ORAL COMMUNICATIONS CONSENT CALENDAR Staff Report 3/26/86 recommending by Motion to deny and refer the following claim to the City's Insurance Adjuster and the City Attorney: Claim as filed by~ ,<o~P~' Milton S. Weiss on behalf of Iesha Carr, alleging injuries sustained as the result of stepping into a pot hole on Arroyo and E1 Camino Real. ACTION TAKEN 7:45 p.m. Mayor Teglia presiding. Council present: Council absent: Nicolopulos, Addiego, Drago, Haffey and Teglia. None. The pledge of allegiance was recited. AGENDA REVIEW ORAL COMMUNICATIONS Mr. Alvaro Bettucci reiterated the sche- dule of events for 4/21/86 when the visi- tors from Lucca, Italy will visit City Hall. Ms. Leslie Shelton spoke in detail on the literacy conference and stated that Cable TV would have a broadcast next Wednesday at 8:00 p.m. Mr. John Ferreira, Troop No. 292, spoke of the race for children at Oyster Point and requested Police barricades of streets. Staff Report 3/26/86 recommending by Motion to accept as complete the public improvements constructed and installed in accordance wi th the Subdivision Improvement Agree- ment dated October 19, 1983 for the Mission Glen Condominium Subdi vi sion. M/S Addiego/Haffey - To approve the Consent Calendar with the exception of Item No. 3. Carried by unanimous voice vote. Councilman Nicolopulos questioned whether the City would have to water the parkway. Deputy City Manager/City Engineer Yee stated that the City would not have to do the maintenance of the parkway. M/S Nicolopulos/Haffey - To accept the public improvements as complete for the Mission Glen Condominium Subdivision. Carried by unanimous voice vote. CITY MANAGER 0 Staff Report 3/26/86 recommending adoption of a Resolution approving and authorizing a Professional Legal Services Agreement. A RESOLUTION AUTHORIZING APPROVAL AND EXECUTION OF AN AGREEMENT FOR SERVICES (KASPER AND ROGERS) COMMUNITY DEVELOPMENT & ADMINISTRATION Public Hearing - Appeal of the Planning Commission denial of UP-86-752 to allow construction of a McDonald's Fast Food Restaur- ant with related parking and landscaping at 264 South Airport Boulevard. Staff Report 3/26/86 recommending: 1) Open the Public Hearing and hear testimony; 2) Close the Public Hearing; 3) Motion to deny the appeal and uphold the action of the Planning Commission based upon the five findings in the Staff Report. POLICE Staff Report 3/26/86 recommending: 1) Motion to waive further reading of an Ordinance; 2) Motion to adopt the Ordinance on vehicles for hire regulated. 2nd Reading/Adoption AN ORDINANCE REPEALING CHAPTER 6.72 OF THE SOUTH SAN FRANCISCO APPROVAL OF BILLS Carried by unanimous voice vote. Vice Mayor Addiego did not vote or participate in the vote of the claim of Brentwood Market. CITY MANAGER M/S Addiego/Nicolopulos - To approve the Resolution. RESOLUTION NO. 65-86 Discussion followed: that the attorney's firm would receive $100.00 per hour and $120.00 per hour after 20 hours a week had been performed for a two month period. Carried by unanimous voice vote. COMMUNITY DEVELOPMENT & ADMINISTRATION Mayor Teglia opened the Public Hearing. Consensus of Council - To continue the Public Hearing to 4/9/86. POLICE City Clerk Battaya read the title of the Ordinance in its entirety. M/S Nicolopulos/Haffey - To waive further reading of the Ordinance. Carried by unanimous voice vote. Sgt. Petrocchi stated that this Ordinance would regulate the day to day operations of these types of businesses, including requiring fingerprints and identification bearing a photograph to substantiate identity of persons presenting property for sale, pawn, exchange or consignment. Petrocchi stated that the Ordinance regulating palmistry and other similar practices had been adopted in 1979 and that this Ordinance would pro- vide increased ability to control the establishment and organization of such businesses with the City in order to reduce the likelihood of fraud or complaints relating to activities asso- ciated with such businesses. Public Hearing - To ascertain whether the public necessity, heal th, safety or welfare requires the removal of poles, overhead wires and associated overhead structures, and the underground installation of wi res and facili- ties to supply electric, commun- ication, or similar associated services in said Airport Boulevard Underground Utility District No. 1. Staff Report 3/12/86 recommending: 1) Open the Public Hearing and hear testimony; 2) Close the Public Hearing; 3) Motion to waive further reading of the Ordinance; 4) Motion to introduce the Ordinance. 1st Reading/Introduction AN ORDINANCE ORDERING REMOVAL OF OVERHEAD STRUCTURES, WIRES AND 0139 TECHNICAL & MAINTENANCE SERVICES City Clerk Battaya read the title of the Ordinance in its entirety. Deputy City Manager/City Engineer Yee stated that this was the third underground utility district proposed to be established: the first was on Produce; the second on South Airport Boulevard between San Mateo Avenue and the bridge. He stated that this particular one was in the area between the S.P. underpass bridge and one hundred feet beyond north of Grand Avenue. He stated that the pur- pose was to underground all of the wires and poles as a beautification measure to enhance the City entrances. He stated that the impact would be minor and that only two major property owners were affected. He stated that he had had a meeting with Mr. Borba, one of the pro- perty owners, and had sent letter to the other property owners indicating the pro- posal. He stated that he had not heard anything in opposition to the undergrounding of the public facilities Mayor Teglia opened the Public Hearing and invited those wishing to speak in favor of the undergrounding to step to the dais. Mr. William Borba, Jr. stated that he would like to see the entrances to the City cleaned up and the poles removed. He stated that the existing parking was difficult and removal of the poles would facilitate future parking. He stated that he would like to be assured that the removal of the poles would be done on weekends so that it would not interfer with the business by shutting down the machines. Ms. Gwen Harding, Manager of PG&E at 234 Miller Avenue, stated that PG&E was more than willing to work with Mr. Borba and that all work would be done at the bus- ness owners convenience. 3/26/86 Page 5 AGENDA ACTION TAKEN TECHNICAL & MAINTENANCE SERVICES 11. ITEMS FROM STAFF ITEMS FROM COUNCIL TECHNICAL & MAINTENANCE SERVICES Mayor Teglia invited those wishing to speak against the undergrounding to step to the dais - no one chose to speak and she closed the Public Hearing. ITEMS FROM STAFF No one chose to speak. ITEMS FROM COUNCIL Councilman Haffey spoke of a number of reports forthcoming on the Magnolia Center Project which would restore the Center's main building and eliminate the back portion of the property. He stated that the primary concern was to keep the Project on target at 2.5 million dollars. He explained in detail the various grant monies anticipated for the Project for senior housing and parking for the residents. He stated that the Project would be under construction by August 1986, and completed by August 1987. Councilman Nicolopulos concurred with Councilman Haffey's remarks and stated that the building was run-down but had a good foundation. Councilman Drago questioned: the rate increase from Cable TV: why there had not been a public hearing; what control the City had over the increases. City Attorney Rogers stated that State Law stated that the companies can deregu- 3/26/86 Page 6 AGENDA ACTION TAKEN ITEMS FROM COUNCIL GOOD AND WELFARE CLOSED SESSION 12. Closed Session for the purpose of the discussion of personnel matters, labor relations and litigation. Discussion followed: that Staff should investigate using other cable companies; scheduling a meeting to interview can- didates for the Youth Commission and the Historical Preservation Commission. GOOD AND WELFARE No one chose to speak. CLOSED SESSION Mayor Teglia stated that the Closed Session would be held to discuss Airport litigation and Council adjourned to the Session at 8:38 p.m. Mayor Teglia recalled the meeting to order at 11:05 p.m., all Council present, no action taken.
