Assistant City Johnson reported that Council took action on Labor Negotiations, and Council provided direction to initiate litigation. 5. Payne, City a~rk'~ City of South San Francisco llin, Mayor San Francisco MINUTES CITY COUNCIL CITY OF SOUTH SAN FRANCISCO REGULAR MEETING AUGUST 14, 2002 MUNICIPAL SERVICES BUILDING COMMUNITY ROOM 33 ARROYO DRIVE CALL TO ORDER: 7:30 p.m. (Cassette Tape No. 1) ROLL CALL: Present: Councilmembers Fernekes, Green, and Matsumoto, Mayor Pro Tem Gonzalez and Mayor Mullin Absent: None PLEDGE OF ALLEGIANCE: Led by Mayor Mullin INVOCATION: Given by Reverendo Francisco Baltodano, Mission Espirito Santo PRESENTATIONS · Day in the Park, September 21, 2002 - Councilman Femekes and committee member, Mr. Jim Metz, gave a visual presentation of the day's events and activities. · City-Wide Garage Sale - Tonya Light gave an update on this year's garage sale and announced that the registration cut-off date is September 9. · Reading the Grapes of Wrath Library Project Update - Assistant Library Director Cheryl Grantano gave a visual presentation, read excerpts from the literary classic, and reviewed the calendar of events that will kick-off on August 20 and end October 29. · New Westborough Learning Club and Childcare Center Programs - Literacy Program Manager Ana Linder, Recreation & Community Services Coordinator Liz Penman and Literacy Services Coordinator Marta Bookbinder gave a visual presentation and overview of the expanded childcare and literacy services that will begin at the Westborough Recreation Center on September 16. AGENDA REVIEW No changes. PUBLIC COMMENTS Ms. Chun Lee, 2375 Fallingtree Drive, San Jose, (spoke previously before Council on June 26) discussed the mistreatment of Falun Gong practitioners (a Chinese spiritual practice). She requested Council adopt a resolution in support of Falun Gong or send a letter to the Chinese government objecting to the persecution of practitioners. (Information distributed to Council.) Mr. Andrew Elsmore, 1814 Moreland Drive, Alameda, discussed the principles of Falun Gong, the current persecution of practitioners by the Chinese government and requested Council voice its support for the human rights of Falun Gong members. Mayor Mullin stated the request will be considered by Council. ITEMS FROM COUNCIL · Community Forum · Subcommittee Reports Councilman Green attended the monthly meetings of the SFO/Community Roundtable, the San Mateo County Council of Cities, and the BART Linear Park Project Orientation meeting on August 6. He acknowledged Police Officer Sharon Cervelli for participating in the Avon Breast Cancer Walk. Mayor Pro Tem Gonzalez reported that the telecommunications subcommittee (Gonzalez/ Fernekes) met and that further information has been requested from staff. He provided an update on the Sister City subcommittee (Gonzalez/Femekes) meeting to consider a request that Cochin, India be designated a Sister City and that further information has been requested from the interested parties. He attended the BART Linear Park Project Orientation meeting on August 6, the SAMCEDA breakfast meeting, Kaiser Permanente's first Latino Association Scholarship Awards Ceremony, the San Mateo County Fair, and the Community Preservation Task Force Committee meeting. He requested a letter or resolution be prepared from Council to the State legislature stating that Council supports the funding of the South San Francisco Ferry Service from a portion of new revenues generated by a $1 increase in State-owned bridge tolls. City Manager Wilson, noting time constraints, stated a draft letter will be forwarded to Council for consideration and will be prepared for the Mayor's signature. Councilwoman Matsumoto requested Council also receive copies of the supporting legislation. Councilwoman Matsumoto acknowledged the Chamber of Commerce's successful South San Francisco Goes Country dinner/dance in July. She reported on the baking project program, located in South San Francisco East of 101 area that trains low-income people baking skills and provides job placement. She attended the BART Linear Park Project Orientation meeting and the Facilities Naming subcommittee (Matsumoto/Fernekes) meeting. Councilman Fernekes attended the Boys' Club National Kids Day Celebration, the County Fair, Kaiser Permanente's scholarship ceremony and dinner, the telecommunications subcommittee (Femekes/Gonzalez) meeting, the BART Linear Park Project Orientation meeting, and the Day in the Park subcommittee (Femekes/Matsumoto) meeting. He reported that the Facilities Naming subcommittee (Femekes/Matsumoto) met to discuss naming the Cultural Arts Commission's scholarship fund program. Councilman Femekes noted that the funds are not public monies and the subcommittee recommended that the decision for naming the program be decided by the Cultural Arts Commission. Council concurred with the subcommittee's decision to have the Cultural Arts Commission name its own scholarship fund program. Mayor Mullin stated he met with Kaiser representatives regarding parking concerns; he attended the SAMCEDA meeting, and an airport siting committee meeting for placing new noise monitoring stations throughout the County. Councilman Femekes announced that the Basque Cultural Center is sponsoring a Basque Festival at Orange Memorial Park on August 24-25. Motion to confirm expense claims of August 14, 2002 in the amount of $3,130,204.60 3. Resolution No. 72-2002, approving modification to compensation plan for AFSCME Local 1569 4. Resolution No. 73-2002, approving modification to compensation plan for Public Safety Managers 5. Resolution No. 74-2002, authorizing Oyster Point Grade Separation Phases II and III - PG&E Utility Relocation Agreements 6. Resolution No. 75-2002, accepting grant from the State of California and to appropriate Solid Waste Funds to SSF Scavengers for recycling eftYrts in the amount of $35,020 7. Resolution No. 76-2002, approving the extension of the Abandoned Vehicle Abatement Program until April 2012 8. Resolution No. 77-2002, accepting Local Law Enforcement Block Grants Program funds in the amount of $36,149 9. Motion to adopt an ordinance amending SSFMC Chapter 2, Administration, related to term limits for boards and commissions Item pulled the from Consent Calendar. 10. Motion to cancel regular meeting of August 28, 2002 12. Recognition of Proclamations issued: National Kids Day, August 4, 2002 Mayor Mullin requested Item No. 9 be pulled from the Consent Calendar. Motion-Fernekes/Second-Green: To approve Consent Calendar Item Nos. 1, 2, 3, 4, 5, 6, 7, 8, 10, 11, and 12. Approved by voice vote. Abstain: Mayor Mullin, minutes of July 24 regular and special meetings. Item No. 9: Mayor Mullin stated his opposition to the ordinance, commenting that sixteen years is excessive, and a turn-over on the commissions is necessary. REGULAR CITY COUNCIL MEETING AUGUST 14, 2002 MINUTES PAGE 3 Motion-Femekes/Second-Green: To adopt Ordinance No. 1314-2002, amending Chapter 2, Administration, of the South San Francisco Municipal Code. Approved by the following roll call vote: AYES: Councilmembers Fernekes, Green and Matsumoto, and Mayor Pro Tem Gonzalez. NOES: Mayor Mullin. ABSTAIN: None. ABSENT: None. LEGISLATIVE BUSINESS 13. Motion to waive reading and introduce an ordinance amending SSFMC Chapter 11, to establish preferential parking areas and approve a resolution for preferential permit parking for residential property near the South San Francisco BART areas Staff report presented by Police Chief Raffaelli. Councilwoman Matsumoto discussed with staff the proposed police procedures for monitoring the preferential parking areas, the issuance of preferential parking permits and visitor parking permits. Councilwoman Matsumoto asked for clarification of Section 11.70.050§D and staff agreed to modify the paragraph. Councilman Green questioned anticipated problems and Chief Raffaelli explained it is based on what Daly City experienced after the opening of its station and the assumption that BART will start charging BART riders for parking. Mayor Pro Tem Gonzalez questioned the process for issuing the permits and instructing the residents of the procedures. He requested that a status report be provided to Council after six months. Councilman Fernekes stated his support for the program and commended the efforts of the Police Department. Mayor Mullin questioned the permit issuing process, the process for citing violators and obtaining permits under false pretenses, and the possibility of overflow parking extending into neighborhoods outside the preferential parking areas. He further questioned the modification to Section 11.70.050§D and Assistant City Attorney responded that the section addresses the overflow of residential parking into commercial zones. She suggested the wording be modified and clarified as discussed. Council agreed that the wording be modified and handled administratively by the City Attorney's office. Assistant City Attorney Johnson requested Council take a brief recess before voting on the proposed ordinance. (Recess: 9:09 pm- 9:12 pm) Assistant City Attorney Johnson requested the resolution be continued until the second reading of the ordinance. Motion-Femekes/Second-Green: To continue resolution for preferential permit parking for residential property near the South San Francisco BART Station until the second reading of the ordinance. Unanimously approved by voice vote. REGULAR CITY COUNCIL MEETING AUGUST 14, 2002 MINUTES PAGE 4 Motion-Matsumoto/Second-Femekes: To waive reading and introduce an ordinance amending SSFMC Chapter 11, to establish preferential parking areas. Unanimously approved by voice vote. ITEMS FROM COUNCIL (continued) Mayor Pro Tem Gonzalez reported that he attended the Project Hope graduation ceremonies at the Safe Harbor Homeless Shelter. He congratulated the graduates who went through the six- month rehabilitation program and Mayor Mullin for his efforts for locating the shelter in South San Francisco.
