At the end of their apprenticeship program upon completion they will be- come full fledge grade 2 certificate waste water treatment plant operators. COMMUNITY DEVELOPMENT City Attorney Noonan advised Council to continue this matter to 5/21/80 and incorporate in the hearings set for that date all the comments made with respect to this Ordinance. Mayor Acosta declared the Public Hearing open. Director of Community Development Dell'Angela explained that the Planning Department had prepared an ordinance amendment to an existing Rural Estates Zone adopted in 1979. After several meetings with the residents and Public Hearings they had come up with some significant changes. One of the changes being that the minimum lot size for lots in 5/7/80 Page 4 AGENDA ACTION TAKEN COMMUNITY DEVELOPMENT - COntinUed 13. Public Hearing - Cont. COMMUNITY DEVELOPMENT - Continued R-E zones would be increased from 20,000 square feet to 32,600 square feet. Some relaxing of requirements in relation to the amount of animals allowed, such as poultry and other small animals. Some changes in limiting accessory buildings to 1,O00 square feet per lot. The zone also includes a provision which is consistent with the present animal regulation fur entire City, which requires a permit be obtained. It is the Planning Commissions recommendation that action be taken to approve the Negative Declaration and waive the reading and intro- duce ordinance for the first time. Director of Community Development Dell'Angela further explained various sections of the ordinance which would pertain to the Country Club area. Discussion followed among Council and staff as to the amounts of birds and small animals that could be lodged on a parcel of land. Further discussion followed and Council was informed that there was a provision that would allow the grandfathering in of whatever animals that presently existed on the land. The only requirement being that each property owner who had animals apply for a permit. There would be no charge for the issuance of the permit. The only requirement was that the County Health Officer would come and inspect the area to as- certain if the animals were being provided for and maintained properly. Council expressed concern that there would possibly be a health hazard should too many large animals be housed in a small area. Director of Community Development Dell'Angela explained the section of the Ordin~ ance pertaining to the requirements of large animals. RECESS: RECALL TO ORDER: COMMUNITY DEVELOPMENT - Continued had met the County's requirements to date, and their requirements were more stringent than those of the City. Mayor Acosta declared a recess at 8:05 p.m. Mayor Acosta recalled the meeting to order at 8:10 p.m., all Council present. Director of Community Development Dell'Angela further explained that there was a section providing for the different types, amount, etc. of large animals that could be retained. Council discussed the health area once again and felt that if the Health Department had inspected the premises and found them satis- factory that should be sufficient. Director of Community Development explained that Council should under- stand that this particular ordin- ance is just a modification of the existing ordinance. It will be applied to other areas than Country Club Park. Vice Mayor Nicolopulos expressed concern that there should be more specifics in this ordinance so that there will not be ramifications at a later date. Mayor Acosta invited those in favor to speak. Mrs. Lillian O'Rourke, 264 Country Club Drive, South San Francisco gave an a very detailed summary of the sections and subsections of the ordinance that the members of the Country Club Park Committee were opposed to. COMMUNITY DEVELOPMENT - Continued She reouested copies of the proposed ordinance. Director of Community Develonment Dell'An~ela explained that the recommendations for the Ordinance were from the Planning Commission's Resolution No. 2270, Exhibit A. Mr. Mont'Eton, resident of Country Club Park, explained to Council that Country Club Park was not a residential city dwellino, as the rest of South San Francisco, but an open space en¥ironment. He further explained that there should be no limit on the amount of animals a resident could have, be they large or smal 1. Mr. Ec~vard Ferarra, 30~} Alta Vista Drive, discussed the amendments of tile Ordinance pertainino to home businesses and asked that those sections be further clarified. Vilma Sirovatka, 205 Country Club Drive expressed her dissatisfaction with sections of the proposed Ordinance pertaininm to the size of lots. She further Questioned why some lots could be subdivided and others could not. Discussion followed between Council and staff as to the reasons why certain parcels were able to be subdivided and others not. Director of Community Development Dell'/~n9ela stated that the minimum lot size was 20,000 square feet. If those residents with lots of that dimension wished to subdivide they could ap~ly for a variance. An in-depth discussion ensued re- garding the size of lots and the different zoning regulations that were possible. Mrs. Elaine Stevenson, 297 Alta Vista, informed Council that these lots can only be split if by a majority vote of the resident~s of Country Club Park. She felt that the City should talk with those residents who wanted to split their parcels before the annexation. She further stated that the County also states One can't have a house on a parcel that's smaller than an acre. Mr. Ron Brown, 217 Country Club Drive, explained that the residents of Country Club park had taken a vote and the majority had voted to retain the large parcels. Mayor Acosta inquired as to the results of the vote. Mr. Ron Brown explained that the vote had been taken and it had been 47 to retain lots as origin- ally designated and 12 against. City Manager Birkelo explained City Attorney Noonan's advice to leave the Public Hearin~ open and to in- corporate all testimony into the re- cord. Director of Community Develo.nment Dell'Anqela explained that basically it is necessary for a General Plan Amendment to be adopted to re-enforce the future zonin~ proposal. The plan as it stands now is for Country Club Park to be medium to low density, however, wi th the General Plan Amendment it is to make this area in to a zone of Rural Residential, which basically defines a Qross density of one o~vellin9 unit per acre. Director of Community Development Dell'Anaela explained that the County Board of Supervisors and LAFCO had requested that the City prezone the subject area before its ~roposed annexation and this zone if adopted would be in effect at the same time the annexation occurred. Mr. Butler, 235 Country Club Park Drive, expressed On behalf of the residents of Country Club Park their thanks and gratitude for the time and consideration that both the Planning Commission and City Council had taken with the preparation of the ordinances and General Plan for Country Club Park. Mayor Acosta declared a recess at 9:30 p.m. Mayor Acosta recalled the meeting to order at 9:45 p.m., all Council present. Director of Community Development Dell'Angela informed Council that on January 22, 1980, the Planning Commission considered the Environ- mental Impact Report and Staff also recommended that a scoped environ- mental impact report should be provided for this project. They addressed five specific areas of this concern, which are: 1) Cumulative impact of this project on surrounding neighborhood; 2) The traffic impact of this project; 3) The adequacy of 5/7/80 Page 10 COMMUNITY DEVELOPMENT - Continued 16. (TF-0651) COMMUNITY DEVELOPMENT - Continued the sanitary sewer system to accomo- date the project; 4) The proposed off street parking demands of the project and; 5) The buffer zone alternatives of the project. He further explained that the Habitat Group had submitted a report to the Planning Commission on March 11, 1980, requesting that the Plann- ing Commission reconsider their original consideration. Basically they have asked that a Negative Declaration be issued. On April 1, 1980, the Planning Commission considered the material submitted by the Developer and recommended that the scoped environmental report should be prepared. This is an appeal from that decision. Mayor Acosta declared the Public Hearing open. Mayor Acosta invited the appelant to speak first. David Van Atta, representing the Habitat Group, explained that they were not there to argue the merits or demerits of the condominium project at this time. We are here to discuss the appropriatness of requiring a focused EIR on this project. The purpose of an environmental impact report is to provide adequate information to the decision maker in their approving or disapproving of a specific project. An Environmental Impact Report should not be used as a mechanism to delay projects which otherwise have vali- dity. Mr. Adolf Coruccini, 223 Country C~tub Drive, requested that the City explain why it has changed its policy on the buildina of this cons tructi on. City Attorney Noonan replied that this question had been raised at a Plannino Commission meetino when a citizen inquired as to whether there was an unaualified rioht to a permit, the answer to that question was no. Mr. Noonanufurther explained that he had not said that the Habitat group had a right to build, due to the fact that he had not even been asked that question. However he stated, "I did advise the Planning Director of the two alternatives, because as he recalled the Planning Staff was recommendingthis in order to recommend a methodology." He further stated that he would like to have the opportunity to make a recommendation regardin9 the adequacy of meeting the environmental con- cerns later in the meeting. Discussion followed regarding the issuance of a building permit, the environmental concerns and other pertinent matters. Mr. Mont'Eton, 226 Country Club Drive, commented on the Staff Report, that under recommendation we propose your third alternative reject this application to repeal the requirement of an EIR and order the project tabled pending a focused EIR as deemed necessary by your Planning Commission. He further informed Council that this kind of development was not meant for the Country Club area. Mr. Ron Brown, 217 Country Club Drive, related facts and background information to the Council relative to this particular piece of property. He further related the hazards of increased traffic. Mr. John Moran, Attorney for Country Club Pmrk Homeowners Committee, explained that the Environmental Impact Review guidelines and pro- cedures which were adopted b.v Reso- lution No. 24-77, by this City Council on February 23, 1977, clearly pro- vides the provisions for proper pro- cedures in the area of environmental concerns, tle further stated certain sections of the Resolution ~nertainine to appeals adn the actions leadin~ up to this appeal. F,r. I.~oran,further exnlained that the City Council was sittine as an Appeal Board and car[vine out muasi-judicial or as it is called a judiciary func- tion and you are to ineuire into whether there was substantial evi- dence before the Plannine Commission on which that Commission could have based it's decision. Reversine a decision of the Plannine Commission even if the aopeal of that decision were timely and proper~y before this Council would deneeate the work and long hours spent by members of the Commission. He ureed Council to reject the improper and over-r£achinm actions of the ,~rplicant in brineine this matter before Council and to re- ject as well, what appears to be the Planning Staffs attempt to usurp the functions of the Plannino Commission. Further discussion ensued in reference to the sew, er s.vstem and other relative matters. Vice Mayor Nicolopulos inquired as to the criteria used to differentiate between tile two apparent continouous parcels, the Rotary Plaza, 55 units, and the Habitat, 36 units. To clearly justify ;~hy one required an EIP, and the other didn't when apparently they are addressing the same issues. Director of Community Development [?ell'Anoela explained that the Staff had recommended a Nenative Declaration for both prospects. Discussion followed as to the ration- ale the Planning Commission had used in its recommendations for the nro- ject.
