February 24, 1982
NOTICE IS HEREBY GIVEN, pursuant to Section 54956 of the Government
Code of the State of California, that the City Council of the City of South San
Francisco will hold a Special Meeting on Wednesday, the 24th day of February,
1982, at 7:00 p.m., in the City Council Conference Room, City Hall, 400 Grand
Avenue, South San Francisco, California.
Purpose of the meeting is a Study Session to discuss the
following:
Fair Share Housing Allocation as presented by a representative
of ABAG.

Senior Planner Philip Gorny introduced
Mr. Dan Lopez, Chief of Housing ABAG
and said that Mr. Lopez would review
the ABAG report. He said that ABAG
had taken on the responsibility to
prepare the housing report for the
jurisdiction and that that report had
been completed in December of 1981.
He continued, the report is currently
under a 90 day review which began
12/31/81 and will end 3/31/82. He

said that local jurisdictions are to
review the report and either accept the
figures or as an alternative to
challenge the figures or come up with
a more reasonable figure or statistic.
He said that the only jurisdictions
unaffected by the report are those
with certified Housing Elements. He
said this City's Housing Element was
adopted but not yet certified by the
State and therefore the status was
unclear at present. He said that the
report determined that this City has a
projected housing need increase of
1327 units from 1980 to 1985 which
was broken down into four income levels:
above moderate - 398, moderate - 411,
low - 279 and very low - 239. He
stated that Mr. Lopez was available
to answer any questions.
Mr. Lopez said that there were nine
counties and lO1 jurisdictions involved
in the 90 day review period in response
to State law AB 2853 mandating councils
of governments such as ABAG to deter-
mine regional housing need shares.
He described in detail the method used
to calculate the needs and said that
ABAG wanted to work closely with the
cities rather than have to testify
against the cities in a lawsuit. He
continued~ that for that reason ABAG
is interested in making sure that the
housing numbers reflect local conditions
and opportunities. He said that the
law dealt with all housing and all
income levels, not a fair share housing
allocation.
Councilman Addiego said that the Agenda
read fair share housing and thanked
Mr. Lopez for the clarification. He
made reference to ~e different cities'
projected needs, i.e., Daly City and
Belmont whose population differed
greatly and asked for further explanation.
Mr. Lopez stated that the law requires
consideration of the following: job
growth, type of housing and tenure of
housing, special needs of farm workers,
availability of land and public services.

He further explained the factors and
the increase of household growth,
regional population growth in a
five year increment which was used
for waste water treatment facilities,
grants for transportation.
Councilman Acosta said that Belmont
had a yearly growth restriction and
asked Mr. Lepez to address that fact
in relation to the report.
Mr. Lopez stated that the law speaks
to the fact that communities must
have enough land zoned to meet the
requirements, however the law says
that if an initiative is the result
of the voters then it is an exemption.
Discussion followed on the Belmont
restriction of 56 units to be built
a year, the fact that if the voters
vote for growth management then
the City is exempt, that the housing
needs must reflect local policies
that are voter initiated.
Mr. Lopez said that all a city had
to do to comply with the law is to
show that the City is doing all that
can be done for the private and public
sector. He discussed Newport Beach
and other cities presently under
going litigation from the State of
California.
Councilman Acosta said that much of
this City's land was zoned industrial
or commercial rather than residential
which would present a problem to
comply with the law.
Mr. Lopez said that once
zoning figures become part of the
housing element, the numbers then
become a fact to be dealt with. He
said that the State law had been
sponsored by the realtors and developers
and was aimed at cities that were
restricted by Council or voter initiatives.

ACTION TAKEN
A discussion followed on rental units,
potential penalties in an unsuccessful
litigation by a City, what the commit-
ment would be on the City to accept
or not accept the housing needs numbers,
the change in Federal assistance from
seniors to low income families, etc.
Mr. Lopez said that Council could adopt
one of two Resolution: l) Says the
City accepts the number; 2) Says the
City wants to make changes to the
income distribution.
Consensus of Council to draft a
Resolution for the 3/17/82 meeting
which accepts the housing number but
not the income distribution.
M/S Acosta/Addiego - That the meeting
be adjourned.
Carried by unanimous voice vote.
The meeting was adjourned at 8:28 p.m.
