AN ORDINANCE REPEALING CHAPTER 8.44 OF THE SOUTH SAN FRANCISCO MUNICI- PAL CODE AND ORDINANCE NO. 229 ENTITLED "AN ORDINANCE REGULATING THE USE OF TRAILERS OR CAMP CARS IN THE CITY OF SOUTH SAN FRANCISCO" AND ADDING CHAPTER 8.44 ENTITLED "PARKING AND STORAGE OF RECREA- TIONAL VEHICLES REGULATED" ~--/ ~./ MINUTES City Council Municipal Services Building Community Room April 30, 1986 0181 ACTION TAKEN ADJOURNED REGULAR MEETING 7:45 p.m. Mayor Teglia presiding. Council present: Nicolopulos, Drago, Haffey and Teglia. Council absent: Addiego. The pledge of allegiance was recited. AGENDA REVIEW So ordered. Mayor Teglia requested that the Staff Report be deliberate, by going through each section of the draft ordinance so that everyone understood the document. She stated that the Council would not be taking action on this item tonight, instead it was an opportunity to explore the subject and allow questioning from the Council. Police Sgt. Petrocchi stated that during the months of March and April 1985, Staff had worked with a large citizens commit- tee in order to draft a nuisance abatement ordinance which was subsequently adopted by the City Council in May 1985. He con- tinued, during that process, the citizen committee identified the storage and parking of recreational vehicles in resi- dential areas of the city as an area that needed enforcement attention in the interest of public health, safety and welfare, to ameliorate street congestion, sight blockage, and aesthetic blight caused by the improper storage and parking of such vehicles. He stated that it had been determined that a new ordi- nance had to be written and it was also 4/30/86 Page I AGENDA 1. Discussion - Continued. ACTION TAKEN 0182 agreed that the RV regulations should be codified in one location rather than be spread out in different codes. He stated that since January 1986, Staff had been involved in several open public meetings and citizen committee workshops, in order to draft a new chapter that would address the concerns of the Committee, and still respond to the con- cerns of community recreational vehicle owners. He stated that this draft ordinance was a result of this cooperative effort and was fair to all involved, interested parties, and would serve as an acceptable enforce- ment tool for City Staff. He spoke of the community meetings held: 300+ members of the community had attended the first meeting and had resembled a lynch mob; that subsequent meetings had dwindled down to 5 or 6 people that were not satisfied with the ordinance; that Village Way did not have on-street parking because there were no distances between curb cuts and the drive- ways were not long enough to park even a compact car, let alone an RV; etc. He stated that the ordinance had been written to correct the concerns of the nuisance abatement committee, rather than draft an ordinance that was geared more on the lines of doing away with RVs from city streets. He stated that the draft ordinance's objective was to get vehicles stored and parked in an acceptable fashion that would be both to the liking of adjacent neighbors and to accommodate the recreational vehicle owners so they can keep their RVs within their own view or on their own property. He gave a summary of changes to the existing Chapter 8.44 of the Municipal Code. Assistant City Attorney Kasper spoke in depth of the Ordinance Summary he had written: prohibited parking and storage of any RV which exceeds 35' in length, 8' 4/30/86 Page 2 AGENDA ACT];ON TAKEN 1. Discussion - Continued. in width or 13'6" in height and regulated the parking, storage and use ol~ any other RV within the City; regulated parking on City streets; storage of RVs; use restrictions and penalties for violations. Discussion followed: the definition of a temporary parking period of RVs; storing of RVs on private property, etc. Mr. Dan Fogliasso, Good Sam Group, stated that his group was working with cities and counties to effect ordinances where necessary and needed. He stated that the draft ordinance was a fair ordi- nance that people could deal with - provided that it was not changed. Councilman Drago questioned whether the draft ordinance was more or less restrictive than other cities. Mr. Fogliasso stated that it was no more or less restrictive. He stated that today 15-18% of the people had RVs and that in five years 30% would have RVs. He spoke of the possibility of using RVs for evacuation purposes in the event of a disaster in the community. Mr. Leonard Valdivia stated that the way the ordinance stood now was a drastic change from the original draft. He stated that the 300 people who attended the first meeting were scared that they were being told to get out of town, that they were not wanted. He stated that now 95% of the RV owners concurred with the ordinance after all of the meetings and public input. Discussion followed: that a person could cement a part of the frontyard provided that section was not more than 1/3 of the property; that an individual could cement up to his property line; RVs parking on lawns; that a camper shell could not be stored in the front yard, etc. Consensus of Council - That the RV ordi- nance should be agendized for the next meeting. 4/30/86 Page 3 AGENDA ACTION TAKEN 0i84 Council determination of which two members of the Historic Preservation Commission, that were newly appointed, will have their terms expire on 12/31/86 and which three members terms will expire on 12/31/88 until a successor is appointed and qualified. o Discussion of Council's Goals and Objectives 1986-1987 as proposed by the Council Subcommittee. Council determination that the newly appointed Youth Commissioners' terms will begin on July 1, 1986~O~ and expire on 6/30/87 or until a successor is appointed and qualified. CLOSED SESSION: RECALL TO ORDER: A RESOLUTION DESIGNATING THE COUNTY OF SAN MATEO AS THE AGENT OF THE CITY OF SOUTH SAN FRANCISCO FOR SERVICE OF PROCESS (REVENUE AND TAXATION CODE 0~- ~ S5149) .~.~ M/S Drago/Haffey - Determined the following terms of office for the Commission: Donald Arndt 12/31/88; Edna Harks 12/31/88; Victor Feudale 12/31/86; Eugene Mullin 12/31/88; Helen Godkin 12/31/86. Carried by unanimous voice vote. Council chose not to discuss this item. M/S Addiego/Haffey - That the terms will begin on 7/1/86 and expire on 6/30/87 or until a successor is appointed and qualified. Carried by unanimous voice vote. M/S Addiego/Haffey - To appoint Madonna Mallari as an alternate member of the Youth Commission. Council adjourned to a Closed Session at 7:50 p.m., to discuss litigation con- cerning Sears Roebuck vs. City of South San Francisco. Mayor Teglia recalled the meeting to order at 8:07 p.m., all Council present, no action taken. City Attorney Rogers suggested that the City Council adopt a Resolution and order him to draft the resolution, and deliver it to the City Clerk, which designates the County of San Mateo as its agent for ser- vice of process for any and all actions brought against the City under the Article of Revenue & Taxation Code in which Section 5149 appears. He con- tinued, these acts are actions to recover taxes paid because of allegations of improper assessments, illegally collected taxes, overpaid taxes and that type of thing.
