Haffey Gus Nicolopulos MINUTES City Council Municipal Services Building Community Room September 17, 1986 NOTICE IS HEREBY GIVEN, pursuant to Section 54956 of the Government Code of the State of California, that the City Council of the City of South San Francisco will hold a Special Meeting on Wednesday, the 17th day of September, 1986, at 7:00 p.m., in the City Council Conference Room, City Hall, 400 Grand Avenue, South San Francisco, California. Purpose of the meeting: Status Report from Director of Recreation & Community Services Norton on the implementation of the Historic Preservation Ordinance No. 978-85. 2. Introductory review of the Capital Improvement Program. ® Closed Session for the purpose of the discussion of personnel mat- ters, labor relations and litigation. Dated: September 12, 1986 0075 AGENDA SPECIAL MEETING CALL TO ORDER: ROLL CALL: (Cassette No. 1) PLEDGE OF ALLEGIANCE ACTION TAKEN SPECIAL MEETING 7:12 p.m. Mayor Teglia presiding. Council present: Council absent: Nicolopulos, Halley, Addiego, Drago and Teglia. None The pledge of allegiance was recited. City Manager Birkelo stated that the major reason for the special meeting had been Item No. 3, a Closed Session for labor relations and litigation. He requested that Item No. 3 be heard first to accommodate the Consultants in atten- dance in a session that would take one to two hours. He stated that the status report on the 9/17/86 Page I AGENDA ACTION TAKEN 0076 implementation of the Historic Preservation Ordinance and the introduc- tory review of the Capital Improvement Program were intended to be informational items. Mayor Teglia questioned if anyone was at the meeting to speak on the Historic Preservation Ordinance. City Clerk Battaya stated that Edna Harks stated that she wanted to address the Council on the subject later in the meeting after the Closed Session. Mayor Teglia then questioned if anyone was at the meeting to speak on the Capital Improvement Program - and received no response. She then asked if the people in the audience where there for the matters to be discussed in Closed Session, i.e., personnel matters, labor relations or litigation on the Serramonte Park Plaza. Mr. Francis McAuley stated that he would like to make a statement before the Council on labor relations before adjourning to a Closed Session. Mayor Teglia requested direction from the City Attorney. City Attorney Armento stated that it was up to the Council if they chose to be addressed by Mr. McAuley before the Closed Session. Mr. McAuley stated that his bargaining units had for some time been involved in negotiations and felt that the Council should have background information from the unit representatives before holding the Closed Session with Staff. He stated that this issue predated the present Staff. He stated that nego- tiations had started in 1983 with Personnel Director Caroline Marshall, who had agreed to do a complete comparable 9/17/86 Page 2 AGENDA ACTION TAKEN worth study of all people in Units 3 and 9. He continued, with a restructuring of the job classes and clarification of the career ladders. He stated that this was to have been done internally with appli- cations in the City, and externally with applications from the private sector. He stated that Ms. Marshall had come down to the Street Department and had made a commitment to the employees of an intent to study the male dominated classes first; align those and then study the female classes using the comparable worth theory. He stated that with that in mind, the Units had signed a contract in 1983 for the 1984-85 year. He stated that that study was supposed to have been done and implemented 45 days after signing the contract. He stated that the study was supposed to have been completed, and then a meet and confer over the implementation some 45 days after the contract was signed. Vice Mayor Addiego questioned if that had been a verbal representation from the Personnel Director at that time. Mr. McAuley stated that it was not ver- bal and had been written into the contract. Mayor Teglia asked that that section of the contract be underlined and given to her for discussion in the Closed Session. Mr. McAuley stated that there had been a few meetings with Ms. Marshall after that wherein she had passed out questionnaires that had been completed, however no results had ever come forward. He stated that the employees got tired of this treatment and forced the issue into mediation, which had taken a year and then there had been another agreement. He stated that the new agreement, dated September 1984, had been for the female 9/17/86 Page 3 AGENDA ACTION TAKEN 0078 CLOSED SESSION Closed Session for the purpose of the discussion of personnel matters, labor relations and litigation. RECALL TO ORDER: Status Report from Director of Recreation & Community Services Norton on the implementation of the Historic Preservation Ordinance No. 978-85. ~?O dominated positions, which the units had been half satisfied with, but still wanted the whole job done. He stated that in May 1985 there had been a memo from the Personnel Office saying that Mr. Oppenheimer would be doing a lengthy, in-depth study. He stated that that study had been received in September, and that revisions had been made in October. He stated that the study was done, but not in full - in that it had not been compared with the private sector. Mr. Bob Reid submitted photos for Council consideration which showed flooding of his property that had occurred that morning. CLOSED SESSION Council adjourned to a Closed Session for the items mentioned and a litigation matter of Serramonte Park Plaza at 7:28 p,ml Mayor Teglia recalled the meeting to order at 10:15 p.m., all Council present, no action taken; specific direction was given to the negotiating team on Mr. McAuley's item. Director of Recreation & Community Services Norton gave an update of the activities of the Historic Preservation Commission activities and implementation of a program in accordance with the Commission Ordinance. He provided background information on the process: receipt of a draft historic sur- vey on the status of various properties (187 in relation to the National Historic Trust); placing a moratorium on the issuance of building permits on the pro- perties, etc. He stated that the Commission had been presented with two priorities: 1) 9/17/86 Page 4 AGENDA ACTION TAKEN 0079 1. Status Report - Continued. ® Introductory review of the Capital Improvement Program. ~/~O Resources/properties identified/listed in the local survey conducted by the S.S.F. Historical Society; 2) Resources/ properties given a ranking of 4D or higher in the survey (bluebook). He stated that it became important to establish standards to condense the list to potential resources that were clearly worth study, and on 9/11/86 the Commission had been presented with cri- teria to eliminate that initial list to a comfortable 65-70 properties. Discussion followed: on the preliminary list of designated candidates; reference numbered to the blue book; page number and rating survey; public hearings to be held by the Historical Commission before a building permit would be allowed for rehabilitation of a public resource; the designations: unusual tree, a culvert that was not in existence, the eternal flame that was not at City Hall; the Council's role being only that of the appeal process; the building at 300 Grand Avenue being for sale and designated an historical resource; that an historical resource designation could not impose an undue hardship on an individual, and in the hearing process the owner would have to bring forth their position. Introductory review - Continued. CLOSED SESSION RECALL TO ORDER: ADJOURNMENT Discussion followed: that bids had been opened today on Magnolia Center which indicated a need for additional funding of $440,000; a need to look for future funding of capital improvements, etc. Deputy City Manager/City Engineer Yee went through the individual projects that had committed and uncommitted 1986-87 figures; the projected 1987-88 unfunded projects. City Manager Birkelo stated that this would be on the next agenda for action before action could be taken on Magnolia Center. Discussion followed: on the 1986-87 uncommitted project funds; buying the Mazzanti property and leasing it back for five years; City entrance landscape pilot project; Forbes medians; arterial traffic study; a traffic study being done at Westborough Boulevard, E1 Camino and from Chestnut to Hillside; that 380 was sup- posed to go over to Pacifica - which had been struck down as a thoroughfare. CLOSED SESSION Council adjourned to a Closed Session at 11:30 p.m. for discussion of litigation (Serramonte Park Plaza). Mayor Teglia recalled the meeting to order at 12:09 p.m., all Council present, no action taken. M/S Haffey/Addiego - To adjourn the meeting. Carried by unanimous voice vote.
