from Staff requesting that Council schedule a continued Study Session next week with regard to the financing of the Police facility. City Manager Item No. 3 on the Appeals of UP-77-396 and SA-77-40/W. W. Dean & Associates and the Westborough Homeowners Association be taken up as City Manager Item No. la. City Manager Item No. 1 relative to the Continued Public Hearing on the ordinance establishing requirements for mailing of public hearing notices be taken up as City Manager' Item No. lb. There being no objections, it was so ordered. The Acting City Clerk read the following items on the Consent Calendar: 1. City Council Minutes of the Regular Meeting of October 19, 1977 - Motion to approve. 385 CONSENT CALENDAR (CONT ' D. ) APPROVAL OF BILLS. NOVEMBER 16, 1977 FINANCE ORD. AMENDING BUSINESS LICENSE ORD. NO. 720-76 1st Reading/Intro. CITY CLERK RESO. NO. 209-77 RE CANDIDATES' STATEMENTS OF QUALIFICATIONS 2. Award of bid for Fire Hose - Motion to approve. Councilman Battaglia moved, seconded by Councilman Mirri that the Consent Calendar be approved as presented. After a brief explanation by the Fire Chief relative to the fire hose, the motion as made and seconded was regularly carried. Mayor Damonte asked if there was a motion approving the Regular Bills of November 16, 1977. Councilman Battaglia moved, seconded by Councilman Padreddii and regularly carried that the Regular Bills of November 16, 1977 be approved as submitted. Council- man Borba abstained from voting and stated that he did not have time to study over the claims. Staff Report,~ dated November 16, 1977, recommending that Council introduce and read for the first time, by title only, an ordinance amending Business License Ordinance No. 720-76. Mayor Damonte ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Borba moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first' time by reading title only, seconded by Councilman Battaglia and passed by a unanimous vote. Councilman Battaglia moved that the ordinance entitled, AN ORDINANCE AMENDING THE SOUTH SAN FRANCISCO BUSINESS LICENSE ORDINANCE NO. 720-76, AS AMENDED, the entire reading of which has been duly waived, be introduced, seconded by Councilman Padreddii and passed by the following rollcall vote. Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, none. Absent, none. Councilman Borba introduced a resolution entitled: A RESOLUTION DETERMINING MATTERS RELATED TO CANDIDATES' STATEMENTS (QUALIFICATIONS) AND "OTHER MATERIAL" IN ACCORDANCE WITH ELECTIONS CODE SECTION 10012 AND RELATED SECTIONS (GENERAL MUNICIPAL ELECTION 1978). Continued Public Hearing -- Appeals of UP-77-396 and SA-77-40/W. W. Dean & Associates and the Westborough Homeowners Association. Staff Report, dated November 16, 1977, recommending that Council accept the withdrawal of the appeal of UP-77-396 and SA-77-40. Mayor Damonte declared the continued public hearing opened and asked if there was anyone present who wished to speak in favor of or in opposition to the appeals. There being no one to speak, Mayor Damonte declared the public hearing closed. Councilman Padreddii moved, seconded by Councilman Battaglia and regularly carried that the recommendation of the City Planner be approved and accepted and that the appeals be dismissed. Continued Public Hearing -- Amendment to Ordinance 353, as Amended, Establishing Requirements for Mailing of Public Hearing Notices Within Ordinance 353, as Amended. Staff Report, dated November 16, 1977, recommending that Council introduce and read for the first time an ordinance amending Ordinance 353, as amended, requiring the mailing of public hearing notices to all property owners within 300 feet of property under consideration for public hearing by the Planning Commission or City Council relativeto Use Permit, Variance and Zone Change Applications. Mayor Damonte declared the continued public hearing opened and asked if there was anyone present who wished to speak in favor of or in opposition to the matter. NO. 210-77 ADOPTING SPECIFIC PLAN TO OPEN SPACE AND CONSERVATION ELEMENT OF GENERAL PLAN City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Battaglia moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first time by reading title only, seconded by Councilman Padreddii and passed by a unanimous vote. Councilman Padreddii moved that the ordinance entitled, AN ORDINANCE DELETING SECTION 6.62(c) AND ADDING SECTION 6.22(c), 6.32(c) AND 6.62(c) PUBLIC NOTICE REQUIREMENTS TO ORDINANCE 353, AS AMENDED, the entire reading of which has been duly waived, be introduced, seconded by Councilman Battaglia and passed by the following roll call vote. In answer to Councilman Mirri's inquiry, the City Planner explained that the adoption of this ordinance would formalize present policies regarding the mailing of public hearing notices. Continued Public Hearing -- Shoreline Development Study Specific Plan No. 1. Staff Report, dated November 16, 1977, recommending that Council adopt a resolution establishing the Specific Plan No. 1 for the establishment of standards of a portion of the City of South San Francisco Shoreline on San Francisco Bay. Supplemental Staff Report, dated November 16, 1977, recommending that Council authorize the design and improvement of the Shoreline public access area in accordance with the permit issued by the Bay Conservation and Development Commission. Mayor Damonte declared the continued public hearing opened and asked if there was anyone present who wished to speak in favor of or in opposition to this matter. There being no one to speak, Mayor Damente declared the public hearing closed. In response to Councilman Borba's and Councilman Battaglia's inquiries, the City Planner and the Director of Public Services explained the cost and funding of the development, the area involved, the date the development would begin and how long the project would take. 11116177 Page 4 CITY MANAGER Councilman Padreddii then introduced a resolution RESO. NO. 210-77 entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY ADOPTING SPECIFIC PLAN OF SOUTH SAN FRANCISCO TO ADOPT A SPECIFIC PLAN RELATED TO OPEN SPACE AND CONSERVATION ELEMENT OF GENERAL PLAN (CONT' D. ) TO THE OPEN SPACE AND CONSERVATION ELEMENT OF THE GENERAL PLAN OF THE CITY OF SOUTH SAN FRANCISCO AND RELATED OPEN SPACE (O-S) ZONE DISTRICT. Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, none. Absent, none. Councilman Padreddii then moved, seconded by Councilman Borba and regularly carried to authorize the design and improvement of the Shoreline public access area in accordance with the permit issued by the Bay Conservation and Development Commission for a total project cost not to exceed $10,000. APPEAL OF DP-77-155/ AL FIRENZE, SR. Public Hearing -- Appeal of DP-77-155/A1 Firenze, Sr. Staff Report, dated November 16, 1977, recommending that Council uphold the action of the Planning Commission and Architectural Committee and deny the appeal of Mr. A1 Firenze. Mayor Damonte declared the public hearing opened and asked if there was anyone present who wished to speak in favor of the appeal. Mr. A1 Firenze commented on the reasons for his appeal, after which the City Planner explained the basis for the Planning Commission's action on this matter. After brief discussion the City Planner stated that if Council wished to uphold the appeal of Mr. Firenze and grant the continued use of these signs, it was recommended that they make the following findings: That the present policy of the Planning Commission and Architectural Committee restricting pictorial displays is in keeping with the expressed position of the City Council. That the granting of the request of Mr. Firenze to continue the use of the pictorial displays at 1001 Airport Boulevard is due to the following circumstances: 11/16/77 Page 5 CITY MANAGER APPEAL OF DP-77-155/ AL FIRENZE, SR. (CONT' m. ) ORD. NO. 748-77 AMENDING ORD. 353 & ESTABLISHING C-O ZONE DISTRICT (SOUTH OF COMMERCIAL AVE ON EASTERLY SIDE OF CHESTNUT AVE) 2nd Reading/Adoption a. That the display signs are in lieu of larger illuminated signs. That the displays are cut outs and do not generally advertise products or services but are utilized to establish a decorative theme. c. That the displays are non-illuminated. That the displays are not considered pictorial advertising displays within the context of the previously established City policies. Mayor Damonte then asked if there was anyone present who wished to speak in opposition to the appeal. There being no one to speak, Mayor Damonte declared the public hearing closed. Councilman Padreddii then moved, seconded by Councilman Borba and regularly carried to uphold the appeal of Mr. Firenze and grant the continued use of these signs subject to the findings as were read into the record by the City Planner. Staff Report, dated November 16, 1977, recommending that Council read for the second time and adopt an ordinance changing the zone district on that property easterly of Chestnut Avenue and southerly of Commercial Avenue from P-1 Professional Office Zone to C-O Commercial Office Zone District. Mayor Damonte ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Borba moved reading of the ordinance in its entirety be waived, and that the ordinance be passed and adopted by reading title only, seconded by Councilman Padreddii and passed by unanimous vote. Councilman Borba moved that the ordinance entitled, AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO" AND ESTABLISHING A C-O ZONE DISTRICT (SOUTH OF COMMERCIAL AVENUE ON THE EASTERLY SIDE OF CHESTNUT AVENUE), the entire reading of which has been duly waived, be passed and adopted, seconded by Council- man Battaglia and passed by the following roll call vote. 11/16/77 Page 6 390 CITY MANAGER ORD. NO. 750-77 AMENDING SECTIONS 9.07, lO.17(a), 11.01 AND 11.18 OF ORD. 603 2nd Reading/Adoption (CONT'D.) DOWNTOWN REVITALIZATION Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, none. Absent, none. Staff Report, dated November 16, 1977, recommending that Council act on the following recommendations from the Downtown Merchants and Property Owners Advisory Task Force: Authorize the staff to select and obtain the services of an attorney specializing in Down- town Revitalization under the California Redevelopment Act. Authorize the staff to select and obtain consultants to prepare a preliminary economic and schematic architectural studies of the Urban Core Area. Set a date for a study session to consider the advantages and disadvantages related to the creation of a redevelopment agency to assist in the Downtown Revitalization Project. Consider the staff recommended amendments to the HCDA Block Grant Budget to provide preliminary funding for Items 1 through 3 above. The City Manager explained that the recommendations as listed in the Staff Report from the Downtown Merchants and Property Owners Advisory Task Force were preliminary proposals necessary for Council and the merchants to make an informed decision on the downtown revitalization. After brief discussion between Council, the City Manager and the City Planner, Councilman Battaglia moved, seconded by Councilman Padreddii and regularly carried that the recommendation of the City Planner be approved and accepted. RESO. NO. 211-77 Staff Report, dated November 16, 1977, recommending that REQUESTING THAT THE Council adopt a resolution requesting that the County of COUNTY AND HUD APPROVE San Mateo and HUD approve a revised budget for all A REVISED BUDGET FOR unexpended HCDA appropriations and a revised target area HCDA FUNDS boundary. 11/16/77 3 ? Page 8 392 CITY MANAGER RESO. NO. 211-77 REQUESTING THAT THE COUNTY AND HUD APPROVE A REVISED BUDGET FOR HCDA FUNDS (CONT' D. ) ? PARAMEDIC PROGRAM RECESS: RECALL TO ORDER: FIRE CHIEF APPOINTMENT Councilman Battaglia introduced a resolution entitled: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO REQUESTING THE COUNTY OF SAN MATEO AND THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT TO APPROVE A REVISED BUDGET FOR ALL UNEXPENDED HOUSING AND COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS WHICH HAVE BEEN APPROPRIATED TO THE CITY OF SOUTH SAN FRANCISCO AND A REVISED TARGET AREA BOUNDARY. The City Planner, in answer to Mayor Damonte's inquiry, summarized his Staff Report~ At'the request of Councilman Borba, the City Planner briefly outlined HCDA expenditures, after which roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, Emanuele N. Damonte and Leo Padreddii. Noes, none. Absent, Councilman Terry J. Mirri. Abstain, Councilman William A. Borba. Councilman Mirri momentarily left the room and returned after roll call. Report on the current status of the Paramedic Program. The City Manager commented on a meeting with the County concerning the selection of Mary's Help Hospital as the new base hospital for the Medevac and Paramedic programs. The City Manager then asked Fire Chief Toellner to address himself to the changes the City could expect from the switch to a new base hospital. The Fire Chief commented on the problems that would arise; namely, training and lack of effectiveness for a period of time. Lengthy discussion then followed between Council and staff, after which Council agreed to appeal to the Board of Supervisors to maintain Kaiser Hospital as the base hospital. It was further decided that Councilman Borba and Councilman Mirri would appear before the Board of Supervisors on Tuesday, November 22, 1977. Mayor Damente declared a recess at 9:30 PM and announced that immediately following the recess Council would be meeting in an Executive Personnel Session to discuss a personnel matter. The Acting City Clerk was excused from attending. The meeting was recalled to order at 9:55 PM with all Council present. Mayor Damonte announced that Council had received in the Executive Personnel Session a recommendation from staff regarding the selection of Fire Chief and that by a majority vote Council had concurred with'the recommendation that Assistant Fire Chief Derk Zylker be appointed. 11116177 Page 9 393 CITY MANAGER FIRE CHIEF APPOINTMENT (CONT'D.) PARAMEDIC PROGRAM (CONT'D.) PARKS AND RECREATION REJECT & CALL FOR NEW BIDS - PECK'S LOT PLAY AREA POLICE DEPARTMENT ORD. REGULATING CONDUCT OF BINGO IN SSF 1st Reading/Intro. Mr. Zykler then expressed his thanks to the Mayor and members of the City Council for their faith in him. Mayor Damonte then called on Dr. Taylor of Mary's Help Hospital who explained in detail the reorganizations that have occurred at Mary's Help Hospital, their qualifications and the program itself. Discussion then followed between Dr. Taylor and members of Council. Staff Report, dated November 16, 1977, recommending that Council reject all bids received on October 24,1977 for Peck's Lot Play Area and authorize staff to revise the plans and specifications and call for new bids. Councilman Borba stated that he had personally inspected the Peck's Lot Play Area, and he requested that, due to the poor condition of the area, it be closed down until repairs were made. Discussion followed between Council and the Director of Parks and Recreation, after which Mr. Norton agreed to remedy those problems which could be handled by City personnel. Councilman Padreddii then m~ved, seconded by Councilman Battaglia and regularly carried that the recommendation of the Director of Parks and Recreation be approved and accepted. Councilman Mirri abstained from voting. Mayor Damonte requested that the record so reflect four "Aye" votes and Councilman Mirri abstaining. Staff Report, dated November 16, 1977, recommending that Council read for the first time and introduce the bingo ordinance. The Police Chief briefly explained his Staff Report and, in answer to the inquiries of Council, stated that the ordinance was based on State law and that local organizations would like to have the ordinance adopted. Mayor Damonte ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised Council regarding procedure for introduction. REGULATING CONDUCT OF BINGO IN SSF 1st Reading/Intro. (CONT' D. ) PUBLIC SERVICES RESO. NO. 212-77 AUTH AMEND. 1 TO CONSULTING ENGINEERING SERVICES AGMT - TREATMENT PLANT RESO. NO. 213-77 APPROVING NOTICE OF SALE & OFFICIAL STATEMENT - GELLERT BLVD EXT PROJECT Councilman Borba moved that the ordinance entitled, AN ORDINANCE REGULATING THE CONDUCT OF BINGO GAMES IN THE CITY OF SOUTH SAN FRANCISCO, the entire reading of which has been duly waived, be introduced, seconded by Councilman Battaglia and passed by the following roll call vote. Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba and Emanuele N. Damonte. Noes, Councilmen Terry J. Mirri and Leo Padreddii. Absent, none. Councilman Padreddii stated that he voted "No" because he would have liked to review ordinances from other cities before considering this one. Councilman Mirri stated that he voted "No" because he did not feel that the state should regulate bingo games. Staff Report, dated November 16, 1977, recommending that Council adopt a resolution authorizing the Director of Public Services to execute an amendment to the present Consulting Engineering Services Agreement to provide for the preparation of a draft outline of the proposed Operations and Maintenance Manual. After an explanation by the Director of Public Services relative to the cost of the amendment to the City, Councilman Battaglia introduced a resolution entitled: A RESOLUTION AUTHORIZING CONTRACT AMENDMENT NO. 1 TO AGREEMENT, CONSULTING ENGINEERING SERVICES IN CONNECTION WITH A PROGRAM OF WASTEWATER TREATMENT FACILITY UPGRADING, SOLIDS MANAGEMENT AND SANITARY SEWER SYSTEM EVALUATION SURVEYS, PROJECT C-06-1235, PROJECT C-06-1267. Roll call vote was as follows: Ayes, Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, none. Absent, none. Staff Report, dated November 16, 1977, recommending that Council adopt a resolution approving Notice of Sale and Official Statement and authorizing and directing certain actions with respect thereto - Gellert Bouelvard Extension Project Assessment District. In reply to Councilman Borba's inquiry, the Director of Public Services explained the financing of the project. Roll call vote was as follows: Ayes, Councilmen Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Noes, Councilman Richard A. Battaglia. Absent, none. Abstain, Councilman William A. Borba. Staff Report, dated November 16, 1977, recommending that Council make a motion to support the "San Mateo County Comprehensive Water Resources Management Plan" and submit the following comments to the County Board of Supervisors: More emphasis be placed on the construction of a fourth water transmission pipeline through the San Joaquin Valley as the'primary method of insuring an adequate water supply for the County. The proposal to increase water rates be revised to provide for increasing rates only as necessary to fund new capital improvements and the oeprating and maintenance budgets of the various water supply agencies. Councilman Padreddii moved, seconded by Councilman Mirri that the recommendation of the Director of Public Services be approved and accepted. After a brief explanation by the Director of Public Services, the motion as made and seconded was regularly carried. The City Manager requested that CoUncil schedule a Study Session for the purpose of discussing the Public Safety Site. There being no objections, the Study Session was scheduled for Monday, November 21, 1977, at 5:00 PM in the Council Conference Room. In answer to Councilman Borba's inquiry regarding the cost to the City for the maintenance of the Brentwood parking lot, the Director of Public Services stated that he would submit a report which would be included in the next Council Status Report. Councilman Padreddii commented on the need for mere police enforcement on abandoned vehicles. The Police Chief reported that the newly appointed police technicians were being assigned to this problem. 11116177 Page 12 396 ITEMS FROM COUNCIL Councilman Mirri requested clarification as to the progress (CONT'D.) of the Spruce Avenue Drive-In Theatre matter. The City SPRUCE AVENUE DRIVE-IN Planner reported that the Planning Commission had extended THEATRE the time for revocation to January I0, 1978 since Syufy ~~ Enterprises had made attempts to remedy the problems.
