Call to Order: 2. Roll Call: o 6:26 p.m. Present: (Cassette Tape No. 1) Councilmembers Femekes, and Matsumoto, Mayor Pro Tem Gonzalez and Mayor Mullin Absent: Councilmember Green Others present: City Manager Wilson, City Attorney Mattas, Assistant City Manager Moss, Directors Nagel and Van Duyn, Fire Chief Lee, Police Chief Raffaelli and Chief Planner Sparks Public Comments: None. Study Session: a) Policy for mobile food vendors City Manager Wilson presented opening comments and provided background information on the mobile food vendors soliciting at Orange Memorial Park. Mayor Mullin questioned City Attorney Mattas if the City had rights to regulate the mobile food vendors. He stated yes, the City did and the regulations that are in the SSFMC are consistent with California case law. Police Chief Raffaelli stated that the main traffic concerns include double parking, illegal U-tums, and jaywalkers. Director Nagel explained the procedures and regulations of building a concession stand for food vendors inside Orange Park. Speakers: Mr. Esteven Calderon, 125 Mulberry Avenue, stated that he has been in business at Orange Park for seven years and if his truck is not allowed to park at Orange Park, he would be unable to pay his rent. He submitted petitions to Council in favor of having mobile food vendors parked at Orange Park. Mr. Kevin Kone, President, Parc Place Homeowners Association, 55 Bay Court, stated that there are 153 homes in the association and their purpose was to protect the property values, provide consistent appearance of the neighborhood, and maintain low homeowners dues for the upkeep of the community. He also stated that the food vending trucks are preventing them from achieving their goals. Mr. Tyler Stavros, Parc Place Homeowners Association, 55 Bay Court, stated that their major concerns were: litter and sanitary issues, increased gardening rates, traffic issues and noise from large commercial trucks. Mr. Rodolfo Peralta, 1140 17th Avenue, Redwood City, stated he has been at Orange Park for thirteen years and has employees to pick up litter from his truck. His other truck is located on Middlefield Road in Redwood City, and his hours of operation are from 10 a.m. to 5 p.m. He also submitted petitions to Council, Mr. Hugo Santana, 624 Hemlock Avenue, stated he has been at Orange Park for three years and has been in business for eight years. Prior to Orange Park, he parked at the shopping center at Hillside Boulevard and Linden Avenue and on Hillside Boulevard in Colma. He has employees to pick up the litter and submitted petitions to Council. Mayor Pro Tem Gonzalez stated that the trucks take parking spaces away from people visiting the park and that Orange Park is not zoned for mobile food vendors. Councilman Femekes responded that the zoning is residential and Orange Park is zoned open space/public use. Councilwoman Matsumoto stated her concerns related to litter and the complaints to the Police Department concerning the blocked sidewalks. Mayor Pro Tem Gonzalez voiced his concern related to the use of butane tanks utilized by the mobile food vendors. Mayor Mullin questioned if the mobile food vendors need to comply with building codes and what the regulations and restrictions are on mobile food venders. City Attorney Mattas read the regulations and restrictions from the South San Francisco Municipal Code. SPECIAL CITY COUNCIL MEETING April 17, 2002 MINUTES PAGE 2 Chief Raffaelli explained the traffic problems with mobile food vendors parked along Orange Avenue. Mayor Mullin stated that the vendors are in violation of the South San Francisco Municipal Code and he is not in favor of having the mobile food vendors within Orange Park. Councilman Fernekes stated he agreed with Mayor Mullin. His concern is setting a precedent having commercial concession stands in our city parks and felt the parking of mobile food vendors along Orange Avenue needs to stop. Councilwoman Matsumoto stated she is not in favor of having mobile food vendors parked on Orange Avenue and that it is a residential area. Council's direction to staff was: 1) it is residential area and not designed for long term commercial use; 2) there is little interest to re-locate the mobile food vendors onto the park property; and 3) application of the law is appropriate, which means that staff will have to enforce current regulations and if there is difficulty in doing so, then there would be a simple curb painting procedure to eliminate it. b) City flag Director of Parks, Recreation, and Maintenance Services Nagel presented background information on the design of a city flag and offered three design samples. Mayor Mullin's concern was that the samples did not incorporate the city seal. He stated that many other cities have their city seal on their flags. Councilwoman Matsumoto gave various reasons as to why the flag should have a separate logo, as well as, the City Seal. She suggested that the flag could be used as an exchange gift with sister cities and used as the logo for "Day in the Park." Councilman Fernekes stated that it is important to emphasize the city seal, as well as, to have the new industry, bio-science, represented. Mayor Pro Tem Gonzales is in support of having a city flag, as long as, it incorporates the city seal with new industry. The consensus from Council is in support of a city flag. They would like to see other design samples that would include the city seal with, possibly, a double helix as a border to represent bio-science.
