City of South San Francisco Entered into Closed Session: 6:32 p.m. Reconvened into Open Session: 6:55 p.m., all Councilmembers present. Report from Closed Session: City Attorney Mattas reported the following action taken - The City Council approved a settlement agreement with San Bruno Mountain Watch, the Center for Biological Diversity, and Myers Development/Sunchase. Under the terms of settlement agreement the Center for Biological Diversity and San Bruno Mountain Watch will, upon approval of final map and issuance of a grading permit for the Terrabay Woods, dismiss with prejudice their CEQA lawsuit and the lawsuit they brought against the Army Corps of Engineers related to endangered species. San Bruno Mountain Watch and the Center will also agree not to bring any further lawsuits challenging construction of the Airport Boulevard realignment, the Oyster Point flyover project, and the proposed hookramps at Phase III of Terrabay. They also agree that any comments that they submit to any agencies involved in the approval of these traffic improvements will not impede or delay construction of those traffic improvements. The last provision of the settlement agreement provides for the creation of what is referred to as a preservation parcel at the northern portion of Phase III, including the entirety of the shellmounds upon which there will be no development and it will be maintained in a preserved state. There is also the creation of a buffer parcel immediately south of that, which also created upon which no structures will be built other than an interpretative center and potential parking facilities. This agreement was approved by a 5-0 vote of the City Council. 4. Adjournment Motion-Fernekes/Second-Penna: To adjourn the meeting at 6:58 p.m. Unanimously approved by voice vote. SPECIAL CITY COUNCIL MEETING MARCH 8, 2000 MINUTES PAGE 2 MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING MARCH 8, 2000 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER: 7:34 p.m. (Cassette Tape No. 1) ROLL CALL: Present: Councilmembers Datzman, Mullin and Penna, Mayor Pro Tern Femekes and Mayor Matsumoto Absent: None PLEDGE OF ALLEGIANCE: Flag ceremony presented by South San Francisco Girl Scout Troop Nos. 431 and 261; Pledge led by Mayor Matsumoto INVOCATION: Given by Reverend Francisco Baltadano, Mission Espirito Santo PRESENTATIONS · Proclamation - National Girl Scout Week, March 5 - 12, 2000 - Mayor Matsumoto read proclamation (to be forwarded to Troop Leader Mary McKay) Census 2000 - Community Outreach Director Quinn and Ms. Patricia Flores-Lacson discussed the census process that will begin on March 15 and end April 15. Ms. Lacson reviewed the outreach that the North Peninsula Neighborhood Services Center will be providing during this period. BART Update - Ms Jaymie Steen, BART liaison representative, reviewed current construction work. Major announcements included Chestnut Avenue being re-paved within 10-15 days, the South San Francisco station is currently in the design phase and will start construction in mid-late June, and the rail installation date has not yet been announced. In reference to Measure B, Mayor Matsumoto asked if BART Director Tom Radulovich's comments in a mailer, that stated "Measure B...it's a bad deal for South San Francisco and a bad deal for BART", is an opinion shared by the BART Board of Directors. Ms. Steen stated Mr. Radulovich is speaking for himself, and BART is neutral on all local and electorical concerns. AGENDA REVIEW City Manager Wilson requested Agenda Item No. 5's language be corrected to read "...in an amount not to exceed $41,000", and Item No. 6 be removed. PUBLIC COMMENTS Mrs. Sophie Mason, 10 Arlington Drive, stated her disappointment with the outcome of the election and the negative impact Costco will have on the community. Mrs. Helen Headlee, 115 Duval Drive, commented on the election regarding Measure B and her disappointment with the Police, and especially the Fire Department for endorsing the measure. Mr. Don Mason, 10 Arlington Drive, asked that the City Engineer respond to his questions regarding verification that Costco is contributing towards traffic signals or road work, if BART was contacted regarding traffic congestion along E1 Camino Real, and if response time for ambulances on their way to Kaiser will be delayed due to traffic congestion along E1 Camino. He submitted his letter to the City Clerk for the record. Ms. Jo-Ann D'Angelo, 60 Calvert Avenue, stated her concerns regarding MTBE contamination from Costco's gasoline tanks. It is her belief that the tanks will leak into the Hetch Hetchy water lines leading to San Francisco. She has informed the City of San Francisco and Senator Feinstein's office of this issue and urged others to write as well. She informed Council that she will be watching their actions closely. Messrs. Dotson Louie, 699 Freesia Drive, and Suresh Patel, 700 Freesia Drive, asked for a status report concerning the access easement through their court to Alta Loma Park. Mayor Pro Tem Fernekes stated that he would be addressing this issue under Items from Council ITEMS FROM COUNCIL · Community Forum · Subcommittee Reports Mayor Pro Tem Fernekes asked for a report on the Greystone/Promenade pedestrian way and staff gave an update on the current number of units that are being held up from occupancy until Greystone's full obligation with the City has occurred. Greystone does have an obligation with the City for all improvements, which includes Alta Loma Park, underground electrical facilities, and to install the planned pedestrian access. A site plan showing a new proposed route to Alta Loma Park from Greenridge was reviewed. Staff indicated that the park's original completion date was May, 1999. Mayor Pro Tem Fernekes stated his frustration with the developer's procrastination and the disappointment little league has also had to share. Councilman Datzman responded to speakers' comments made about Council, the election and Costco. He discussed the process that took place, the reports and studies that were presented, the public hearings that were held by both the Planning Commission and City Council. He stated his frustration with comments that continue to be negative and misrepresented, and that it was now time to move forward. REGULAR CITY COUNCIL MEETING MARCH 8, 2000 MINUTES PAGE 2 ;El'/ Councilman Mullin suggested that a representative from the San Francisco Water Department be contacted and respond to the MTBE concerns and that the City Engineer respond also. He stated that he would be traveling to Washington DC to meet with Jane Garvey, the head of FAA on Monday, March 13, to request Bay TRACON equipment funding that will enhance air traffic safety and increase aircraft landing patterns. He will also be meeting with the House Transportation Committee which has control of the funds for the noise insulation programs. He reported that the South San Francisco Community Partnership group is making substantial strides and asked that Director Quinn make a presentation to Council on the program's development. He announced Youth in Government Day events that will begin on March 22, and end with a mock council meeting on April 5. He reported that he will be meeting with the emergency homeless shelter committee on Friday, March 10, and that although a one year leeway was given to find a North County site a decision must be made in the next month or two to keep on schedule. He stated that CDBG funding is being pursued to help rehabilitate the facility. Mayor Matsumoto asked that the MTBE report include the status of service stations in the area and if they're exempt from pumping gasoline containing MTBE. She mentioned that MTBE is to be phased out in the next couple of years through State legislation. She affirmed her support for the Fire and Police Departments and their job performance. She stated that the next community meeting is April 13, 7:00 p.m. at E1 Camino High School. She announced that the City received two grants from the County Bikeways Committee and thanked staff members City Engineeer Kianpour, Dennis Chuck and Steve Carlson for submitting the proposals. She suggested that residents who have problems with RCN contractors call the Council hotline. She announced that in an effort to reduce the length of Council meetings, speakers allotted time limit is being reduced from five minutes to three minutes and it will take effect March 22. She stated that a County survey was conducted and it was found that a majority of cities limit comments to three minutes. CONSENT CALENDAR Motion to approve the minutes of the February 16 special meeting and February 23, 2000 regular meeting 2. Motion to confirm expense claims of March 8, 2000 in the amount of $2,416,333.10 Resolution No. 18-2000, authorizing an amendment to the Library FY 1999-2000 operating budget and receipt of $42,602 from the State of California Public Library Fund Resolution No. 19-2000, amending the 457 deferred compensation plan and trust document Resolution 20-2000, awarding contract to planning consultant James Harnish for revision of the zoning ordinance in the amount of Sd 5,000 an amount not to exceed $41,000 Councilman Mullin stated he will be abstaining from the motion to approve the minutes of February 16. Councilman Penna requested Agenda Item No. 2 be removed from the Consent Calendar. PUBLIC HEARING o Public hearing to receive comments on the City's housing and community development needs, review proposed activities requesting CDBG funding, and provide direction to staff regarding funding priorities for the 2000-01 program year Public hearing opened. Staff reported presented by CDBG Coordinator Fragoso. Speakers: each speaker briefly described the services their agency provides, what the funding is to be used for, and responded to questions regarding their funding level, which has been traditionally based on previous allocations. Councilman Penna asked CDBG Coordinator Fragoso why HUD is not allocating more money to cities and she stated that a formula was standardized approximately twenty years ago and has not been updated by HUD. Resolution approving Terrabay Phase II Woods East and Woods West subdivision final map, accepting offers of dedications, approving a subdivision improvement agreement and authorizing the recording of the final map and its related documents Item removed under Agenda Review. LEGISLATIVE BUSINESS o Waive reading and introduce an ordinance amending SSFMC Chapter 8.54 entitled Community Preservation Ordinance to authorize summary abatement of immediate dangers to health and safety Staff report presented by City Attorney Mattas. In response to Councilman Mullin, City Attorney Mattas explained that an example of an immediate danger may be a refrigerator, with its door intact, and left in an area accessible by children. He stated each situation must be looked at on a case by case basis.
