Payne, City Cl~'k City of South San Francisco Approved: MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING MAY 22, 2002 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER: 7:30 p.m. (Cassette Tape No. 1) ROLL CALL: Present: Councilmembers Fernekes, Green, and Matsumoto, Mayor Pro Tem Gonzalez and Mayor Mullin Absent: None PLEDGE OF ALLEGIANCE: Led by Mayor Mullin INVOCATION: Given by Reverend John Cantley, Grace Covenant Church PRESENTATIONS · Spring Ballet Recital - Instructor Maria Spremich and students Council Members presented certificates of recognition to the following students in recognition of their years of participating in the ballet program: Tiffany Dong Bevin Femandez Laura Lucchesi Kristin Paulson Kristen Quok Melissa Velarde Christina Young 12 years 13.5. years 12 years 12 years 15 years, plus 6 years as instructor 13.5 years 13 years Dispatchers of the Year - Mayor Mullin presented certificates to South San Francisco Communication Dispatchers Sue Galloway and Karen Grimley. AGENDA REVIEW No changes. PUBLIC COMMENTS Mr. John Baker, 975 Sandra Court, stated his disappointment that SamTrans does not provide bus service at the South San Francisco train station on Dubuque Avenue and asked if a SamTrans bus stop can be moved closer to the train station, noting that the closest one is currently at Airport Boulevard/Baden Avenue. Mayor Mullin concurred with Mr. Baker's concerns and directed City Manager Wilson to explain the future improvements for the Caltrain station. City Manager Wilson additionally stated that Caltrans is working with the City on a possible pedestrian walkway from Airport Boulevard to the train station and possibly an underground walkway or overpass, lbr E101 pedestrians. For Council's information, City Manager Wilson stated that a Caltrain representative will be present at a June City Council meeting on a matter concerning pile driving work at the Colma Creek railroad crossing. Mrs. Dawn Regan and Mr. Chris Regan, 2744 Kilconway Lane and Mr. Joe Juni (address unknown) reiterated their concerns regarding the Caltrans' property and Carter Park condominium development that is under construction next to their residence and its affect on the area's wildlife (photos submitted to Council). Mr. Regan stated that he would like to see the Caltrans' property turned over to the City and a basketball court built. City Manager Wilson concurred that the State does not properly maintain the site; it is on a fault line so its value is limited, but Caltrans has not indicated that they will convey the land to the City. He stated that staffhas prepared a report has in response to the concerns raised by the Regans at the May 8 meeting. Mrs. Regan and Mr. Juni affirmed that the construction work has not been contained to just the construction site and that the work is affecting their quality of life. At the direction of Council, Deputy Fire Chief White reviewed his report (copies of report distributed to Council). Engineering Project Coordinator Mike Rozzi indicated that the excavation and compaction work for the foundation is just about completed and he stated that he is unaware of any weekend work taking place. Mayor Mullin directed staff to follow-up on the complaint that work is being conducted on Saturdays and is continuing past 5:00 pm. Mayor Mullin informed the Regans that they will be contacted when Deputy Fire Chief White meets with Caltrans and that the City does not have the authority to stop the construction work. ITEMS FROM COUNCIL · Community Forum · Subcommittee Reports Councilman Fernekes reported that he attended the budget subcommittee (Fernekes/Green) and Day in the Park subcommittee (Fernekes/Matsumoto) meetings. Community events he attended included the West Winston Manor Community Homeowners Association's barbecue at Clay Avenue Park, the South San Francisco Scholarship Association annual award ceremony, the Gateway art commissioning event, the Tip-A-Cop dinner at the Hungry Hunter, and the annual South San Francisco Girl Scouts' award ceremony. Councilwoman Matsumoto stated the community events she attended included the Girl Scouts' award ceremony, and she joined local legislators who traveled to Sacramento as part of the League of California Cities LOCAL Coalition. She complimented Hines on its piece of sculpture work at the Gateway Business Park, and announced that the 49ers are partnering with the City on community issues. She reported that the bond committee (Matsumoto/Gonzalez) met with staff and that she attended the San Mateo County Council of Cities legislative meeting. She asked that Council mark their calendars as a reminder that the Council of Cities legislative breakfast is scheduled for October 26, 2002 and announced that the Millbrae skate park has opened. She attended a San Mateo County peace officers memorial with poignant remarks made by State Attorney General Bill Lockyer. Councilwoman Matsumoto noted that one South San Francisco police officer lost his life in 1953, Officer William Moyle. Councilman Green briefly reported on the budget subcommittee (Fernekes/Green) meeting and that the events he attended included the League of California Cities LOCAL Coalition bus trip to Sacramento, the Tip-A-Cop dinner, and the Girl Scouts' award dinner. REGULAR CITY COUNCIL MEETING MAY 22, 2002 MINUTES PAGE 2 Mayor Pro Tem Gonzalez stated that community events he attended included the Northern California Square Dancers Association celebration, the West Winston Manor CHOA barbecue, the LOCAL Coalition bus trip to Sacramento, and the Chamber's Positive Attendance meeting. He announced a farewell banquet for Paul Hamann, Executive Director for Families on Track, will be held June 6. Mayor Mullin reported that the LOCAL Coalition met with six State legislators last week in Sacramento to discuss the plight of cities and counties with respect to budget cut-backs. He further reported that he attended a partnership breakfast with the School District and that the School District Liaison Committee (Mullin/Gonzalez) met and a report will be compiled and submitted to Councilmembers for their information. CONSENT CALENDAR Motion to approve the minutes of the May 6, 2002 special meeting and May 8, 2002 regular meeting 2. Motion to confirm expense claims of May 22, 2002 in the amount of $3,655,366.97 o Resolution No. 37-2002, authorizing the acceptance of grant funds from Peninsula Partnership to support the South San Francisco Community Partnership and the Partnership's Transitional Kindergarten Program in the amount of $41,940.33 Motion to accept the 1999-2000 Street Resurfacing Project complete in accordance with plans and specifications o Motion to accept the Chestnut and Grand Avenues Intersection Improvement Project complete in accordance with plans and specifications o Motion to accept the Police Department Report Writing Room Upgrade Project as completed in accordance with plans and specifications o Resolution No. 38-2002, authorizing execution of a Cooperation Agreement with the County of San Mateo to continue the HOME Consortium for a three year period covering FY 2003, 2004 and 2005 Acknowledgement of proclamation issued: Northern California Square Dancers, May 11, 2002 Motion-Fernekes/Second-Gonzalez: To approve the Consent Calendar as submitted. Unanimously approved by voice vote. Abstain: Mayor Mullin, minutes of the May 6 special meeting. ADMINISTRATIVE BUSINESS Motion to adopt an ordinance adding Title 1, Chapter 1.25 of the SSFMC entitled Administrative Citations and resolution establishing fines Staff report presented by Assistant City Attorney Johnson. REGULAR CITY COUNCIL MEETING MAY 22, 2002 MINUTES PAGE 3 In response to Councilwoman Matsumoto, Assistant City Attorney Johnson reviewed the limitations of the fine process and explained that the fees are set by the Government Code. She further explained that the intention of the administrative citation process is to gain code compliance in a non-criminal, non-adversarial way. Deputy Fire Chief White further reviewed how the ordinance will give code enforcement a tool to work with repeat violators and will provide a financial incentive to comply. In response to Mayor Pro Tem Gonzalez, Assistant City Attorney Johnson stated that there is a late payment penalty of 1% per month for the unpaid fine balance. Deputy Fire Chief White stated that an article will be in the Independent newspaper and community groups will be contacted for formal presentations. Mayor Pro Tem Gonzalez suggested the Philippine and Spanish newspapers also be contacted. In response Councilman Green, Deputy Fire Chief White reviewed the fine increment process and clarified that if the Administrative Citation process fails to work in the instance of a repeat violator, staff will evaluate the situation and look at other code enforcement tools to gain code compliance, such as the civil route or abatement. Councilman Fernekes stated his support for increasing the fine for the third violation from $300 to $500. In response to Mayor Mullin's concern regarding a judicious and impartial process, Assistant City Attorney Johnson confirmed that code enforcement officers are empowered to use discretion on a case-by-case basis to determine what mechanism is most appropriate under the circumstances. Mayor Mullin stated that he does not support increasing the third fine to $500, but will concur for the sake of unanimity. Mayor Mullin asked for a consensus from Council to set the fines at $100 for the first violation, $200 for the second violation, and $500 for the third violation. Council concurred. Motion-Fernekes/Second-Green: To adopt Ordinance No. 1309-2002, adding Title 1, Chapter 1.25 of the SSFMC entitled Administrative Citations and Resolution No. 39- 2002, adopting a schedule of fines for the Administrative Citation Ordinance, including that the fines be set at $100 for the first violation, $200 for the second violation, and $500 for the third violation.
