3. Public Comments
Mayor Mullin announced that Agenda Item 4b will be taken first on the agenda.
4. Study Session:
b) Consideration of consumer privacy legislation
City Attorney Mattas asked that Council provide direction for the preparation
of a consumer privacy protection ordinance. He explained the origins of the
legislation and that San Mateo County and the City of Daly City have adopted
ordinances that are being challenged by Bank of America and Wells Fargo. He
suggested that Council first decide if they want to consider a privacy
ordinance, and then provide direction to staff on how the ordinance would be
enforced, by either, a) City Attorney's office to prosecute violations, b) private
cause of action, or c) coordinate prosecution through the district attorney's
office. He further explained the basis of the banks' lawsuits, suggested
Council discuss a time line for the ordinance to go into effect, and mentioned a
previous circumstance when Council delayed implementation of an ordinance
until after the courts had resolved the issue.
Council discussed the time factor and cost for handling/prosecuting a case; the
enforcement options; the option to introduce the ordinance and delay the
second reading, and potential lawsuits from financial institutions.
Mayor Mullin polled Council for a consensus. Councilwoman Matsumoto and
Mayor Pro Tem Gonzalez stated their preference is to approve a resolution in
support of the County of San Mateo and City of Daly City in their actions.
Councilmembers Femekes and Green and Mayor Mullin reached a consensus
to consider a privacy ordinance at the October 9 meeting.
City Attorney Mattas stated he will consult with the district attorney's
office for direction and policy as an enforcement option. Mayor Mullin
clarified that Council is not anxious to see the City participate in any
lawsuits and does support the actions of San Mateo County and the City of
Daly City.
a) E1 Camino Real Corridor/Chestnut Avenue Land Use and Urban Design Plan
Ms. Jeanne Rena, 130 Alta Loma Drive, speaking with concem, stated she did
not receive a meeting notice and opined that the urban design plan will increase
traffic and housing, and add little open space. She stated that buses and
eighteen-wheelers block the Alta Loma Drive/Arroyo Drive intersection and
that it is dangerous to cross the street.
Brief staff report presented by Senior Planner Lappen.
Mayor Mullin requested Police Sergeant Mike Newell follow-up on buses
parking at Alta Loma Drive/Arroyo Drive, tracks loading and unloading at the
comer, and to report back to Council on the installation of surface lighting at
the pedestrian crossing.
Mr. Rick Williams reviewed the alternatives and summarized the community
meetings and discussions held with business owners.
Councilman Femekes commented that his preference is to locate a linear park
along the BART right-of-way, noting that the proposal to mn a linear park into
Orange Park and connecting with existing linear parks is a "given". He stated
that both can be accomplished.
Councilwoman Matsumoto questioned the alternative to place the linear park
up to E1 Camino Real and whether there was an expectation that commuter
bikers will be using the pathway. Mr. Williams explained that more details
will surface with the overall bike master plan which will address the commuter

biking issue. She approved of the concept for the Chestnut/E1 Camino
"gateway" and asked that the comparisons of the three alternatives be
forwarded to Council.
Councilman Green stated his concerns include the potential displacement of
two businesses at Chestnut/E1 Camino Real, the procurement of the water
department land for the proposed route of the linear park into Orange Park, and
the opening up of Oak Avenue through to Arroyo Drive which will likely
increase the traffic flow up Arroyo Drive through residential neighborhoods.
Councilman Femekes discussed with staffhis concems regarding ingress/
egress at South City Car Wash and noted that the site's re-design, as illustrated,
hampers circulation.
Mayor Pro Tem Gonzalez stated his preference to have the linear park on the
BART right-of-way and that Oak Avenue open up onto E1 Camino Real, but
not through to Arroyo Drive.
Director Van Duyn reminded Council that Callander Associates is conducting
a parallel public process that is studying the linear parkway concept and that
additional public comments will be forthcoming for Council's consideration.
He also stated that the Oak Avenue extension requires further study and several
options are being reviewed.
Mayor Mullin stated he originally preferred the linear park along the BART
alignment, but finds the Mission Road concept to be more feasible which will
allow substantial upgrades through the aggregation of properties.
Councilman Femekes commented that both concepts for the linear parks are
doable.
Director Van Duyn stated that staff will continue with the public meeting
process, will look at cost factors, and will have another draft by mid-October.
Mayor Mullin concluded the study session.
5. Adjournment
Motion-Gonzalez/Second-Green: To adjourn the meeting at 8:27 p.m. Unanimously
approved by voice vote.
