Council present: Council absent: Addiego, Drago, Halley, Nicolopulos, and Teglia. None. Recited. Rev. Merton Johnson, Our Redeemers Lutheran Church gave the invocation. AGENDA REVIEW City Manager Armas stated that he had nothing to add or delete from the Agenda. ORAL COMMUNICATIONS Mr. Jake Jones congratulated Councilmembers Jack Drago and Gus Nicolopulos, and Councilman Elect John Penna on their election wins. He also thanked the voters for approvin~ Measure C. He commended Recreation Senior Services Supervisor Deborah Byrne, and Earthquake Relief Fund Chairperson Vi Valine for their successful efforts in raising $1,043.00 for the Red Cross Earthquake Relief Fund. COMMUNITY FORUM Mayor Teglia also congratulated the two incumbents on their successful re-election efforts. Councilman Addiego congratulated City Clerk Barbara Battaya as the high vote getter in the election. Approval of the Regular Bills of 11/08/89· Motion to waive building fees for George Frleta at 548 Theresa Drive in the amount of $112.00. ® Motion to adopt two ordinances: a) adoption of ordinance amending PERS Contract with the City; b) adoption of ordinance pertaining to bingo games. AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM ~1o~ AN ORDINANCE AMENDING CHAPTER 6.32~-I~ OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE PERTAINING TO BINGO GAMES Resolution authorizing the City's Agent to provide information to the State Office of Emergency Services for financial assistance. A RESOLUTION DESIGNATING AGENTS FOR THE CITY FOR THE PURPOSE OF OBTAINING FEDERAL AND STATE FINANCIAL ASSISTANCE NECESSITATED BY THE OCTOBER 17, 1989 EARTHQUAKE COMMUNITY FORUM be an installation of new Councilmembers, and the organization of Mayor and Vice Mayor on 11/22/89. She invited the public to attend, and stated that refreshments would follow the short meeting. Councilmembers Drago and Nicolopulos each thanked the electorate for their support, and the opportunity to serve another four years. CONSENT CALENDAR Approved. Regular bills of 11/08/89 approved in the amount of $1,028,717.38. Approved the waiver of Building fees. Carried by unanimous voice vote. LEGISLATIVE BUSINESS Mayor Teglia questioned why the ordinan- ces were being introduced before public hearings were held. City Attorney Armento stated that State Law was very specific on the adoption of Uniform Codes, and was different than the normal ordinance activity. She con- tinued, State Law requires that the Council introduce the ordinance, and then call for the Public Hearing. She stated that it must be advertised twice before the Public Hearing is held, and that the Council hold the Public Hearing at the adoption time; and this was because the Council was adopting Uniform Codes by reference. Mayor Teglia questioned if the Council could change the ordinances after the Public Hearing was held. City Attorney Armento answered in the affirmative. Councilman Nicolopulos questioned page 1 of the staff report wherein it states: "State law requires that we approve all amendments to the uniform model codes prior to January 1, 1989." Director of Economic & Community Development Costello stated that that was a mistake, and should read "prior to January 1, 1990." Motion by Councilman Nicolopulos - To waive reading and introduce the seven ordinances. Councilman Nicolopulos complimented Ms. Costello on the ordinances being intro- duced tonight when she had been with the City for a short period. He requested that in future staff reports covering changes in ordinances that the changes be 11/8/89 Page 3 AGENDA ACTION TAKEN ~LEGISLATIVE BUSINESS 6. Motion - Continued. f) AN ORDINANCE AMENDING CHAPTER 15.20 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE TO ADOPT THE NATIONAL ELECTRICAL CODE, 1987 EDITION, AND TO REPEAL THE NATIONAL ELECTRICAL CODE, 1984 EDITION g) AN ORDINANCE AMENDING CHAPTER 15.24 OF THE SOUTH SAN FRANCISCO MUNICIPAL CODE TO ADOPT THE UNIFORM FIRE CODE, 1988 EDITION, AND TO REPEAL THE UNIFORM FIRE CODE, 1985 EDITION ITEMS FROM COUNCIL GOOD AND WELFARE CLOSED SESSION e Closed session for the purpose of discussion of personnel matters, labor relations, property nego- tiations and litigation. RECALL TO ORDER: LEGISLATIVE BUSINESS highlighted for Council comparisons. Councilman Nicolopulos withdrew his Mot i on. M/S Addiego/Haffey - To waive reading and introduce six ordinances. City Attorney Armento stated that the Motion had been for six ordinances, yet there were seven ordinances in total. Carried by unanimous voice vote. Councilman Drago stated that he wanted reasons stated at the Public Hearings on the changes being made in the ordinances. Director of Economic & Community Development Costello related that State law requires that when another Code was adopted, the Council had to go back and readopt previously made changes. M/S Haffey/Addiego - To waive reading and introduce the seventh ordinance. Carried by unanimous voice vote. ITEMS FROM COUNCIL No one chose to speak. GOOD AND WELFARE No one chose to speak. CLOSED SESSION Council adjourned to a Closed Session at 7:50 p.m. to discuss the items noticed, as well as the Downtown Redevelopment lawsuit. Mayor Teglia recalled the meeting to order at 9:22 p.m., all Council present, no action was taken. M/S Addiego/Haffey - To adjourn the meeting.
