Call to Order 7:29 p.m. 2. Roll Call Present: Public Comments Absent: None. (Cassette Tape No. 1) Councilmembers Femekes, Green and Matsumoto, Mayor Pro Tem Gonzalez and Mayor Mullin None Interview applicant for the Cultural Arts Commission Mayor Mullin welcomed applicant, Mr. Andrew T. Lee. Mr. Lee responded to questions asked by Council. (Questions were consistent with those asked at previous interviews.) Discussion and appointment to Cultural Arts Commission Motion-Fernekes/Second-Matsumoto: To appoint Andrew T. Lee to the Cultural Arts Commission. Unanimously approved by voice vote. Mul~yor Cithpt' South San Francisco MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING JANUARY 23, 2002 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER 7:45 p.m. (Cassette Tape No. 1) ROLL CALL Present: Councilmembers Fernekes, Green, and Matsumoto, Mayor Pro Tem Gonzalez and Mayor Mullin Absent: None PLEDGE OF ALLEGIANCE Led by Mayor Mullin INVOCATION Given by Rev. Tate Crisp, Good News Chapel Mayor Mullin announced that the meeting will be adjourned in memory of Ambrose Galli, Sr., a community patriarch. PRESENTATIONS Introduction of new and promoted employees: Fire Chief Lee introduced Administrative Assistant II Anne Sullivan, Paramedic/Firefighter John Grimaldi, Fire Captains Jess Magallanes and Brian Grasser, and Battalion Chiefs Dick Dennin and Jim Selvitella (Deputy Fire Chief Phil White was unable to attend). Finance Director Steele introduced Assistant Finance Director David Woo. Police Captain Guglielmoni introduced Police Corporal Michael Rudis and Communications Dispatcher Suzanne Perez. Edgewood Kinship Support Services - Program Director Ron Alexander presented background information and explained that the program supports caregivers who are raising a child of a relative. He stated that KSSP recently opened an office at 1115 Mission Road (program material was distributed to Council). California Campaign for Libraries - Library Director Sommer explained that the campaign is to increase the public's awareness of library services through public service announcements (PSA) presented by celebrity spokespeople. Library Services and Technology Act Grant monies is paying for the PSAs, and the campaign motto is "The Library - Check it Out". A video presentation was given and bookmarks were distributed to Council. AGENDA REVIEW City Manager Wilson requested Item No. 5 be removed from the Agenda. City Attorney Mattas requested that Council, by motion and a two-thirds vote, add Aetna v. City of South San Francisco to the Closed Session. Motion-Fernekes/Second-Green: To add Aetna v. City of South San Francisco to the Closed Session. Unanimously approved by roll call vote. PUBLIC COMMENTS Mr. Don Mason, 10 Arlington Drive, stated his concern regarding the width of the sidewalk on the 200 block of Baden Avenue (in front of Giorgi Bros.) and asked whether it meets the guidelines of the Americans Disability Act. He also asked for further information regarding a payment of $10,000 to the City, the date the Giorgi Bros. project was red-tagged, and requested the response be made in writing. Mayor Mullin directed City Attorney Mattas to respond to Mr. Mason in writing. Mr. Greg Cochran, South San Francisco Chamber of Commerce, announced that a candidates' night forum is being held for the Democratic Candidates of the 19th Assembly District on Tuesday, February 12, 2002, 7:00 p.m., at the Municipal Services Building. He stated the forum is sponsored by the North San Mateo County Chambers of Commerce and the League of Women Voters. He further reviewed the schedule for the television coverage. ITEMS FROM COUNCIL · Community Forum · Subcommittee Reports Councilman Green thanked Police Property Evidence Clerk Peggy Hart for her efforts in organizing the recent Blood Drive, the South San Francisco Scavengers for allowing the YMI to use their facilities for the annual Christmas food basket program. He stated that he will be doing volunteer work at Safe Harbor on Thursday, January 24, 2002. Mayor Pro Tem Gonzalez reported on events he recently attended, including the first day of food distribution by the Salvation Army and Second Harvest Food Bank, the Fire Department Badge Ceremony, the Place Making Workshop that was sponsored by the Project for Public Spaces, and the San Mateo County Emergency Services meeting. Councilwoman Matsumoto commented on a recent newspaper article that Millbrae is enacting tougher massage parlor legislation and that South San Francisco is in the forefront of this issue due to model legislation drafted by Chief Raffaelli and City Attorney Mattas several years ago. She stated that paving of streets and pothole repair work is continuing during dry weather and E1 Camino Real will be re-paved by Caltrans this Spring. She reported that the BART Art project includes a photo history of South San Francisco and that a public grand opening is being planned. She further reported that the South San Francisco BART station will not be opened prior to the other three stations. REGULAR CITY COUNCIL MEETING JANUARY 23, 2002 MINUTES PAGE 2 Councilman Fernekes reported that the South San Francisco Sister City organization is planning two Sister City visits this year to Italy and Mexico. He stated the organization is setting guidelines for visiting delegations and that the Rotary Club is planning a student exchange visit to Kishiwada in April. Mayor Mullin reported that he welcomed the Child Development Policy Institute to the community during its statewide meeting held last week, and attended Samtrans' inauguration of its 24/7 service along E1 Camino Real. He also thanked Peggy Hart for her blood drive efforts and wished South San Francisco resident Elizabeth Lewis a happy 90th birthday. Mayor Mullin reported that a School Liaison Committee meeting is being scheduled for either February 5, 11 or 12, and notification will be sent out once the date is selected. CONSENT CALENDAR 1. Motion to approve the minutes of the January 9, 2002 special and regular meetings 2. Motion to confirm expense claims of January 23, 2002 in the amount of $2,187,329.38 Motion to accept the painting at Siebecker Center, Magnolia Center, and the MSB/ Recreation Division project as complete in accordance with plans, specifications and contract documents Motion to accept the Shaw Road Pump Station Force Main Repair Project as complete in accordance with plans and specifications o Resolution authorizing the execution of an agreement with Jane DeDecker for the production and installation of a bronze sculpture entitled "Safe Haven" in the Orange Memorial Park Sculpture Garden in the amount of $30,000 Removed from agenda. Motion-Gonzalez/Second-Fernekes: To approve the Consent Calendar as presented. Unanimously approved by voice vote. PUBLIC HEARING Consideration of Appeal of Planning Commission denial of Use Permit (UP-01-064) to allow for the co-location of a second wireless telecommunications facility within 300' of a residential zoning district (R-1-E Single Family) on the 0.44 acre parcel at the terminus of Avalon Drive (Westborough); Owner: California Water Service; Applicant: Metro PCS/Richard C. Riley Applicant has requested the item be continued off-calendar. Notification has been sent to those listed on the project mailing list. Public hearing opened. Motion-Fernekes/Second-Green: To continue the consideration of Appeal of Planning Commission denial of Use Permit (UP-01-064) off-calendar. Unanimously approved by voice vote. REGULAR CITY COUNCIL MEETING JANUARY 23, 2002 MINUTES PAGE 3 ADMINISTRATIVE BUSINESS Motion to approve the "Public Comments" time limitation and modify the City Council Handbook Staff report presented by City Attorney Mattas. Mayor Mullin stated his preference that the time limit being increased from three to five minutes during his term as Mayor. Mayor Pro Tem Gonzalez stated his support for Mayor Mullin's recommendation, and noted that he has spoken to other council members in other communities and three minutes is very common. He also commented that the timer is distracting during Public Comments. Motion-Fernekes/Second-Gonzalez: To approve an amendment to the City Council Handbook and the City Council and Redevelopment Agency agendas to modify the time limits for individual speakers during the public comments section of the Council meetings and during any public hearing. Unanimously approved by voice vote. CLOSED SESSION o Pursuant to Government Code Section 54957.6, conference with Labor Negotiator Jennifer Bower related to PERS benefits for AFSCME Local 1569, Operating Engineers Local 39, Teamsters Local 856, Police Association/Non-Sworn, Mid-Management and Executive Management; and Pursuant to Government Code Section 54956.9(a), existing litigation: Aetna v.
