Code of the State of California, that the Joint Special Meeting of the South
San Francisco City Council and the San Mateo County Board of Supervisors on
the 15th day of November, 1982, at 7:30 p.m., in the Community Room of the
Municipal Services Building, 33 Arroyo Drive, South San Francisco was adjourned
to Thursday, the 2nd day of December, 1982, at 7:30 p.m., in the Community

Purpose of the meeting is a continued Public Hearing:
To consider adoption of the Terrabay Specific Plan
for the lower southeastern slopes of San Bruno
Mountain.
Consider proposed prezoning of the property hereinafter
described, and amendment of Title 20 of the South San
Francisco Municipal Code, entitled "Zoning" and of
Zoning Ordinance No. 353, as amended, in particular
Sections 2.1 and 2.2 thereof. (Terrabay Specific Plan
Zoning District - Proposed Prezoning of Cross Hatched
Area to Terrabay Specific Plan District - Continued to

Dell'Angela stated that at the
prior joint meeting held November
15, 1982, the City Council had con-
tinued the discussion of the prezoning
to their regular meeting of December
15, 1982, based on Staff's recommendation
Director of Community Development
Dell'Angela commented on the issues
which had arisen at the previous joint
meeting regarding noise mitigation
measures, legal issues regarding develop-
ment agreements, and a request from
Mr. Bill Dean, Developer, for
changes and clarifications to four of
the proposed amendments to the Plan. He
stated,that these matters had been
referred back to the City's Planning
Commission . He explained that
the Planning Commission had approved
changes to the following amendments:
Amendment No. 4 which dealt with the
deletion of the term development agree-
ment. He stated, the City intended to
proceed with the development agreement
but, on the recommendation of the City
Attorney, the City in the event of a
referendum issue would retain control
under the new wording to dictate and
determine the phasing out of the parti-
cular project; Amendment No. 5, which
dealt with the term of the Specific
Plan document. He stated the ten year
period would not start until any liti-
gation which occurred reached a
decision~ Amendment No. 11 dealt
with recreational vehicles. He stated
that the Planning Commission had decided
rather than allow recreational vehicles
in certain parking lots in the project,
that on the recommendation ~f the
developer the City would delete any
recreational vehicles in the project
through the DCC&Rs; Amendment No. 21

dealt with wording suggested by the
City Attorney relating to the develop-
ment agreement insofar as COuncil
determining prior to approval of a
tentative map or precise plan the
phasing out of the project; Amendment
No. 32, which made reference to the
development agreement and upon the
recommendation of the City Attorney
the reference to the development
agreement was deleted; Amendment No.
43, dealt with a minor change to
the 5% stipulation for disabled persons;
Amendment No. 44, was a request by
the City Engineer for the addition
of new wording referring to the
worst storm of record or a hundred
year storm, whichever is worse. He
explained that it would make the
particular design of the storm drainage
system more restrictive and specific;
Amendment No. 45 dealt with a question
of the noise issue. Director of
Community Development Del~.l'Angela
stated that the Planning Commission
did not concur that avigation easements
should be required in connection with
the project, but that the property
should have a disclosure statement
and that potential purchasers should be
provided with disclosure statements
that there will be noise impacts on
particular property; Amendment No. 46,
which was a new amendment stated that
"residential structures with the Specifi(
Plan area shall be designed to insure
that the interior noise levels do
not exceed a CNEL of 45 decibels."
Director of Community Development
Dell'Angela con~nented on a letter
which had been received from the
City's Airport Consultant, Dr.
Maurice Garbell, addressing
issues related to the height'of
the proposed hotel and mitigation
measures to reduce noiseilevels in
the project in the future. He stated
that Dr. Garbell had concluded that
the proposed height of the hotel was
within the safe take off path and would
not present any particular problem.
He stated that Dr. Garbell had related
in regard to the issue of mitigation

measures to reduce noise levels in
the project; that the 45 decibel level
or standard could be achieved through
standard insulation provided in the
energy requirements of the Building
Code and suggested that Council con-
sider a slightly more restrictive
requirement in terms of dealing with
the night time noise levels from air-
planes taking off by the San Bruno
Mountain. He stated that Dr. Garbell
had indicated through additional
insulation measures which are not
costly, that the decibel level could be
reduced from 3 to 5 additional decibels.
He explained that Dr. Garbell had con-
cluded that the key area was the bed-
room area and that Council and Board
might want to establish a 40
decibel level as a standard in the
bedroom area. He concluded by
stating that it was the recommendation
of Staff and the Planning Commission
that the Resolution be adopted
approving the Specific Plan based on
the findings contained in the Staff
Report.
San Mateo County Director of
Environmental Management Paul Koenig,
presented a Staff Report and commented
on the matters which had been referred
back to the Planning Commissions of the
City and County. He stated that the
County's Planning Commission had
made the following decisions: Amendment
No. 5, which dealt with the extension
of the expiration date of the project
should the project be stalled by
litigation, stating that the Planning
Commission had no objection to the
language; Amendment No. 11, regarding
the parking of recreational vehicles
and the proposal that they be pro-
hibited. He stated that the Planning
Commission felt that the parking of
recreational vehicles is desirable;
Amendment No. 21, which proposes
to delete the requirement for the develop.
ment agreement between the City and
the Applicant. He stated that the
Commission had no comment; Amendment
No. 44, concerning the design of the
storm drainage trunk system

objection to the proposed language;
Amendment No. 45, which would require
that a disclosure statement concerning
airport related noise be attached to
the title report and recorded with the
deed transferring title in each sale
and resale. He stated that the Commission
commented that it might be appropriate
to submit that language to the Airport
Land Use Commission at such time as it
is proposed ~nd placed on the deed;
Amendment No. 46, requiring the noise
insulation to reduce impacts to 45
decibels, to which he stated that the
Commission had no objections; Amendment
No. 47, Which dealt with affordable
housing, he stated that the Planning
Commission had found the language
that the County had prepared for the
last meeting acceptable, and suggested
that the City might consider the use of
Redevelopment funds to write down the cos
of residential units and that it was
possible that space could be made
available within the hotel, which is~
going to ben.built, to house employees ?
of the hotel. He stated that the
County Planning Commission recommended
that proper action be taken to approve
the Environmental Impact Report
and the Speci~c Plan.
Mayor Teglia declared a recess at
7:53 p.m.
The meeting was recalled to order
at 8:00 p.m., all Council and
the Board present.
Mayor Teglia asked, in regard to the
correspondence received from Dr.
Garbell, if/there was a condition
or a way in,which direction could
be given to assure that in the
early stages of construction, modest
costs could achieve decided improve-
ments with regard to noise mitigation
measures.

it was his understanding that an
acoustical report be done as a
mitigation measure as a requirement
of the EIR.
An in-depth discussion followed
regarding Dr. Garbell's letters
of November 24, 1982, regarding
the issues of climbout noise;
low pitch vibrations; the City's
ability to acc~mpli~sh the reco-
mmendations off-Dr. Garbell ~by
setting a standard of 40
decibels within the interiors
of the proposed structures; a
design which would cut down on
the effects of low pitch frequency
upon the buildings; Use of the
Noise Element of the General Plan
in regard to the mitigation of
noise in the construction of the
structUres.
Supervisor Ward stated that during
the construction phase of the project,
assuming that the acoustical treat-
ment reached 40 decibles during
the first phase of construction, they
could bring in the necessary equip-
ment and test to see if it was
effective and that whatever adjust-
ments were necessary could be accomplishe
during the next phase of construction.
City Manager Birkelo stated that the
decibel level might vary according
to the location within the project.
He stated that there would be a need
for cooperation between the City's
Building Division and the Developer
in the design stages of the project
to try and achieve the same level.
City Attorney Rogers spoke o~ the
standards which were to be set in
relation to the General Plan.
Discussion folloWed regarding the
costs if the level was set at 40
decibels and that if they were
to exceed the 40 decibel level
the costs would go up dispro-
portionately.

stated that ~here were somelchanges
to Amendment No. 42 they would like
to make in regard to the eliminatino
the desirability for meeting rooms
for each of the homeonwers associations.
He Stated that the cost did not
justify the use and commented that
the Recreation Center had the capacity
to accommodate the needs that would
be required. He stated that he
had contacted the City's Director of
Parks and Recreation concerning the
use of the proposed facility. Mr.
Dowling stated that he had been advised
by Director of Parks and Recreation
Norton that the City currently made
facilities available for private function~
at no cost. He stated that Amendment
No. 42 could read that an additional
room would be built that would provide
a meeting room for the homeowner
associations and provide a room for
meetings, and other functions to be
held.
Mayor Teglia questioned the addition
of another room to the existing design
of the project.
Councilman Acosta asked what size
the additional room would be.
Mr. Dowling stated that the additional
room would be approximately 800 square
feet in size.
Discussion followed as to the
number of people the proposed
additional room would accommodate;
the number of rooms currently planned
for the recreation center; and~the
importance of prioritizing the use
the proposed room for members of
homeowners associations.
Supervisor Speier asked if there
would be kitchen facilities available
for use in the additional room.
Mr. Dowling explained that the'deYeloper
would like to design a connecting breeze-
way to the recreation center in order
to accommodate the ~needs for kitchen
and bathroom facilities for the addi-

tional room.
Further discussion followed regarding
the size of the proposed addition;
uses which would be utilized for the
room; location of the tot lot; etc.
Mr. Dowling spoke regarding the
nature of the Hillside Development
with respect to handicapped persons.
He explained that Mr. Dean recoanized
that there were some problems with
building units under .handicapped
standards and indicated that there
would be 40 units available for the
handicapped - designed so that
they would be fitted according to
California's handicapped access stan-
dards. He explained that When re-
ferring to handicapped access it
was whee~ chair access. He commented
that the units would be held exclusively
for handicapped persons for the first
60 days and after that they would be-
come available for the general market.
Vice Mayor Addiego asked if the
specific language Was for a period
of 60 days from the point of
initiation of construction and
asked when construction was considered
to be initiated.
Mr. Dowling stated t'hat construction
would be considered from the date of
pouring the foundation and explained
that it would take approximately
four months to complete the building.
Discussion followed relative to the
requirement that the units be provided
for the handicapped; the potential
that members of the handicapped com-
munity would not be financially
capable of handling the costs of
the proposed units; and the criteria
used in determining where the handi-
capped units would be located, at
which time a question was raised
regarding the requirement that units
,be constructed for handicapped persons.

no requirements in the City's General
Plan for the provision of handicapped
units. He explained that it
was an idea that had been conceived
by the Planning Commission.~
Councilman Acosta asked if the developer
would 'built one unit so that
handicapped persons would be able
to see what could take place if he/she
were to purchase a unit.
Discussion followed regarding keeping
the 40 units for handicapped persons
indefinitely rather than the proposed
60 days.
Supervisor Speier stated that 60
days was a very short span of time and
cOmmented on the specialized operation
(handicapped housing) within the
community and asked where the item
had first originated.
Director of Community Development
Dell'Angela explained that the idea
had originated at the County Planning
Commission level.
Mr. Dowling explained that there would
be 40 units that will be identified
for handicapped use and there will be
60 days from the time the 40 units
are identified. He stated that
it would probably be a year or more
before the units would be sold. He
explained that one unit would be
outfitted and the other 39 would be
designated as available.
Councilman Damonte expressed con-
cern that all of the handicapped units
would be lcoated in one area of the
development and asked if a handicapped
person wished to purchase a detached
single family unit would it possible.
Mr. Dowling explained that all the
other units in the development would
be either two story units or units
with access at levels other than
ground floor.
Mayor Teglia stated that if it was
agreed that there should be a completed

model in advance, then language
needs to be worked into Amendment
No. 43.
Supervisor Speier asked if the
handicapped units would be sold
at a comparable price with other
units with the same plans.
Mr. Dowling indicated that they
would be sold at the same price.
Supervisor Speier asked that the
language stating that the units
would be sold at the same comparable
price as similar units be included..
Mr. Dowling stated that it could
state the planned alternate design
at no additional cost.
Discussion followed regarding the
wording which spoke of the 60 days
for the ~handicapped to purchase the
special units being changed to read
60 days from the date of completion
rather than 60 days from the date
of initiation of construction.
Mr. Dowling explained that the units
if equipped for the handicapped would
not be marketable for any other faction
of society.
Mrs. Doris Agee, 819 Ridge Court,
stated that it would be advantageous
to the' residents of the Terrabay
Development if each homeowners
association was to have its own
meeting room. She spoke of the
need for a room where the members of
the various associations could meet
to discuss their ideas and plans for
their homes.
Mayor Teglia stated that members of ''
the South San Francisco community
had facilities to use for their
meetings and commented that she
did not see a reason for duplicating
a room 5 or 6 times.
Mr. Dowling presented a map showing
the proposed prOject. He commented
on the proposed recreational center

to be constructed and stated that a
large meeting room would be available
for the homeowners associations use.
Discussion followed on the viable use
of the community rooms and the total
number of units to be constructed
within the project; and the need for
an activity room for use by members of
the community.
Supervisor Ward expressed concern
regarding the actual need/demand for
the community room.
Mrs. Agee stated that if the members of
the condominium units did not meet
and discuss their concerns then the
care and maintenance of the conomdiniums
would begin to deteriorate. She stated
that there was a need for the
residents of the units to exchange
ideas and goals in relation to the
future of the condominiums.
Councilman Nicolopulos stated that
he felt Mrs. Agee ~as concerned that
the condominium concept contained some
unique problems which the other types
of residential units did not have.
Mrs. Agee commented on the repairs
which were currently taking place at
Stonegate with regard to rOof repairs.
She spoke of the rules and regulations
which were a part of the ownership of
a condominium.
Discussion followed concerning the
number of units managed by Mrs. Agee
at Stonegate; number of units within
the Stonegate development and those
persons involved in the associations.
Mrs. Agee stated that in regard to
Amendment No. 19 of the proposed Plan,
there should be wording which stated
that the developer shall provide all
signs for traffic control inClud~ng
those which indicate private property
and numbering off,driveways to provide
ready recognition of addresses for
emergency situations.

Mayor Teglia asked Director of
Community Development Dell'Angela if
Amendment No. 19 would encompass the
program addressed by Mrs. Agee.
Director of Community Development
Dell'Angela stated that it was not the
primary direction of Amendment No. 19,
but that there was wording in
Amendment No. 25 that talks about
no parking signs being posted. He ex-
plained that signing is a given con-
dition any time the responsibility
through the building permit process
and through the precise plan process,
is given to the developer. He ex-
plained that Amendment No. 19 would
encompass those areas addressed by
Mrs. Agee.
Further discussion followed regarding
the proposed additional activity room
as to location and size of the facility.
Councilman Damonte indicated his
approval of the addition of the
activity room as recommended by the
developer, including the 800 square
foot size.
Further discussion followed relative
to the use of the additional room;
costs to be incurred for use; and
the possibility of ~dding a stipulation
or provision that facilities be
provided for light refreshments within
the room.
Council expressed concurrence with
the Amendment No. 42 as recommended
by Mr. Dean for the additional room
with the stipulation that the room
have a minimum floor area of 800 square
feet.
Vice Mayor Addiego asked if the Terrabay
Master Association of Homeowner groups
would be retaining ownership of the
additional activity room and if it
would be leased to the City. He asked
who would be responsible for the
maintenenace of that particular part
of the overall structure.
Mr. Dowling stated that it was the

developers intent that the City
would be responsible for tha+ portion
of the structure and that the cost would
be offset by the use of the additional
space.
Vice Mayor stated that in a lease
arrangement the person who holds the
lease is usually in charge of the
maintenance of the property, but
not responsible for the
structure itself. He commented on the
expenses which Mrs. Agee spoke of
which were born by the homeowners
association as the result of poor
design which the City had allowed
and now we find that the City is taking
on additional responsibilities that
would normally be the homeowners asso-
ciations.
Mayor Teglia stated that perhaps the
Council would be wise to delineate
exactly how much maintenance they
would be willing to assume for the
dollar a year use.
Director of Community Development
Dell'Angela stated that it was
planned that once the community center
building and complex was completed,
that it would be conveyed to the
City. He stated that it did not
make sense to have a separate owner-
ship situation on an individual
room when the bulk or 99% of the complex
is going to be City owned. He suggested
that if the City felt an additional'.
room was necessary then the City should
take ownership and title to it.
Mayor Teglia asked what vehicle for
guaranteeing priority use of the
activity roomto homeowners association
would be used.
Director of Community Development
Dell'Angela stated that a policy
could be set with the Director of
Parks and Recreation in terms of the
use of the facility.
Mayor Teglia asked why the City
couldn't share some of the costs
with t~he Master ASsociation for the

City Attorney Rogers stated that if
.the additional room was going to be
an additional room for the Hillside
'Recreation complex, it is almost
creating a type of condominium owner-
ship between the City and the
.Association. He indicated that
.he could see complication arising in
the future. He stated that the best
icourse for the City in this regard
would be to provide enough space
at the Hillside Recreation Center
complex so that a room could be made
available in keeping with our ad-
ministrative policies of running the
City's recreational facilities. He said
that that way the City could control it
and charge for use of the facility.
Mayor Teglia asked if it could be
worked in that the associations would
have a priority use of the facility.
City Attorney Rogers stated that
the City could work that into our own
administrative policy.
Mayor Teglia asked Mr. Dean if he
would amenable to that.
Mr. Dean responded that he would.
Consensus of Council that an
extra room would be provided in the
recreation center, with a minimum of
800 square feet with facilities
and that the City would own, maintain
and give priority use to the homeowners
associations for their meetings.
Mr. Paul Koenig read Amendment No. 43,
which had been edited. He stated that
it would read "The developer shall
provide within the Terrabay Commons
Development, 40 residential units capable
of being interior finished to meet the
HUD Standards for adaptable dwellings. Th
units shall be deSigned in such a manner
as to allow easy construction or retro-
fitting to serve the handicppaed. A
planned alternate design shall be made
available, at no additional cost for
potential handicapped buyers. Handi-
capped buyers shall be given preference
in pruchasing the 40 identified units. A

with the alternate design, and all
marketing literature shall prominently
identify the available units. The
unit shall be kept available for purchase
for a period of 60 days from the
completion of the model for exclusive
purhcase of handicapped buyers."

Dell'Angela stated that Amendment
No. 46 was proposed to read as follows:
"Residential structures within the
Specific Plan area shall be designed
to assure that interior noise levels
do not exceed a Community Noise
Equivalent Level (CNEL) of 40dBA and
maximum noise levels of 60 dba. Said
residential structures shall also be
so designed and constructed as to miti-
gate or suppress structural vibrations
that are harmonically responsive to
low pitch noise emanating from air-
craft climbing over San Bruno Mountain
on a northeast to southwest heading
and emanating from aircraft spooling
up their engines for takeoff from
Rdnway 10."
Discussion followed regarding the
type of insulation to be used in
reducing noise; costs for the
insulation; and the affect on
other cities in the area.
Further~discussion followed regarding
the ability to obtain lower noise
levels at the proposed devel~.opment.
Mayor Teglia declared a recess at
9:26 p.m.
The meeting was recalled to order at
9:45 p.m.: all Council and the Board
present.
City Attorney Rogers read the new
wording for Amendment No. 42, "The
project sponsor shall construct as
part of the presently designed Hillside
Recreation Center Complex, an additional
activity room having a minimum floor
area of 800 square feet. Terrabay
Association members ~hall be given
priority use of this facility with

a thirty day notice and upon payment
of facility use fees as set forth in
the Master Fee Schedule of the City
of South San Francisco."
Mayor Teglia asked if the City would
have the right to waive payment of
the fees.
City Attorney Rogers stated that
the City could within the Master
Fee Schedule indicate that the fee
was waiverable.
City Attorney Rogers read the additional
language to Amendment No. 46, "In order
to reasonably achieve the objectives
outlined above, measures imposed as
a result of this amendment shall be
implemented in the first phase of
residential construction. Those
measures shall then be tested and
evaluated from the standpoint of
cost effectiveness. To the extent
that the measures imposed above are
found, by the City, to be unreasonably
expensive when weighed against the
results achieved, they shall be
waived by the City in subsequent
residential construction phases."
Supervisor Ward asked what the City's
position was in respect to an
avigation easement.
Mayor Teglia stated that the City
was not interested in tying in
easements and indicated at Some point

Dell'Angela stated that the additional
wording came from the prior joint
meeting of the City Council and the
Board of Supervisors.on November 15,
1982. He explained that the development
agreement was going to be pursued in
terms of a time table for improvements
in a buildout schedule for the project and
indicated that a guarantee through
a financial bond or cash deposit would
be required.
Discussion followed regarding the
form of guarantee to be required;
traffic as related to the proposed
Oyster Point Interchange; etc.
