Consideration of agreement between Myers Development Company and City of
South San Francisco related to issuance of permits for the 70 single-family paired
residential units (Heritage) and implementation of existing development obligations
regarding the set-aside letter, dedication of the recreation parcel, and Point
restoration. Resolution approving an agreement between Myers Development
Company and the City of South San Francisco
City Attorney Mattas presented the staff report and distributed a revised version of
the proposed agreement.
Councilman Gonzalez questioned the status of the 43 affordable housing units, and
City Attorney Mattas responded that the obligation to provide below market units is
tied to issuance of the first certificate of occupancy for the commercial development.
Councilwoman Matsumoto questioned that the end result of the agreement to assure it
is not effecting any environmental mitigation measures or conditions of approval.
City Manager Wilson and City Attorney Mattas responded that the agreement
separates the residential development from the commercial portion of the
development, all other conditions remain in effect. This modification will allow
Myers the ability to address issues that the Engineering Division has identified in
order to obtain a rough grading permit. Councilwoman Matsumoto confirmed that
The Point will be graded in the first phase, that the theater and other obligations are
tied to the commercial portion, and that the condominium structure is still projected.
Mr. Myers responded to Councilwoman Matsumoto's concerns and detailed the
efforts Myers Development is making considering the current economic market.
Motion-Matsumoto/Second-Gonzalez: To approve Resolution No. 72-2001,
approving an agreement, that was placed before Council this evening, with Myers
Development Company related to issuance of permits for the 70 single-family paired
residential units and implementation of existing development obligations regarding
the set-aside letter, dedication of the recreation parcel and restoration of The Point
area, including that the final version of the agreement be subject to approval as to
form by the City Attorney for minor word changes to reflect Council authorization.
Approved by voice vote. Absent: Mayor Pro Tem Mullin.
